17 1. Firehouse No. 2, Preliminary Site and Building Plans- Mayor Reinert
18 explained that this item would be postponed. There are options to be discussed and more
19 time is needed for complete information. The matter will be discussed at a council work
20 session on October 13, before the regular council meeting.

22 2. EDAC Economic Development Plan- Community Development Grochala
23 explained that the City's Economic Development Advisory Committee (EDAC) has sent
24 forward a proposed economic development plan for the council's review. He reviewed
25 the goals and objectives included in the plan. He noted, looking ahead, the group will
26 also be doing an inventory of what's out there to help meet the goals. Mayor Reinert
27 said he'd like to add the word "promote" to the "retain and expand" goal. Council
28 Member Stoesz wondered if the city could provide deferred utility payments as an
29 incentive to businesses. Mr. Grochala remarked that water use isn't a big item for most
30 of the businesses they are looking at; he added that SAC and WAC charges can be a big
31 ticket item. Council Member Roeser suggested that the Blue Heron Days venue be used
32 to promote local businesses and also that staff look for grant money or funding such as
33 through the local tourism group to assist with economic development activities.

35 The council discussed the value of the local chamber of commerce. Mr. Grochala added
36 that the EDAC group is considering producing an annual local business newsletter.

38 The Mayor asked about the Legacy at Woods Edge area and Mr. Grochala provided an
39 update, including on utility work and the release of a request for interest to developers.

41 The council discussed the business area at County Road 49 and J. There is a large broker
42 firm working on the area; utility service remains a problem so staff is working with the
43 city's engineering company on ways to address the problem.

45 The council also asked about the area of I35E and Mr. Grochala provided an update,
46 noting that storm water is the biggest problem there.

51 Mayor Reinert asked that staff continue to bring information to the council as EDAC
52 moves forward with plans.

54 3. 2015 Budget — Fund Reserves- Administrator Karlson remarked that staff is
55 following up on the council request for more information on the history of the city's cash
56 reserves. Finance Director Rolek was not present for the meeting but had prepared a
57 listing and status of the reserve funds. Mr. Karlson pointed out that the Closed Bond
58 Fund is the only fund noted that isn't dedicated and/or closed.

60 Mayor Reinert noted that there will be capital costs related to the start-up of the city fire
61 department; those costs will be one-time, one-year costs. He wonders about the use of
62 bond funds to cover those expenses. Mr. Karlson explained that the funds in question are
63 normally used to front-end capital projects, not to bring down the tax levy. Council
64 Member Roeser added that he supports the concept of paying for capital items over time
65 because otherwise the city taxpayer at the front end pays the full cost even though they
66 may not benefit further down in the life of the asset.

68 Mayor Reinert suggested that the report brings forward much information to absorb. He
69 recommends that the council continue studying the information and have more discussion
70 at a future meeting. He added that the Water and Sewer Enterprise fund has gone up $4
71 million in the last four years. Mr. Grochala explained that those are user fees in the fund
72 and they are kept in reserve to support the city's system — a system that is valued at many
73 millions of dollars. Generally the money is there for future replacement needs.

75 4. Monthly Progress Report- Administrator Karlson reviewed his written report.
76 He noted, regarding the city's digital scanning project, that staff will be bringing forward
77 a request for extension of the part-time temporary scanner positions.

86 4A) Public Safety Department Update — Chief Swenson provided an update on the following:

88 - The Deputy Director of Public Safety — Fire has been hired and although he has not officially
89 begun his employment, he has been engaged in the interview process for new firefighters;

90 - Given the current numbers including staff, there will be 35 people completing training in July
91 and ready for firefighter service; recruitment efforts are continuing;
92 - Finalizing asset distribution through the Centennial Fire District; there is an opportunity to

94 Discussion of design of the new fire station is underway; a design decision is anticipated in
95 November for bids in January of 2015.

97 Council Member Kusterman discussed the recruitment area for the new station; Chief Swenson is
98 currently recruiting following standards.

100 Mayor Reinert noted that the fire service model that the city is moving to is becoming more and more
101 popular; it is proving to be very efficient. He remarked that the city is ahead of schedule in moving to
102 the new model and assumptions have been proven all along the way. He noted that Chief Swenson
103 has been ultra -professional in bringing the effort to this point and soon he will have the assistance of
104 the new Deputy Director of Fire Services. He applauded the work of Chief Swenson.

TOPIC: Consideration of Resolution No. 14-123 Approving 2015 Twin
City Gateway (T C G) Budget

INTRODUCTION
The Twin Cities Gateway (TCG) Convention and Tourism Bureau serving the northeast metro
area, has established its 2015 budget. According to its by-laws, the annual budget shall be
reviewed by each member city. Attached is the proposed FY15 Budget. The budget was
approved by the TCG Board of Directors on September 1 6'h and will be effective from
January 1, 2015 - December 31, 2015.
BACKGROUND
The TCG Board continues to budget somewhat conservatively and maintains a healthy fund
reserve for a strong fiscal policy. 2014 has been an exceptional year for the entire metro area
tourism industry, including Twin Cities Gateway. TCG's hotel occupancy /RevPar — revenue per
available room - and ADR — average daily rate — have exceeded 2013 levels for each month this
year through August 2014. Because the Board is uncertain whether or not similar levels can be
achieved in these areas in 2015, the budgeted amount for 2015 lodging tax receipts is slightly less
than the projection for calendar year 2015.

APPROVING 2015 TWIN CITIES GATEWAY BUDGET
WHEREAS, the City of Lino Lakes approved the creation of Chapter 607 of the City Code
Relating to a Tax Imposed upon Lodging on October 12, 2009; and
WHEREAS, the lodging tax is to be used to support Twin Cities Gateway for the purpose of
promoting and marketing the participating Member Cities; and
WHEREAS, Article XV, Section 6 of the MN Metro North Tourism By-laws state
that the annual budget of estimated income, income expense and capital expense shall be
approved by the Board of Directors and submitted to each Member City's city council.
NOW, THEREFORE, BE IT RESOLVED by The City Council of The City of Lino
Lakes, Minnesota: The Lino Lakes City Council adopts this resolution supporting the Twin
Cities Gateway budget for 2015.
Adopted by the City Council of the City of Lino Lakes this 27th day of October, 2014.

TOPIC Consider Resolution No. 14-125 Authorizing the Certification of
Delinquent Water and Sewer Utility Charges for collection with

BACKGROUND
Staff annually brings before the City Council delinquent water and sewer utility charges for
certification to the County Auditor for collection with the following year property taxes. Affected
property owners received mailed notice of this proceeding and have been allowed ample time to
pay the delinquent charges.
RECOMMENDATION
Staff recommends that the City Council adopt Resolution No. 14-125 authorizing the certification
of delinquent water and sewer utility charges to be collected with 2014 property taxes payable in
2015 at an interest rate of 8% per annum.

RESOLUTION AUTHORIZING THE CERTIFICATION OF DELINQUENT WATER
AND SEWER UTILITY CHARGES FOR COLLECTION WITH THE 2014 PROPERTY
TAXES PAYABLE IN 2015
WHEREAS, pursuant to City Code Section 401.29 and Section 402.14, Subd. 5, the Clerk has
prepared a list of properties having delinquent water and sewer charges to be certified
to the Anoka County Auditor for collection with the 2014 property taxes, payable in
2015, and
WHEREAS, notice of such certification was mailed to affected property owners, and
WHEREAS, the City Council has met to consider the certification of such delinquent water and
sewer charges.
NOW, THEREFORE, BE IT RESOLVED by the City Council of Lino Lakes, Minnesota that
the Clerk is hereby authorized to certify the delinquent water and sewer charges as indicated on the
attached listing to the Anoka County Auditor to be collected with the 2014 property taxes, payable
in 2015 at an interest rate of 8.00% per annum.

