RESOLUTION NO. 07-75
RESOLUTION APPROVING AMENDMENT OF AN EXISTING CONDITIONAL USE
PERMIT TO ALLOW THE CONSTRUCTION OF AN OFFICE BUILDING AT MOLIN
CONCRETE, 415 LILAC DRIVE
WHEREAS, Molin Concrete has submitted a request to the City to amend an existing
conditional use permit to allow for an office building at 415 Lilac Drive, and
WHEREAS, the legal description of the property is:
• The South Half of the Northwest Quarter of the Southwest Quarter of Section 8,
Township 31, Range 22, Anoka county, Minnesota;
The Southwest Quarter of the Southwest Quarter of Section 8, Township 31, Range 22,
EXCEPT the East 260 feet of the South 832 feet thereof, ALSO EXCEPTING the South
412 feet of the Southwest Quarter, Anoka County, Minnesota;
The South 412 feet of the Southwest Quarter of the Southwest Quarter of Section 8,
Township 31, Range 22, Anoka County, Minnesota, EXCEPT the East 260 feet thereof.
and
WHEREAS, the City's review is based on the Molin Plan Set received April 27, 2007;
WHEREAS, the Planning Commission held a public hearing on the application on May 9, 2007,
and recommended approval with conditions, and
WHEAREAS, the City Council of the City of Lino Lakes adopted Resolution 01-182 on
November 13, 2001, and

WHEREAS, the City Council of the City of Lino Lakes finds that, with the conditions of
approval included in this resolution, the following findings of fact apply as required by Section 2
Subd. 2.B.7 and by Section 8 Subd.2.I.4 of the zoning ordinance:
a. This application is consistent with the comprehensive plan, including future and present
land uses. The building additions do not alter existing uses on the site.
b. The application meets all performance standards.
c. The project will not increase traffic generation or impacts.
d. The project will not increase demands on sanitary sewer and water use.
e. The project will not require capital improvements by the City.
f. The project will not create detrimental impacts.
g. The project will not impact natural or historic features.
h. All applicable Minnesota Pollution Control Agency requirements are satisfactorily met.
i. The project will not alter the site's drainage system previously approved by the City
Engineer.
• NOW, THEREFORE, BE IT RESOLVED, that the Lino Lakes City Council hereby approves an
amendment of the existing conditional use permit to allow the construction of an office building.
BE IT FURTHER RESOLVED that the following conditions apply:
1. All conditions in Resolutions 01-182, Resolution 03-73, Resolution 05-13, and
Resolution 06-32 continue to apply.
2. Issues discussed in the City Engineer review memo must be addressed to his satisfaction.
3. All conditions of the previous amendments shall continue to apply.
4. A Performance Agreement between the applicant and city must be executed prior to the
issuance of building permits for the site.
5. A photometric lighting plan in conformance with the standards of the zoning code must
be submitted prior to the issuance of building permits. All lighting fixtures will be
• downcast shielded as required by the zoning code.
6. Trash enclosures must incorporate the same materials used in the construction of the
main building.
7. The applicant shall obtain the necessary Rice Creek Watershed District permits.
8. The improvements are limited to those areas depicted as Phase One. Phase Two will
require a separate Conditional Use Permit Amendment application.

Conditional Use Permit Amendment
Molin Concrete Office Building and Campus Addition
BACKGROUND
Molin Concrete is proposing a 7,785 square foot office building and some minor fagade
• improvements to the existing office building to create a more cohesive appearance to their
facilities at 415 Lilac Street. The improvements to the site include two phases. The first phase
being that of the office building and the associated site work, and the second phase being the
wetland mitigation/enhancement area that was included as part of their application to the Rice
Creek Watershed District for the future addition to the manufacturing building. The First Phase
is the only part of the application that the city is being asked to review at this time. Phase Two
will require a separate application for a Conditional Use Permit Amendment.
The Molin property is covered by a conditional use permit for the concrete plant. The northern
20 acres is covered by an interim use permit for outdoor storage. This new application does not
involve the storage area. The Conditional Use Permit covers the entire site. Building additions
such as those proposed in this application require an amendment to the Conditional Use Permit.
Since the original approval, the city has approved amendments to the CUP in 2003 with
Resolution 03-73, in February 2005 with Resolution 05-13, and again in February 2006 with
Resolution 06-32.
Molin Concrete has sent a notice to the surrounding home owners to inform them of the
proposed expansion and invited anyone interested to provide comment. These same
homeowners were also noticed by the city of the public hearing that was held at the Planning and
Zoning Board meeting on May 9tn

