time person. The person would also eliminate the position of treet
inspector.
Shop Department - There was discussion on why the mechanics benefits
were budgeted to Shop Department when in theory all his time is spent
working in a particular deparment. It was explained this is the most
reasonable way to handle benefits as far as bookkeeping is concerned.
Cable TV - Mrs. Elsenpeter explained the figures on the budget work-
sheet and noted that once the cable system is in place the City will
receive 5% of the gross reveinue from the cable system.

Assessor - Mr. Schumacher noted that Mrs. Roisum had elected to dis-
continue the City offered helath insurance program. Therefore, the
assessor's budget figures will increase only $10.00.
Consultants -Mr. McLean suggested that the City look into the idea
of hiring the City Attorney on a retainer basis. Mr. Schumacher explained
he had cut this budget drastically this year and was going to strongly
recommend that nobody contact any consultant without going through the
City Administrator's office.
RESOLUTION 81 -39
Resolution 81 -39 Authorizing thelssuance of a Certificate of Indebtedness
was discussed. Mr. Jaworski moved to adkpt Resolution 81 -39. Mr. McLean
seconded the motion. Motion carried unanimously.
Mr. Jaworski moved to adjourn at 9:40 P.M. Mr. Kulaszewicz seconded
the motion. Aye.
These minutes were considered and approved as presented at a regular
meeting held on October 26, 1981.

October 26, 1981
The regular meeting of the Lino Lakes City Council was called to order bu
Mayor Gourley at 7:30 P.M., October 26, 1981 will all members present.
Mr. Locher and Mr. Schumacher were also present.
MINUTES - OCTOBER 13, 1981
On page two, second line under '1981 Audit' after the work 'will' add
'not'. Mr. Jaworski moved to approve as corrected. Seconded by Mr.
Kulaszewicz. Motion carried unanimously.
DISBURSEMENTS
Mr. McLean moved to approve the disbursements as presented. Seconded
by MR. Kulaszewicz. Motion carried unanimously.

Mr. Jaworski had requested time under this portion of the agenda, but had
withdrawn his request.
MINUTES - BUDGET HEARING
Mr. Jaworski moved to approve the minutes of October 19, 1981. Seconded
by Mr. Kulaszewicz. Mr. McLean questioned the statement 'moved to adjourn'
should it state 'moved to continue'? general consensus 'moved to adjourn'
is correct. Motion carried, with Mayor Gourley abstaining.
AUTHORIZATION OF THE ISSUANCE OF CERTIFICATES OF INDEBTEDNESS
Mr. Schumacher reported his actions on the issuance of these Certificates.
The interest rate is 10.750, this matter has been certified to the County.
Mrs. Elsenpeter moved to adopt the RESOLUTION AUTHORIZING A TAX LEVY TO
REPAY THE CERTIFICATE OF INDEBTEDNESS IN THE SUM OF $111,400.00 FOR THE
PURCHASE OF POLICE AND STREET EQUIPTMENT IN THE CITY OF LINO LAKES,
MINNESOTA. Seconded by Mr. Jaworski. Motion carried unanimously.
CABLE TV COMMISSION APPOINTMENT - RESOLUTION 81 -41
This is action ratifying previous action taken by this Council. Mr. McLean
moved to adopt Resolution 81 -41 appointing Mrs. Bobbi Volk as Director and
Official Representative of the City of Lino Lakes to the Cable Commission.
Seconded by Mr. Kulaszewicz. Motion carried unanimously.
A recess was called at this point in the meeting. The meeting reconvened.
PUBLIC HEARING - RESHANAU SHORES

The public hearing on thisplat was called to order at 8:00 P.M. Mayor
Gourley suggested the continuation of this hearing be January 11, 1981.
Mr. Jaworski moved to continue this hearing until January 11, 1981 at 8:00
P.M. Seconded by Mrs. Elsenpeter. Motion carried unanimously.
ATTORNEY's REPORT
Mr. Locher reported that the Judge has not issued his decision by he did
state that he would not require the bond to be changed, the temporary
trestaining order is outstanding and becomes a temporary injunction. He
said there is no case law and is subject to interpretation. He did state
that he found the actions of the Council not to be in contempt of Court.
Mr. Jaworski felt taht since this action cancells the bond sale and since
that it is true, he would see no further action on this matter.
Mr. Locher said Judge Dablow did state that he would certify this matter to
the Supreme Court.
Mayor Gourley asked if both actions are one and the same and Mr. Locher
said, Yes, the Judge would certify the entire file to the Supreme Court.
Mayor Gourley said he was concerned with the impact this action could have
on the bonding capacity of this City and on the band market as a whole in
the State of Minnesota.

Mayor Gourley moved to authorize the Attorney to submit these questions
to the Supreme Court. Seconded by Mr. Jaworski.
Mr. Kulaszewicz questioned the wisdon of spending more money. Mr.
Jaworski reminded Mr. Kulaszewicz that the sewer priject is dead, this is
an attempt to try to reestablish this City in the bond market.
Mr. Kulaszewicz asked the cost involved in taking this matter to the
Supreme Court and Mr. Locher said, approximately $5,000.00.
Mr. Ross asked if there was any legal assurance when this City will be
on the agenda for the Supreme Court and Mr. Locher said, there was none.
Mr. Ross said he understood they have a pretty full agenda, is that
correct? Mr. Locher said, that was correct, however, if the Judge cer-
tifies it and states that it is pressing issue, they (the Supreme Court)
may gove the City preference, but he has no assurance that this will
happen.
Mr. Ross felt this should have been thought out very clearly before the
City got into this istuation.
Mayor Gourely asked if there was any other Aisucssion and there was none.
The question was put for a vote and the motion carried with Mr. McLean
and Mr. Kulaszewicz voting, No.
Mr. Jaworski moved to adjourn. Seconded by Mrs. Elsenpeter. Motion
carried unanimously.

The Special Meeting of the Lino Lakes City Council was called to order
at 7:05 P.M., on November 5, 1981, by Acting Mayor Elsenpeter. Members
present: Kulaszewicz, McLean. Absent; Gourley, Jaworski.
This meeting was called to canvass the results of the City Election held
on November 3, 1981.
