Mr. Schumacher briefly noted the suggestions submitted by the Auditor
in conjunction with the 1979 audit report. There should be a roll over
figure of approximately 75/100,000 dollars at the end of the year for a
City of the size of Lino Lakes. Several other suggestions were 1) to
set an assessment file, 2) break the utility fund out of the general fund
and 4) creat an adequate interanl control progra. Mr. Schumacher asked
the Council members to read the auditor's report and this will be on the
next meeting's agenda.
Discussion on the in -depth study on fire coverage raised many questions with
no answeres. It was felt this is important due to the fact that contract
costs are rising with each year, the increase'in the City's population,
when will Lino Lakes be forced to start itl own department. These are
decisions that are costly. This will be discussed at future meeting.
Mayor Gourley read a letter of commendation for Officer Salvatore Costa from
Mrs. Mary Lou Tyson, Anoka County Employee, who had spent an evening
riding with Officer Costa.
Mayor Gourley also read a letter from Mrs. Betty Bell, President of MFOCA,
informing the Council of the Certification of Edna Sarner, Clerk - Treasurer
of this City.
These letters are to be put into the employees' record file.
Mr. McLean moved to adjournat 12:15 A.M. Seconded by Mr. Kulaszewicz. Aye.
Thees minutes were considered, corrected and approved at a regular Council
meeting held on April 28, 1980.

Council Meeting
The regular meeting of the Lino Lakes City Council was called to order at 7:32 P. M.
April 28, 1980, by Mayor Gourley. Council Member present; Elsenpeter, Jaworski,
Kulaszewicz, McLean. Absent; None. Mr. Locher, Mr. Meisner, and Mr. Schumacher were
also present.
On considering the minutes of March 17, 1980, several members did not have copies.
Mr. McLean moved to table until the next agenda and copies to be sent to Council
members. Seconded by Mr. Jaworski. Motion declared passed.
On considering the minutes of April 14, 1980, Mayor Gourley asked that the persons
who testified in conjunction with the hearing on the accessory buildings be included
in the minutes, on page 5, a time should be included in the public hearing set for Land
and Oaks - this is set for 9:45 p.m.; Two letters of commendations were read by Mayor
Gourley just before adjournment - this to be included.
Mrs. Elsenpeter asked to have her vote on the LAWCON Grant changed from 'No' to 'Yes'
There was discussion on the legality of changing. It was decided that a statement of
her intentions be included in these minutes, but the record of these minutes will
stand.
Mr. McLean moved to approve the minutes of April 14, 1980 with the corrections.
Seconded by Kulasxwicz. Motion carried unanimously.

Several questions on the disbursements were answered. Mayor Gourley requested
that the disbursement checks written for the Board members be presented for
approval. Mr, Jaworski questioned the'checks to 'Anoka- Rubber Scamp' this is
for printing costs. Mr. Tom Shaughnessy's check was questioned - Mr. Schumacher
said tfnfs was overlooked at -the time the checks were written. Mr. Kulaszewicz
moved to approve the disbursements as presented, withholding Mr. Shaughnessy's
check. Seconded by Mr. McLean. Motion carried unanimously.
Under the Open Mike portion of the meeting, Mr. Donald Ma,rier appeared to tell
the Council that they are not following the standard rules as set forth for the
conduction of a Council meeting. He felt the citzens of the city had elected
one individual. "There are certain rules that are put out by the League of
Municipalities which the Council has not followed, such as the Mayor opening
up a motion, which he may not.do,Secondary to that, call for a motion, didn't
get it, then called for a recess at which time, I do not know what took place
however, the motion was then presented by a Council person. When you people
ran for election, you ran to represent the Citizens of Lino Lakes and it does
not appear this is the case today with the exception of two of the older types,
I have to take Mr. McLean and Mr. Kulaszewicz out of this. You Gentlemen sit
back and relax, I want to talk to the new Council members. You have not done
your homework, you don't know what the rules are, you have an Administrator
here tonight who says a Council person can change their vote, with no Council
action on it, this week a mining permit was issued with no Council action or
P &Z action on it. I think it is time you gather yourselves together and start
thinking of this community rather than the structure you come into office on.
Some of you campaigned that you would have a balance, a balance for all, I don't
see that. I served on this Council and I was proud to serve on this Council
and I wasn't the easiest Council member in the area and I admit that. However,
I think you have an obligation and it's time you look at it. There another
situation that youfre.faced with called the Sunshine Law. I think you people
have violated that just on your recess sessions. I've cautioned you on that,
Mr. Mayor you've been cautioned by the previous Mayor on opening up motions but
you continually do that. I would think at this time that you should search
yourselves into a situation as to who you are really representing - 1) your-
selves or the community. I leave that up to you."
Mayor Gourley responded to the matter of the Mayor making and seconding motions
this is permissable undef,-the League of Minnesota Municipalities and he did not
feel that any member of this Council had violated the Sunshine Law. Mayor
Gourley felt the only time you violate the Sunshine Law is when information is
kept form the Public and he did not feel any member of this Council was guilty
of withholding information from the public.
The next item on the agenda was the consideration of Mr. Henry Suchy's special
use permit application. Mayor Gourley asked for Mr. Locher's report on this
matter.
Mr. Locher said that whatever use existed at the time of transfer moy be con-
tinued. Mr. Locher read the legal description of the parcel of land and
noted the dates of transfer. He noted that the property did not meet the re-
quired frontage for a farm classification.
Mayor Gourley presented the affadivate from Mr. P. Nadeau which states that
only dogs, cats and horses were on the property at the time of the sale.
Mr. Jaworski asked, since this matter has -been presented to previous Council,
and allowed to continue, what position does this put this Council in? Mr.

