HomeMy WebLinkAbout04/14/1980 Council Minutes74 March 24, 1980 had called about an internship for a student at that University. He presented the information to the Council for their consideration. There would be no cost to the City other than a small amount the City might want to give for expenses. This would be in the area of $200.00. Mr. McLean moved to adjourn at 9:40 P.M. Seconded by Mr. Jaworskl, Motion carried unanimosuly. These minutes were considered and approved at the regular Council meeting held April 14, 1980. x Edna L. Sarner, Clerk- Treasurer April 14, 1980 The regular meeting of the Lino Lakes City Council was called to order at 7:32 P.M., on April 14,1980, by Mayor Gourley. Council members pre - sent; Elsenpeter, Jaworski, Kulaszewicz, McLean. Absent; None. Mr. Schumacher was present, Mr. Locher was absent, due to illness. On considering the Minutes of March 24, 1980, they were declared approved as presented. The disbursements as listed were considered. Tere were several questions which were answered. Mrs. Elsenpeter moved to approve the disburse- ments. Seconded by Mr. Kulaszewicz. Motion carried unanimously. Mr. Steve Messerli, representing the Circle Pines Lions Club asked to use Sunrise Park on September 6/7, 1980 to conduct a fund raising event. This would be called Sandburr Days and would be basically the same as last year. He was aaked if the format would be the same as last year amd Mr. Messerli said there could possibly be more events - the format isn't set as yet but will be presented to the Council for their approval when it is finalized. Mr. McLean moved to approve this use subject to the Lions Club providing the necessary insurance, obtaining a beer permit and supplying the City Council with a format of the activities planned. Seconded by Mr. Jaworski. Mr. Marier asked who would be responsible for cleaning the Park after this had been completed. Mr. Messerli said the Lions Club rents a dump - ster and the Park is cleaned by that organization. Mr. McLean added that the Lions Club he held responsible for the clean up in the Park. This was seconded by Mr. Jaworski. Motion carried unanimously. Mrs. Gerald Illg appeared before the Council asking that the Ordinance governing the placement of mobile homes on private property be amended to allow them to place a mobile home on five acres of land they own along Pine Street. She cited the cost of homes at the present time and the interest rates. She felt that they own land and they own the mobile home and should be allowed to live on their own property. They have the home in Restwood Terrace at the present time. April 14, 1980 Mr. Schumacher said the Planning Commission had gone over this request and had read the Ordinance restricting the placement of mobile homes. He pointed out that a mobile home is allowed while a home is being constructed. Mr. Elsenpeter felt that the only difference between a modular and a mobile home is the wheels. She wondered if, modular are allowed, would there be a reason for not allowing bobiles. The Ordinance does not address modular homes. Mr. McLean saidthe problem with mobile homes is there cannot be an on- site inspection. This would be of concern to this Council. Mayor Gourley asked if there had been a variance application submitted to the Planning and Zoning and Mr. Schumacher saind, No, Mayor Gourley advised Mrs. Illg that would be the place to start. Mr. Scumacher felt this should be handled through a special use permit application. In this form, limitations could be set and monitored. Mrs. Illg was advised to proceed in this manner. The next item to be considered was the Special Use Permit by Mr. Henry Suchy. Mayor Gourley noted that a letter had been sent of Mr. Suchy along with a special use permit form. Mr. Suchy had returned the special use permit as an inventory of the livestock he has on his land at this point in time. This special use permit should have been for anon- conforming use. Mayor Gourley told Mr. Suchy that he should have the signatures of the person who own lands within 350' of his property. Mr. Suchy felt that his land is surrounded by lands owned by Mr. Nadeau or relatives and no one would sign this form. Mayor Gourley answered Mr. Suchy's question on the size of the land noting that, in order to be classified as a farm, it it necessary to have five acres with 300' frontage. Mr. McLean pointed out that Mr. Nadeau had used the site as the center of his farming operations. He had operated on 100+ acres at the time. Mr. Nadeau pointed out that there had been no cattle raising on his farm. Mr. McLean said that was not mentioned - Mr. Nadeau sold the house and barn with five acres of land to Mr. Suchy and Mr. Nadeau agreed. Mr. McLean pointed out the section in the Ordinance requiring any new farming operation to be issued a special use permit. He felt that this Council needs a legal opinion from Mr. Locher in order for this Council to make a decision. Mr. McLean moved this be tabled, a legal opinion from Mr. Locher, find out what the pre- existing use was and what the legal aspects of this is and make a decision. Seconded by Mr. Jaworski. Motion delcared carried with Mayor Gourley voting, No. Mr. Peter Kluegel gave a brief