HomeMy WebLinkAbout1981-038 Council ResolutionRESOLUTION NO. 81 - 38 EXTRACT OF MINUTES OF MEETING OF THE CITY COUNCIL OF THE CITY OF LINO LAKES ANOKA COUNTY, MINNESOTA Pursuant to due call and notice thereof, a special meeting of the City Council of the City of Lino Lakes, Minnesota, was duly held in the City Hall in the City of Lino Lakes on Thursday, October 15, 1981, commencing at 7:30 o'clock p.m., C.T. The following Councilmembers were present: F. Kenneth Gourley, Marilyn Elsenpeter, John McLean, Ronald Jaworski and Richard Kulaszewicz and the following were absent: None • The following Resolution was presented by Councilmember Ronald Jaworski , who moved its adoption. RESOLUTION AWARDING THE SALE OF $1,600,000 GENERAL OBLIGATION TEMPORARY IMPROVEMENT BONDS OF 1981. WHEREAS, on February 23, 1981, this Council received a petition for a sanitary sewer improvement along Highway No. 49 from Rice Creek north to its end at Minnesota Correctional Facility, and also from Highway 49 north to 77th Street along Lake Drive, and this Council did further find that such petition was signed by the required number of front footage property owners as provided in Minnesota Statutes, Section 429.035; WHEREAS, following published and mailed notice in accordance with law, a public hearing on said improvement project was held on May 27, 1981, and was continued to July 15, 1981; WHEREAS, this Council did by a vote of 3 ayes and 2 nays on August 13, 1981, order a sanitary sewer improvement project to serve a portion of the properties contained in the original petition; • WHEREAS, by order dated October 8, 1981, the Minnesota District Court, Tenth Judicial District, the Honorable John F. Dablow, Judge of District Court, presiding, did determine that, because in the Court's view the project as ordered by this Council varied from the improvement as origin- ally petitioned for, four affirmative votes of the Council were required to order said project pursuant to Minnesota Statutes, Section 429.031; WHEREAS, pursuant to duly published notice of sale, this Council adopted a Resolution at a special meeting on September 17, 1981, entitled "Resolution Awarding the Sale of $2,150,000 General Obligation Temporary Improvement Bonds of 1981; Fixing their Form and Specifications; Directing their Execution and Delivery; and Providing for their Payment;" WHEREAS, this Council has by Resolution adopted on this 15th day of October, 1981, and in response to the above - mentioned District Court order, ordered a portion of the originally petitioned for sanitary sewer improve- ment project, pursuant to Minnesota Statutes, Section 429.031, subdivision 1, more particularly, for sanitary sewer on Highway 49 along the petitioned for route, northerly to Interstate Highway No. 35W, and there terminating; WHEREAS, the engineers for this project, Orr, Schelen, and Mayeron, have by letter dated this 15th day of October, 1981, presented a revised engineering report to the Council concerning the above - mentioned reduced project and have further indicated that said revised project is feasible and have estimated a total cost of $1,600,000 for said project; WHEREAS, in order to avoid an overissuance of the bonds sold on September 17, 1981, and with the prior consent of the purchaser thereof, it is necessary to reduce the size of said bond issue. NOW, THEREFORE, IT IS HEREBY RESOLVED by the City Council of the City of Lino Lakes, Minnesota, as follows: 1. The reduced project mentioned above as ordered this day by this City Council involves the following expenses: Construction Contracts, Engineering and Contingency $1,162,000 Fiscal, Administrative, Legal and Miscellaneous Capitalized Interest TOTAL 209,160 210,000 $1,581,160 2. This Council's Resolution awarding the sale of the $2,150,000 General Obligation Temporary Improvement Bonds of 1981 is hereby amended to the following extents: (a) The total amount of the bond issued shall be reduced to $1,600,000; (b) The purchase price of said obligations shall be $1,570,080, the sum of $29,920 representing an addi- tional issuance .of bonds needed to market said obli- gations at this time. The Bonds shall be numbered 1 through 320, inclusive, and the terms and conditions of the prior sale shall remain in full force and effect except as modified by this Resolution. The motion for the adoption of the foregoing resolution was duly seconded by Councilmember Marilyn Elsenpeter , and upon vote being taken thereon, the following voted in favor thereof: Ronald Jaworski, Marilyn Elsenpeter and F. Kenneth Gourley and the following voted against the same: John C. McLean and Richard Kulaszewicz where upon said resolution was declared duly passed and adopted. • STATE OF MINNESOTA COUNTY OF ANOKA CITY OF LINO LAKES I, the undersigned, being the duly qualified and acting City Deputy - Clerk fiate&( of the City of Lino Lakes, Minnesota do hereby certify that I have carefully compared the attached and foregoing extract of minutes of a special meeting of the City Council of said City held on Thursday, October 15, 1981, with the original thereof on file in my office and the same is a full, true and complete transcript thereof, insofar as the same relates to the issuance and sale of $1,600,000 General Obligation Temporary Improvement Bonds of 1981, of the City.
