Special Meeting
April 19, 1983
The Special Meeting of the Lino Lakes City C ouncil was called to order
at 7:00 P.M., A pril 19, 1983 by Mayor Benson with all Council members
present. Mr. Hawkins, Mr. Short, Mr. Schumacher, Mr. Kluegel and Mrs.
Sarner were also present.
Mayor Benson called the Public Hearing to order noting the purpose of
this meeitng is to discuss the proposed new zoning ordinance and zoning
district map. A task force has spent approximately ten months putting
these documents together - there has been a lot of thought put into this
map and ordinance. Mayor Benson asked that this meeting be conducted
in an orderly manner. Each person will be allowed to speak without
interruption had he requested that comments be liminted to 5 to 8 minutes,
but if it takes longer - no problem. If this meeting carries into a late
hour, then the meeting will be continued to another date in order for
everyone who has questions to present them to the Council.
Mayor Benson stated the format for this meeting will be as follows: The
Planner will make a presentation. Mayor Benson asked that Mr. Short be
allowed to complete his presentation before ny quesitons are aksed. If
there is a quesitonn, please write it down, and it will be answered later.
When Mr. Short has finished, there will be a hort break to give the
people time to look at the maps, talk with Mr. Short or complete one
of the forms in the rear of the Hall if they wish to speak to the Council.
The meeting will be reconvened and the public will be heard. Mayor Benson
requested that each person come forward and speak into the microphone,
stataing their name and address and, if they are representing someone,
their name and address. This will done on an individual basis.
Mayor Benson felt there would be no decision made at this meeting.
This meeting is for the purpose of taking input from the concerned
residents. This input will then be considered by the Council.
MR. SHORT's PRESENTATION
Mr. Short noted that he had appeared at four quadrant meetings and had
presented basically the same review at those meetings. Mr. Short said
this began by going thorugh the existing Ordinance #56, page by page,
and making extensive revisions. In fact the number of pages has
basically doubled.
The task force had also discussed this entire City, section by section,
which encompasses over 33 square miles. After the work done by con-
sulting maps, the task force had then toured the City on several different
occasions.
Mr. Short listed the work done by the City in conformance with the laws
passed by the State Legislature in Chronoligical order listing the reason
why this work was necessary.
Mr. Short said this zoning ordinance and zoning map is necessary to
conform to the Land Use Chapter contained withing the Comprehensive
Plan of the City that has been adopted by the City Council.

IAn Urban service boundary was established. This is the aeea where growth
will be encouraged, where services can be provided without the need to
expand the existing services by any great amount. The rural area is where
rapid growth will be discouraged, the minimum lit size is to be 5 acres,
with the option to replat when sewer is available.

As this land use was discussed, the classifications have been expanded to
17 different districts. These districts were then tranferred to a zoning map.
The relationship of commercial land use. Projections of how much commercial
land is needed was done, and it was felt that approximately 400 acres of
land would be needed. The decision of where to locate this classification
was based on many factors.
Some of the factors considered was the location of the commercial where
access was adequate and to eliminate the strip zoning along Lake D rive and
Hodgson Road. The most sensible location was at the intersections of the
Freeways. The commercial lands along Lake Drive was located in clusters
to eliminate the necessity for individual driveways along that thoroughfare.
It creats a safer flow for the traffic.
Mr. Short pointed out there are two parts to this - the zoning ordinance
and the zoning district map. The ordinance sets the rules and regulations
governing the districts as shown on the map.
Mr. Short completed his presentation. Mayor Benson requested that each
person who had a question to list it on the forms at the rear of the hall
Iand leave it on the council table and they will be heard after the break.
A ten minutes break was called at 7:45 P.M. The meeting reconvened at 8:OOP.M.
Mr. James Flannery - representing Mr. Jim Spetzman with property on Lake
Drive. Mr. Flannery pointed out this property was rezoned in 1979 from C -A
to LI. Mr. F lannery pointed out that if this property is rezoned at this
time he felt it would be inequitable and the owners would suffer a financial
loss. Mr. Flannery had submitted a letter setting forth this matter in
detail and requested the Council consider his request to not change the
classification of this land.
Forest Tagg - SE Corner of I35W and Lake Drive - He wons 29 acres and re-
quested that the rear portion of this land be included in the LI classifi-
cation. He also owns 10 acres on the North side of the Lino Air Park which,
under this ordiannce, cannot be split.
Gary Duncanson - Luther's Marine - the back of his buildings are about 10
yards from the GB calssification border. If the area remains divided in
this manner, he will only be able to park about 10 boats in the proper area.
Mr. Duncanson requested that the GB calssification be extended to include
all his property to include the house and the two lots within the plat
to the East that is under the high lines. Due to the lines, the lots are
unbuildable.
IMR. Reinert aksed would it create a problem by including the lakd where
the house is and Mr. Duncasnon said, No, he would prefer the house not be
there. With this calssification, he would then have more space for the
storage of boats.

