The regular meeting of the Lino Lakes City Council was called to order
at 8:00 P.M., November 26, 1979, by Mayor Karth. Council members present;
Kulaszewicz, McLean, Schneider, Zelinka. Absent; None. Mr. Locher, Mr.
Gotwald and Mr. Schumacher were also present.
Mr. Schneider moved to approve the minutes of November 13, 1979 as pre-
sented. Seconded by MR. Kulaszewicz. Motion declared passed.
The Clerk presented the following items for Council consideration:
..Approval of the W &G Rehbein plat, Peltier View, had beeb received from
the Rice Creek Watershed Board. Mr. McLean moved to continue the public
hearing on this plat to December 10, 1979 at 8:45 P.M. Seconded by Mr.
Kulaszewicz. Motion declared passed.
..A resident had called asking the procedure for selling Christmas Trees
from his yard on Pines Street - The Clerk is to tell this resident that
he must obtain a Special Use Permit.
..Mr. Mobley's resignation as Building Inspector effective Jaunuary 1,
1980 had been received.
..Homestead Credit, Attached Machinery Aid, Mobile Home Homestead Credit
and the fourth quarter State Aid Check in the amount of $54,492.62 had
been received.
..Municipal fines for the month of October was $1232.50.
Mayor Karth presented two bids for the moving of Mr. Shcumacher. After
omparing the bids, Mr. McLean moved to accept the bid from Global Van
Lines in the amount of $1,935.29. Seconded by Mr. Kulaszewicz. Motion
declared passed.
Mr. McLeam presented the following actions from the Planning and Zoning
Board meeting held on Nomveber 21, 1979.
The Arena Acres plat had been considered. There is more information
needed. Consideration of this plat was tabled until the information
is received.
Mr. Dale Ramsden had applied for a special use permit for the parking of
commercial equipment in a residential area. The equipment consists of
1 truck, 2 rollers and a paver. There is to be a building to house this
equipment. There was discussion of requiring a rezoning of this land but
it was felt this would be handled in the updating of the Comprehensive
Land Use Plan. Planning and Zoning had recommended approval of the requet.
Mr. McLean moved to approve a special use permit for the storage of
commercial equipment in a residential area at 502 Lilac Street, special
use permit to have an issue date of:July 1, to be reviewed annually on
that date and the permit is non - transferrable. Seconded by Mr. Zelinka.
Motion dedlared passed.
Mr. and Mrs. Jerry Christianson had applied for a special use permt for
a kennel License for the breeding and raising of Collie Showdogs at 261
Elm Street. Signatures of the surrounding property owners had been ob-
tained. The adult dogs are 'de- barked'. Mr. McLean moved to approve a
special use permit to be non - transferrable - with a maximum of 8 adult
dogs - with a July 1 issuance date - to be reviewed annually on that date.
Seconded by Mr. Zelinka. Motion declared passed.
The Forest Glen Plat had not been considered.
Mr. Tim Rehbine had applied for a special use permit to use one -half of
a proposed duplex as an office and model home. He would provide off

