HomeMy WebLinkAbout2006-073 Council ResolutionCouncil Member O'Donnell introduced the following resolution and moved its adoption: CITY OF LINO LAKES RESOLUTION NO. 06-73 RESOLUTION APPROVING A CONDITIONAL USE PERMIT TO ALLOW A DOG KENNEL AT 7933 24TH AVENUE WHEREAS, Linda Ide has submitted a request to the City to grant a conditional use permit to allow for a dog kennel at 7933 24th Avenue, and WHEREAS, the legal description of the property is: The South 926.80 feet of the east 470 feet of the northeast quarter of the northeast quarter of section 12 township 31 range 22, excluding road and subject to easements of record. and WHEREAS, the City's review is based on the Plan Set received January 11, 2006; WHEREAS, the Planning Commission held a public hearing on the application on April 12, 2006, and recommended approval with conditions, and • WHEREAS, the City Council of the City of Lino Lakes finds that, with the conditions of approval included in this resolution, the following findings of fact apply as required by Section 2 Subd. 2.B.7 and by Section 8 Subd.2.I.4 of the zoning ordinance: a. This application is consistent with the comprehensive plan, including future and present land uses. The building additions do not alter existing uses on the site. b. The application meets all performance standards. c. The project will not increase traffic generation or impacts. d. The project will not increase demands on sanitary sewer and water use. e. The project will not require capital improvements by the City. f. The project will not create detrimental impacts. g. The project will not impact natural or historic features. h. All applicable Minnesota Pollution Control Agency requirements are satisfactorily met. i. The project will not alter the site's drainage system previously approved by the City Engineer. NOW, THEREFORE, BE IT RESOLVED, that the Lino Lakes City Council hereby approves a conditional use permit to allow a dog kennel at 7933 24th Avenue. BE IT FURTHER RESOLVED that the following conditions apply: 1. The applicant must obtain a dog kennel license from the City of Lino Lakes. • 2. Ongoing compliance with Sections 502, 503, and 607 of the City Code. 3. At no time shall dogs that are not owned by the occupant of the dwelling be allowed to remain on the property overnight. • • 4. A maximum of six dogs over the age of six months shall be kept on the property at any one time. 5. All animals kept on the property shall be licensed in accordance with city policies. 6. At no time shall the property be used for sale of animals or merchandising directly to customers. 7. Failure to comply with any of the conditions of this conditional use permit shall constitute grounds for revocation of the license of such kennel. 8. If a license for a kennel is not obtained within one year after the date of the conditional use permit, the permit is void. 9. The motion for the adoption of the foregoing resolution was duly seconded by Council Member Reinert and upon vote being taken thereon, the following voted in favor thereof: O'Donnell, Reinert, Carlson, Stoltz, Bergeson The following voted against same: None Whereupon said resolution was declared duly passed and adopted.
