WHEREAS: The Cities of Circle Pines and Lino Lakes have re- quested the State of Minnesota to enact a law per- mitting the Cities of Circle Pines and Lino Lakes to determine the size of the Circle Pines Utility Commission, and WHEREAS: The State'of Minnesota did enact Minnesota Laws, 1985 Chapter 90, Utilities Commission Membership permitt- ing both cities to determine the size of the Circle Pines Utilities Commission, NOW THEREFORE BE IT RESOLVED BY THE CITY COUNCILS OF THE CITY OF LINO LAKES AND CIRCLE PINES, 1. [CIRCLE PINES UTILITIES COMMISSION.] 8 Notwithstanding Minnesota Statutes, section 412.341 9 relating to the number of members that may be appointed to a 10 utilities commission, the cities of Circle Pines and Lino Lakes 11 may determine, by joint resolution, the number of members to 12 serve on the Circle Pines utilities commission. Their terms 13 must be as provided in Minnesota Statutes, section 412.341 and, 14 so far as possible, staggered so that an equal number expire in 15 each year. 16 Sec. 2.
