Mr. Reinert felt that there should be some reimbursement for the wear and tear on City streets created by the existence of this facility. Perhaps the City should contact the legislators. NEW BUSINESS Mayor Benson presented the order by the Governor that all State vebicles use Gasahol and requested support in this effort from the local communities. Mayor Benson had received a copy of the amendment for the installation of the interceptor to the Lino Lakes border noting that this has been approved by the Metro Council. Mr. Schumacher had also received a copy. A copy will be made for each Council member. Mayor Benson noted that he had received a Certified letter from Mr. Spetzman in reference to the new zoning map as proposed by the Task Force. All Council members had received the same letter. The Clerk was instructed to write to Mr. Spetzman informing him of the Public Hearing on April 19, 1983. Mr. Marier moved to adjourn at 9:15 P.M. Seconded by Mr. Kulaszewicz. Aye. Sarner, Clerk- Treasurer (:::3e A 'C(-41ffigirogket 40!.- Benjam'n B :nn CV n, Mayor April 25, 1983 The regular meeting of the Lino Lakes City Council was called to order at 7:00 P.M., April 25, 1983, by Acting Mayor Marier, with Council members Kulaszewicz and Reinert present. Absent: Elsenpeter and Benson. Mr. Schumacher was also absent. Mr. Hawkins, Mr. Kluegel, Mr. Volk and Mrs. Sarner were present. MINUTES - April 11, 1983 Mr. Reinert moved to approve the minutes as presented. Seconded by Mr. Kulaszewicz. Motion carried unanimously. DISBURSEMENTS - April 25, 1983 Mr. Kulaszewicz moved to approve the disbursements as presented. Seconded by Mr. Reinert. 24 April 25, 1983 Mr. Kulaszewicz asked if the vouchers for meals were within the limits and was told they were. The Clerk reported there are two checks to be approved that are not on the disbursement listing - they will be on the next disbursement listing. Mr. Reinert asked if we received a report from the animal control and the Clerk said, Yes. Mr. Reinert asked if they were on a regular schedule or what and asked if he could receive a copy of that report. The Clerk said she would make a copy for him. Motion carried unanimously. OPEN MIKE There was no one to speak under this portion of the agenda. WATER PROBLEM - PETE SCHERER Mr. Volk and Mr. Kluegel had inspected this area and Mr. Volk had written a report which he presented to the Council. Mr. Marier said he had had a call from Mr. Scherer and Mr. Scherer had said he and the, residents of the area will solve the problem that exists at this time. Mr. Volk recommended that no more fill be allowed in that area until a drainage plan has been prepared for that area. Mr. Reinert asked if Mr. Davidson should be involved in this matter, and Mr. Volk said not at the present but he should be if and when this plan is done. Mr. Reinert moved to refer this report to Mr. Davidson for his information. Seconded by Mr. Kulaszewicz. Motion carried unanimously. Mr. Scherer asked, if he blacktopped the street from the bottom of the hill to the top, will the City accept this as a City street? Mr. Marier said he does not have the answer for this and it will have to be checked out with the Attorney and the Council. PLANNING AND ZONING ACTIONS - MR. KLUEGEL - WALLS - 62nd Street. This is a meets and bounds subdivision that was recorded withle the moratorium was not in effect. The recommendation of the Planning and Zoning Board was to approve this subdivision. Mr. Kulaszewicz moved to approve the variance to the moratorium for this subdivision. Seconded by Mr. Reinert. Motion carried unanimously. Roy Stanley — Sunset Oaks II - this land had been platted and had received preliminary approval on June 23, 1980. The final plat has not been recorded. Mr. Stanley said he was told to hold upon this plat due to the possibility of sewers. The Planning and Zoning Board had recommended that this not be approved for a final plat due to the moratorium an is not in con- formance with the Comprehensinve Plan or the Zoning Ordinance. Mr. Reinert questioned the statement of not being able to hold this 1 April 25, 1983 25 property until sewers are available. Mr. Stanley said the possibility of sewers is a long way down the road and he cannot hold this land that long. Mr. Reinert moved to uphold the Planning and Zoning Boards' recommen- dation. Seconded by Mr. Kulaszewicz. Motion carried unanimously. ATTORNEY'S REPORT Mr. Hawkins had no report other than the City Administrator had successfully defended the City in the case of Mr. Adams. RESOLUTION #83 -12 - ROAD PROPOSAL Mr. Volk presented the following Resolution for Council consideration: WHEREAS, pursuant to instructions of the City Council, a report has been prepared by Mr. Donald Volk with reference to the Seal - coating program designating certain streets wtihin the City of Lino Lakes for the 1983 work shcedule, and this report was received by the City Council on March 28, 1983. NOW THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF LINO LAKES, MINNESOTA, that 1) Such imporvement is hereby ordered as proposed in the report received by the Council on March 28, 1983. 