SPECIAL COUNCIL MEETING
April 15, 1985
A Special meeting of the Lino Lakes City Council was called
to order by Mayor Benson at 7:00 P.M. Council members pre-
sent: Bohjanen, Reinert, Marier. Mr. Kulaszewicz arrived
at 7:10 P.M. Assessor, Margie Roisum; County Assessor, Ed
Thurston and City Clerk, Marilyn Anderson were also present.
The purpose of this Special Council Meeting is to conduct
the annual Board of Equalization.
CONDUCTING THE ANNUAL BOARD OF EQUALIZATION
Mayor Benson asked Mrs. Roisum the status of the Red Maple
Lane citizen complaint heard in January. She explained there
had been an additional meeting in January with the residents
and they have not returned with further questions or request
for action.
Mr. Pierre Nadeau of 6644 - 20th Avenue appeared before the
Council to let them know that he is appealing to the state
the City Assessors estimated market value on his property.
Mr. Nadeau said he has been before the Council for the,past
three years to tell them the Assessor is not doing her job.
He also requested that there be four to six weeks between
when the valuation cards are sent from the County and the
date of the Board of Equalization so that citizens have more
time to check the accuracy of the cards.
Mr. Reinert moved to attempt to give thirty days from the time
the valuation cards are mailed before conducting the Board of
Equalization. Mr. Marier seconded the motion. Motion carried
unanimously.
Mr. Nadeau asked why the newspapers were not present tonight.
He told the Council that last year someone from City Hall had
told the reporters not to attend this meeting. He was told
his statement was not true. Mr. Nadeau said this is one of
the most important meetings of the year and reporters should
be here. Mr. Reinert said it has been his experience when
you tell reporters not to attend they come in bunches to see
why they were told not to come.
Mr. Nadeau gave some of his concerns: taxes are too high, the
City budget is higher than neighboring cities that have more
land and residents and the City should be encouraging develop-
ing and getting some industry. He felt developers were sitting
on properties that could be developed because the land is valued
so low by the Assessor they pay so little taxes. He referred

to the Peltier View plat. It was established that platted pro-
perty is not assessed per lot until after the plat has been
recorded as a plat for three years. Currently the lots facing
the street are now assessed as buildable residential lots.
The remaining lots are now assessed as farm land.
Mr. Nadeau referenced his own parcel #25- 31 -22 -22 -0010 which is
a ten acre parcel with nine acres tillable. The estimated mar-
ket value is $14,500.00. He felt this was over valued .because
it is land locked and cannot be used for a building site. It
was established that this land borders another parcel owned by
Mr. Nadeau and is not land locked.
Mr. Nadeau asked why a ten acre parcel owned by Mr. Andrew Cardinal
#35- 31 -22 -12 -0001 is valued lower than his ten acre parcel. Mrs.
Roisum said most of this particular parcel was low and could not
be cultivated. Mr. Nadeau's land is high and all of it is tillable.
Mr. Nadeau questioned Mrs. Rykl's property: #26- 31 -22 -44 -0001 valued
at $57,700.00. It was determined the present market value is
$65,200.00.
Mayor Benson said that it is ridiculous:to go through this each
year. The Council should follow up and bring this to a conclus-
ion. He suggested that the Council investigate Mr. Nadeau's
complaint and bring him back to Council and answer his questions.
Mr. Marier said the Council should look at the property person-
ally. Mr. Reinert asked if the Council personally looks at the
property and makes some decision, would Mr. Nadeau abid by what
the Council decides. Mr. Nadeau said definitely, No., he has
the right to appeal to the state.
Mayor Benson asked Mr. Nadeau what is the point he wants to make?
Mr. Nadeau said he wanted to show that somebody can come in
with an extreme situation where the Assessor is not doing a
very good job of evaluation and the Council says this has to
be changed.
Mr. Marier moved to meet at Mr. Cardinal's home on Tuesday,
April 16, 1985 at 6:00 P.M. with Mrs. Roisum, Mr. Bohjanen
and Mayor Benson to look at Mr. Cardinals property. Mr. Boh-
janen seconded the motion. Motion carried unanimously. Mr.
Cardinal said Mr. Nadeau would not be welcome on his property.
Mrs. Roisum will contact the below listed parcel owners to
see if they can look at their parcels as well: 26- 31 -22 -42 -0002;
24- 31 -22 -24 -0001; 13- 31 -22 -23 -0001 and 26- 31 -22 -43 -0001.

Mr. Nadeau said he had a list of thirty five parcels with their
1984 assessed values. Mr. Thurston said if the City wanted to
reassess these parcels and raise the estimated market value,
the Council would have to call the landowners before the Council
and discuss this with them.
Mr. Nadeau said he is looking at why is comparable land here
worth so much more than somewhere else. He said the big factor
is supposed to be value, not who is using it or how they are
using it. Mr. Nadeau again asked why whether somebody is farm-
ing the land or not, should make a difference in the value.
Just as soon as somebody plows the land the land value triples.
The land has not changed but the value changes.
Mr. Kulaszewicz moved to meet with Mrs. Roisum and Mr. Reinert
at 8:30 A.M. Saturday, April 20, 1985 to look at some of the
parcels Mr. Nadeau has listed. Mr. Reinert seconded the motion.
Motion declared passed.
Mrs. Roisum told the Council she had received two telephone calls
from residents questioning their land values. Mr. Richard Klenck
questioned values on parcels R36- 31 -22 -13 -0005 and 836- 31- 22 -13-
0002. Ms. Nancy Yapp questioned values on her parcel 832- 31 -22-
14 -0008.
Mr. Marier moved to continue the Board of Equalization on Monday,
April 22, 1985 at 5:45 P.M. Mr. Kulaszewicz seconded the motion.
Motion declared passed.
Mr. Marier moved to adjourn at 8:30 P.M. Mr. Bohjanen seconded
the motion. Aye.
These minutes were considered, corrected and approved at a regular
meeting of City Council on April 22, 1985.
