CITY OF LINO LAKES
RESOLUTION NO. 05-180
A RESOLUTION EXTENDING THE EXISTING JOINT POWERS AGREEMENT
BETWEEN THE COMMUNITIES OF THE VADNAIS LAKE AREA WATER
MANAGEMENT ORGANIZATION UNTIL JANUARY 1, 2007
WHEREAS, VLAWMO was organized in 1983 to be the responsible governmental unit to
provide oversight and management to see that the requirements of the
Metropolitan Water Management Act were enforced in the Vadnais Lake
Watershed area; and
WHEREAS, the existing Joint Powers Agreement will expire on January 1, 2006; and
WHEREAS, the City of Lino Lakes acknowledges that there are area of VLAWMO's
authority that need to be improved and potential changes to the Joint
Powers Agreement considered during 2006; and
WHEREAS, the extension of the Joint Powers for an additional year will provide
adequate time to accomplish those organizational changes and
improvements,
NOW THEREFORE BE IT RESOLVED, that the City Council of Lino Lakes recommends
that the Point Powers Agreement between member communities be extended for a period
of one year, until January 1, 2007; and that work on updating the VLAWMO Water
Management Plan begin immediately.

for VLAWMO

BACKGROUND
The existing joint powers agreement with the member units which comprise the Vadnais Lake
Area Water Management Organization (VLAWMO) expires at the end of 2005. Throughout
the past year, the City of Lino Lakes has maintained a position that it favored merging into a
watershed district in order to have a structure which would have the resources to more
effectively manage water issues. While some other members have also expressed concern
about VLAWMO's effectiveness and the need to make changes to the structure of governance,
all other members have indicated that they will extend the current JPA for another year. The
withdrawal of the City of Lino Lakes has the impact of reducing the effectiveness of
VLAWMO's ability to manage the watershed unit as a portion of it would be outside of their
area of jurisdiction and the City would have to find another means of administering wetland
regulations.
At the City Council work session of October 19, 2005, the Council concluded that the best
course of action at this time is to agree to an additional one -year extension of the JPA, allowing
for progress to be made on the completion of the water plan, developing plans for obtaining
adequate funding for the future, and resolving issues of governance related to member unit
representation, eligible representatives, and voting.
OPTIONS
1. Approve Resolution No. 05 -180, Extending the Joint Powers Agreement for
VLAWMO.
2. Return to staff with direction.

Staff recommends extending the Joint Powers Agreement for VLAWMO.