Locher said his understanding was, that Mr. Suchy was to have applied for a
special use permit but has not done so.
Mr. Suchy referred to a letter written from the City offices stating that he
was not in violation. Mayor Gourley noted that in the Ordinance, any non -
conforming use should cease within three years. Also, any new farming oper-
ations need a special use permit and a farm requires 300' frontage which this
parcel does not have (only 265').
The minutes of the previous meeting were consulted at this point, as were
the letter written to Mr. Suchy.
Mr. Jaworski moved that Mr. Suchy disposed of the pigs and be allowed to keep
the remaining animals. The motion died for lack of a second.
Mayor Gourley asked that Ordinance #26 be consulted. This allows domestic
animals to be kept on five acres of land.
Mayor Gourley felt that in 1977 when Mr. Suchy bought the property he was
governed by this Ordinance.
Mr. Nadeau pointed out 4.01, paragraph B in Ordinance #56 which says that
any new ordinance, which is more restrictive, prevails.
Mayor Gourley said the Council is aware of the fact that Mr. Nadeau feels
that Mr. Suchy does not have a farm due to the lack of the necessary frontage.
Mr. Nadeau said that Mr. Suchy had more pigs' now then he had then.
Mr. Suchy said that was not a correct statement. In fact he has less pigs now
than he did at the begining. Mr. Suchy said as long as he rented the barn to
Mr. Nadeau, rented the land, things were friendly until he told Mr. Nadeau that
he would no longer be able to rent the barn and lands.
Mr. Suchy said the reason he bought this property with the buildings was to
raise his own beef, pigs and fowl. If he had known he would be restricted as
to what he could keep on the land, he would not have purchased this property.
Mr. McLean moved to require Mr. Suchy to cease all farming operations involv-
ing the keeping of animals on his property since 265' frontage does not
qualify the property for a farm plus the affadivat from the previous owner
states that only cats, dogs and horses. A special use permit may be required
for specific uses. Seconded by Mr. Gourley.
Mrs. Elsenpeter asked if this Council is not considering Mr. Suchy's request
for a special use permit. She felt he had presented a special use permit as
he had been instructed from the offices. Mr. McLean felt this form does„not
state what he wanted. Mrs. Elsenpeter felt the intent was there. Mr. Schumacher
felt the words 'to have' should be added at the begining of his request.
Mr. Kulaszewicz asked 'when this property was sold, did either of the parties
discuss the raising of animals ?' Mr. Nadeau said he asked Mr. Suchy what he
was going to do with this land and he had said he wanted a big garden.
Mr. Suchy said he had told them he planned to raise hogs and was told he
should not raise too many, that he was too close to Centerville.
Mayor Gourley called for the vote on the motion. Motion carried unanimously.