street parking ofr some of his equipment and employees. Planning and
Zoning had recommended approval. Mr. McLean moved to approve a special use
permit for the above listed uses - to be non - transferrable - to have a
July 1 issuance date and to be reviewed annulally. Seconded by MR.
Zelinka. Motion declared passed.
The Industrial plat of Land and Oaks was considered. This is located
along County Road 14 East of 135E and a portion borders 24th Avenue.
There was discussion on the condition of 24th and the ability to handle
commercial usage. The County's recommendation for only two driveway
exits had been received - Mr. Short, the Planner, had felt this rezoning
is consistant with teh Comprehensive Land Use Plan - Mr. Gotwald was
questioned on this and he will submit his remarks in writing. Planning
and Zoning had recommended approval of this rezone. Mr. McLean moved to
set a public hearing on this plat for December 10, 1979, at 9:00 P.M.
Seconded by Mr. Kulaszewicz. Motion declared passed.
Shoreview had submitted a preliminary plat of Royal Oaks which borders
County Road J and had asked for this City's comments. Mr. McLean moved
that htis development he delayed until Anoka County and Ransey County has
made a complete study on the ability of the adjoining street to handle the
increase in traffic that would be generated by this planned development.
It was also suggested that the Metropolitan Council be involved in this
study. Seconded by Mr. Zelinka. Motion declared passed.
Mr. Schneider presented the prepared list of investments and the due date
on the CD's. There is to be some reinvesting of these monies. Mr. Schneider
and Mr. Schumacher will do this.
Mr. Kulaszewicz presented the bids for the new Police car. The low bid
was from Main Motors in Anoka in the amount of $8969.47. After some dis-
cussion, Mr. Schneider moved to approve this bid. Seconded by MR. Zelinka.
Motion declared passed.
There was no report on the Park Board.
Mr. Locher noted that Mr. Babcock had done the title search on the Bloom's
Addition. There was to be some change in the legal description. He will
check with Mr. Anderson, the County Surveyor, on this matter.
Mr. Zelinka reminded the Council that his term on the Circle Pines Utility
Commission expires at the end of this year and this Council should make
their wishes known to the Circle Piens Council as soon as possible at to
whom they would recommend to serve on that Commission.
Mr. Zelinka asked Mr. Locher if there is any way this City can assist in
collecting overdue bills or unpaid bills on the gas system in Lino Lakes.
In Circle Pines this is handled by the lein process but since Cirlce Pines
has no jurisdiction in Lino Lakes, it cannot be hadled in that manner. Mr.
Locher said he did not know, but would research and get back to Mr. Zelinka
with an answer.
Mr. Gotwald reported that he had been reviewing all projects in relation-
ship to Letters of Credit with Mr. Schumacher. Some of the Letters of
Credit should be renewed in an amount sufficient to complete the project.
Mr. Gotwald said he had contacted NSP several times on the street lights
in the Shenandoah area. He felt the construction on Birch Street and the
sewers being installed in the area had delayed the installation. He will
check again.

The contractor will start some of the garding in Lakes Add. #3 within the
next 2 to 3 weeks. He will set up a schedule as to when money will be
needed to pay the contractor in order to allow the investment of most of
the bond issue monies.
Mr. Gourley asked about LaMotte Road and the break up of that street. He
asked if there is a possibility of warranty work and Mr. Gotwald said, No,
there had not been defective construction work. This is a street that
has certain problem areas and will need routine maintenance which is the
responsibility of the City.
Mr. Schneider moved to approve requisitions #934 and #935. Seconded by
Mr. Zelinka. Motion declared passed.
Mr. Schnieder moved to approve checks #10153 through and including #10182,
with #10174 being void. Seconded by Mr. Zelinka. Motion declared passed.
Mr. Kulaszewicz moved to adjourn at 9:45 P.M. Seconded by MR. McLean.

These minutes were considered and approved at the regular Council meeting
held on December 10, 1979.

November 27, 1979
The Special Council meeting was called to order at 7:30 P.M. by Mayor
Karth. Council members present; Kulaszewicz, McLean, Schneider, Zelinka.
Newly elected Mayor Gourley and Council members Elsenpeter and Jaworski
were also present.
The meeting was turned over to Mr. Schumacher, City Administrator, who
presented a sample copy of a proposed ordinance setting forth the duties
and responsibilities of his position.
The sample ordinance was discussed by paragraph and work changes made as
was deemed necessary.
Under section 'e', Mr. Schumacher recommended the Personnel Commission
be eliminated. Mr. McLean moved that the Personnel Commission be disbanded
effective January 1, 1980. Seconded by Mr. Kulaszewicz. Motion declared
passed.
Under 'f', discussion was held on what meetings Mr. Schumacher should
attend; if he should serve as liaison; or should a member of the Commission
serve in this capacity? There was:also discussion on the Council agenda.
Mr. Schumacher presented his suggestions as to the manner in which this
will be handled. He will prepare a detailed agenda with back up material
and each Council member will receive a packet on Friday before the Council
meeting. These packets will be delivered by the Police Department. It
was generally concluded that Mr. Schumacher will attend all Council meet-
ings, Park Board and Planning and Zoning meetings and report back to the
Council on the actions of these Commissions.