19 1. Fire House No. 2, Preliminary Site and Building Plans — Public Safety Director
20 John Swenson introduced Quinn Hutson of CNH Architects and firm representative
21 Brooke Jacobson. Mr. Hutson reviewed the preliminary site and building plans for the
22 fire station, including space needs, an update on site development (including soil
23 conditions, wetlands and engineering), an overall site plan (including future uses of the
24 facility and the surrounding property), and the preliminary site plan of the station property
25 itself. He noted the possibility of including training features in the development and the
26 benefits of doing so. He reviewed three building design options. Option A is the most
27 basic option but it would meet national standards for fire facilities. This option would be
28 smaller in square footage than the city's current Fire Station No. 1. Option B would be
29 larger and include items for additional functions such as training, offices, and a day room.
30 Option C, the largest facility, includes the most facilities including a public area
31 (community room) and dorms and an added training function with a tower and a second
32 level. The council then reviewed the cost estimates for the three options. Mr. Hutson
33 explained that the cost estimates include site work, soil work, building, design
34 contingency and inflation consideration. When Mayor Reinert asked why the cost per
35 square foot rises with a smaller building, Mr. Hutson explained that is due to loss of
36 economy of scale and inclusion of more first time elements.

38 Mayor Reinert remarked that the council must look at what the city needs. He sees that
39 Option C has everything that's attractive but at a huge cost — it's too high for his support.
40 Public Safety Director Swenson indicated that he wanted to get the information on station

45 The council discussed the options. The mayor noted that the city currently has one station
46 and it does have office space and is located close to city hall, a benefit for the police
47 element. He likes the concept of having training facilities with the new station but
48 realizes it comes with a cost. Chief Swenson remarked on the importance of having
49 office facilities at each station to handle employment and administration for that station;
50 he encourages the council to think about future call volumes on the south side. Mayor
51 Reinert indicated that he likes Option B but perhaps with more training and less
52 administrative space. Council Member Kusterman asked if the city saves money by
53 having its own training and Chief Swenson explained that it becomes a minimum of
54 training if it's outsourced, but it can be frequent if you're doing it on site. Council
55 Member Rafferty said he's interested in more information that breaks down the cost
56 estimates.

66 The council continued discussion of the fire station preliminary design options. Council
67 Member Rafferty said he likes some of what he is seeing but is concerned about the cost.
68 Architect Quinn Hutson recalled that there have been meetings and discussions about
69 preliminary design options. Some of the design options are based on what is being seen
70 in other new fire facilities; things that could have value for this city. When asked about
71 the value of dorm rooms, Chief Swenson explained that they open up the recruiting pool
72 beyond borders. On the training elements, Chief Swenson said there is definitely bang for
73 the buck — it is good for the organization and would provide for having a well-trained
74 force. The mayor said he is leaning toward including some training facilities at the right
75 cost. Council Member Roeser noted that he doesn't see the need for dorms or a
76 community room; a training tower is a good idea.

78 The council discussed parking needs and also the possible future conversion of space for
79 dorms. There was also discussion about reaching out for input from the current
80 firefighters and Chief Swenson said he would talk to Pat Devaney.

82 The mayor suggested that the council was gravitating toward Option B but with changes.
83 Administrator Karlson suggested that the footprint could remain but elements within the
84 preliminary design could be changed. Chief Swenson noted that he supports including
85 training elements over dorms. Council Member Rafferty recommended that the architect
86 be directed to work on the aesthetics of the building also because he feels improvement is
87 needed in that area. The council discussed the use and value of including a day room; it's
88 an absolute need if an ambulance service was to ever be included at the facility. The
89 council would like additional information on the value of having in-house training.

96 2. 2015 Budget - Administrator Karlson recalled that the council received an update
97 on the city's cash reserves at the last work session. Staff is responding to questions that

101 sewer and water system. The value of the system is approximately $26,000,000
102 depreciated; the sewer and water reserve funds exist to support that infrastructure.

104 Mr. Rolek distributed a new gap analysis sheet. The mayor noted that the city will be
105 receiving funding from the Centennial Fire District in 2015 as part of the split; he's
106 interested in the possibility of using those funds for some of the start-up costs for the new
107 department. Chief Swenson explained that those funds would be well used also for
108 future expenses for aging fire equipment.

110 Mr. Rolek noted that the source of funding the city has been using to fund debt service for
111 the Legacy improvements will soon not be available and he suggested that the Closed
112 Bond Fund would be a possible and sensible resource for that need.

118 2016. The bond debt service has been estimated at $70,500 per million. He noted the

1. Review of Fund Reserves — Terri Heaton, Springsted, Inc., the City's financial
advisor was present.
Mayor Reinert noted that the staff report on this matter was submitted to council
members very late so discussion at this point will be limited to allow future discussion
after more time for review of the information.
Finance Director Rolek explained that the staff report includes information on all city
funds including their purpose and reserve balance. He has also provided information on
interest income by fund since 2008. He reviewed the different types of overall funds —
general, special revenue, debt service, enterprise and agency and fudiciary funds. It was
noted that state law does include some restrictions on the investment of city reserve
funds.
Mayor Reinert noted an overall increase of $3 million in last three years and Mr. Rolek
responded that the city has received an advance of Municipal State Aid (MSA) funds
from the State in the amount of $3.5 million. Mayor Reinert said he is interested in
having a better understanding of the increase in reserve funds over the past few years,
including the interest that is yielded from the funds. He understands that the state limits
the type of investments for the city but he is also concerned about the possibility of losing
money by simply holding it in account. He feels it is an important discussion for the
council.
Council Member Roeser noted the road fund reserves and asked why the city isn't
spending that money down when road projects are needed. Community Development
Director Grochala responded that staff is always working on planning for future road
improvements that will utilize those funds.

44 Mayor Reinert asked that the council review the statutory language for a better
45 understanding of the restrictions on city use of reserve funds. Finance Director Rolek
46 concurred that it is very important to understand those restrictions.

49 dedicated funds and the council discussed funds that are discretionary for borrowing.
50 Staff discussed with the council the possible ramifications of borrowing.

52 Ms. Heaton added that one of the biggest considerations for the city's bond rating is cash
53 on hand. She recommends that the council decide what the "savings account" will be and
54 move from there. She also recommends that the council look ahead at a period such as
55 five years to determine what funds will actually still be in reserve. A lack of cash on
56 hand can lead to the need to borrow and that is not recommended.

58 The mayor noted that there should be more analytical ability with the new financial
59 system coming on line.

BACKGROUND
Hammerheart Brewery located at 7785 Lake Drive has requested Sunday liquor sales.
Hammerheart is a current On -Sale Brewer Taproom liquor license holder.
Ordinance 08-14 Amending Title 700, Chapter 701 of the Lino Lake Code of Ordinances
Relating to Liquor Licensing has been updated to authorize sales on Sunday for a license holder
of an On -Sale Brewer Taproom license.
Ordinance 08-14 takes effect October 30, 2014.
Hammerheart is in compliance with their current liquor license requirements.
The city code requires that when the city council considers the issuance of a liquor license,
opportunity shall be given to any person to be heard for or against the granting of the license.
RECOMMENDATION
Adopt Resolution 14-127 approving Sunday liquor sales for Hammerheart Brewery to run in
conjunction with their current liquor license November 1, 2014 through June 30, 2015.

WHEREAS, the licensing period for liquor, wine, beer and dance licenses in the City of
Lino Lakes is one year, commencing on July 1 and ending on June 30 the following year. The
licensing period for Sunday sales for Hammerheart will begin November 1, 2014 and following
with the normal licensing schedule;
WHEREAS, the City Council is required to approve liquor sales;
WHEREAS, City staff has reviewed the Sunday liquor application that has been
submitted and verified that local licensing regulations are met;
WHERAS, the Lino Lakes Police Department has conducted the required background
investigations for the license;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
LINO LAKES, MINNESOTA:
The City of Lino Lakes hereby approves the Sunday liquor sales, with said approval contingent
upon applicants meeting all city and state requirements for said licenses.