The Special Use Permit application was for the keeping of 4 hogs, 45 hens, 50
rabbits, 150 fryers and 50 geese.
Mr. Suchy said there was cattle on this land previously and he would add a
beef to his list.,The general consensus of the Council was this could be added
to the special use permit application.
Mr. Locher pointed out that all persons within 300 feet must be notified.
Mayor Gourley asked that the Clerk mail notices to all persons within 300'
of the subject property.
Mr. Mclean moved to table the special use permit request and also allow Mr.
Suchy to amend his application to include the animals he wishes to keep on
his property. Seconded by Mr. Kulaszewicz.
Mrs. Elsenpeter suggested that Mr. Suchy work with Mr. Schumacher to insure
the language on this special use permit is specific. This point to be in-
cluded in the motion.
There was suggestion from the audience that this matter be presented to the
Planning and Zoning Board. Mrs. Elsenpeter reminded the audience that Mr:
Suchy appeared before the Council at the Council's request.
Mayor Gourley called for the vote on the motion. The motion carried un-
animously.
Mr. Nadeau asked what happens in the meantime and the general consensus of
the Council was this operation remains status quo.
Mayor Gourley called the continued hearing Ordinance Regulating order at 8:45
P m
Mr. Schumacher presented the revised suggestions of this ordinance. He had
consulted the Building Inspector and the conclusion that some type of restric-
tions on large metal buildings in a residential areas rather than the accessory
building. The idea of limiting the metal building in a residential area to 150
square feet. This will allow for storage of lawn equipment and lawn furniture
There was also the suggestion that the secondary building should not exceed the
square footage of the primary building.
Mr. McLean asked if the metal building included all pole buildings also and
Mr. Schumacher said, yes, but this ordinance would not apply to agricultural
buildings. Mr. McLean felt this ordinance should be keyed to the land classif-
ications as set forth in the Comprehensive Land Use Plan.
Mr. Schumacher felt this ordinance should deal with specific zones rather than
lot sizes. This would eliminate the necessity to deal with each request on an
inducidual basis.
Mr. McLean felt this is the way to go and asked Mr. Schumacher to put this to-
gether for presentation at a later Council meeting. This is to cover 3 points,
1) limit to 150 sq. ft in residential areas; 2) accessory building not larger
than primary buildings; and 3) not to apply to agricultural lands.
Mr. McLean moved to contimue this until the Council meeting on May 12, 1980.
• Seconded by Mr. Kulaszewicz. Hearing to be held at 8:00 p.m. Motion carried
unanimously.

The proposed Ordinance No. 73 was considered. This repeals Ordinance #26
and 26A that deals with the keeping of animals. Mayor Gourley explained the
changes inserted in this new proposed ordinance dealing with the acreage
needed and limiting the number of animals being kept.
Mr. Locher was requested to include a definition for domesticated animals in
the definitions. There was discussion on the needed rewording of a section
of this Ordinance.
Mr. McLean moved to set a public hearing for May 27, 1980 at 8:00 p.m.
Seconded by Mr. Kluaszewicz. Motion carried unanimously.
Consideration of the Circle Pines Comprehensive Land Use Plan. Mayor Gourley
asked if anyone had any problems with the text of the park portion, please be
specific.
Mr. McLean asked if this indicated that Circle Pines was looking to annex land
for park and Mayor Gourley said, he felt this was pointing out the need for
cooperation and was not anticipating annexing any lands.
Mr. McLean moved to approve the Circle Pines Comprehensive Land Use Plan.
Seconded by Mr. Kulaszewicz. Motion carried unanimously.
A five minute recess was called at this time.
The meeting was reconvened and the Public Hearing on Wollan's Estate was
called to order at 9:15 p.m.
Mr. Schumacher summarized the action that had occured at the previous Council
meeting. This layout has been redesigned to give 18fiacres to the City for
Park purposes and also providing access to this park land. This had been
the major contention at the last meeting.
Another concern was the access to Highway 8 in a second location - this had
been provided so that, if and when, the land is developed there is an addit-
ional access to the Highway to assist in the traffic flow.
It was noted this park land dedication is to include the lands being platted
as the Lino Industrial Park.
Mayor Gourley asked about the rezoning of the back portion of the lots that
face Highway #8 - he suggested this hearing be set at this meeting in order
to facilitate this hearing.
Mr. McLean moved to approve this plat, Woolan Estates, as presented and
amended, including the approval of the 18+ acres to be deeded to the City to
include the park requirements from the Lino Industrial park, require a letter
of Credit to be issued before building permits are issued, lot elevations to be
set by the City Engineer, and Rice Creek Watershed requirements be met. Seconded
by Mr. Kulaszewicz. Motion carried unanimously,.
Mr. Jaworski moved to set the Public Hearing for the rezoning of the Lots along
Highway #8 for May 27, 1980 at 8:30 p.m. Seconded by Mr. McLean. Motion
carried unanimously.
Mayor Gourley indicated to the Engineer what this Council is requiring in re-
ference to the lot elevations.

