RESOLUTION NO. 06-13
RESOLUTION APPROVING A CORRECTION TO
ORDINANCE NO. 10 -05
WHEREAS, the City Council adopted Ordinance No. 10-05 on October 24,
2005, thereby establishing the 2007 salary rate for the Mayor and City Council
members;
WHEREAS, it has been determined that the salary rates listed in said
Ordinance did not correctly reflect the action of the Council;
NOW, THEREFORE, BE IT RESOLVED:
That Ordinance No. 10 -05 be corrected to tead as follows:
1.
The City Code of the City of Lino Lakes, Section 203.01 Subdivision 1 is
amended as follows:
Pursuant to the provision and allowance of Minnesota State Statute
415.11, the salary of the Mayor of the City of Lino Lakes shall be six thousand
two hundred seventy two dollars ($6,272) and the salary of each council member
shall be five thousand eighteen dollars ($5,018) for the year beginning January 1,
2007.

2007 City Council /Mayor Salary Ordinance (No. 10 -05)
VOTE REQUIRED: Simple Majority
On October 24, 2005, the City Council approved Ordinance No. 10 -05 entitled
Amending the Lino Lakes City Code by Setting the Salaries of the Mayor and City
Council Members, thereby establishing the 2007 salary rates for City Council members
and the Mayor.
The minutes reflect that the Council's intent was to adjust their salary down by 3%
from the 2006 rate. However, City Finance staff discovered that the figures included in
the ordinance did not reflect that reduction.
In order to correct this clerical error, the City Attorney has advised that the City Council
may pass a resolution amending said ordinance and including the accurate salary
level for 2007. A resolution providing for that correction is attached for your
consideration.
1. Adopt Resolution No. 06 -13 correcting Ordinance No. 10 -05 that establishes
the 2007 salary rate for the Mayor and City Council members.

and the salary of each council member shall be five thousand one hundred sixty three dollars

9 Councilmember Stoltz advised he asked that this item be placed on the agenda. At the
10 last Council meeting, their were two no votes for the approval of the Council salaries. He
11 stated there were no objections at the work session when this item was discussed.

13 Councilmember Carlson stated she felt concern about the budget cuts that were made for
14 the 2006 budget and was uncomfortable with the Council salary increase. She also stated
15 she saw no reason in the staff report to increase Council salaries by 3 %.

19 Councilmember Carlson stated she requested this item be placed on the agenda. She
20 stated she believes the City needs a Donated Leave Policy as soon as possible. She asked
21 if the policy could be added to the regular Council meeting for Monday. She noted if that
22 were not possible she would like for the policy to be retroactive when it is approved.

24 City Administrator Heitke advised information has been collected from other cities
25 regarding a policy. He stated he also has calls in to the City of Roseville with some
26 questions about their policy. The City's draft policy is almost completed and will be on
27 the next Council work session agenda. The Council will receive the draft policy prior to
28 the Council work session.

BACKGROUND
This is the second reading of Ordinance
Every four years, the city council has been asked to consider the maintenance of their own
salaries. Per statute, this is considered before the election, before that year the increases are to
take place.
At the council's 21 September work session, I provided the council with the 2005 Elected
Officials Salary Survey — a study produced by the Association of Metropolitan Municipalities. It
appeared as though the Mayor's salary was 5% below market and council salaries were 8.8%
below market. The market for our purposes is cities with populations between 10,000 and
20,000. I was asked to provide council with additional information (prior 4 year Ordinance 07-
97) and the question was raised regarding pay for special meetings. Ordinance 07 -97 was
provided.
In 1991, the council amended the city code to add a $40.00 per additional meeting charge up to
two meeting per month. In 1997, that was amended to include 4 extra meetings per month. I have
factored the $40.00 council members receive for attending council work session meetings and re-
calculated the figures which now indicate a market adjustment is not necessary. In which case I
would recommend that an Ordinance for council pay for years 2007 -2010 be adopted which
would increase council salaries by 3% for each year which will maintain council salaries at a
marketable rate.
OPTIONS
1. Adopt Ordinance Number 10 — 05 adjusting council salaries by 3% for the years 2007 -2010.
2. Return to staff for additional consideration.