INTRODUCTION
Earlier this year the City Council awarded a bid to construct the 21' Avenue Extension project. In addition,
the City has been petitioned by the developer to construct street and utility improvements in the Northpointe
development. The City will also be constructing Well #6 and well house improvements. These projects will
all be undertaken in the Summer/Fall, 2014 and Spring 2015 and require debt financing.
BACKGROUND
On September 22 the City Council approved Resolution 14-107 providing for the issuance of approximately
$2,645,000 G.O. Improvement Bonds, Series 2014A. The purpose of the bonds is to finance the
improvements noted above. The bond issue would have a 10 -year term and will be repaid through special
assessments levied against benefitted parcels and through proceeds from the Area and Unit Trunk Fund.
The City has since issued its Official Statement and advertised for bids for this issue. Bids were received
earlier today by the City's financial advisors, Springsted, Inc. Terri Heaton of Springsted, Inc. is here
tonight to present the results of the bidding process. The exact amount of the bonds to be sold will be
determined pending the outcome of the bids.
RECOMMENDATION
Following Ms Heaton's presentation, staff recommends that the City Council adopt Resolution No. 14-124
Awarding the Sale of General Obligation Improvement Bonds, Series 2014A.

BE IT RESOLVED By the City Council of the City of Lino Lakes, Anoka County, Minnesota
(the "City"), as follows:
Section 1. Sale of Bonds.
1.01. Authorization for Sale of Bonds. Pursuant to a resolution adopted by the City Council of
the City on September 22, 2014, the City authorized the sale of its General Obligation Bonds,
Series 2014A (the "Bonds"), for the following purposes:
(a) to finance the construction of certain assessable public improvements, including
the extension of sanitary sewer, water, storm sewer facilities and ponds, street, trail and signal
improvements known as the 21' Avenue Improvements and the bituminous paving, sanitary
sewer, water main, street, storm sewer, and sidewalk improvements known as the North Pointe
Improvements (collectively, the "Assessable Improvements"), pursuant to Section 8.07 of the
charter of the City (the "City Charter") and Minnesota Statutes, Chapters 429 and 475, as
amended (collectively, the "Improvement Act"); and
(b) to finance the construction of various improvements to the City's water system,
including the construction of a new well and well house (the "Utility Improvements"), pursuant to
Section 8.07 of the City Charter and Minnesota Statutes, Chapters 444 and 475, as amended
(collectively, the "Utility Revenue Act").
1.02. Award to the Purchaser and Interest Rates. The proposal of United Bankers' Bank,
Bloomington, Minnesota (the "Purchaser"), to purchase the Bonds of the City is hereby found and
determined to be a reasonable offer and is hereby accepted, the proposal being to purchase the Bonds at a
price of $2,632,436.25 (par amount of $2,645,000.00, less underwriter's discount of $12,563.75), plus
accrued interest to date of delivery, if any, for Bonds bearing interest as follows:

1.03. Purchase Contract. The sum of $13,886.25, being the amount proposed by the Purchaser
in excess of $2,618,550.00, shall be credited to the accounts of the Debt Service Fund hereinafter created
or deposited in the accounts of the Construction Fund hereinafter created, as determined by the Finance
Director of the City in consultation with the City's financial advisor. The Finance Director is directed to
deposit the good faith check or deposit of the Purchaser, pending completion of the sale of the Bonds, and
to return the good faith deposits of the unsuccessful proposers. The Mayor and City Administrator are
directed to execute a contract with the Purchaser on behalf of the City.
1.04. Terms and Principal Amounts of the Bonds. The City will forthwith issue and sell the
Bonds pursuant to the City Charter, the Improvement Act, and the Utility Revenue Act (collectively, the
"Act") in the total principal amount of $2,645,000, originally dated November 20, 2014, in the
denomination of $5,000 each or any integral multiple thereof, numbered No. R-1, upward, bearing
interest as above set forth, and maturing serially on February 1 in the years and amounts as follows:

1.05. Optional Redemption. The City may elect on February 1, 2023, and on any day thereafter to
prepay Bonds due on or after February 1, 2024. Redemption may be in whole or in part and if in part, at the

option of the City and in such manner as the City will determine. If less than all Bonds of a maturity are
called for redemption, the City will notify DTC (as defined in Section 7 hereof) of the particular amount of
such maturity to be prepaid. DTC will determine by lot the amount of each participant's interest in such
maturity to be redeemed and each participant will then select by lot the beneficial ownership interests in such
maturity to be redeemed. Prepayments will be at a price of par plus accrued interest.
1.06. Mandatory Redemption; Term Bond. The Bonds maturing on February 1, 2026 shall
hereinafter be referred to collectively as the "Term Bond." The principal amounts of the Term Bond subject
to mandatory sinking fund redemption on any date may be reduced through earlier optional redemptions, with
any partial redemptions of the Term Bond credited against future mandatory sinking fund redemptions of
such Term Bond in such order as the City shall determine. The Term Bond is subject to mandatory sinking
fund redemption and shall be redeemed in part at par plus accrued interest on February 1 of the following
years and in the principal amounts as follows:

Section 2. Registration and Payment.
2.01. Registered Form. The Bonds will be issued only in fully registered form. The interest
thereon and, upon surrender of each Bond, the principal amount thereof, is payable by check or draft
issued by the Registrar described herein.
2.02. Dates; Interest Payment Dates. Each Bond will be dated as of the last interest payment
date preceding the date of authentication to which interest on the Bond has been paid or made available
for payment, unless (i) the date of authentication is an interest payment date to which interest has been
paid or made available for payment, in which case the Bond will be dated as of the date of
authentication, or (ii) the date of authentication is prior to the first interest payment date, in which case
the Bond will be dated as of the date of original issue. The interest on the Bonds is payable on
February 1 and August 1 of each year, commencing August 1, 2015, to the registered owners of record
thereof as of the close of business on the fifteenth day of the immediately preceding month, whether or
not that day is a business day.
2.03. Registration. The City will appoint a bond registrar, transfer agent, authenticating agent
and paying agent (the "Registrar"). The effect of registration and the rights and duties of the City and the
Registrar with respect thereto are as follows:
(a) Register. The Registrar must keep at its principal corporate trust office a bond
register in which the Registrar provides for the registration of ownership of Bonds and the
registration of transfers and exchanges of Bonds entitled to be registered, transferred or
exchanged.
(b) Transfer of Bonds. Upon surrender for transfer of a Bond duly endorsed by the
registered owner thereof or accompanied by a written instrument of transfer, in form satisfactory
to the Registrar, duly executed by the registered owner thereof or by an attorney duly authorized
by the registered owner in writing, the Registrar will authenticate and deliver, in the name of the