Mr. Jaworski moved to close the hearing at 9:25 p.m. Seconded by Mr. McLean
Motion carried unanimously.
The next agenda item was the Attorney's report and the first matter to be dis-
cussed was the matter of 77th street. Mr. Locher presented the deeds for the
South 282 feet - this is measured from the Section Line.
Mr. Locher pointed out that the State Law, the Cartway easement, it is the pro-
visions of this law that, if a cartway has been maintained for a period of
six years continuously or longer, then the cartway easement exists from then on
33 feet on either side of the traveled portion of the roadway. Mr. Locher noted
that the traveled portion of this roadway is basically north of the center line.
The Engineer had prepared a map showing the existing roadway. The traveled sur-
face is approximately 22 to 23 feet wide. 3 to 4 feet lies South of the section
line - 19 to 20 feet of the surface is to the North of the center line.
Mayor Gourley asked Mr. Marier to present his arguments on this matter. Mr.
Marier said when the road was upgraded in 1971, Mr. Gotwald was to have centered
the traveled surface and he pointed out that the major portion of the street
was on his property to the North. He suggested this would cause a setback pro-
blem with the development now being done on the South side of the street. Mr.
marier disputed the Certicate of Survey that was to have been done in 1966 - he
said this was not a survey, just a sketch.
He felt that Milner Carley had been paid to do a survey and had only done a
sketch.
Mr. Marier said there is no easement on the North side of the section line.
Mayor Gourley asked Mr,. Locher and Mr. Locher said he could only repeat what
the State Law says on cartways.
Mr. Marier said his main concern was the setbacks on the South side of the
street. Mayor Gourley said there is no problem with the setbacks - the
building department has already been alerted to the fact that the traveled
portions is basically North of the center. Mayor Gourley asked if there is
an agreement that the traveled road is within the right -of -way and Mr. Marier
agreed.
Mr. Marier said the South portion was paid fo'r. and Mr. Locher pointed out
that the minutes report that the Check to Mr. Theis had been returned.
Mr. McLean felt that since the road is not in very good shape, there is a
possivility this could be centered as it is upgraded. Mayor Gourley said
there is the possibility the abutting property owners would be assessed.
Mr. Marier asked if the Council knew who the Engineer was on the Peltier
View Plat and it was agreed that they had that knowledge. He asked if Mr.
Gotwald had consulted the Council on this matter before he did the plat and
Mr. McLean said, No. Mr. Marier then presented a document dealing 'with con-
flict of interest. This is from the Minnesota Architectural Board accord-
ing to Mr. Marier, these are laws.
Mr. Locher told the Council 'that Mr. Gotwald had been given permission to plat
land in this City by a previous Council.

Mayor Gourley noted, that since the road lies entirely within the right -of-
way, why is it the City's responsibilty to move it. He felt this should be
reconized by this City and if and when improvements are made, they should
be on the South side of the road.
There was discussion on the number of lots in the new plat that faces onto
77th street. It was determined there are only 9 lots facing onto this street.
It was the general opinion of the Council that the Street will need some up-
grading, the costs to be shared.
Mr. McLean suggested that Mr. Volk discuss this matter with Mr. Locher when
he plans the upgrading in order to bring this into a more proper alignment.
This will have to be put in the capital improvement program for future con-
sideration. Mr. Locher pointed out that this Council is not bound by previous
Council's actions.
Mr. McLean moved that 77th street be a priority item to be considered in the
road improvement planning and the road within the right -of -way be looked at
with the possibility of centering as previous Councils had attempted to do.
Seconded by Mr. Kulaszewicz.
Mr. Marier asked, that rather than considering this matter, he would request
that some action be taken on this matter within a specific time. Mr. McLean
told him this would be decided at budget time.
Mayor Gourley called for the vote and the motion carried unanimously.
The next item on Mr. Locher report was the matter of Mr. Jeffrey Kirschbaum.
Mr. Kirschbaum has accepted the check for $500.00 as severance pay and has
signed an agreement to tht effect.
Mr. Jaworski moved to accept the resignation of Mr. Jeffrey Kirschbaum.
Seconded by Mrs. Elsenpeter. Motion carried unanimously.
Mayor Gourley asked for authorization to sign the agreement document. Mrs.
Elsenpeter moved to authorize Mayor Gourley's signature. Seconded by Mr.
Kulaszewicz. Motion carried unanimous *.
Mayor Gourley asked fot- the Engineer's Report on the status of the Black Duck
project. Mr. Meisner reported that the project is on schedule. He also
reported that Rice Creek Watershed Board is requesting a permit for the
existing well and a permit for the culvert going under the street. Also, a
permit application for the amoung of fill that has been put into some of the
areas.
Mayor Gourley asked if the Rice Creek Watershed Board can come in and make
this sort of request after the fact and Mr. Locher said they feel they can.
Mayor Gourley said the City has entered into a contract and issued bonds for
the construction of this project- if some of the lots are not allowed fill,
is the Rice Creek Watershed Board picking up the assessments on those lots?
Mayor Gourley requested Mr. Schumacher to contact these people and open some
negoiations to solve this matter.

