HomeMy WebLinkAbout2012-032 Council ResolutionII • • CITY OF LINO LAKES RESOLUTION NO. 12 -32 RESOLUTION APPROVING THE EXTENSION OF VLAWMO JOINT POWERS AGREEMENT WHEREAS, the cities of Gem Lake, Lino Lakes, North Oaks, Vadnais Heights, and White Bear Lake and the Township of White Bear have entered into a Joint Powers Agreement to meet the requirements of the Metropolitan Surface Water Management Act of 1983; and WHEREAS, the parties have agreed that it is reasonable, appropriate, and in the best interests of the public to extend the Agreement until December 31, 2016. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Lino Lakes, Minnesota that Section IX of the Agreement be amended to read: "Each member agrees to be bound by the terms of this Agreement until December 31, 2016." Adopted by the City Council of the City of Lino Lakes this 9th day of April 2012. The motion for the adoption of the foregoing resolution was introduced by Council Member Rafferty and was duly seconded by Council Member Roeser and upon vote being taken thereon, the following voted in favor thereof: Rafferty, Roeser, Stoesz, O'Donnell, The following voted against same: none ATTEST: Juli. e Bartell, Cit; Cler Reinert eff Reine • • CITY COUNCIL AGENDA ITEM 3A STAFF ORIGINATOR: Jeff Karlson, City Administrator MEETING DATE: April 9, 2012 TOPIC: Resolution Extending VLAWMO Joint Powers Agreement VOTE REQUIRED: 3/5 INTRODUCTION The Vadnais Lake Area Water Management Organization (VLAWMO) is requesting an extension of the Joint Powers Agreement. BACKGROUND The VLAWMO Joint Powers Agreement was ratified in 2006 in conjunction with the 10 -year Comprehensive Water Management Plan that was approved in 2007. It has been amended twice since then. In 2008, the section addressing the financing of the watershed was amended to allow for the storm water utility. In 2009, VLAWMO completed the cleanup of the watershed boundaries with its neighbors and amended the legal description. The proposed change is to extend the existing JPA until December 31, 2016. RECOMMENDATION Staff recommends approval of Resolution No. 12 -32, extending the Joint Powers Agreement.
