Wedel MEETING DATE: December 10, 2012 TOPIC: Consider Resolution No. 12 -133, Authorizing Professional Services to Prepare Amendment to Wellhead Protection Plan VOTE REQUIRED: 3/5 BACKGROUND On June 6, 2012, City staff met with representatives from the Minnesota Department of Health to discuss the requirements for amending the City's Wellhead Protection Plan. The amendment is broken down into Part I and Part II. Part I of the amendment includes the following items: • Delineations of the Wellhead Protection Area (WHPA) • Delineations of the Drinking Water Supply Management Area (DWSMA) • Well and aquifer vulnerability assessments The goal of the plan amendment is to prevent human - caused contaminants from entering the water supply wells and to protect all who use the water supply from adverse health effects associated with groundwater contamination. The City Council is being asked to consider authorizing professional services for Part I only of the plan amendment. The City is required to complete Part I by December 2013. The City Council will be asked to consider authorization for professional services for Part II at a later date. Part II is required to be completed by March 10, 2015. The majority of the work for Part I involves ground water modeling. WSB has teamed up with Leggette, Brashears, & Graham, Inc. (LBG) to provide the ground water modeling. The costs break down as follows: LBG $14,000 WSB $ 3,500 Total $17,500 It should be noted that LBG was able to reduce their fee for the modeling since they will be concurrently working on the modeling for the City of Hugo. Funding for the plan amendment is proposed to come from the City's Water Fund. WSB and LBG are immediately available to begin work on the Wellhead Protection Plan Amendment Part I. • RECOMMENDATION • Staff is recommending that the City Council adopt Resolution 12 -133 authorizing WSB & Associates, Inc. to provide professional engineering services for the Wellhead Protection Plan Amendment Part I. The preparation of the City's WHPP is a requirement of Minnesota Rules 4720.5100 to 5720.5590. Part 1 of the WHPP includes: • Delineations of the Wellhead Protection Area (WHPA). • Delineations of the Drinking Water Supply Management Area (DWSMA). • Well and aquifer vulnerability assessments. • Associated reporting requirements. The goal of the Plan is to prevent human- caused contaminants from entering the water supply wells and to protect all who use the water supply from adverse health effects associated with groundwater contamination. A scoping meeting with the Minnesota Department of Health (MDH) for the development of Part 1 of the WHPP was held on June 6, 2012. At that meeting the MDH introduced the contact persons and discussed requirements to complete the WHPP. The City has until March 10, 2015, to complete both Parts 1 and 2 of the WHPP. Project Approach/Scope of Services To complete the WHPP Part 1, WSB has teamed with Leggette, Brashears, & Graham, Inc. (LBG) to satisfy the groundwater modeling requirements of the plan. LBG's proposal is attached. WSB and LBG will be completing the following scope of services in cooperation: • Coordinate with the MDH and other applicable agencies. • Respond to information requests. • Assemble data elements. • Delineate the WHPA using MODFLOW • Delineate Porous Media and Fracture Flow Capture Zones, WHPAs and DWSMA. • Assess wellfield and DWSMA vulnerability. • Prepare report. WSB and LBG will be present at the meetings and will prepare meeting information as necessary. Proposed Fee WSB proposes to complete the above scope of services on an hourly basis in accordance with our 2012 billing rate schedule for an estimated fee of $17,500. LBG's fee of $14,000 is included in the proposed fee and will be passed through to the City with no mark -up. Please note that LBG provided two different fees in their proposal and was able to provide the lower fee to the City since they will concurrently be working on the City of Hugo's groundwater modeling for their wellhead protection plan amendment. The fee may vary depending on MDH review and requirements not presented during the scoping meeting. In MDH's letter dated July 3, 2012, the MDH states that they will review data and results of our analysis as they become available and may adjust their requirements. Schedule WSB and LBG can begin work immediately and estimate the work for Part 1 can be completed within the allowable time detailed by the MDH. Once Part 1 has been completed, we can provide you with a proposal to complete Part 2 by the MDH deadline. Part 2 will need to be completed during 2014 to meet the 2015 MDH deadline.