The matter of the petition to Anoka County to take over 24th Avenue and 81st.
Mr. Schumacher had discussed this with Mr. Gotwald and he asked the Council
for permission to proceed with this project.
Mayor Gourley suggested that Hugo be included in the matter of 24th Avenue.
Mr. McLean moved to authorize Mr. Schumacher to initate a petition to Anoka
County to take over 24th Avenue and 80th Street. Seconded by Mr. Jaworski.
Motion carried unanimoulsy.
The Planning and Zoning Board report was considered.
Mr. George Meadows' application for a long driveway was considered. Mr.
Schumacher reported that this application had been recommended for approval
by the Planning and Zoning Board. This driveway is over 1000' long and is
necessitated by a low area in the front of the lot.
Mayor Gourley questioned the absence of a Certificate of Survey - he wondered
why this had been considered without this survey. Mayor Gourley was con-
cerned over the possibility of this land being split and the City ending up
with a house with only a street easement access. Mayor Gourley asked if there
was some way the City could control this manner of splitting land.
Mr. Locher felt that this land is not buildable and, if this manner, the City
is protected somewhat. There was discussion of the filing of lands in Anoka
as long as the parcel contains 22 acres, the County does not check for
frontage footage.
Mr. Locher suggested filing Ordinance #22 with the County, this sets forth the
requirements for obtaining building permits. Mr. Locher suggested that perhaps
Anoka County should not file any land splits unless they are approved by the
local Clerk's office.
Mr. Meadows was told to get a Certificate of Survey and this matter will be
put on the agenda for May 12, 1980. Mr. McLean so moved. Seconded by Mr..
Kulaszewicz. Motion carried.
Mrs. Mary Goodale appeared before the Council with a special use permit
application for welding in a three car garage at 6864 Lakeview Avenue. This
has been in operation since t979, August; presently employes 12 persons; hours
for 7:00 a.m. to 5:00 p.m.; this shop is located in a residential area;
according to ordinances, welding is allowed in a light industrial area.
The special use permit application had been signed by all persons within 300
feet of the property.
Mr. McLean asked about delivery trucks ans was told that there are deliveries
about once every 6 months. He was told that the steel used is picked up on a
'as needed basis'; The filtering system for the spray painting was explained;
the parking spaces were discussed (there seems to be plently).
The matter of the building being adequate for this type of work was questioned.
It would seem the building inspector said this building is inadequate for this
type of work.
Mr. Kulaszewicz moved to table this request until the building is brought up
to code. Mayor Gourley did not feel the issue was the condition of the build-