report on the Rules and Regulations of WPC -40. He stated there have been very few changes. The sizing of the drainfields has been changed to reflect the volumn rather than the number of bedrooms. The depth of the drainfields has been lessened. The footage above the water table has changed from a four foot requirement to a three foot requirement. In problem soils, alternate systems are to be installed. April 14, 1980 Mr. McLean asked if there was any requirements as to the monitoring of the systems and Mr. Kluegel said the pumping is monitored. Mr. McLean moved to adkpt WPC -40 by reference abolishing that portion of the State Code that had been adopted by rederence. Seconded by Mr. Kulaszewicz. Motion carried unanimously. A recess was called. The meeting was reconvened at 8:30 P.M. and the Public Hearing on the amendement to Ordinance #56 dealing with the sizes of accessory building was called to order. Mr. Schumacher presented the affadivate of publication. He pointed out the suggested changes - the first building would be limited to 750 square feet and the second building to 150 square feet. This would apply to residential areas only, single family dwellings. The other residential areas were discussed - it was felt they may possibly have to be included. Mayor Gourley questioned this in reference to multi- family - he felt there the garages tend to be long, possibly underground, buildings with 8 to 20 stalls on each side. It was felt there was a need for special language to'deal with this sutuation. Mr. Kluegel said this would not apply to agricultural builings but would apply to other uses regardless of land area. The State Buiding code allows a maximum of 1000 square feet. There was discussion of the many aspects of this proposal and some questions from the audience were answered, with the suggestion that the upper limit be cahnged from 750 square feet to 1000 square feet. The subject of the hangers in the Lino Air Park plat was discussed. It was felt this could be dealt with as a separate issue. One of the concerns was that accessory building should not be larger than the primary building. Mayor Gourley gelt that some language to this affect should be added. Mr. McLean moved this be tabled until this Ordinance is amended to in- clude the various aspects discussed this evening. The Hearing to be con- tinued until April 28, 1980 at 8:30 P.M. Seconded by Mr. Kulaszewicz. Motion declared passed. Mayor Gourley asked that anyone who has any ideas on this amendment, please submit to the offices to the attention of Mr. Schumacher. -*The next item to be considered was the discussion of applying for a LAWCON Grant. Mr. Schumacher reported that the Park Board has a working session to discuss this matter. The application would be for the use of developing the Country Lakes Park. Mr. Schumacher pointed out some of the criteria for qualifying for this type of grant. The Park Board recommended a boat landing for passive use such as canoe and sailing - a picnic area and open areas for unstructured use. Mr. Schumacher flet there would be a major cost to do the dredging needed for a beach area. It is possible to obtain a grant for 50% or perhaps 75%, but the City would have to supply the re- maining portion. Mr. Schumacher said the Council would need to make a decision on the use of the funds now in the dedicated park funds. Mr. McLean pointed out this fund has been ear marked for the building pro- posed for the City Hall Park. He wondered how many ways this money could be split. Mr. Schumacher pointed out this is a time consuming process to complete this application and he wanted the Council to be aware of what is involved. This is a preliminary application and a second one will need to be com- pleted bofore it is considered by Metro. April 14, 1980 77 There was discussion on the boat launch proposed and if the Park Board had considered the plans of Anoka County on the North end of the Lake for such Iand installation. Mr. Jaworski felt a park in that area will increase the problem of having a very narrow street and having encroachment on provate property and he also felt enforcement would be a problem Mayor Gourley moved to approve the preliminary application. Mr. McLean seconded the motion with the provision that this come before the Council before the final application to allow the residents to have a say in the matter. Motion carried with Mrs. Elsenpeter voting, No. The continuation of the Public Hearing on Wollan's Estates was called to order. Mayor Gourley asked that a representative explain this plat. Mr. Kolstad presented a new design for this plat. The lots have been re- aligned. Mr. Schumacher presented the actions on this plat to this date. The street ended in a 'T'. The proposed park land is in the Northwest corner of the plat and a 20' easement 550' long has been shown as access. Mr. McLean questioned the accessability of this park for persons wishing to drive and Mr. Kolstad said this was to be a walk -in park fand felt the Park Board had wanted this park to remain as is with very little, if any. development. III Mr. Schumacher reported that the Park Board had not been concerned with the exact location of the Parkland, just that it would be located