ANALYSIS

SITE PLAN
Buildings: Site plans have been submitted for the proposal. The office building will occupy the
space between the existing office building and the existing maintenance building. It will be
• single story with a trellis attaching the new office building to the existing to create a cohesive
appearance to the site. The building materials meet all of the city requirements and the design
appropriately addresses the base/middle/top approach required by the zoning ordinance.
Lighting: The lighting attached to the building will be required to meet all city standards for
downcast, shielded lighting. A lighting plan will be required prior to the issuance of building
permits that will confirm compliance.
Grading/Drainage, Utilities: A grading and utility plan was submitted with this application,
and was thoroughly reviewed by the City Engineer. A memorandum is attached to this report
that outlines all of the City Engineer's comments. The applicant has also submitted their plans to
the Rice Creek Watershed District for review and will be required to obtain any necessary
permits.
The wetland mitigation and enhancement proposed on the site plan is not meant to be a part of
this request. It was shown on the plans by the applicant to depict the ultimate plans for the site.
A condition of approval clearly indicates that Phase Two will require a separate conditional use
permit amendment most likely to coincide with the expansion of the manufacturing building.
Landscaping: With each addition to the site the largest concern has been the exterior
landscaping on the site, which continually is inspected by city staff for compliance. The City
Forester visited the site on April 5, 2007 and met with the applicant to address any landscaping
concerns that existed. This office building proposal will require some changes to the
• landscaping plan to account for some building plantings,but no major changes to the exterior
landscaping plan are being proposed.

RECOMMENDATION
Staff recommends adoption of Resolution No. 07-75 approving the construction of an office
building, subject to the following conditions:
1. Issues discussed in the City Engineer review memo must be addressed to his satisfaction.
2. All conditions of the previous amendments shall continue to apply.
3. A Performance Agreement between the applicant and city must be executed prior to the
issuance of building permits for the site.
4. A photometric lighting plan in conformance with the standards of the zoning code must

The following review is based on these submittals:
1. Molin Concrete Addition Preliminary Grading and Utility Plan(Office and Overall) and SWPPP,
submitted by Plowe Engineering, dated November 21, 2006, and revised March 22, 2007.
2. Moline Concrete Addition Drainage Calculations, submitted by Plowe Engineering, dated
November 16, 2006, and revised January 11, 2007.
• The following are significant issues that must be addressed prior to preliminary plat approval:
l: Provide information regarding the type of soil and ground water elevation at the location of the
Infiltration Basin. There should be a minimum of 3 feet of separation between the ground water
elevation and the bottom of the Infiltration Basin.
The following are minor plan, calculations, and drafting corrections that must be addressed prior to final
approval.-
1. The Grading Plan shows that the proposed culvert located north of the proposed office building is
discharging towards the existing office building and ascending slope. Direct the culvert away from
the existing building.
2. Determine the high water level at the upstream end of the culvert located north of the proposed
office building. Label the high water level of the culvert on the Grading and Utility Plan.
3. Show the location and elevation of the emergency overflow for the proposed culvert located north
of the proposed office building on the Grading and Utility Plan. The low opening elevations of
adjacent buildings are required to be 1 foot above the emergency overflow elevation.
4. It appears that runoff from the parking area located south of the proposed office building flows
south to Lilac Street,not to proposed Pond 9, as shown on the watershed maps. Ensure that runoff
from the roof of the proposed office building is directed to Pond 9,not to the south parking area.
• 5. Include a rock construction entrance detail on the Plan.
6. Show the location of the rock construction entrance and silt fence on the Grading and Utility Plan.

7. Show the location and types of seed mixes on the Grading and Utility Plan.
8. Update the top board elevations of the outside board of the baffled weir, and the bottom elevations
of the inside board of the baffled weir to be consistent with the 6 inch lumber dimension height, as
shown on the baffle weir detail. The City recommends concrete or metal weirs instead of wood.
9. Approval from Rice Creek Watershed District(RCWD)is required. Submit a copy of the RCWD
Permit when available.
10. Submit a copy of the NPDES permit for the City's records when available.
