CITY OF LINO LAKES
RESOLUTION NO. 05-163
RESOLUTION APPROVING THE CONDITIONAL USE PERMIT FOR OUTDOOR DINING, AND
THE PLANNED UNIT DEVELOPMENT — FINAL PLAN FOR BETTY'S PIES
WHEREAS, the City has received an application for a planned unit development — final plan approval for
property currently described to -wit:
Outlot E, THE VILLAGE NO. 3, Anoka County, Minnesota.
; and
WHEREAS, the City has approved a final plat entitled THE VILLAGE NO. 4, which will create the parcel on
which the Betty's Pies is proposed to be constructed. This parcel will be described as:
Lot 2, Block 2, THE VILLAGE NO. 4
; and
WHEREAS, the planned unit development — final plan approval request is based on the following submittals:
• 1. Betty's Pies Plan Set received September 27, 2005.
2. Betty's Pies Outdoor Dining Plan received October 5, 2005.
3. Village No. 4 Final Plat received September 7, 2005
; and
WHEREAS, at their meeting on October 12, 2005, the Planning & Zoning Board recommended approval of the
planned unit development — final plan subject to the conditions listed in the meeting minutes; and
WHEREAS, the proposed planned unit development — final plan meets the requirements of the City's zoning
ordinance, subdivision ordinance, and the Lino Lakes Town Center Design and Development Guide, subject to
certain conditions of approval.
NOW, THEREFORE, BE IT RESOLVED that the City Council of Lino Lakes hereby approves the planned
unit development — final plan for the Betty's Pies subject to the following conditions:
1. A site performance agreement between the city and the developer must be completed prior to the
issuance of building permits.

2. Issues discussed in the S.E.H. engineering review memo must be addressed to the satisfaction of city
staff.
3. Operation and maintenance agreements for the site, including provisions for stormwater facilities, must
be submitted for review by city staff prior to the issuance of building permits.

• 4. All parking lot lighting fixtures and poles shall be painted to complement the city's decorative street
lighting; shall be mounted to round lighting poles measuring no more than twenty feet in height; shall be
mounted to a concrete base no higher than twenty -four inches above the surrounding grade; and shall be
located within landscape planter islands.
5. The final plat for the project (Village No. 4) must be approved prior to City Council approval of this
building.
6. The developer must work with staff to identify the most appropriate location for bicycle parking within
this block of the development.
BE IT FURTHER RESOLVED that the Lino Lakes City Council hereby approves the conditional use permit
for an accessory outdoor seating area in the commercial district of the Lino Lakes Town Center, subject to the
following conditions:

1. Accessory outdoor seating areas:
a. The applicant shall submit a site plan and other pertinent information demonstrating the
location and type of all tables, refuse receptacles, and wait stations.
b. Access to the dining area shall be provided only via the principal building if the dining
area is full service restaurant, including table waiting service.
c. The size of the dining area is restricted to thirty (30) percent of the total customer floor
area within the principal structure.
d. All lighting shall be hooded and directed away from adjacent residential uses in
accordance with Section 3, Subd. 4. F of the Lino Lakes Zoning Ordinance.
e. The applicant shall demonstrate that pedestrian circulation is not disrupted as a result of
the outdoor dining area by providing the following:
1) Outdoor dining area shall be segregated from through pedestrian circulation by
means of fencing, bollards, ropes, plantings, or other methods, and shall be
subject to review and approval by the City Council.
2) Minimum clear passage zone for pedestrians at the perimeter of the restaurant
shall be at least six (6) feet without interference from parked motor vehicles,
bollards, trees, tree gates, curbs, stairways, trash receptacles, street lights, parking
meters, or the like.
3) Overstory canopy of trees, umbrellas or other structures extending into the
pedestrian clear passage zone or pedestrian aisle shall have a minimum clearance
of seven (7) feet above sidewalk.

The dining area shall be surfaced with concrete, bituminous or decorative pavers or may
consist of a deck with wood or other flooring material that provides a clean, attractive,
and functional surface.
A minimum width of thirty -six (36) inches shall be provided within aisles of the outdoor
dining area.
h. Storage of furniture shall not be permitted outdoors between November 1 and March 31.
Outdoor furniture that is immovable or permanently fixed or attached to the sidewalk
shall not be subject to the storage prohibition of this section. However, any immovable or
permanently fixed or attached furniture must be approved as part of the administrative
permit application.
ii. Refuse containers shall be provided for self - service outdoor dining areas. Such
containers shall be placed in a manner which does not disrupt pedestrian circulation, and
must be designed to prevent spillage and blowing litter.