some- where in lots 14 and 15. This park would be for both Wollan's Estates and Lino Industrial Park. There was discussion on the development of this park, the need for a road, the cost of the installation of this road, a'suggestion that this remain in the plat and the City take lands abutting the'T'. Mayor Gourley said if the City cannot have park land that is accessable, then the City would be in a better position if they took maney in liey of land. It was also suggested that the City would be satisfied with less than the 10.5 acres and take money for the Industrial Park. There were several suggested al- ternatives to the proposal presented. The lots along Old Highway #8 will remain in the Commercial zone. A re- zoning application must be submitted for the back portion of those lots. Mrs. Shilling said she would stop by the office tomorrow to fill out the necessary forms. Mr. Kulaszewicz moved to continue the hearing on Wollan's Estates to April 28, 1980 at 9:15 P.M. Seconded by Mr. McLean. Motion declared passed. Planning and Zoning Board report was considered. Mr. Schumacher presented the actions taken in reference to Lino Industrial Park explaining this will be platted in three phases. This platting is concerned with 8 lots bordering Lilac and 4th Avenue. This plat meets all the requirements of this City. A preliminary plat has been presented for the complete plat, but only this first phase is to be considered at this time. Mr. Kulaszewicz moved to set a public hearing for May 12, 1980 at 8:30 P.M. Seconded by Mr. Jaworski. Motion declared passed. 78 April 14, 1980 The application of Mr. George Meadows was continued until the April 28, 1980 meeting to allow time for the Council members to take a look at the proposed site for the long driveway. Mayor Gourley moved, Mr. Jaworski seconded. Motion declared passed. The Planning and Zoning Board had suggested that the Council take a look at the Ordinance requirements on driveways with teh suggestion, that since these requests are almost an automatic thing, this requirement should be modified. This is to be put on the April 28, 1980 agenda. The Land and Oaks Plat was considered. Mr. Schumacher presented the actions of the Planning and Zoning Board. There was discussion of the additional footage provided along Main Street for use by the County for the upgrading of Main Street and the providing a service road into these lots. Mr. Gotwald had recommended this plat be returned to Rice Creek Watershed Board for approval of the drainage plan. Mr, Tschida said this has been presented to that Board. The money in lieu of land for Park Funds on this plat computes to $3,000.00. Mr. McLean asked that Mr. Gotwald address the traffic in general and what should be provided for this plat. Mr. Jaworski moved to set a public hearing on the Land and Oaks Plat for May 12, 1980 at 9:45 P.M. Seconded by Mr. Kulaszewicz. MOtion declared passed. The Circle Pines Comprehensive Plan and been considered by the Planning and Zoning Board. Mr. Short had made several recommendations as to how this plan would affect Lino Lakes. The Planning and Zoning Board had recommended approval of this plan and recommended tat the Park Board work with the Park planning as set forth in this plan. Mayor Gourley requested that a copy of Mr. Short's review of this plan be provided for each member. This will be dealt with at the next council meeting. There was a five minutes recess. The Lino Lakes Comprehensive Land Use Plan was considered. Mr. Jaworski moved to change NO. 18 on page 46, this deals with the 15% of smaller homes - leave the sentence as is. Mr. McLean felt this dealt with allowing 10,000 square foot lots in the sewered area. Mr. McLean felt this 15% of smaller housing is an experiment and needs to be evaluated before committing to a set figure. Change the word 'shall' to 'may' on page 46 eliminate the last sentence. Mr. Jaworski want to put back in - page 44- Mr. Jaworski moved to eliminate the 15% figure for construction in the sewer - ed area he felt that the land use should be maximized - Mayor Gourley suggested the City 'may' allow a portion - -- John add 'upon the completion of the expermiental evaluation' Mr. Jaworski suggested that'the lands South oftbe Peltier View Plan be changed from Rural Residential. Mayor Gourley suggested that a statement expressing a need for sewer in the Southeast area of the City be included. Mr. McLean felt this is included in a statement that the City Anticipated the need for sewers in taht area by 1990 - this is set forth on page 14. This is included in the statement on the rural residential area. Mayor Gourley felt this area should be pointed out and a statement made to the effect that the need for sewer extensions in this area is expected by 1990. April 14, 1980 79 Mayor Gourley noted the chages, 1) change the word 'shallf to '',masse 2) change the word 'eill' to 'may'; 3) eliminate the 15% designation on the portion of allowable smaller lots; 4) change the designation of the lands located North of the Centerville line, bordered on the West by Peltier Lake Drive and on the East by 20th Avenue and on the North by 77th Street - this land to be designated as "R "; 5) insert a statement to the