HomeMy WebLinkAbout2005-159 Council Resolution• • CITY OF LINO LAKES RESOLUTION NO. 05-159 RESOLUTION ADOPTING THE I -35E CORRIDOR FINAL ALTERNATIVE URBAN AREAWIDE REVIEW WHEREAS, the City Council, as the Responsible Governmental Unit, authorized the preparation of an Alternative Urban Areawide Review (AUAR) with Resolution 05 -51; and WHEREAS, the City prepared a the I -35E Corridor Draft AUAR document and the City Council authorized distribution it for public comment with Resolution 05 -85; and, WHEREAS, the City received comments, prepared responses to substantive comments and prepared a mitigation plan to prevent potentially significant impacts from occurring from specific projects within the AUAR area; and WHEREAS, the City distributed the I -35E Corridor Final Alternative Urban Areawide Review as authorized by the City Council with Resolution 05 -144; and WHEREAS, no objection have been filed by State agencies or the Metropolitan Council; and WHEREAS, the entire process has been conducted in accordance with MN Rules 4410; and WHEREAS, the Environmental Board discussed the Final AUAR at a special meeting on October 12, 2005 and unanimously approved supporting the adoption of the Final AUAR by the City Council. NOW, THEREFORE, BE IT RESOLVED that the City Council adopts the I -35E Corridor Final Alternative Urban Areawide Review dated September 26, 2005. ��. MEETING DATE: October 24, 2005 TOPIC: Resolution 05 -159 Adopting the Final AUAR ACTION: 3/5 BACKGROUND We have come to the end of the entire process for the I -35E Corridor Alternative Urban Areawide Review. The City Council authorized distributing the Final Alternative Urban Areawide Review (AUAR) with Resolution 05 -144. The document was distributed to persons on the EQB's distribution list as well as to any persons who commented on the Draft AUAR. State agencies and the Metropolitan Council had ten days to file an objection to the Final AUAR. No objections were filed. Under MN Rules, "unless no objection is filed...the RGU shall adopt the revised environmental analysis document and the plan for mitigation at its first regularly scheduled meeting held 15 or more days after the distribution of the revised document." October 24 is that meeting. Resolution 05 -159 adopts the Final AUAR. The Environmental Board discussed the Final AUAR at a special meeting on October 12. The Board unanimously approved the following statement: The Environmental Board strongly supports the adoption of the final AUAR by the City of Lino Lakes. The mitigation plan within the document serves as an invaluable tool to identify & minimize environmental impact of developments. Adoption of the AUAR should not be interpreted or misconstrued as endorsing an aggressive development scenario. OPTIONS 1. Approve Resolution 05 -159, adopting the Final AUAR. 2. Return to staff with direction. RECOMMENDATION Option 1
