Mayor Gourley thanked Mr. Scherer for attending this meeting and assisting with the Park Board minutes. Mr. Schumacher announced a League meeting on February 20, 1980 discussing many items that are of interest to this Council. This is an all day meeting and felt this is a good meetng for Council to attend. Mr. Jaworski moved to adjourn at 9:35 P.M. Seconded by Mr. Kulaszewicz. Aye. These minutes were considered, corrected and approved at the regular scheduled meeting held on March 10, 1980. Re: Edna L. Sarner, Clerk- Treasurer RESOLUTION Permit Number MN 0044423 BE IT RESOLVED, that the City Council of the City of Lino Lakes, Minnesota, takes the position that there is no City opposition to the three (3) Year extension and reissuance of an existing NPDES Permot to continue discharge into the designated receiving waters as issued to the Minnesota Department of Corrections. However, the City wishes to also stress that the existing facility is only temporary and the Mennesota Department of Corrections should go on record as conceeding this and committing the Department for support of Minicipal Improvements and to hook up to such, as soon as feasible, to a minicipal sewage system of Lino Lakes, after same is constructed, and to pay its fair share thereof. Further that the City of Lino Lakes does request a hearing to solidify the above and to examine the present operations. Passed by the Lino Lakes City Council this 25th day of Februaru, 1980. Sarner, Clerk- Treasurer February 25, 1980 The regular meeting of the Lino Lakes City Council was called to order at 7:30 P.M. by Mayor Gourley. Council members present, Kulaszewicz, Elsenpeter, Jaworski, McLean. Anseng: None. Mr. Locher, Mr. Gotwald and Mr. Schumacher were also present. February 25, 1980 65 The minutes of February 11, were held until the March 10, 1980 meeting for consideration at that time. Mayor Gourley moved the minutes of February 11, 1980 be held until the next meeting. Seconded by Mr. Kulaszewicz. Motion declared passed. Mrs. Elsenpter moved to approve the disbursements as presented. Seconded by Mr. Jaworski. Motion declared passed. There was no comments from the audience. The Council istened to a presentation on the proposed new construction of Rite -Way Waterproffing. The proposed building plans, grade plans and outer construction plans — these plans are fairly complete to include and energy analysis. This is to be a metal building with steel frame and wood studs in the interior. There will be a more extensive discussion of this when it is presented to the Planning adn Zoning Board for approval. The back portion of this land will need to be rezoned and the company will need to apply for a special use permit for construction in this area. Mr. Locher suggested t?is be rezoned to Light Industrial. Mr. Volk presented the bids for the equipment for the new dump truck. Itasca - $12,492.00; Truck Utilities - $14,729.77; Garwood - $16,929.00; MacQueen - $21,479.00. Mr. Volk recommended that the bid from MacQueen be accepted in that this is the only bid that conformed to the specifications. After some extensive discussion, listening to presentations by two of the bidders, Mr. Jaworski moved to accept the MacQueen bid for the equipment. Seconded by Mrs. Elsenpeter. Motion carried uanaimously. IThe Public Hearing on the Peltier View Plat was called to order at 8:25 P.M. Mayor Gourley asked Mr. Schumacher to bring this plat up to date as to the actions that have been taken. Mr. Schumacher noted that the two areas of concern was run -off and on -site septic systems. He asked Mr. Gotwald to pre- sent his report on these problems. Mr. Gotwald read a letter from Mr. Jack McConoha, soils tester, who gave his findings as to the borings he had done on the land. Mr. Gowald discussed the soils types in this plat, noting that the Western part is sand - to the East is Bloomfield fine sand, and Webster fine sands. The water table is between 2 to 3 feet down to 5 to 6 feet. Mr. Gotwald determined the water table in the area would be 2 feet for the purpose of elevations and grades. He elt this is a very cautious approach, but the only safe way he could proceed. Mr. Gotwald discussed the amount of ponding required by Rice Creek Watershed Board. He said the average lot elevations is 904. Mr. Gotwald said the fill required on most of these lots is approximately 5' in order to bring these homes at least 4 feet baove the water table. This will be watched closely as the development progresses. The problem of the drainage was discussed including the xistence of drain tile and the fact that the forty acres to the South drains onto this property. Mr. Gotwald said the requirements of the Rice Creek Watershed Board demand that the drainage is such that there will be no change in the amount of water drainage. The ponding msut be so designed to handle the run -off in such a way so as to insure that the run -off will be contained within the ponding area. Mr. Gotwald felt the water table would present a larger problem than the run -off. Mr. Rehbein presented the developer's points on this plat. He was asked if 66 February 25, 1980 he was aware that some of the lots require five feet and possibly mo, or fill and Mr. Rehbein said he was agreeable. Mr. Marier presented his objections to this plat to include the problem of drainage and the matter of density. He questioned the boring tests - on the number taken the manner ie which they were numbered. He said if there was any additional water flow to his property or any effluent de- rived from this development, he will hold this Council and the developer accountable. He will also