ing but that the use of the building was the issue here. This is a bight
industrial use and, as such, should be rezoned. Mayor Gourley pointed out
the ordinances that this usage violates.
Mr. Kulaszewicz's motion dies for lack of a second. Mr. Jaworski moved to s.
deny the special use permit on the grounds that this does not comply to the.
Ordninace requirements for land use Seconded by Mr. McLean. Motion
carried unanimously.
Mrs. Goodale asked if this decision could be appealed. Mr. Locher checked
this .
Mr. Schumacher reported on the Rite -way request for rezoning the lands be-
yond the 300' from Ag /Res to LI. A public hearing must be set on this matter.
Mr. McLean moved to set a public hearing for Rite -Way for May 27, 1980 at
9:00 p.m. Seconded by Mr. Kulaszewicz. Motion carried unanimously.
The next item was a preliminary plat known as Schunemann's Corners. Mr.
Schumacher reported on this plat. Located near the corner of Ware Road
and 62nd. street. This plat contains 4 lots with a proposed cul -de -sac. The
Planner suggested that future street easements be included in the plat in
order to allow for an orderly splitting of these Tots when sewer becomes
available. The Planning and Zoning Board had also recommended money in leiu
of land for Park purposes. There is a nine foot strip on the South that is
being sold to the existing home.
Mr. Schumacher pointed out the recommendation of the planner for the future
streets. There was discussion on this and how it could be accomplished in
this plat. Mayor Gourley asked this be redesinged showing the future lay-
out of this plat. The matter of the power line easement was discussed -
this would affect the setbacks on those front lots. This has been taken into
consideration.
Mr. McLean moved to table this plat for redesinging. Seconded by Mr.
Kulaszewicz. Motion carried unanimously.
The next item was consideration of a side yard set back variance request by
Mr. Tim Rehbine. This is concerned with a home on Knoll Drive where the house
was constructed too close to the adjoining lot line. This is the second
request for this variance. Mr. Schumacher said the adjoining property owner
is willing to sell the needed property. Mr. McLean moved to deny the variance
and instruct Mr.-Rehbine to contact the adjoining property owner for the pur-
chase of the necessary footage to meet the City codes. Seconded by Mrs.
Elsenpeter. Motion carried unanimously.
Mr. Locher reported that a repeal for a special use permit may not be re
submitted for one year.
Mr. Michael Kenny's request for a special use permit for the operation of-
a shop for floral arrangements. The buiIdiing is located on Hodgeson Road
within the commercial zone. Mr. Jaworski moved to approve this request.
Seconded by Mr. Kulaszewicz. Mr. Schumacher reported that the Planning and
zoning Board has recommended approval of this with the request that a dust
free driveway be installed. Motion carried unanimously.

A special use permit request for Gehrman Storage Building. No one present
to represent this firm. Mr. Jaworski said he had looked at this property
and it is on the North side of the bus barns. It was felt this should be
rezoned for Tight industrial - useage. Mr. McLean moved to table this matter
for more information. Seconded by Mrs. Elsenpeter. Motion carried unanimously.
The special use permit for a repair shop on 62nd Street. Mr. Emly was not
present. After some discussion on this matter, Mr. McLean moved to table
for more information. Seconded by Mr Jaworski. Motion carried unanimously.
The next item was a special use permit for the expansion of Skyline Autobody.
Mr. St .humaChar presented the proposed improvements as proposed. This to in-
clude screening fencing for the rear of the property. Parking will be in the
front of the buildings. They also plan to remodel the front of the buildings
to face them in brick. Mr. Kulaszewicz moved to approve this request.
This operation is to make one car out of two or three and they would like
permission to sell the, left over parts. Mr. McLean suggested this work be
done within the next three years. Mayor Gourley suggested two years and if
it is not finished within that period, come for an extension. The owners
agreed. Mr. McLean also asked that this not include an outside sale lot.
Mayor Gourley was concerned that the junk cars would come in and never leave.
Mr. Locher cautioned the owners about the filling of the lands in the rear
of the lots, they have already consulted the Corps of Engineers on this
matter and are aware of the. problems. They were questioned on the disposal
of the waste oils and such and the Council was told this material is mostly
burned.
The amendments were accepted and seconded. Motion carried unanmously. Mayor
Gourley reminded Mr. Olson there will be a review. on this permit one year.

The next item on the agenda was the application of MarDon Homes for rezoning.
There was no one present to represent the company. Mrs. Elsenpeter moved to
table until a representative was present. Mayor Gourley asked to amend to
table this, until a letter of Credit was received. Seconded by Mr. McLean.
Motion carried unanimously.
A special use permit for the placing of a mobile home on private property had
been submitted by Mrs. IIIg. Mr. Schumacher reported this special; use permit
had been requested by the Council to be processed through the normal channels.
The Ordinance governing the placement of mobile homes within this City was
reviewed.
This proposal was to place, this mobile home on five acres abutting Pine
street, for a period of five years. The Planning and Zoning Board had re-
commended this request be denied.
Mr. McLean moved to deny this request. Seconded by Mr. Jaworski. Motion
carried unanimously.
Anoka County Historical Society had requested funds. Mr. McLean moved to
table this until budget hearings. Seconded by Mr. Kulaszewicz. Motion
carried with Mayor Gourley voting, No.

