Home My WebLink About2007-143 Council Resolution• Council MemberReinert introduced the following resolution and moved its adoption: CITY OF LINO LAKES RESOLUTION NO. 07 -143 RESOLUTION APPROVING CHANGE ORDER NO. 3 LAKE DRIVE /I35W IMPROVEMENT PROJECT WHEREAS, pursuant to the resolution of the City Council adopted May 14, 2007, the City awarded the construction contract for the Lake Drive /I -35W Improvement Project to Lunda Construction Company, and WHEREAS, a delay of the Award and Approval for S.P. 0280 -55, has pushed back the concrete werarring course of placement according to the Contractors original schedule submittal beyond the Mn /DOT Standard Specification 2403.A placement date of October 1st, and WHEREAS, to remain on schedule as planned, the Project Engineer with the concurrence of the Mn /DOT Bridge Office will all the Contractor to cast Bridge No. 02817 stage 1 deck to its full deck thickness of nine inches using a concrete mix design 3Y43 HFWC and eliminating the concrete weraring course in stage 1. Resolution No. 07 -145, Approving Change Order No. 5, Lake Drive /35W Improvement Project VOTE REQUIRED: 3/5 Vote Required BACKGROUND: On May 14, 2007 the City Council awarded the Lake Drive /I -35W Improvement Project to Lunda Construction Company in the amount of $7,531,701.71. Construction is underway with paving of the northbound lanes anticipated the week of the 10t ". The northbound center pier of the bridge has been completed and the northeast and southeast bridge abutments are anticipated to be completed within the next month. Change Order No. 3. Due to a delay in the award and approval of the contract the date for placement of the bridge concrete wearing course was pushed back beyond the Mn /DOT required placement date of October 1St. In order to remain on schedule Mn /DOT recommended a full depth deck pour using a different concrete mix. The net amount of the change order is $20,041.88. Change Order No. 4 is a deduct for concrete materials that failed to meet specifications. Mn /DOT Concrete Office has determined that the material can remain in place at a reduced price. The change order represents a credit in the amount of $869.00. Change Order No. 5. In August the City approved Change Order No. 2 eliminating the majority of the concrete median islands with a irrigated landscape system. The change order reduced the quantity for four inch concrete walk from 23,758 square feet to a balance of 4,680 square feet. The contract with Lunda Construction includes a provision that allows for an adjustment to a unit price for contract items that underrun • less than 75% of the contract bid quantity. Accordingly the contractor has requested a • modification of the 4 inch concrete walk unit price from $2.25 s.f. to $2.64 s.f. The total amount of Change Order No. 5 is $1,825.20. This concrete was used for Br #02817 Stage I Pier Ftg. This Contract further provides for, Four (4) inch concrete walk. At the request of the City of Lino Lakes, the median construction on C.S.A.H. 23 is eliminating the four (4) inch concrete walk and replacing it with an irrigated landscape system. Change Order No. 2 reduced the quantity of this item by 23,758 square feet leaving a quantity balance of 4,680 square feet. The Contractor has requested a modification of the Contract Bid Price in accordance with Mn/DOT Specification 1903 for contract items that underrun less than 75% of the contract bid quantity and the Engineer has determined that this request is justified. Now, therefore it is mutually agreed and understood that: The unit price for item 2521.501 (four inch concrete walk) is hereby modified for the remaining quantities needed. Contract time will not be revised except as may be provided in Mn/DOT Specification 1806. The Contractor will not make claim of any kind or character whatsoever for any other costs or expenses that he may have incurred or that may be hereafter incurred in performing the work and furnishing the materials required by this Agreement.