designated transferee or transferees, one or more new Bonds of a like aggregate principal amount
and maturity, as requested by the transferor. The Registrar may, however, close the books for
registration of any transfer after the fifteenth day of the month preceding each interest payment
date and until that interest payment date.
(c) Exchange of Bonds. When Bonds are surrendered by the registered owner for
exchange the Registrar will authenticate and deliver one or more new Bonds of a like aggregate
principal amount and maturity as requested by the registered owner or the owner's attorney in
writing.
(d) Cancellation. Bonds surrendered upon transfer or exchange will be promptly
cancelled by the Registrar and thereafter disposed of as directed by the City.
(e) Improper or Unauthorized Transfer. When a Bond is presented to the Registrar
for transfer, the Registrar may refuse to transfer the Bond until the Registrar is satisfied that the
endorsement on the Bond or separate instrument of transfer is valid and genuine and that the
requested transfer is legally authorized. The Registrar will incur no liability for the refusal, in
good faith, to make transfers which it, in its judgment, deems improper or unauthorized.
(f) Persons Deemed Owners. The City and the Registrar may treat the person in
whose name a Bond is registered in the bond register as the absolute owner of the Bond, whether
the Bond is overdue or not, for the purpose of receiving payment of, or on account of, the
principal of and interest on the Bond and for all other purposes and payments so made to
registered owner or upon the owner's order will be valid and effectual to satisfy and discharge the
liability upon the Bond to the extent of the sum or sums so paid.
(g) Taxes, Fees and Charges. The Registrar may impose a charge upon the owner
thereof for a transfer or exchange of Bonds, sufficient to reimburse the Registrar for any tax, fee
or other governmental charge required to be paid with respect to the transfer or exchange.
(h) Mutilated, Lost, Stolen or Destroyed Bonds. If a Bond becomes mutilated or is
destroyed, stolen or lost, the Registrar will deliver any new Bond of like amount, number,
maturity date and tenor in exchange and substitution for and upon cancellation of the mutilated
Bond or in lieu of and in substitution for a Bond destroyed, stolen or lost, upon the payment of
the reasonable expenses and charges of the Registrar in connection therewith; and, in the case of a
Bond destroyed, stolen or lost, upon filing with the Registrar of evidence satisfactory to it that the
Bond was destroyed, stolen or lost, and of the ownership thereof, and upon furnishing to the
Registrar of an appropriate bond or indemnity in form, substance and amount satisfactory to it
and as provided by law, in which both the City and the Registrar must be named as obligees.
Bonds so surrendered to the Registrar will be cancelled by the Registrar and evidence of such
cancellation must be given to the City. If the mutilated, destroyed, stolen or lost Bond has
already matured or been called for redemption in accordance with its terms it is not necessary to
issue a new Bond prior to payment.
(i) Redemption. In the event any of the Bonds are called for redemption, notice thereof
identifying the Bonds to be redeemed will be given by the Registrar by mailing a copy of the
redemption notice by first class mail (postage prepaid) to the registered owner of each Bond to be
redeemed at the address shown on the registration books kept by the Registrar and by publishing the
notice if required by law. Failure to give notice by publication or by mail to any registered owner, or
any defect therein, will not affect the validity of the proceedings for the redemption of Bonds. Bonds

so called for redemption will cease to bear interest after the specified redemption date, provided that
the funds for the redemption are on deposit with the place of payment at that time.
2.04. Appointment of Initial Registrar. The City appoints U.S. Bank National Association,
Saint Paul, Minnesota, as the initial Registrar. The Mayor and the City Administrator are authorized to
execute and deliver, on behalf of the City, a contract with the Registrar. Upon merger or consolidation of
the Registrar with another corporation, if the resulting corporation is a bank or trust company authorized
by law to conduct such business, the resulting corporation is authorized to act as successor Registrar. The
City agrees to pay the reasonable and customary charges of the Registrar for the services performed. The
City reserves the right to remove the Registrar upon 30 days' notice and upon the appointment of a
successor Registrar, in which event the predecessor Registrar must deliver all cash and Bonds in its
possession to the successor Registrar and must deliver the bond register to the successor Registrar. On or
before each principal or interest due date, without further order of this Council, the City Administrator
must transmit to the Registrar monies sufficient for the payment of all principal and interest then due.
2.05. Execution, Authentication and Delivery. The Bonds will be prepared under the direction
of the City Administrator and executed on behalf of the City by the signatures of the Mayor and the City
Administrator, provided that those signatures may be printed, engraved or lithographed facsimiles of the
originals. If an officer whose signature or a facsimile of whose signature appears on the Bonds ceases to
be such officer before the delivery of a Bond, that signature or facsimile will nevertheless be valid and
sufficient for all purposes, the same as if the officer had remained in office until delivery.
Notwithstanding such execution, a Bond will not be valid or obligatory for any purpose or entitled to any
security or benefit under this resolution unless and until a certificate of authentication on the Bond has
been duly executed by the manual signature of an authorized representative of the Registrar. Certificates
of authentication on different Bonds need not be signed by the same representative. The executed
certificate of authentication on a Bond is conclusive evidence that it has been authenticated and delivered
under this Resolution. When the Bonds have been so prepared, executed and authenticated, the City
Administrator will deliver the same to the Purchaser upon payment of the purchase price in accordance
with the contract of sale heretofore made and executed, and the Purchaser is not obligated to see to the
application of the purchase price.
2.06. Temporary Bonds. The City may elect to deliver in lieu of printed definitive Bonds one
or more typewritten temporary Bonds in substantially the form set forth in EXHIBIT B attached hereto,
with such changes as may be necessary to reflect more than one maturity in a single temporary bond.
Upon the execution and delivery of definitive Bonds the temporary Bonds will be exchanged therefor and
cancelled.
Section 3. Form of Bond.
3.01. Execution of the Bonds. The Bonds will be printed or typewritten in substantially the
form as attached hereto as EXHIBIT B.
3.02. Approving Legal Opinion. The City Administrator is directed to obtain a copy of the
proposed approving legal opinion of Kennedy & Graven, Chartered, Minneapolis, Minnesota, which is to
be complete except as to dating thereof and to cause the opinion to be printed on or accompany each
Bond.
Section 4. Payment; Security; Pledges and Covenants.
4.01. Debt Service Fund. The Bonds are payable from the General Obligation Bonds,
Series 2014A Debt Service Fund (the "Debt Service Fund") hereby created. The Debt Service Fund shall

be administered by the Finance Director as a bookkeeping account separate and apart from all other funds
maintained in the official financial records of the City. The City will maintain the following accounts in
the Debt Service Fund: the "Assessable Improvements Account" and the "Utility Improvements
Account." Amounts in the Assessable Improvements Account are irrevocably pledged to the
Improvement Bonds, and amounts in the Utility Improvements Account are irrevocably pledged to the
Utility Revenue Bonds.
(a) Assessable Improvements Account. Proceeds of special assessments levied or to
be levied for the Assessable Improvements (the "Assessments") are hereby pledged to the
Assessable Improvements Account of the Debt Service Fund. There is appropriated to the
Assessable Improvements Account (i) a pro rata portion of amounts over the minimum purchase
price of the Bonds paid by the Purchaser, to the extent designated for deposit in the Debt Service
Fund in accordance with Section 1.03 hereof; and (ii) capitalized interest, if any.
(b) Utility Improvements Account. The City will continue to maintain and operate its
Water Fund to which will be credited all gross revenues of the water system and out of which will be
paid all normal and reasonable expenses of current operations of such system. Any balances therein
are deemed net revenues (the "Net Revenues") and will be transferred, from time to time, to the
Utility Improvements Account of the Debt Service Fund, which Utility Improvements Account will
be used only to pay principal of and interest on the Utility Revenue Bonds and any other bonds
similarly authorized. There will always be retained in the Utility Improvements Account a
sufficient amount to pay principal of and interest on all the Utility Revenue Bonds, and the
Finance Director must report any current or anticipated deficiency in the Utility Improvements
Account to the City Council. There is also appropriated to the Utility Improvements Account a pro
rata portion of amounts over the minimum purchase price of the Bonds paid by the Purchaser, to
the extent designated for deposit in the Debt Service Fund in accordance with Section 1.03
hereof.
4.02. Construction Fund. The City hereby creates the General Obligation Bonds, Series 2014A
Construction Fund (the "Construction Fund"). The City will maintain the following accounts in the
Construction Fund: the "Assessable Improvements Account" and the "Utility Improvements Account."
Amounts in the Assessable Improvements Account are irrevocably pledged to the Improvement Bonds,
and amounts in the Utility Improvements Account are irrevocably pledged to the Utility Revenue Bonds.
(a) Assessable Improvements Account. Proceeds of the Improvement Bonds, less
the appropriations made in Section 4.01(a) hereof, together with any other funds appropriated for
the Assessable Improvements and Assessments collected during the construction of the
Assessable Improvements, will be deposited in the Assessable Improvements Account of the
Construction Fund to be used solely to defray expenses of the Assessable Improvements and the
payment of principal and interest on the Improvement Bonds prior to the completion and payment
of all costs of the Assessable Improvements. Any balance remaining in the Assessable
Improvements Account of the Construction Fund after completion of the Assessable
Improvements may be used to pay the cost in whole or in part of any other improvement
instituted under the Improvement Act under the direction of the City Council. When the
Assessable Improvements are completed and the costs thereof paid, the Assessable Improvements
Account of the Construction Fund is to be closed and subsequent collections of Assessments for
the Assessable Improvements are to be deposited in the Assessable Improvements Account of the
Debt Service Fund.
(b) Utility Improvements Account. Proceeds of the Utility Revenue Bonds, less the
appropriations made in Section 4.01(b) hereof, will be deposited in the Utility Improvements