Wesley Jensen - has property just North of the 49 Club. Under the old
ordinance all the frontage was zonaed as commerncial - under the new
zoning it woul dbe 2 commercial and 1 residential. Mr. Jensen would
ask for consideration of putting the eintre parcel in the commercial
zoning district.
V.S.Petersen - concerned with property in the 6900 blick of Lake Drive -
owns approximately 400' of currently zoned commercial property. The land
is too small to construct more than one home and is not the nest use of
the land. Mr. Petersen suggested to begin to plan for a service road
behind what was once the commercial property, leave the commercial zoning
to create a buffer zone for the residential property on the lake. Another
factor is the use of the land across the highwway is commercial. Mr.
Petersen felt that perhaps this could also be used for a multi- family
complex that could also serve as a buffer. Mr. Petersen pointed out that
he has no immediate plans.
Mr. Short noted that any lots of record can be developed even though
they do not meet the proposed regulations.
Roland Ford - Northland Tree Service - 6074 Hodgson Road. This has always
been commercial ans would like the commercial zoning to remain - in fact, he
would prefer LI zoning. This property is located in the same general area
as Mr. Jensen's.
Christie Grieve - 7859 Meadow View Trail in MarDon Acres - si concerned
with the LI zoning proposed adjacent to their homes. She asked the
rationale behind zoning this LI and if anyone has an invested interest
in this land?
Mr. Short noted this property is owned by the Molin C oncrete Co and
is already zoned as LI. Also, the property is located under the runway
of the Lino Air Park and there is limited development allowed in this
type of area.
Mrs. Grieve suggested that perhaps the lands north of 77th be R and the
lands south of 77th remain LI.
Kay Zisk - also from the same area - reiterated the same thoughts as above.
Milt Jorgenson - 8221 Lake Drive - has 9 acres of land - is currently
zoned commercial and requested that this land remain commercial. There
is currently a pipe line running through his property which limits the
develop,ent of residential. He felt the option of selling commerncial
versus Residential has quite a financial advantage.
John Benson - 6347 Red Maple Lane - has bought property to the South with
the idea of restricting development in that area. Is in partnership
(T.J.J.T.) had had propsoed this land be platted in lots of approximately
1.5 acres - had presented to P &Z and was advised to present this to Rice
Creek Watershed Board. They have quite an investment in this property
and the plans - now, with this new zoning, this land goes into Rural -
one home per 10 acres - would be a substantial loss for the firm.
Mr. Rinert wasked what size his lot is - Mr. Benson said his home is
located on approximately 1 acre. Mr. Benson said the land cannot be
farmend - has a lot of ponding areas, he felt that it could not be used
IJeff Joyer - Lake Drive - 31 acres North of Main Street - He is purchasing
this property with 1100 fee of commercial property along Lake Drive. They
plan to farm the land but do have long range plans of a commercial nature
and would request that the commercial zoning remain on that land.

for industrial - nothing could occur in that area for a long time with the
exception of residential development.
Greg Coleman - 940 Evergreen Trail - was concerned with the ability of not
being able to construct a 2nd garage. He has 2 acres of land and has plans
of constructing a detached single garage for the storage of his equipment.
Mr. Short read the arules and regulations as they refer to accessory
buildings and in this case, Mr. Coleman would only be allowed to construct
a tool shed of 120 square feet.
Mr. Coleman said his equipment is tored outside - he would ask that the
size of the lot requiring 22 acres or under for the 120 square foot tool
shed and no extra garage perhaps should be set at 2 acres.
Charels Prokop - 2210 Deer Pass Trail - was concerned with the SE quadrant
of the City that is proposed to be zoned as Rural. He felt that perhaps
this should reflect zoning of ER since there are several plats already
existing in that area. He suggested that since the zoning in Ramsey County
directly to the South, perhaps the immediate area should be ER then to the
R zone.
IGlement Schmitz - owns the land on the corner of Lake Drive and Highway 49
which is proposed to be zoned as commercial. Mr. Schmitz requeisted that
the zoning on this land be R. He has plans for the development of this
land.
Mr. Short pionted out this was proposed as commercial in the Comp Plan
and multi - family use due to the location and the access to the property.
Mr. Schmitz felt that the designation of GB is of no value to this land.
Jerry Blackbird - repreesnting E 1 Rehbein and Son - has three parcels in
qustion - the warehouse has LI use at the present time - the second parcel
is located just South of Vicky Lane on the West side of Lake Drive - this is
proposed for ER and the firm would like this to remain as Commercial
property. This property was purchased for commercial property,only
contains about 1 acars. Would also like this parcel to remain as commercial.
Arlo Morehouse - owns 40 acres at 660 79th Street. He pointed out that
all lands around his land is platted into one acre lots - the land is pro-
posed for ER - one house per 5 acres - felt no one would build on 5 acres.
Mr. Short said this wouldonly remian this way until sewer is available
and then could be platted in 4 acre lots.
IJerry DeMars - 7090 Lake Drive - adjacent to Bastein Products - there has
been conversation with that firm about purchasing his property and if the
commercial zoning is removed, this would make this property unavailable to
tha firm —would ask that the commercial zoning remain on his property.

