moved its adoption:
CITY OF LINO LAKES
RESOLUTION NO. 11 -13
RESOLUTION AMENDING THE CITY OF LINO LAKES FLEXIBLE SPENDING ACCOUNTS
PLAN, (the "Plan ")
WHEREAS, the plan was adopted per Resolution No. 78 -90 with the effective
date of January 1, 1991, and
WHEREAS, the plan was amended and restated per Resolution No. 95 -156 with
an effective date of January 1, 1996, and again per Resolution No.
00 -119 with an effective date of January 1, 2001 and again per
Resolution No. 03 -07 with an effective date of January 1, 2003, and
per Resolution No. 05 -181 with an effective date of January 1,
2006,and again per Resolution No. 07 -204 with an effective date of
January 1, 2008,
WHEREAS, the City of Lino Lakes wishes to amend the plan document effective
December 31, 2010, to include the following;
•The Plan shall make available changes imposed by the Patient
Protection and Affordable Care Act (PPACA). This new mandate
specifies the following: Any health insurance that provides
coverage for dependents must now be extended to dependent
adult children who are age 26 and will not reach age 27 within the
calendar year. For this purpose, a child includes a son, daughter,
stepchild, adopted child (even if the child is not a "dependent"
and /or is married).
NOW THEREFORE BE IT RESOLVED, by the City Council of the City of Lino
Lakes that:
1. The City of Lino Lakes Flexible Spending Accounts Plan be
amended and adopted in the form presented to the City
council effective as of December 31, 2010.

The motion for the adoption of the foregoing resolution was duly
seconded by Council Member Roeser and upon a vote being taken
thereon the following voted in favor thereof:
Gallup, Roeser, Rafferty, O'Donnell, Reinert
The following voted against same: none
Whereupon said resolution was declared duly passed and adopted.

Resolution No. 11 -13, Resolution Amending the City
of Lino Lakes Flexible Spending Accounts Plan (the
"Plan')
VOTE REQUIRED: Simple Majority (3/5 Vote)
BACKGROUND:
It is recommended that the city's Flexible Spending Accounts Plan be amended
to incorporate changes in law that have occurred which affect our current plan.
The last plan document was updated in 2008.
The following resolution incorporates one change to the current plan document.
It is:
• The Plan shall make available changes imposed by the Patient
Protection and Affordable Care Act (PPACA).
Staff recommends the adoption of Resolution 11 -13.
OPTIONS:
1. Approve Resolution 11 -13 .
2. Return to Staff for further review.
2. Deny Resolution 11 -13.
RECOMMENDATION:
Option 1.
