HomeMy WebLinkAbout2011-130 Council ResolutionS Council Member Gallup introduced the following resolution and moved its adoption: CITY OF LINO LAKES RESOLUTION NO. 11 -130 RESOLUTION APPROVING A SUMMARY OF ORDINANCE NO. 22 -11 FOR PUBLICATION WHEREAS, the City Council approved Ordinance No. 22 -11, establishing the 2012 Fee Schedule, for first reading on November 28, 2011 and second reading and final passage on December 12, 2011; and WHEREAS, Ordinance No. 22 -11 is lengthy and MN statute 412.191 allows the city to publish a summary of an ordinance, and WHEREAS, the City Council has determined that the summary clearly informs the public of the intent and effect of the ordinance, and WHEREAS, the publication in the official newspaper will include a notice that a full printed copy of the ordinance is available at City Hall; NOW, THEREFORE BE IT RESOLVED THAT the City Council approves the summary in Attachment A for publication according to state law and the City Charter. ATTACHMENT A, RESOLUTION 11 -130 CITY OF LINO LAKES COUNTY OF ANOKA SUMMARY OF ORDINANCE NO. 22 -11 AN ORDINANCE ADOPTING THE 2012 CITY OF LINO LAKES FEE SCHEDULE; REPEALS ALL ORDINANCES, PARTS OF ORDINANCES AND PREVIOUS FEE SCHEDULES THAT CONFLICT THEREWITH. The City of Lino Lakes City Council does ordain the following: Section 1. Findings. Pursuant to Minnesota Law, the Lino Lakes City Charter, and the Lino Lakes City Code, and upon a review of a study conducted by City staff, a fee schedule for City services and licensing is hereby adopted as follows: 2012 FEE SCHEDULE A. Alcoholic Beverages; B. Amusement and Commercial Recreation; C. Business and Miscellaneous; D. Park & Recreation User Fees; E. Fire Regulations; F. Police Fees; G. Building — Construction Utilities; H. Escrow Deposits; I. Right -Of -Way Management; J. Utility Fees; K. Surface Water Management; L. Culvert Prices; M. Land Use; N. Engineering; O. Staff Time; P. Late Fee Section 2. Effective Date of Ordinance. This ordinance shall be effective 30 days after its publication. Passed by the Lino Lakes City Council on December 12, 2011. A full printed copy of the ordinance is available at City Hall. • • AGENDA ITEM 3Bi STAFF ORIGINATOR: Julie Bartell, City Clerk DATE: December 12, 2011 TOPIC: Second Reading and Adoption of Ordinance No. 22 -11 Establishing the 2012 Fee Schedule VOTE REQUIRED: Simple Majority (3/5 Vote) INTRODUCTION In order to provide for a more efficient and timely method of reviewing and adjusting the various fees charged by the City, fees are consolidated into one schedule to be reviewed and adopted on an annual basis. BACKGROUND The City's current fee schedule has been circulated to department directors with a request to update or amend the schedule as appropriate for 2012. Ordinance No. 22 -11 (the proposed 2012 Fee Schedule) is attached. Recommended amendments to the ordinance are printed in red. The two changes proposed for 2012 are outlined below for your review: Investigation Fee for Liquor License Applications - In 2011 the council elected to change when an investigation fee is charged for the background investigation associated with liquor license applications. The fee is only charged for initial applications and not for renewals. Utility Fees — New language is being added to clarify that there are different sewer rates and stating the late penalty. This language does not add new charges but rather clarifies current practice. The council held a public hearing on the establishment of this fee schedule and approved first reading of the ordinance on November 28, 2011. The 2012 Fee Schedule Ordinance is now presented for council consideration of second reading and final adoption. RECOMMENDATION Approve second reading and adoption of Ordinance No. 22 -11, Establishing the 2012 Fee Schedule. • • AGENDA ITEM 3 Bii STAFF ORIGINATOR: Julie Bartell, City Clerk DATE: December 12, 2011 TOPIC: Resolution No. 11 -130, Summary of Ordinance No. 22 -11 for publication (2012 Fee Ordinance) VOTE REQUIRED: 4/5 vote BACKGROUND: Ordinance No. 22 -11 establishing 2012 fees will be considered for second reading and approval by the city council on December 12, 2011. Due to the length of this ordinance, if the council approves the ordinance, staff is requesting authorization to publish the ordinance in a summary form. Minnesota Statutes, Section 412.191 allows for summary publication when appropriate; a copy of the summary is attached to Resolution No. 11 -130. RECOMMENDATION: Staff recommends that the City Council approve Resolution No. 10 -114, Authorizing Summary Publication of Ordinance No. 22 -11 (the 2012 City Fee Schedule).
