HomeMy WebLinkAbout2005-091 Council Resolution• CITY OF LINO LAKES RESOLUTION NO. 05-91 RESOLUTION APPROVING THE RUSSIAN BAPTIST CHURCH PERFORMANCE AGREEMENT WHEREAS, the Site Building Plan Review and Conditional Use Permit for the Russian Baptist Church was approved with Resolution No. 02 -82 by the City Council on September 23, 2002, and WHEREAS, the City Council approved Resolution 03 -148 on September 8, 2003, which extended the project initiation time for the project until June 30, 2004; and WHEREAS, the City Council approved Resolution 05 -90 on July 11, 2005, which further extended the project initiation time for the project until September 23, 2005; and WHEREAS, the City's zoning ordinance and conditions of Site and Building Plan approval provide for the execution of a performance agreement to insure satisfactory completion of the improvements, • NOW, THEREFORE BE IT RESOLVED THAT Lino Lakes City Council approves the Site Improvement Performance Agreement with Russian Baptist Church and authorizes the Mayor and City Clerk to execute such agreement on behalf of the City. MEETING DATE: TOPIC: VOTE REQUIRED: BACKGROUND AGENDA ITEM 6.E.ii Paul Bengtson July 11, 2005 Consideration of Resolution No. 05 -91: Approving Russian Baptist Church Site Improvement Performance Agreement Simple Majority The City Council has approved the Site and Building Plans and Conditional Use Permit for the Russian Baptist Church, with conditions, per Resolution No. 02 -82 on September 23, 2002. The approval was then extended by Resolution 03 -148 on September 8, 2003, and Resolution. On the same agenda (Item 6.E.i) another extension of time (Resolution 05 -90) is being requested by the church, and has been recommended for approval by staff. In accordance with the Site and Building Plan approvals, staff has prepared a Site Improvement Performance Agreement. The agreement provides for the following: 1. Submittal by the developer of a Letter of Credit representing thirty -five (35) percent of the site improvement costs to insure completion of the project in accordance with the approved plans. 2. Deposit of a cash escrow to reimburse the City for costs incurred by the city related to the development and improvement of the site and developer improvements. A previous Performance Agreement was approved by the City Council with Resolution 03 -80 on June 9, 2003. Attached to this report is an updated version of the Performance Agreement. The developer has reviewed the agreement and is aware of the conditions set forth. RECOMMENDATION Staff is recommending approval of Resolution No. 03 -80 approving the Site Improvement Performance Agreement. ATTACHMENTS 1. Resolution No. 05 -91 2.