take a water flow test, analyze this water and document. He will continue to do this at various times. Mr. McLean asked if this City has made a Tresolution as to WPC -40 - The City is committed to adopting these rules and regulations when they become final. It would seem they have not become final at this point in time. The Council moved into discussion of this plat. Mr. Kulaszewicz was con- cerned with the high water table. He felt this was a problem that could cost the consumer a lot of money. After much discussion, Mrs. Elsempeter moved to approve this plat with the following stipulations: 1) only split entry or ramblers without basements be constructed, 2) pond and weir to be in place before any building permits are issued, 3) roads are to be in and 100% completed before the second phase is started, 4) minimum elevations according to Mr. Gotwald's plan to be maintained. Mr. Jaworski added the requirement 'that all perc tests be taken in the area where the drainfields are to be installed'. The motion and addition was seconded by Mr. Kulaszewica. The motion carried with Mr. Kulaszewicz voting, No. The permit application of the MMTC for renewal on their waste water treatment facility was discussed. The recommendations of the Council was that a public hearing be called for this permit. Mr. Locher prepared a Resloution (see beginning of minutes). Mr. McLean moved to adopt this Resolution. Seconded by Mr. Kulaszewicz. Motion carried unanimously. Mr. Schumacher presented the actions of the Planning and Zoning Board. The first item had been a variance request for a driveway of over 300'. This is necessary due to a lwo spot in the front of the lot. The Planning and Zoning had recommended approval of this driveway. Mr. McLean was con- cerned that this lot, since it contains five acres, could at some point in time, be split into several other lots. The City would then be faced with a short street ending in a cul -de -sac. There was some discussion on this matter. Mr. McLean moved o approve this variance with the stipulations that this driveway is not to be converted to a City street, and the owner must be responsible for the maintenance of the driveway so as to be passable for emergency vehicles at all times. Seconded by Mr. Kulaszewicz. Motion declared passed. The plat of Wollan Estates was considered. The Planning and Zoning Board had approved this plat and recommended a public hearing be set. Mr. McLean moved that a public hearing for Wollan Estates be set for March 24, 1980 at 8:45 P.M. Seconded by Mr. Jaworski. Motion declared passed. On considering the request of Mr. Robert Barett to store cars in the rear of his garage, the Council requested that Mr. Barett contact all persons within 300 feet of his property. He is to be on the March 10, 1980 agenda. North NorthEast had presented a sketch for the platting of a portion of the outlots in Lakes Add. #2 & 3. The lots facing Lantern Lane will be platted February 25, 1980 67 for single family dwellings. The Plannimg and Zoning Board did not ake any action on this proposal. The general consensus of the Council was they had no objections to this platting. IMr. Gotwald presented a request from Brown & Cris, contractor for the utility installation in the Lakes Add. area. Mr. Gotwald felt that if equipment and materials are on the site, the partial payment could be considered. At the present time only some equipment has been moved in. He would :consider what has been done and have a recommendation for the Council by the next Council meeting. Mr. Gotwald also presented a copy of a study done in conjunction to the areas to the North draining inot the St. Paul sewer system that the people of St. Paul are having to pay for the treatment. Mr. Gotwald said he had met with one of the Engineers and felt that the portion of Lino Lakes would be removed from that study. He pointed out that the portion of Lino Lakes included in the study did not flowo in the direction that would affect the volumn of water to the St. Paul area. Mr. Locher had no report. Mrs. Elsenpeter suggested, that since no person is available for membership on the Park Board, that this information be published and interested person write to the City on this matter. She moved to adver- tise in the Circulating Pines, Forest Lake Times and Mr. McLean added the White Near Press. Seconded by Mr. McLean. Motion declared( passed. Mr. McLean moved to authorize the First National Bank of St. Paul to act as Paying Agent for the 1979 Improvement Project. Seconded by Mr. Kulaszewicz. Motion declared passed. Sarner, Clerk- Treasurer March 10, 1980 The regular meeting of the Lino Lakes City Council was called to order at 7:30 P.M. on March 10, 1980 by Mayor Gourley. Members present; Elsenpeter, Jaworski, Kulaszewicz, McLean. Mr. Locher, Mr. Carley and Mr. Schumacher were also present. The minutes of February 11, 1980 and February 25, 1980 were approved as presented with the adjournment time to be added to the minutes of February 25, 1980. Mr. Kulaszewicz moved to approve the disbursements as presented. Seconded by Mrs. Elsenpeter. Motion declared passed. Under comments from the audience, Mr. Pa Berry appeared to ask advise on Ihow a parcel of land he owns cna be used. This land has no fromtage and only an easement for access. He was told he would need to obtain 150' on astreet or construct a road according to City specifications intothe property. Mr. William Bohjanen appeared with a report from the Correctional Advisory Committee that he has been serving. He asked the Council to supprot tWQ bills now before the Legislature - House File #119 and Senate File #234.