Account of the Construction Fund to be used solely to defray expenses of the Utility Improvements.
When the Utility Improvements are completed and the cost thereof paid, the Utility Improvements
Account of the Construction Fund is to be closed and any funds remaining may be deposited in the
Utility Improvements Account of the Debt Service Fund.
4.03. City Covenants with Respect to the Improvement Bonds. It is hereby determined that the
Assessable Improvements will directly and indirectly benefit abutting property, and the City hereby
covenants with the holders from time to time of the Bonds as follows:
(a) The City has caused or will cause the Assessments for the Assessable
Improvements to be promptly levied so that the first installment will be collectible not later than
2016 and will take all steps necessary to assure prompt collection, and the levy of the
Assessments is hereby authorized. The City Council will cause to be taken with due diligence all
further actions that are required for the construction of each Assessable Improvement financed
wholly or partly from the proceeds of the Bonds, and will take all further actions necessary for the
final and valid levy of the Assessments and the appropriation of any other funds needed to pay
the Bonds and interest thereon when due.
(b) In the event of any current or anticipated deficiency in Assessments, the City
Council will levy ad valorem taxes in the amount of the current or anticipated deficiency.
(c) The City will keep complete and accurate books and records showing receipts
and disbursements in connection with the Assessable Improvements, Assessments levied therefor
and other funds appropriated for their payment, collections thereof and disbursements therefrom,
monies on hand and, the balance of unpaid Assessments.
(d) The City will cause its books and records to be audited at least annually and will
furnish copies of such audit reports to any interested person upon request.
(e) At least 20% of the cost of the Assessable Improvements described herein will be
specially assessed against benefited properties.
4.04. City Covenants with Respect to the Utility Revenue Bonds. The City Council covenants
and agrees with the holders of the Bonds that so long as any of the Bonds remain outstanding and unpaid,
it will keep and enforce the following covenants and agreements:
(a) The City will continue to maintain and efficiently operate the water system as a
public utility and convenience free from competition of other like municipal utilities and will
cause all revenues therefrom to be deposited in bank accounts and credited to the Water Fund, as
hereinabove provided, and will make no expenditures from those accounts except for a duly
authorized purpose and in accordance with this resolution.
(b) The City will also maintain the Utility Improvements Account of the Debt
Service Fund as a separate account and will cause money to be credited thereto from time to time,
out of Net Revenues from the water system in sums sufficient to pay principal of and interest on
the Utility Revenue Bonds when due.
(c) The City will keep and maintain proper and adequate books of records and
accounts separate from all other records of the City in which will be complete and correct entries
as to all transactions relating to the water system and which will be open to inspection and
copying by any Bondholder, or the Bondholder's agent or attorney, at any reasonable time, and it

will furnish certified transcripts therefrom upon request and upon payment of a reasonable fee
therefor, and said account will be audited at least annually by a qualified public accountant and
statements of such audit and report will be furnished to all Bondholders upon request.
(d) The City Council will cause persons handling revenues of the water system to be
bonded in reasonable amounts for the protection of the City and the Bondholders and will cause
the funds collected on account of the operations of such systems to be deposited in a bank whose
deposits are guaranteed under the Federal Deposit Insurance Law.
(e) The City Council will keep the water system insured at all times against loss by
fire, tornado and other risks customarily insured against with an insurer or insurers in good
standing, in such amounts as are customary for like plants, to protect the holders, from time to
time, of the Bonds and the City from any loss due to any such casualty and will apply the
proceeds of such insurance to make good any such loss.
(f) The City and each and all of its officers will punctually perform all duties with
reference to the water system as required by law.
(g) The City will impose and collect charges of the nature authorized by
Section 444.075 of the Act, at the times and in the amounts required to produce Net Revenues
adequate to pay all principal and interest when due on the Utility Revenue Bonds and to create
and maintain such reserves securing said payments as may be provided in this resolution.
(h) The City Council will levy general ad valorem taxes on all taxable property in the
City when required to meet any deficiency in Net Revenues.
4.05. General Obligation Pledge. For the prompt and full payment of the principal of and interest
on the Bonds, as the same respectively become due, the full faith, credit and taxing powers of the City will be
and are hereby irrevocably pledged. If the balance in the Debt Service Fund is ever insufficient to pay all
principal and interest then due on the Bonds and any other bonds payable therefrom, the deficiency will be
promptly paid out of monies in the general fund of the City which are available for such purpose, and such
general fund may be reimbursed with or without interest from the Debt Service Fund when a sufficient
balance is available therein.
4.06. Debt Service Coverage. It is hereby determined that the estimated collection of
Assessments and Net Revenues from the water system of the City for the payment of principal and
interest on the Bonds will produce at least five percent in excess of the amount needed to meet, when due,
the principal and interest payments on the Bonds and that no tax levy is needed at this time.
4.07. Filing of Resolution. The City Administrator is authorized and directed to file a certified
copy of this resolution with the Manager of Property Records and Taxation of Anoka County, Minnesota, and
to obtain the certificate required by Section 475.63 of the Act.
Section 5. Authentication of Transcript.
5.01. City Proceedings and Records. The officers of the City are authorized and directed to
prepare and furnish to the Purchaser and to the attorneys approving the Bonds, certified copies of
proceedings and records of the City relating to the Bonds and to the financial condition and affairs of the
City, and such other certificates, affidavits and transcripts as may be required to show the facts within
their knowledge or as shown by the books and records in their custody and under their control, relating to

the validity and marketability of the Bonds, and such instruments, including any heretofore furnished,
may be deemed representations of the City as to the facts stated therein.
5.02. Certification as to Official Statement. The Mayor, the City Administrator, and the Finance
Director are authorized and directed to certify that they have examined the Official Statement prepared
and circulated in connection with the issuance and sale of the Bonds and that to the best of their
knowledge and belief the Official Statement is a complete and accurate representation of the facts and
representations made therein as of the date of the Official Statement.
5.03. Other Certificates. The Mayor, the City Administrator, and the Finance Director are
hereby authorized and directed to furnish to the Purchaser at the closing such certificates as are required
as a condition of sale. Unless litigation shall have been commenced and be pending questioning the
Bonds or the organization of the City or incumbency of its officers, at the closing the Mayor, the City
Administrator, and the Finance Director shall also execute and deliver to the Purchaser a suitable
certificate as to absence of material litigation, and the Finance Director shall also execute and deliver a
certificate as to payment for and delivery of the Bonds.
Section 6. Tax Covenants.
6.01. Tax -Exempt Bonds. The City covenants and agrees with the holders from time to time of
the Bonds that it will not take or permit to be taken by any of its officers, employees or agents any action
which would cause the interest on the Bonds to become subject to taxation under the Internal Revenue Code
of 1986, as amended (the "Code"), and the Treasury Regulations promulgated thereunder, in effect at the time
of such actions, and that it will take or cause its officers, employees or agents to take, all affirmative action
within its power that may be necessary to ensure that such interest will not become subject to taxation under
the Code and applicable Treasury Regulations, as presently existing or as hereafter amended and made
applicable to the Bonds.
6.02. No Rebate Required.
(a) The City will comply with requirements necessary under the Code to establish and
maintain the exclusion from gross income of the interest on the Bonds under Section 103 of the
Code, including without limitation requirements relating to temporary periods for investments,
limitations on amounts invested at a yield greater than the yield on the Bonds, and the rebate of
excess investment earnings to the United States if the Bonds (together with other obligations
reasonably expected to be issued in calendar year 2014) exceed the small -issuer exception amount of
$5,000,000.
(b) For purposes of qualifying for the small issuer exception to the federal arbitrage
rebate requirements with respect to the Bonds, the City hereby finds, determines, and declares that
the aggregate face amount of all tax-exempt bonds (other than private activity bonds) issued by the
City (and all subordinate entities of the City) during the calendar year in which the Bonds are issued
and outstanding at one time is not reasonably expected to exceed $5,000,000, all within the meaning
of Section 148(f)(4)(D) of the Code.
6.03. Not Private Activity Bonds. The City further covenants not to use the proceeds of the
Bonds or to cause or permit them or any of them to be used, in such a manner as to cause the Bonds to be
"private activity bonds" within the meaning of Sections 103 and 141 through 150 of the Code.

