Mr. McLean moved to approve checks #9924 through and including #9946, with #9929 being void. Seconded by Mr. Zelinka. Motion declared passed. Mr. McLean moved to adjourn at 1:10 A.M. Seconded by Mr. Kulaszewicz. Aye. These minutes were considered and approved at the regular Council meeting held on September 10, 1979. Edna L. Sarner, Clerk- Treasurer The regular meeting of the Lino Lakes City Council was called to order at 8:00 P.M. on September 10, 1979, by Mayor Karth. Council members present; Kulas_aewc cLean, chneider, Zelinka. Absent; None. Mr. Locher was also present. Mr. Zelinka moved to approve the minutes of August 22, 1979 as presented. Seconded by Mr. McLean. Motion declared passed. Mr. Kulaszewicz moved to approve the minutes of August 27, 1979 as pre- sented. Seconded by Mr. MCLean. Motion declared passed. The final plat of Shenandoah III had been delivered for final approval and signatures. Mr. Gotwald has also delivered the plans and specifi- cations for sewer, storm sewer and street construction for the Shenandoah III plat. He had checked the preliminary plat against the final plat and had found no changes. He had not had time to write a cover letter, but had asked these plans and specifications be approved. Mr. McLean moved to approve the plans and specifications for sewer, storm sewer and street construction for Shenandoah III as prepared by Mr. Gotwald. Seconded by Mr. Zelinka. Motion declared passed. Mr. Zelinka moved to approve the final plat of Shenandoah III and authorize the Mayor and Clerk to sign the plat. Seconded by Mr. McLean. Motion declared passed. Mr. Zelinka presented a request from the Circle Pines Utility Commission. They have reqeusted the Clerk's office to notify them of the address of homes in their service area received for assessment searches. Mr. Zelinka so moved. Seconded by Mr. McLean. Motion declared passed. The Saint Paul Water Department had delivered an agreement to allow the City to cross over Water Department property in the construction of the utility system on Black Duck Drive. Mr. Locher checked the agreement and found it acceptable. Mr. McLean moved to approve this agreement and to authorize the Mayor and Clerk to sign the document. Seocnded by Mr. Kulaszewicz. Motion declared passed. The continued hearing on the Bruner rezoning was called to order at 8:15 P.M. Mr. Locher read the notice of legal publication and indicated September 10, 1979 the mailing list of sent notices. IMr. McLean presented the actions of the Planning adn Zoning Board. There were two petitions - one against the rezoning adn one with signatures of persons who had no objections. The Planning adn Zoning Board had recommended approval of this rezoning from Commercial /R1 to R -2 of the home located at 790 Vicky Lane. Mr Schneider asked to see the petitions. Mr. Zelinka questioned the effect of 6.21 of Ordinance 56 on this rezoning adn Mr. Locher said that applied to construction and development. The matter of septic systems was discussed with Mr. McLean suggesting that this should be left to be handled according to the rules in effect at the time the home is used as a duplex. Mayor Karth asked for comments from the audience. Mrs. Bruner suggested the objections relating to creating a parking problem would be handled by the City's Ordinance on parking; that the home had been used as a duplex for thirteen (13) years - what had been the effect on depreciating property in the area over this time period. Mr. McLean moved to grant the R -2 zoning to the property located at 790 Vicky Lane. Seconded by MR. Zelinka. Motion declared passed. Mr. Kulaszewicz moved to close the hearing at 8:23 P.M. Seconded by Mr. Zelinka. Motion declared passed. Mr. Robert Burman, Anoka County Commissioner, was present to answer questions on the proposed location of the juvenile detention center at St. Joe's Church. Mr. Burman gave a brief outline of what is required by the County in the area of juvenile detention and that the leased space at the State Facility must be vacated. He said the Committee working on a relocation site had looked at the Church but that he was working to have the center located at a more centrally location. Mr. Burman said he could not guarantee that this facility would not be located in Lino Lakes. Mayor Karth said he understood that the County had asked the City of Anoka for a hearing on a site loacted near the State facility in Anoka. Mr. Burman agreed to this. Mr. Burman was asked if the Advisory Board had a member from Lino Lakes and he said, No, there is one person from each Commissioner's District. Mayor Karth read the petition presented to the City Council opposing this proposal. This petition was also presented to Mr. Burman by Mr. Bohjanen. Mr. Bohjanen saying