HomeMy WebLinkAbout2013-081 Council Resolution• CITY OF LINO LAKES RESOLUTION NO. 13 -81 RESOLUTION AMENDING JOINT POWERS AGREEMENT WITH TOWN OF WHITE BEAR AND CITY OF NORTH OAKS PROVIDING FOR PUBLIC WATER AND SANITARY SEWER SERVICE WHEREAS, Minnesota Statutes, Section 471.59, authorizes political subdivisions to enter into Joint Powers Agreements, and WHEREAS, the City of Lino Lakes, City of North Oaks and the Town of White Bear entered into a Joint Powers Agreement for the purpose of providing public utilities to the Rapp Farm development in North Oaks in 2004, and WHEREAS, North Oaks Company, LLC, a Minnesota limited liability company has proposed to extend the service area of the utilities within the City of North Oaks, and WHEREAS, The Joint Powers Agreement requires that any extensions of the service area be set forth in an Addendum to the agreement, and WHEREAS, the City of Lino Lakes finds that it is in the best interests of the community to cooperate with North Oaks and the Town on the extension of Town sewer and water lines in order to serve the Rapp Farm development in North Oaks. • NOW, THEREFORE BE IT RESOLVED by The City Council of The City of Lino Lakes that the amendment to the Joint Powers Agreement with the City of North Oaks and the Town of White Bear is hereby approved and the Mayor and City Clerk are authorized to sign the agreement on behalf of the City. Adopted by the Council of the City of Lino Lakes this 8th day of July, 2013. The motion for the adoption of the foregoing resolution was introduced by Council Member o' Donnell and was duly seconded by Council Member Roeser and upon vote being taken thereon, the followin voted in favor thereof: O'Donnell, Roeser, Rafferty, Stoesz, Reinert The following voted against same: none ATTEST: e Bartell, C. , Cle Jeff Reinert, • • • CITY COUNCIL AGENDA ITEM 1D STAFF ORIGINATOR: Michael Grochala MEETING DATE: July 8, 2013 TOPIC: Consider Resolution No. 13 -81, Approving Amendment to Joint Powers Agreement with Town of White Bear and City of North Oaks VOTE REQUIRED: 3/5 INTRODUCTION Staff is requesting City Council consideration to approve an amendment to the existing Joint Powers Agreement (JPA) with the Town of White Bear and the City of North Oaks for the provision of sanitary sewer and water services. BACKGROUND In 2004 the City entered into a JPA with the Town of White Bear and North Oaks to allow for the extension of sanitary sewer and water main to service the Rapp Farm development in North Oaks. The utilities were provided by the Town of White Bear via trunk sanitary sewer and water main located in Centerville Road. The utilities were extended through Lino Lakes to access the Rapp Farm property, on the western side of Wilkinson Lake, south of County Road J. North Oaks Development Company is currently proposing the expansion of the Rapp Farm development. Accordingly they have requested an amendment to the agreement for expansion of the service area. The agreement has no effect on the City of Lino Lakes. Maintenance on the system and billing is all provided by the Town of White Bear.