6.04. Qualified Tax -Exempt Obligations. In order to qualify the Bonds as "qualified
tax-exempt obligations" within the meaning of Section 265(b)(3) of the Code, the City makes the
following factual statements and representations:
(a) the Bonds are not "private activity bonds" as defined in Section 141 of the Code;
(b) the City hereby designates the Bonds as "qualified tax-exempt obligations" for
purposes of Section 265(b)(3) of the Code;
(c) the reasonably anticipated amount of tax-exempt obligations (other than any
private activity bonds that are not qualified 501(c)(3) bonds) which will be issued by the City
(and all subordinate entities of the City) during calendar year 2014 will not exceed $10,000,000;
and
(d) not more than $10,000,000 of obligations issued by the City during calendar year
2014 have been designated for purposes of Section 265(b)(3) of the Code.
6.05. Procedural Requirements. The City will use its best efforts to comply with any federal
procedural requirements which may apply in order to effectuate the designations made by this section.
Section 7. Book -Entry System; Limited Obligation of City.
7.01. The Depository Trust Company. The Bonds will be initially issued in the form of a
separate single typewritten or printed fully registered Bond for each of the maturities set forth in
Section 1.04 hereof Upon initial issuance, the ownership of each Bond will be registered in the
registration books kept by the Registrar in the name of Cede & Co., as nominee for The Depository Trust
Company, New York, New York, and its successors and assigns ("DTC"). Except as provided in this
section, all of the outstanding Bonds will be registered in the registration books kept by the Registrar in
the name of Cede & Co., as nominee of DTC.
7.02. Participants. With respect to Bonds registered in the registration books kept by the
Registrar in the name of Cede & Co., as nominee of DTC, the City, the Registrar and the Paying Agent
will have no responsibility or obligation to any broker dealers, banks and other financial institutions from
time to time for which DTC holds Bonds as securities depository (the "Participants") or to any other
person on behalf of which a Participant holds an interest in the Bonds, including but not limited to any
responsibility or obligation with respect to (i) the accuracy of the records of DTC, Cede & Co. or any
Participant with respect to any ownership interest in the Bonds, (ii) the delivery to any Participant or any
other person (other than a registered owner of Bonds, as shown by the registration books kept by the
Registrar) of any notice with respect to the Bonds, including any notice of redemption, or (iii) the
payment to any Participant or any other person, other than a registered owner of Bonds, of any amount
with respect to principal of, premium, if any, or interest on the Bonds. The City, the Registrar and the
Paying Agent may treat and consider the person in whose name each Bond is registered in the registration
books kept by the Registrar as the holder and absolute owner of such Bond for the purpose of payment of
principal, premium and interest with respect to such Bond, for the purpose of registering transfers with
respect to such Bonds, and for all other purposes. The Paying Agent will pay all principal of, premium, if
any, and interest on the Bonds only to or on the order of the respective registered owners, as shown in the
registration books kept by the Registrar, and all such payments will be valid and effectual to fully satisfy
and discharge the City's obligations with respect to payment of principal of, premium, if any, or interest
on the Bonds to the extent of the sum or sums so paid. No person other than a registered owner of Bonds,
as shown in the registration books kept by the Registrar, will receive a certificated Bond evidencing the
obligation of this resolution. Upon delivery by DTC to the City Administrator of a written notice to the

effect that DTC has determined to substitute a new nominee in place of Cede & Co., the words "Cede &
Co." will refer to such new nominee of DTC; and upon receipt of such a notice, the City Administrator
will promptly deliver a copy of the same to the Registrar and Paying Agent.
7.03. Representation Letter. The City has heretofore executed and delivered to DTC a Blanket
Issuer Letter of Representations (the "Representation Letter") which shall govern payment of principal of,
premium, if any, and interest on the Bonds and notices with respect to the Bonds. Any Paying Agent or
Registrar subsequently appointed by the City with respect to the Bonds will agree to take all action
necessary for all representations of the City in the Representation Letter with respect to the Registrar and
Paying Agent, respectively, to be complied with at all times.
7.04. Transfers Outside Book -Entry System. In the event the City, by resolution of the City
Council, determines that it is in the best interests of the persons having beneficial interests in the Bonds
that they be able to obtain Bond certificates, the City will notify DTC, whereupon DTC will notify the
Participants, of the availability through DTC of Bond certificates. In such event the City will issue,
transfer and exchange Bond certificates as requested by DTC and any other registered owners in
accordance with the provisions of this Resolution. DTC may determine to discontinue providing its
services with respect to the Bonds at any time by giving notice to the City and discharging its
responsibilities with respect thereto under applicable law. In such event, if no successor securities
depository is appointed, the City will issue and the Registrar will authenticate Bond certificates in
accordance with this resolution and the provisions hereof will apply to the transfer, exchange and method
of payment thereof
7.05. Payments to Cede & Co. Notwithstanding any other provision of this Resolution to the
contrary, so long as a Bond is registered in the name of Cede & Co., as nominee of DTC, payments with
respect to principal of, premium, if any, and interest on the Bond and notices with respect to the Bond will
be made and given, respectively in the manner provided in DTC's Operational Arrangements, as set forth
in the Representation Letter.
Section 8. Continuing Disclosure.
8.01. Execution of Continuing Disclosure Certificate. "Continuing Disclosure Certificate"
means that certain Continuing Disclosure Certificate executed by the Mayor and City Administrator and
dated the date of issuance and delivery of the Bonds, as originally executed and as it may be amended
from time to time in accordance with the terms thereof
8.02. City Compliance with Provisions of Continuing Disclosure Certificate. The City hereby
covenants and agrees that it will comply with and carry out all of the provisions of the Continuing
Disclosure Certificate. Notwithstanding any other provision of this resolution, failure of the City to
comply with the Continuing Disclosure Certificate is not to be considered an event of default with respect
to the Bonds; however, any Bondholder may take such actions as may be necessary and appropriate,
including seeking mandate or specific performance by court order, to cause the City to comply with its
obligations under this section.
Section 9. Defeasance. When all Bonds and all interest thereon have been discharged as
provided in this section, all pledges, covenants and other rights granted by this resolution to the holders of the
Bonds will cease, except that the pledge of the full faith and credit of the City for the prompt and full
payment of the principal of and interest on the Bonds will remain in full force and effect. The City may
discharge all Bonds which are due on any date by depositing with the Registrar on or before that date a sum
sufficient for the payment thereof in full. If any Bond should not be paid when due, it may nevertheless be