Betty's Pies
Legacy at Woods Edge
The Hartford Group has applied for a Planned Unit Development final plan for a single tenant restaurant within
the Legacy at Wood's Edge project located on the southeast quadrant of Interstate 35W and Lake Drive. The
final plan consists of the building plans for the restaurant building as well as the final plat for the lot (Village
No. 4).
•etty's Pies is a full service restaurant that meets the intent of the city's vision for a family oriented,
neighborhood gathering place in the new mixed use downtown. Owners Marti Sieber and Carl Ehlenz run the
Two Harbors, Minnesota, destination restaurant and this will be their first expansion into the metro area.
The overall area of the building will be 7,935 square feet. The majority of the building itself is single story,
with the exception of an office area which is located over the center section of the building.
The Planning and Zoning Board continued this item at the September 14th regular meeting, and offered up
comments to both staff and the developer about the proposal. Numerous revisions have been made to the plans
and are addressed throughout this report.
ANALYSIS
Governing Plans
This site is located within the Legacy at Woods Edge project and is therefore subject to the Lino Lakes Town
Center Design & Development Guide that was adopted by Ordinance 04 -04 as part of the original Planned Unit
Development for the site.
The layout generally follows the original Legacy at Wood's Edge layout, with the exception of the combination
of lots 3, 4, and 5 to create two lots. The main entry of the building will be from the parking lot, which is

atypical for this type of urban development. However, the plaza that is being proposed in combination with the
outdoor dining area and the walkway from the street into the site has been determined to sufficiently act as an

1. Accessory outdoor seating areas:
a. The applicant shall submit a site plan and other pertinent information demonstrating the

Staff has reviewed the application for the Conditional Use Permit in regards to the conditions above and the
proposed use can clearly meet all of the conditions as is proposed. Attached to the report is an exhibit depicting
the outdoor dining area layout.
Building Massing & Placement
The proposed building is within a portion of the development that requires build -to lines, specifically for this
site a maximum 5 foot setback is prescribed and is being substantially met with this proposal. The only section
of the building that does not specifically meet the 5 foot maximum setback is the portion of the site designated
for outdoor dining and plaza. This meets the standards of the build to line which require a minimum of 70% of
*he block to meet the build -to lines, and up to 20% can be plaza/park areas.

•Along the build -to line the building is also required to have a minimum height of 20 feet. The proposed
elevations depict the parapet walls (the lowest point) at a height of 20 feet, with additional height being supplied
to the structure thanks to the retaining wall on the street side of the site. The height of the building never
exceeds 40 feet, even when measured from the base of the retaining wall to the very peak of the highest roof.
Architectural Standards
The relationship between the building and the street is required to be accentuated by expressive wall faces, with
a minimum of 60% of the wall face being windows, doors, or arcades. The proposed elevations meet or exceed
all of those requirements.
Due to the grade differences of the site and the adjacent sidewalk, as well as the location of parking for the
property, the primary building entry is being placed on the parking lot side of the building. While this does not
specifically meet the standards of the guidelines, the location of the outdoor dining as well as the design of the
connecting walkway /plaza creates an entry feature not only for this building, but also for the adjacent building
and the entire interior of the block.
The tower elements proposed for the building clearly accentuate the two main public entrances for the
restaurant.
Due to the grade differences between the site and the pedestrian streetscape, the scale of the building is slightly
�exaggerated; however the revised plans address this separation between the streetscape and the building with
uilding fenestrations; the integration of the retaining wall into the structure itself; and the outdoor dining
area/plaza entry feature.
The base of the structure is clearly articulated through the use of a stone veneer applied at a variety of heights
ranging from 1 foot to almost 16 feet when integrated into the retaining wall portion on the southwest corner of
the building. The top is also clearly articulated with the use of bracketing below all areas proposed with roofs
above; with the parapet element that mimics the accentuation of the cementitious wall board banding below the
roof lines (Though this parapet element is slightly understated in mass it is appropriately integrated into the
overall scale of the building); and with the stepping effect that is created by the use of both standard angled
roofing as well as parapet walls above flat roofing.
The parapet walls will also provide an adequate screening device for the roof mounted equipment that will be
required for this type of use.
The building materials proposed for the site include stone and brick veneers; cementitious wall board or
E.I.F.S., and a prefabricated metal roofing material. All of these materials meet the stringent standards of the
design guidelines, and are incorporated consistently throughout the building's elevations.
The proposed structure has integrated a couple of climatic response devices that meet the design guidelines.
Daylighting of the interior space is being achieved through the large number of windows provided, and is
accentuated by the clerestory windows that surround the main dining area. Patrons of the establishment will
also be offered shelter from the elements in the entry vestibules while waiting to be seated and the provision of
shade umbrellas within the outdoor dining area.

