RESOLUTION NO. 12-42
RESOLUTION APPROVING AMENDMENT NO. 2 TO THE JOINT POWERS
AGREEMENT FOR THE RECONSTRUCTION OF COUNTY STATE AID HIGHWAY 14
(MAIN STREET) AND I -35E INTERCHANGE
WHEREAS, Anoka County and the City of Lino Lakes previously entered into a joint powers
agreement for the turnback of Lilac Street.
WHEREAS, the City of Lino Lakes has previously received $300,000 from the County as
stipulated in the joint powers agreement.
WHEREAS, the City of Lino Lakes has requested Anoka County to include Lilac Street from
Sunset road to 4th Avenue with the County's 2012 Reclamation projects.
WHEREAS, the City of Lino Lakes agrees to refund the original $300,000 to the County and
fund any additional costs required to complete this project.
WHEREAS, Minnesota Statutes section 471.59 authorizes political subdivisions to enter into
joint powers agreements.
NOW, THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LINO
LAKES, MINNESOTA: The City Council hereby approves the amendment to the Joint Powers

AMENDMENT NO. 2
TO JOINT POWERS AGREEMENT
FOR THE RECONSTRUCTION OF
COUNTY STATE AID HIGHWAY 14 (MAIN STREET) AND I -35E INTERCHANGE
COUNTY PROJECT NO. S.P. 02- 614 -28
THIS AMENDMENT is made and entered into this day of
2012, the date of the signature of the parties notwithstanding, by and between the County of
Anoka, a political subdivision of the State of Minnesota, 2100 Third Avenue, Anoka, Minnesota
55303, hereinafter referred to as the "County," and the City of Lino Lakes, 600 Town Center
Parkway, Lino Lakes, Minnesota 55014, hereinafter referred to as the "City ".
WITNESSETH:
WHEREAS, it is mutually agreed upon that the County and the City wish to amend its
Joint Powers Agreement for the reconstruction of the Interchange of I -35E and County State
Aid Highway 14 (Main Street) including the bridge over I -35E, hereinafter referred to as the
"Project "; and,
WHEREAS, Section XII. ENTIRE AGREEMENT REQUIREMENT OF A WRITING of
said Agreement provides that any alterations, variations or modifications of the provisions of
this Agreement shall be valid only when they have been reduced to writing and duly signed by
the parties.
NOW, THEREFORE, in consideration of the mutual covenants hereinafter stated or
contained in the Agreement, the parties do hereby agree as follows:
1. The parties agree to delete Section III, F.4. of Amendment 2009 -0569A in its
entirety and replace it with the following:
F. The Payment from the City to the County shall be as follows:
4. In lieu of a $300,000 payment for the turnback of County Road 153 (Lilac Drive)
from the County to the City, the County will perform a reclaim and overlay on
County Road 153 (Lilac Drive). Upon written demand, the City shall return to the
County, in full, the previously paid $300,000 within 30 days.
This work shall be designed and constructed by the County and completed with
the County 2012 Overlay Program, with work to be finished by December 31,
2012.

Upon completion of the County Road 153 (Lilac Drive) project, the County shall
bill the City for any construction costs in excess of the $300,000. Payment shall
be made within 30 days of written demand by the County.
2. This Amendment is hereby made a part of and shall be amended to the
Agreement of the parties.
3. All other terms and conditions of the original Agreement and Amendments
shall remain in full force and effect.

TOPIC : Consider Resolution 12 -42 Authorizing Amendment to Joint Powers
Agreement with Anoka County

BACKGROUND
On October 5, 2009, the City Council approved a joint powers agreement (JPA) with Anoka
County for the reconstruction of the I -35E /CSAH 14 interchange. On September 12, 2011, the City
Council approved an amendment to the JPA that included a payment to the City of $300,000 in
consideration for the turnback of Lilac Street. The City has since received that payment.
Lilac Street is currently included in the City's 2012 overlay project. As part of the design of Lilac
Street, we completed several pavement corings of the existing pavement and determined that the
pavement is only 3- inches thick and is paved directly on top of the existing sand subgrade without
any class 5 beneath it. The existing pavement is not in great shape and we believe performing an
overlay will only extend the life of the street another 10 -15 years.
Staff is recommending that the City reclaim the existing pavement, creating a new class 5 base with
the reclaimed material, and pave 4- inches of new pavement on top of the reclaimed material. This
will provide a structurally stronger street section that will have an estimated life expectancy of 30-
40 years.
Anoka County is completing a massive pavement reclamation project at multiple locations within
the County this year and they graciously included Lilac Street as an alternate to their bids at the
City's request. The bid opening occurred on April 4th and the low bidder included an alternate price
of $312,278.56 for Lilac Street. The bid price received by the County is very favorable and it is
therefore in the City's best interest to have the County complete this project on behalf of the City.
The County is requesting the refund of the original $300,000 that was provided to the City for Lilac
Street and that the City fund any costs in excess of $300,000. The additional cost above the
$300,000 is proposed to be covered from the City's pavement management fund. Due to past
pavement management projects coming in under budget, there is a sufficient balance to cover the
additional costs.

Resolution 12 -42 authorizes the execution of the second amendment to the JPA for the return of the
$300,000 payment from the County for the pavement reclamation and repaving of Lilac Street and
agreement by the City to pay any costs that exceed this refund. Staff is recommending approval of
Resolution 12 -42.