2 ) Mr. John Davidson, of TKDA, is hereby designated as Engineer for the seal - coating program. He shall prepare plans and specifications for the completing of the seal- coating on those certain streets so designated in the report. Motion carried unanimously. CONSIDERATION OF SALARIES - NON -UNION EMPLOYEES Mr. Reinert said he would like to refer this back to the Ways & Means Committee and report at the next Council meeting with a better explanation on the salary ranges and the effect on the City Budget. How this would also affect the City and the employees in the future. Mr. Reinert moved the above. Seconded by Mr. Kulaszewicz. Motion carried unanimously. NEW BUSINESS Item #1 - Intern Program - Mr. Marier asked the Clerk to explain this 26 April 25, 1983 program which she did. She also reported that Mr. Schumacher had called and said if the Council had questions on this, a delay would be in order. There was some discussion on the amount that would be paid to this person, which the Clerk did not have the answer and there was some discussion on the work programs that this intern would be involved with. Mr. Reinert moved to table this item for the next agenda. Seconded by Mr. Kulaszewicz. Motion carried unanimously. Item #2 - Fertilizer bids - Mr. Volk apologized for not having this information in the packets but he had been waiting for a bid which turned out to be the -low bid. Mr. Volk reported this fertilizer is for the City Parks and is to be used this Spring and again in the Fall. Mr. Reinert questioned the unit costs - sometimes the lower cost item does not have the nutrients as the one that costs a little more. Mr. Volk said he had the breakdown of this on the quotes and felt the lower one was the better buy. Mr. Reinert asked when this must be finalized and Mr. Volk said as soon as possible due to the fact that this should be spread as soon as possible. Mr. Reinert moved to approve the lowest bid and asked Mr. Volk to contact the Anoka County Agent and ask for the best buy on this material. Seconded by Mr. Kulaszewicz. Motion carried unanimously. SECOND READING - CITY CODE Mr. Marier asked the Clerk to read the Ordinance adopting the City Code as follows: ORDINANCE NO. 1 -83 AN ORDINANCE ADOPTING THE LINO LAKES CITY CODE. The City Council of the City of Lino Lakes ordians" SECTION I CODE ADOPTED There is hereby adopted that certain revision oand codification of the Ordinances of the City contained in a printed compilation entitled "Lino Lakes City Code ". A copy of such code shall be marked "Official Copy" and filed as aprt of the official records of the City in the office of the Clerk - Treasurer. SECTION II REPEALS 1 1 Appendix A of the Lino Lakes City Code is a listing of all ordinances of the City from No. 1 to No. 83. All Ordinances listed in Appendix A are hereby repealed, except those ordinances noted in the right - hand column of Appendix A as being included in the Appendices B April 25, 1983 through G. Ordinances so noted, being or limited in nature or application, are continued in force but not set forth in the Code. The rest of Appendix A consists of a cross reference table indicating where in the Lino Lakes City Code the material from the various repealed ordinances may be found. SECTION III COPIES The Clerk- Treasurer shall provide a sufficient quantity of the Lino Lakes City Code for general distribution to the public and he shall give notice in the official newspaper for at least two successive weeks that copies are available in his office for examination or purchase. SECTION IV. PRIMA FACIE EVIDENCE The Lino Lakes City Code shall be prima facie evidence of the law of the City. SECTION V. EFFECTIVE DATE This Ordinance becomes effective June 1, 1983. SET MEETING WITH P &Z AND TASK FORCE - OLD BUSINESS The meeting would be for the purpose of the Council to present the concerns of the citizens that appeared before the Council at the Public Hearing on the Zoning Map and Zoning Ordinance. After some discussion, this meeting was set for May 3, 1983 at 7:00 P.M. The Clerk is to send written notices to all members concerned. NEW BUSINESS - ITEM #3 27 This item is concerned with the annual meeting of the League of Minnesota Cities and is on the agenda to determine how many of the Council members will be attending. The Clerk is to get the exact dates and put this on the next agenda. Mr. Melvin Neilsen, from the audience, asked the Council if there was to be any action on the letter he had written to the Council and Mr. Marier said, No, not at this meeting. Mr. Reinert moved to put this matter on the May 9, 1983 agenda. Seconded by Mr. Kulaszewicz. Motion carried unanimously. 28 April 25, 1983 Mr. Kulaszewicz moved to adjourn at 7:33 P.M. Mr. Hawkins, Mr. Schumacher, Chief Myhre, Mr. Davidson and Mr. Kluegel were also present. Mrs. Sarner was absent. OFFICER OF THE YEAR Chief Myhre presented the "Officer of the Year" award to J. David Zerwas noting his many accomplishments during the year. Mayor Benson added,_ his thoughts and Thanks on behalf of the Council. MINUTES, APRIL 19, 1983 Mr. Reinert moved to approve the minutes of April 19, 1983 as pre- sented. Seconded by Mr. Marier. Motion carried unanimj thiy. MINUTES, APRIL 25, 1983 Mr. Marier moved to approve the minutes of April 25, 1983 as pre- sented. Seconded by Mr. Kulaszewicz. Motion carried unanimously. OPEN MIKE Mr. Phillip Osheim appeared before the Council to present a problem he has concerning septic systems located adjacent to and on his pro - prety. These systems are the ones that serve the Town Houses. Mr. Osheim is concerned with the possibility of pollution of the area to include the lake. He said in wet weather there is an odor and he wondered if the systems are operating properly. Mr. Osheim requested the City to inspect these systems. 1 1