effect that the City anticipates the need for sewers in the Southeast portion of the City on either side of the Freeway by 1990. This does not exclude the previous statement on page 14, this is to be an additional statement. This motion was seconded by Mr. Kulaszewicz. Motion carried unanimously. The sample street lighting ordinance was to be considered, but, since either Mr. Locher or Mr. Gotwald was present, it was suggested that any action on this be delayed until the next meeting. Mr. Schumacher briefly outlined what this ordinance implies and the com- parisons as to costs. The matter of the type of insurance to be required will be delayed until Mr. Locher is here. Mr. Locerh is absent - no Attorney's Report. On considering the list of rezoning and special use permits existing, the status of these had been broken down into the ones being used and the ones that are inactive. It will be necessary to hold a public hearing to revoke these permits and lirrezonings. This hearing was set for June 9, 1980 at 8:00 P.M. Mr. McLean moved, seconded by Mr. Kulaszewicz. Motion declared passed. This hearing will need to be advertised. The consideration of amending Ord. #56 and Ord. #26 was tabled until Mayor Gourley has a chance to prepare an amendment. This deals with the keeping of animals and what constitutes a farm. The proposals for gas extensions for North Central and Circle Pines utility was considered. The one for North Central inot the School Addition was considered first. Mr. McLean moved to approve this request. Seconded by Mr. Kulaszewicz. Motion declared passed. The City's suggestion that the Circle Pines utilite be allowed to service Lots 18 through 23, and Lot 8, Rice Lake Add. #3 was considered. This has been discussed with North Central Public Service and they have agreed this is the most frasible method to service these lots. Mr. Jaworski moved to approve this suggestion. Seconded by Mr. Kulaszewicz. Motion declared passed. On considering the establishment of a lsit of consultants for dealing with special problems of the City, Mr. Schumacher felt the City should take a look at some of the specialists amd ne aware pf the servoces tjat are pffered and just how this City could benefit. Mr. McLean moved to authorize Mr. Schumahcer to pursue this matter. Seconded by Mr. Kulaszewicz. Motion litdeclared paseed. The matter of the City signs was considered. Mr. Schumacher presented some alternatives with adjusted cost figures. The genreal consensus of the Council was to go with the standard signs. on April 14, 1980 Mr. Schumacher briefly noted the suggestions submitted by the Auditor in conjunction with the 1979 audit report. There should be a roll over figure of approximately 75/100,000 dollars at the end of the year for a City of the size of Lino Lakes. Several other suggestions were 1) to set an assessment file, 2) break the utility fund out of the general fund and 4) creat an adequate interanl control progra. Mr. Schumacher asked the Council members to read the auditor's report and this will be on the next meeting's agenda. Discussion on the in -depth study on fire coverage raised many questions with no answeres. It was felt this is important due to the fact that contract costs are rising with each year, the increase'in the City's population, when will Lino Lakes be forced to start itl own department. These are decisions that are costly. This will be discussed at future meeting. Mayor Gourley read a letter of commendation for Officer Salvatore Costa from Mrs. Mary Lou Tyson, Anoka County Employee, who had spent an evening riding with Officer Costa. Mayor Gourley also read a letter from Mrs. Betty Bell, President of MFOCA, informing the Council of the Certification of Edna Sarner, Clerk- Treasurer of this City. These letters are to be put into the employees' record file. Mr. McLean moved to adjournat 12:15 A.M. Seconded by Mr. Kulaszewicz. Aye. Sarner, Clerk- Treasurer April 28,1980 Council Meeting The regular meeting of the Lino Lakes City Council was called to order at 7:32 P. M. April 28, 1980, by Mayor Gourley. Council Member present; Elsenpeter, Jaworski, Kulaszewicz, McLean. Absent; None. Mr. Locher, Mr. Meisner, and Mr. Schumacher were also present. On considering the minutes of March 17, 1980, several members did not have copies. Mr. McLean moved to table until the next agenda and copies to be sent to Council members. Seconded by Mr. Jaworski. Motion declared passed. On considering the minutes of April 14, 1980, Mayor Gourley asked that the persons who testified in conjunction with the hearing on the accessory buildings be included in the minutes, on page 5, a time should be included in the public hearing set for Land and Oaks - this is set for 9:45 p.m.; Two letters of commendations were read by Mayor Gourley just before adjournment - this to be included. Mrs. Elsenpeter asked to have her vote on the LAWCON Grant changed from 'No' to 'Yes' There was discussion on the legality of changing. It was decided that a statement of her intentions be included in these minutes, but the record of these minutes will stand. Mr. McLean moved to approve the minutes of April 14, 1980 with the corrections. Seconded by Kulasxwicz. Motion carried unanimously.