this contains approximately 400 signatures and is merely supporting data for the City Council. Mr. Bohjanen asked if he would be on the agenda for the Commissioner's meeting scheduled for September 11, 1979 and Mr. Burman said he would be on the agenda at lo:00 A.M. IMr. Bohjanen asked if any of the Council members could make the meeting and Mr. Schneider said he would try. Mr. Zelinka asked where the Commissioners meeting room was and Mr. Burman said in the new part of the Courthouse. Mayor Karth thanked Mr. Burman and Mr. Bohjanen for their time and information. September 10, 1979 Mr. Burman said the bids on Birch Street had been let to Forest Lake Cont- racting at about one -third more than had been planned for. Mr. Kulaszewicz questioned the onitting of the paved shoulders on Birch Street - he felt this area got left out on this kind of installation. Mr. Burman said it may seem so, but was not. Mr. Bill Houle asked what other Countys had done in providing centers for juveniles and a lady from the audience said that Ramsey had one on St. Peter Street near the churches and their counselors. Mr. Schneider asked Mr. Burman if there was any indications that current bills outstanding would be paid to the City for Police coverage in both the Park and at the juvenile center and Mr. Burman did not know. He felt the Council should meet with Mr. Torkildson. Mr. Burman asked that a letter with the current bills be sent to him. The meeting with Mr. Torkildson was set for September 24, 1979 at 8:10 P.M. Chief Myhre will also be asked to attend this meeting. Mayor Karth opened the continued hearing on the uses of Federal Revenue Sharing Funds at 9:00 P.M. Since the final figures had not beeb avail- able, this had not been published. Mr. Schneider moved to continue this hearing until September 24, 1979 at 10:00 P.M. Seconded by Mr. Zelinka. Motion declared passed. Mayor Karth reported on the condition of the manholes in East Shadow Lake Drive and gave some figures on the seepage into those manholes on wet days. The Clerk was to ask Mr. Gotwald to get some cost figures on the repair of the manholes and have ready for the next Council meeting. Mr. Norm Firtchie, of the Centerville Fire Department had contacted Mayor Karth with a proposition on the storing of a fire truck. Center- ville has three trucks and only storage for two. They had suggested the idea that, if Lino Lakes would provide a place for storage, and ina an area where there would be manpower to man the equipment, Center- ville will train the per sonnle and provide the uniforms. This matter will be discussed at the bidget meeting - could perhaps be put in the five uear plan - needs to be discussed. The Public Hearing for the W &G Rehbein plat was called to order at 9:10 P.M. Due to the delay on approval from the Rice Creek Watershed Board, Mr. McLean moved to continue this hearing until the receipt of the necessary information from the Rice Creek Watershed Board and set a date for the hearing at that time. Seconded by Mr. Kulaszewicz. Motion declared passed. Mayor Karth reported on discussion by the Planning adn Zoning Board on the use of commercially zoned property to construct residential homes. It had been suggested this practice not be allowed. There was some discussion on the precedence that have been set in this matter. Mayor Karth said the Planning adn Zoning isrecommending this be re- quired to be rezoned ro R -1, enforce the Ordinance and notify the Building Inspector of this action. Mr. Zelinka moved that any residential, R -1 through r_6, application for construction on lands presently zoned as commercial, be forwarded to Planning adn Zoning for review and /or rezoning. Seconded by Mr. Kulaszewicz. Motion declared passed. September 10, 1979 9 Mr. Robert Keefe was present to discuss the installation of the cul -de -sac into his property. His letter of credit expires 9/15/79 and the Council would like to have the work done. Mr. Keefe suggested paying for this work through the assessment process. The Council warned him it would cost a lot more. Mr. Gotwald is to get a bid for Mr. Keefe to have the work done at the time Deer Pass Trail is completed. There was discussion on the completion of that portion of Rolling Hills Dirve between Deer Pass Trial and this cul -de -sac and the general feeling was that Mr. Gotwald would take this into consideration at the time the work is considered. Mr. McLean moved that Mr. Gotwald be instructed to obtain a bid for the in- stallation of this cul -de -sac, also to porvide figures for both methods and to have ready for Mr. Keefe at the next meeting. Mr. Keefe to renew his letter of credit for at least 2 months until the work is completed. Second- ed by Mr. Kulaszewicz. Motion declared passed. The