*he building integrates all of the necessary service areas into the building including the trash handling area,
which is accessed through a roll up door on the north side of the northeast comer of the building.

Per Chapter 3.5 of the guidelines, the City is maintaining a shared parking analysis for the entire development.
This analysis identifies peak parking demands at key times throughout the day. In the case of a restaurant the
peak periods are identified as 8 PM on both weekdays and weekends.

The proposed use is clearly being provided enough parking within the parking lot layout that the applicant has
proposed with this application.

The shared parking spreadsheet has been adjusted to match the proposed building layout for this entire block,
specifically the buildings for lots 3, 4, and 5 have been adjusted to reflect only two users. The shared parking
spreadsheet is based on the Urban Land Institute's Shared Parking Standards and as is required by the
Development and Design Guidelines. As always, staff will continue to review each project to maintain the
parking standards within this block as well as the entire development.
Staff has included a condition requiring that the developer work with staff to identify an appropriate location for
bicycle parking facilities on this block.
Landscaping Requirements
The submitted plans meet all of the landscaping requirements of Chapter 3.6, including the number of Parking
Lot Trees, the height of retaining walls, and the design of the connecting walkway between the main entrance
and the street right -of -way.
As previously mentioned in the Parking section of the report, the site plan indicates a total of 93 parking spaces.
This means that the 12 trees provided throughout the lot exceeds the requirement of 1 tree for every 10 parking
spaces. The parking lot does not abut any public streets, so no additional landscaping buffer is required in that
regard. The overall plan for this block will include roughly 288 parking spaces, which does not meet or exceed
ikhe threshold of 300 spaces which would require the implementation of connecting walkways throughout the
arking lot.

•The plaza entry provided from the Town Center Parkway streetscape adequately functions as a `connecting
walkway' to the main entry of the building. This connecting walkway exceeds the six foot width requirement;
is to be constructed out of decorative pavement; and will be planted with shade trees spaced 25 feet on center.
The lighting will be built directly into the steps leading from the streetscape to the plaza, and with a decorative
light fixture matching the city's fixtures for the streetscape.
All of the landscaping materials proposed as a part of the planting palette for the site satisfy the comments of
the Environmental Board as well as city staff.
Lighting
The photometric lighting plan submitted with the application is in conformance with the minimum standards of
Chapter 3.7 of the guidelines. The parking lot fixtures do not meet city standards and are being conditioned to
be replaced by shoebox fixtures. The parking lot lighting that will be used for this phase of development must
be repeated throughout this block, if not throughout the entire Legacy at Woods Edge project area.
The building itself will include some architectural and building entry lights mounted directly to the building.
These fixtures will be used to highlight the building massing and will enhance the pedestrian environment.
Additionally, as was discussed in the landscape section of the report, a decorative lighting fixture is indicated
within the plaza entry area on the southeast corner of the site.
En ineerin
The city's consulting engineer on the Legacy project is Short Elliot Hendrickson (S.E.H.), and a memorandum
including all of their comments is attached to the report. Any outstanding issues will be addressed through the
site performance agreement and building permit process prior to construction.
Final Plat
The final plat for the project (Village No. 4) is attached to the same agenda as a separate item, and a condition
will be added to this review that the final plat must be approved prior to City Council approval for this building.
ENVIRONMENTAL BOARD
The Environmental Board reviewed this application at the August 31st regular meeting. Their comments are
attached and are addressed in the landscaping portion of this report.
PLANNING AND ZONING BOARD
The Planning and Zoning Board reviewed this project at the October 12, 2005 regular meeting, recommending
approval subject to the conditions included in this staff report.

RECOMMENDATION
•
The submitted plans are in substantial conformance with the standards of the Lino Lakes Town Center
Design and Development Guide. Therefore, staff recommends approval of the Conditional Use Permit and
Final Plan for Betty's Pies, subject to the following conditions:
1. A site performance agreement between the city and the developer must be completed prior to the
issuance of building permits.
2. Issues discussed in the S.E.H. engineering review memo must be addressed to the satisfaction of city
staff.
3. Operation and maintenance agreements for the site, including provisions for stormwater facilities, must
be submitted for review by city staff prior to the issuance of building permits.
4. The `gull wing' fixture (type EE and EE1 as shown on sheet C4.1) shall be changed to a shoebox
fixture. This fixture type will need to be approved by staff and used throughout the rest of the parking
area on this block, if not the rest of the project site.
5. The final plat for the project (Village No. 4) must be approved prior to City Council approval of this
building.
6. The developer must work with staff to identify the most appropriate location for bicycle parking within
this block of the development.