The City of Lino Lakes, Minnesota, a duly organized and existing municipal corporation in
Anoka County, Minnesota (the "City"), acknowledges itself to be indebted and for value received hereby
promises to pay to the Registered Owner specified above or registered assigns, the principal sum of
$ on the maturity date specified above, with interest thereon from the date hereof at the
annual rate specified above, payable February 1 and August 1 in each year, commencing August 1, 2015,
to the person in whose name this Bond is registered at the close of business on the fifteenth day (whether
or not a business day) of the immediately preceding month. The interest hereon and, upon presentation
and surrender hereof, the principal hereof are payable in lawful money of the United States of America by
check or draft by U.S. Bank National Association, Saint Paul, Minnesota, as Bond Registrar, Paying
Agent, Transfer Agent and Authenticating Agent, or its designated successor under the Resolution
described herein. For the prompt and full payment of such principal and interest as the same respectively
become due, the full faith and credit and taxing powers of the City have been and are hereby irrevocably
pledged.
The City may elect on February 1, 2023, and on any day thereafter to prepay Bonds due on or after
February 1, 2024. Redemption may be in whole or in part and if in part, at the option of the City and in such
manner as the City will determine. If less than all Bonds of a maturity are called for redemption, the City will
notify The Depository Trust Company ("DTC") of the particular amount of such maturity to be prepaid.
DTC will determine by lot the amount of each participant's interest in such maturity to be redeemed and each
participant will then select by lot the beneficial ownership interests in such maturity to be redeemed.
Prepayments will be at a price of par plus accrued interest.
The Bonds maturing on February 1, 2026 shall hereinafter be referred to collectively as the "Term
Bond." The principal amounts of the Term Bond subject to mandatory sinking fund redemption on any date
may be reduced through earlier optional redemptions, with any partial redemptions of the Term Bond
credited against future mandatory sinking fund redemptions of such Term Bond in such order as the City

This Bond is one of an issue in the aggregate principal amount of $2,645,000 all of like original
issue date and tenor, except as to number, maturity date, interest rate, and redemption privilege, all issued
pursuant to a resolution adopted by the City Council on October 27, 2014 (the "Resolution"), for the
purpose of providing money to defray the expenses incurred and to be incurred in making certain
assessable public improvements and improvements to the water system of the City, pursuant to and in full
conformity with the home rule charter of the City and the Constitution and laws of the State of Minnesota,
including Minnesota Statutes, Chapters 429, 444, and 475, as amended, and the principal hereof and
interest hereon are payable in part from special assessments levied against property specially benefited by
improvements and in part from net revenues of the water system of the City, as set forth in the Resolution
to which reference is made for a full statement of rights and powers thereby conferred. The full faith and
credit of the City are irrevocably pledged for payment of this Bond and the City Council has obligated
itself to levy ad valorem taxes on all taxable property in the City in the event of any deficiency in special
assessments and net revenues pledged, which taxes may be levied without limitation as to rate or amount.
The Bonds of this series are issued only as fully registered Bonds in denominations of $5,000 or any
integral multiple thereof of single maturities.
The City Council has designated the issue of Bonds of which this Bond forms a part as "qualified
tax-exempt obligations" within the meaning of Section 265(b)(3) of the Internal Revenue Code of 1986,
as amended (the "Code") relating to disallowance of interest expense for financial institutions and within
the $10 million limit allowed by the Code for the calendar year of issue.
IT IS HEREBY CERTIFIED AND RECITED That in and by the Resolution, the City has
covenanted and agreed that it will continue to own and operate the water system free from competition by
other like municipal utilities; that adequate insurance on said system and suitable fidelity bonds on
employees will be carried; that proper and adequate books of account will be kept showing all receipts
and disbursements relating to the Water Fund, into which it will pay all of the gross revenues from the
water system; that it will also create and maintain a Utility Improvements Account within the General
Obligation Bonds, Series 2014A Debt Service Fund, into which it will pay, out of the net revenues from
the water system a sum sufficient to pay principal of the Utility Revenue Bonds (as defined in the
Resolution) and interest on the Utility Revenue Bonds when due; and that it will provide, by ad valorem
tax levies, for any deficiency in required net revenues of the water system.
As provided in the Resolution and subject to certain limitations set forth therein, this Bond is
transferable upon the books of the City at the principal office of the Bond Registrar, by the registered
owner hereof in person or by the owner's attorney duly authorized in writing, upon surrender hereof
together with a written instrument of transfer satisfactory to the Bond Registrar, duly executed by the
registered owner or the owner's attorney; and may also be surrendered in exchange for Bonds of other
authorized denominations. Upon such transfer or exchange the City will cause a new Bond or Bonds to
be issued in the name of the transferee or registered owner, of the same aggregate principal amount,
bearing interest at the same rate and maturing on the same date, subject to reimbursement for any tax, fee
or governmental charge required to be paid with respect to such transfer or exchange.

The City and the Bond Registrar may deem and treat the person in whose name this Bond is
registered as the absolute owner hereof, whether this Bond is overdue or not, for the purpose of receiving
payment and for all other purposes, and neither the City nor the Bond Registrar will be affected by any

The Lino Lakes Public Safety Department is requesting council approval to hire one police
officer.
BACKGROUND
The police department has been engaged in a police officer hiring process to fill this vacancy.
This hiring process included:

3. Initial Oral Interview / Physical Fitness Testing
4. Supervisor Oral Interview
5. Background Investigation
6. Medical Examination
7. Psychological Examination
This hiring process has been extensive and has identified officer candidates that will continue
the proud tradition of providing high quality public safety services.
Approval of this request will bring the police department to the 2014 budgeted authorized
sworn staffing of 25 police officers; therefore this will not result in an increase to the 2014
approved budget.
RECOMMENDATION
Staff recommends the Council approve the hiring of Tenzin Dongag as a Police Officer
effective November 17, 2014.

City Code Section 1010 Relating to the Regulation of
Signs

INTRODUCTION
Staff is requesting City Council consideration to amend the City sign regulations.
BACKGROUND
Following a City Council request to review the City's temporary sign regulations, the Planning
and Zoning Board held a public forum, in December of 2012, to solicit comments from area
businesses and institutional uses. Staff also completed a survey of sign regulations for
surrounding communities. Nine (9) individuals brought forth suggestions regarding signage
needs. In general the respondents requested more flexibility in the annual day allowance,
location and duration of temporary sign permits. The board discussed several options in
February of 2013 no final recommendations were made.
In September of 2013 the City Council was approached by the pastor of Gethsemane Church
requesting additional signage and expressing concern over the limited flexibility for multiple
temporary signs on a property. The council directed staff to bring the issue back to the
Planning and Zoning board for further discussion. The following modifications were discussed
at the October 9, 2013 Planning and Zoning Board meeting. Comments were forwarded to the
City Council and discussed at the November 4, 2013 Council work session. A draft ordinance
was prepared and a public hearing was held at the May 14, 2014 Planning and Zoning Board
meeting. Additional public comment was received including discussion on the display of flags.
The hearing was continued and additional discussion was held by the board on June 11, 2014,
July 9, 2014 and August 13, 2014 regular meetings. The Planning and Zoning Board took
action at the August 13th meeting to recommend approval of the ordinance as drafted.
The City Council discussed the proposed changes at the September 2, 2014 work session.
Council directed staff to limit the allowable period to display temporary off -premise signs to
Friday through Monday.
A summary of changes by section has been provided for council review along with the
proposed ordinance amendment. Changes to the Sign Ordinance text is shown by either strike
out or underline. Text shown with a strike out is proposed to be deleted. Underlined text is
new or has been moved from a different location in the ordinance.
The proposed changes for consideration can be summarized in three categories; 1)
Administrative changes; 2) Changes to temporary sign requirements and 3) Changes to
permanent signs requirements. A summary of major changes are as follows:
Administrative Changes
Reorganized chapter to consolidate similar code requirements. For example prohibited
signs are now located in a Prohibited Signs section rather than dispersed throughout
ordinance.
Added definitions to clarify existing terms used in the ordinance.
Repetitive requirements where removed as applicable.
Temporary Signs
1. Amendment provides for a temporary sign allowance of 90 days annually. This is
roughly equivalent to one week a month. Business owners would determine dates but
display would be limited to no more than 30 consecutive days. The City currently
allows one permit each quarter for a maximum of 17 days each totaling 68 days.
2. One temporary sign is allowed per property except that properties with multi occupancy
buildings are allowed one per business up to maximum of 3.
3. A deposit will be required at time of permit to provide incentive for removal.
4. Temporary off premise signs (advertising signs) are allowed between 6:00 a.m. Friday
and 6:00 a.m. Monday provided not greater than 3 sq. ft. No permit required.
5. Governmental flags are no longer subject to the sign regulations. Requirements for
non-governmental flags remain unchanged.
Permanent Signs
Increase allowance for permanent signage for non-residential uses in residential areas
e.g., schools & churches by allowing for both a wall sign and a monument sign for these
uses. The ordinance does not currently allow for both.
Change the wall sign requirements to allow for signs on any facade not adjacent to a
residential zone. Signs may not exceed 100 square feet or 10% of the building facade
area. The city currently limits the number of wall signs to one unless the business
fronts 2 streets. In this case a second sign is allowed.
Change the wall and ground sign maximum sign area allowed for non-residential uses
in Rural, Residential and Rural -Business Reserve districts to 50 square feet and 80
square feet respectively.
RECOMMENDATION
Staff is recommending approval of the 1st Reading of Ordinance 09-14.

