CITY OF LINO LAKES
COUNTY OF ANOKA
RESOLUTION NO. 06 -139
RESOLUTION APPROVING CITY OF LINO LAKES
RIGHT OF WAY PLAT NO. 3
(LAKE DRIVE /I -35W INTERCHANGE)
WHEREAS, the City of Lino Lakes, Minnesota is proposing to undertake the
reconstruction of the Lake Drive (CSAH 23)/I -35W interchange; and
WHEREAS, the proposed project will require the acquisition of certain properties
to facilitate the roadway improvements; and
WHEREAS, the City's Engineering Consultant has prepared a plat outlining all
tracts and parcels of land affected by the proposed acquisition in accordance
with Minnesota Statutes 505.1793.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
• OF LINO LAKES, MINNESOTA:
1. That City of Lino Lakes Right -of -Way Plat No. 3 is hereby approved.
2. The Mayor and City Clerk are hereby authorized to execute said plat on
behalf of the City.
Adopted by the Council of the City of Lino Lakes this 28th day of August, 2006.

Consideration of Resolution No. 06 -139 Approving
City of Lino Lakes Right -of -Way Plat No. 3, Lake
Drive /35W Interchange
VOTE REQUIRED: 3/5
BACKGROUND:
As part of the Lake Drive /35W Interchange reconstruction project the City will
need to acquire permanent right -of -way, drainage and utility easements and
temporary construction easements. Sixteen (16) parcels are affected by the
acquisition process.
Short, Elliott, Hendrickson, the City's consulting engineer, has prepared a right -
of -way plat describing the parcels affected by the proposed acquisition. The plat
has been prepared in accordance with Minnesota Statutes 505.1793.
The plat does not transfer title to the property described and designated by
appropriate parcel number. The plat is used for delineation purposes during the
application process. Approval of Right -of Way plats are not subject to the
statutory requirements associated with subdivision approvals.
RECOMMENDATION
Staff is recommending approval of Resolution No. 06 -139.