Public Hearing for the rezoning of lots in Carole's Estates that border 77th Street was called to order at 9:30 P.M. Mr. Locher read the notice of legal publication and the list of persons to whom notices were mailed. Mr. MCLean reported this matter had been before the Planning adn Zoning on August 15, 1979 and this Board had recommended approval of this rezoning with the stipulation that these lots may be used for single family res- idents if so disired. The time limit imposed by Section 6.21 of Ordinance #56 would apply to this rezoning. IMayor Karth asked for comments from the audience and there were none. Mr. McLean moved to approve this rezoning request. Seconded by Mr. Kulaszewicz. Motion declared passed. Mr. McLean moved to close the hearing at 9:40 P.M. Seconded by Mr. Kulaszewicz. Motion declared passed. Mr. Lyndal Nelson was present to discuss a lot line problem in Sunset Oaks. The foundations had been staked using the wrong back lot line thus putting the home much too near the side lot line. Mr. Nelson was advised to consult with his mortage insurance company and the bank hokding his mortgage. Mr.'Kulaszewicz will present the Personnel Commission report at the Budget hearing. Mr. Schneider gave a very brief financial report. A11 Council members have a copy of the latest report. Mr. Zelinka reported on the Park Board meeting. Cost figures for the con - struction of a new hockey rink had been considered. This would cost about 11/12,000.00 The Park Board felt that a pleasure rink should be built instead of the hockey rink but a lcittle further apart. The Board recommended that the base be garded and the area line with perhaps railroad ties - this cost approximately $600.00 with about $125.00 for the surveying. IAny decision on this was tabled until the budget hearing to be held on September 11, 1979. Mr. Zelinka reported that the LAWCOM application for the construction of the building had been denied becasue Lino Lakes does not fit inot any of the catagories as set forth by the State. 10 September 10, 1979 The Clerk presented the following times for Council consideration: ..Application from Northwestern Bell for installation of buried cable on Cedar Street. Mr. Gotwald and checked and approved. Mr. Zelinka moved to approve this request. Seconded by Mr. MCLean. Motion declared passed. ..A second request from Northwestern Bell for buried cable on 4th Avenue. Mr. Kulaszewicz moved to approve. Seconded by Mr. Zelinka. Motion declared passed. ..The Statement of Assurance for the Federal Revenue Sharing will be con- sidered at the budget hearing scheduled for SEptember 11,1979. ..The lights in Shenandoah were discussed and the Clerk was instructed to contact Mr. Gotwald on this matter. ..Mr. Zelinka requested permission for Mrs. Billik to move a small storage shed to her new home. Council had already granted this request. Chief Myhre reported that he and checked with Mr. Kelly and the Police Reserve unit he and proposed would be covered by Wrokers Comp. It would cost the City $6.50 per 100 man hours per month. The City is also covered if another person is injured. Chief Myhre wxplained this would be a sex man. Police Reserve to ride with the officers. Uniforms would cost $120.00/$150.00 per man. The matter of physicals and physioligical exams has not been finalized as yet. Mr. McLean moved to approve this plan as presented. SEconded by Mr. Kulaszewicz. Motion declared passed. Chief Myhre asked the status of Jeffrey Kirschbaum and the general consensus of the Council was that he was no longer considered an employee of this City. The Clerk was instructed to write to Feed Rite and ask their plans for development on a parcel of land that has been rezoned to Light Industrial. Mr. Schneider so moved. Seconded by Mr. Zelinka. Motion declared passed. 1 Mr. Locher presented an update report on the Don Holzmer home and the manner of portions of the construction not meeting State Building Code. There is not the required number of courses of block in the basement thus making the ceiling too low. Mr. Locher said the house should either be jacked up and this situation corrected or a variance should be filed with the abstract. This would be to pro tect a prospective buyer. Mr. Zelinka moved to approve checks #9952 through and including #9992. Seconded by Mr. Kulaszewicz. Motion declared passed. Mr. MCLean moved to adjourn at 10:55 P.M. Seconded by Mr. Kulaszewicz. Aye. Sarner, Clerk- Treasurer September 12, 1979 The public hearing on the request by El Rehbein and Son for a rezone from R -1 to R -5 on lutlots H and parts of outlots J and K, Lakes Addition II, was called to order at 8:00 P.M., September 12, 1979 by Mayor Karth. All Council members were present, Robert Schneider, John McLean, Richard