Consideration of the Hand Bill Ordinance as presented by Mrs. Elsenpeter.
Mrs. Elsenpeter moved to table. Seconded by Mr. Jaworski. Motion carried
unanimously.
Consideration of Susan Sears to the vacancy on the Park Board. Mrs.
Elsenpeter moved to approve this appointment. Seconded by Mr. Kulaszewicz.

Consideration of the March financial report. Mr. Schumacher explained briefly.
Mayor Gourley said he had gone through this report and found no problems.
Mr. Schumacher pointed out that over $40,000.00 in interest has been earned
the, first quarter of this year. There was discussion on the different aspects
of this report,. with Mr. Schumacher explaining the discrepancies.
Under new business, the subject of a mining permit fee was discussed. There
had been a mining permit fee schedule set up by Resolution - $100.00 plus 150
per yard; (5/29/73 - 8/28/72.)
The next request was from the Fire Chief in Lexington who had suggested an
open house to view the fire fighting equipment. The request is for this
Council to select a date for this function. This was set for May 18, 1980
from 1:00 p.m. Mr. Schumacher will set this up.
The Boy�Scouts, Girl Scouts and Cub Scouts spent the week end cleaning up
the road sides. Mayor Gourley will find who the letter should be addressed
and inform the Clerk. A letter of thanks to be sent.
Mayor Gourley reported on a meeting with County officials to discuss their
plans for the new jail - to be completed in approximately 18 months - faced
with the overcrowed conditions in the present building - the plan presented
was to take over the three cottages at the Prison facilities. They proposed
to takeover the cottages used by the girls and then use that facility for
persons on the Huber program.
The County has negotiated an extension of the lease with the State until
July 1891. The County indicated they would cooperate with the City on
additional risks or liabilities. Mr. Schumacher was asked to pull together
some figures that represent costs in relationship to police calls and present
this to the County. This to include past costs.
Mr. Jaworski moved to approve this action. Seconded by Mr. Kulaszewicz.
Motion carried unanimously.
The matter of. the LAWCON Grant application was discussed. Mr. Schumacher
discussed has position on this matter. He felt that Mrs. Elsenpeter could
bring up additional information and change her vote on that matter at this
time.
Discussion of the access to this lake and how this could be controlled. The
general idea was that after a certain number of boats are throught the ramp,
then the ramp is closed.

Mr. Schumacher said if there are objections to the use of the lake,
it should be brought out at this time. Mrs. Elsenpeter moved to au-
thorize Mr. Schumacher to apply for a LAWCON Grant, this is on the
basis of new information presented at this meeting. Mr. Mayor Gourley
restated the motion in the April 14, 1980 minutes. Seconded by Mr.
McLean. Motion carried unanimously.
Mayor Gourley read a letter cancelling the open house at the Anoka
County Airport and informing this Council that all further consider-
ation for the expansion of the airport has been cancelled.

Mayor Gourley read a letter of compliments to the Police Department. The
Mayor requested this be directed to the proper department.
The Action Alert from the League of Minnesota Cities was discussed. This
is concerned with the interest rates on bonds sold by the City and this
will affect the bonds the City will need to sell in 1982.

Board of Review
The annual Board of Review meeting was called to order at 7:05 P.M. All
Councilmembers were present with the exception of Mr. Jaworski. Mayor
Gourley stated this meeting is for the purpose of reviewing the 1980
real estate assessed valuations.

Mr. Marlin Hansen had some questions on the plat of Otter Lake Estates. There
was a question on the three ye ,:r limitation for the values on newly platted
property. Mr. Hansen said he ad called and had been told the property
would remain frozen until the 1981 assessment year, Mrs. Roisum said the
plat was filed in 1977, thus 1'80 is the first year for the valuation to be
raised. He cited several lots that he felt the value should not have been
raised. Mr. Starkey was not c-rtain of this and felt this should be
checked. He will check the law on this matter and get back to Mrs. Roisum
on this matter.
There was some discussion on several of the parcels of land in this plat.
Mrs Roisum asked Mr. Hansen if she could make an appointment and look at
this land and Mr. Hansen agree .