John Doyle - of New Brighton - owns property on Pheasant Run and Captains
Place. He is a contractor - is concerned with the property on Captain's
Place. Has a problem with some of the lots on that street due to the
high water table. These lots are zoned as R1. Mr. Doyle said one
consideration is to retain the density but to construct homes such as
a townhouse complex leaving some of the land open. Mr. Doyle pointed
out that 4 of the lots are unbuildable according to the DNR and Corps
of Engineers.
John Tobish - owns at 6192 Hodgson Road - z mile North of Co. Road J. He
would recommend to the Council that the commercial property zoning
remain on Hodgson Road for at least 2 mile north of County Road J.
Jim Schaffer - representing the Chamber of Commerce - expressed their
appreciation of the work done on these documents. Explained their
concern is with the business people of the area and one of the goals is
to create cooperation between the business people, the City Ccuncil and
the residents of the area. He noted one of the major concerns is the re-
zoning of the Spetzman property. Mr. Schaffer asked that if the Council
has any questions, please feel free to approach the Chamber.
A ten minute recess was called at this point. The meeting reconvend at
8:55 P.M.
Lyle Carpenter - represented Carpenter's Automotive - they have a re-
claimnation yard which has a LI zoning at this time and he requested this
zoning remain as is.
Mr. Short felt this fell within the GB district on the propsoed map.
Mrs. Elsenpeter suggested this could remain as a non - conforming use.
Mr. Carpenter said he had paid premium proce for that land and wanted the
LI zoning to remain.
Bill Flannagan - 908 Orange St. - has an auto repari shop adjacent to the
tire shop and he noted that his land has been left in the Ri Area.
Mr. Short said this could operate as a non - conforming use that could
continue as is with limits on expansion and if destroyed to a certain
percentage, could not be rebuilt.
Mr. Flannagan pointed out that he had been there for 20 years and if he
could not rebuild, that would take away his means of income.
There were no more questions from the audience.
Mayor Benson said this meeting will be continued. He felt there have
been some questions that this C ouncil will want to discuss with the
Planning and Zoning and with the TAsk Force. All these questions will
be discussed with those committees. This will then be discussed at a
future dae with the property owners.
It was suggested that after the meetins with the P &Z and the Task Force,
a meeting be scheduled with these property owners. This meeting will be
advertised in the paper and each one of the property owners, who had

concerns, will be notified by mail of the meeting date.
IMr. Jorgenson asked, if the rezoning of commercial to residential, which
would lower the value of the land, what would happen if a property owner
filed an injunction against the City - would this halt the proceedings
on this?
Mayor Benson said he couldn't answer that question - this would have to
be handled as it occured. Mayor Benson also pointed out that the Metro
Council has also given some guidelines that must be followed or the City
must obtain permission for the deviations.
Mr. Jorgenson asked if the City would reimburse the property owners for
the devaluation of the property by the down zoning? Mayor Benson said he
did not have an answer.
Mr. Marier moved to continue this hearing. Seconded by MR. Kulaszewicz.
Motion carried unanimosuly.
Mr. Marier moved to adjourn. Seconded by Mr. Kulaszewicz. Motion carried
unanimously. 9:25 P.M.
These minues were considered and approved at a regular Council meeting
held on May 9, 1983.

The regular meeting of the Lino Lakes City Council was called to order at
7:00 P.M., September 12, 1983, by Mayor Benson with all members present
with the exception of Mr. Marier. Mr. Burke, substituting for Mr. Hawkins,
Mr. Schumacher, Mr. Wetzler of TKDA, Mr. Kluegel and Mrs. Sarner were
also preent.
MINUTES - AUGUST 22, 1983
Mr. Reinert moved to approve the minutes of August 22, 1983 as presented.
Seconded by Mr. Kulaszewicz. Motion carried unanimously.
DISBURSEMENTS AUGUST 31, 1983/ SEPTEMBER 12, 1983
IMr. Kulaszewicz moved to approve the disbursements as presented. Seconded
by Mrs. Elsenpeter. Motion carried unanimously.