Chapter 1010 Signs
Summary of Changes:
October 2014
General: The Sign Code section has been modified to improve organization. Two new sections have been
created from the existing code; Non -Conforming Signs and Prohibited Signs.
1010.001 Purpose, Intent and Findings
Subpart (1)(g) was amended to include temporary commercial speech and off -premise signs for special events.
Subpart (2)(h) included the addition of the word "speech".
1010.02 Definitions
The term Advertising Sign was changed to Off -Premise sign.
A definition for Fagade was added.
The definition for Portable Sign was amended.
The definition for Sign Area was amended.
The definition for Temporary Signs was amended.
1010.003 Administration and Enforcement.
The terms temporary and permanent was added to clarify permit requirements for signs.
Permit fee requirement was placed in a new subpart. The double permit fee penalty was moved from Section
1010.009 and placed in this subpart.
A permit is no longer required for maintenance of a sign unless it is altered, for example to change color, copy or
structural elements.
1010.004 Non -Conforming Signs
This section previously covered Dynamic Signs which are now covered in section 1010.006. Non -Conforming
Sign requirements were previously included in Section 1010.006 General Regulations. No language was
changed.
1010.005 Prohibited Signs.
This section previously covered Zoning District Regulations which are now covered in section 1010.008.
Prohibited Signs were previously enumerated in section 1010.006 General Regulations and intermixed with
other provisions.

The only material change was the addition of subpart (7) Signs placed on vehicles or trailers which are parked or
placed for the primary purpose of displaying the sign, exempt for lettering on buses, taxis, or vehicles operating
during the normal course of business except as otherwise permitted in 1010.009.
1010. 006. Dynamic Display Sign Regulations.
This section previously covered General Regulations which are now included in section 1010.007. Dynamic
display regulations were previously located in section 1010.004.
The only changes recommended for this section are:
1 Removing the exception for time and temperature displays; and
2 The inclusion of location and size provisions currently contained within the general regulations section.
The current requirements prohibit dynamic signs in all zoning districts except those that those that are
less than 20 square feet in size.
Staff is recommending that this be amended to read as follows:
(4) In all districts no more than 20 square feet of the allowable sign area provided for in section 1010.009
may be used for dynamic display signs, except that in Rural, Residential and Rural -Business Reserve zoning
districts dynamic display signs shall only be allowed for non-residential uses.
The intent here is to clarify that the 20 square feet is not in addition to but included in the total sign area
allowed. Additionally, the amended language would eliminate the potential for placement on a residential
property.
1010.007 General Regulations Applicable to All Districts
This section previously covered the Substitution Clause which is now contained within section 1010.009.
General Regulations were previously located in section 1010.006.
General changes include:
Prohibited signs previously listed under this section have been moved to section 1010.005.
Sign construction requirements were amended to conform to the state building code rather than the
uniform sign code which is no longer in effect.
The requirements for illuminated signs were changed to allow them in all zoning districts. The source of
lighting must be controlled to not shine on or light adjacent property or right-of-way. Signs not
internally lit must have fixtures and sources screened from view.
The temporary signs requirements were amended to include the following provisions:
o Signs are allowed in all districts except that in Rural, Residential and Rural — Business Reserve
Districts temporary signs are only allowed for non-residential uses
o One sign per property except one per business for multi -occupancy structures with no more
than 3 displayed at a time.
o 90 days per year. Multi occupancy properties shall be one 90 day period per business. Cannot
be displayed by more than 30 days.
o Signs require a permit. Includes a deposit provision to insure removal of sign.

o Permit signed by property owner/manager.
o Maximum height of 10 feet.
o No illumination allowed.
o Not allowed in public right-of-way.
Multiple Occupancy building requirements were amended to provide for signs on each building facade.
Non -conforming sign requirements were moved to section 1010.004
Dynamic display requirements were moved to section 1010.006
o The provisions for the display of flags were changed as follows specify that Government flags
are not governed by this chapter. Non-government flags continue to be limited to one per
property.
The section includes a new provision that specifies the applicable sign standards for Planned Unit
Developments.
Off -premise signs are allowed on a temporary basis subject provided they are no greater than 3 square
feet in area and the display is limited between 6 am on Friday to 6 am on the following Monday. No
permit would be required for these signs.
Temporary Sign Table previously located in Section 1010.009 was moved to this section.
1010.008 Zoning District Regulations
This section previously contained Severability which is now located in section 1010.010.
This section now contains the Zoning District Regulations previously located in section 1010.005 and 1010.009.
The section previously located in section 1010.009 contains the specific sign requirements for all zoning districts.
Changes include:
Permanent Signs — Rural and Residential
o Nonresidential uses and licensed residential care facilities may have one ground sign and one
wall sign. Ground sign area was increased from 32 SF to 50 SF. Wall Sign area was increased
from 50 SF to 80SF
Permanent Signs — Neighborhood, Limited and General Business Public/Semi-Public Districts.
o Wall sign area amended to allow 100 sq. ft. or 10 % of wall surface area.
o Wall signs permitted on each facade unless directly adjacent to residential zones.

1010.010 Severability
§ 1010.001 PURPOSE, INTENT AND FINDINGS.
(1) Purpose and intent. It is not the purpose or intent of this sign chapter to regulate the message
displayed on any sign; nor is it the purpose or intent to regulate any building design or any display not
defined as a sign, or any sign which cannot be viewed from outside a building. Rather, the purpose and
findings of the sign chapter are as follows. The sign chapter is intended to establish a comprehensive and
balanced system of sign control that accommodates the need for a well-maintained, safe and attractive
community, and the need for effective communications including business identification. It is the intent
of this chapter to promote the health, safety, general welfare, aesthetics and image of the community by
regulating signs that are intended to communicate to the public, and to use signs which meet the city's
goals by authorizing:
(a) Permanent signs which establish a high standard of aesthetics;

(b) Signs which are compatible with their surroundings;
(c) Signs which are designed, constructed, installed and maintained in a manner that does not
adversely impact public safety or unduly distract motorists;
(d) Signs which are large enough to convey the intended message and to help citizens find
their way to intended destinations;
(e) Signs that are proportioned to the scale of, and are architecturally compatible with,
principal structures;
(f) Permanent signs which give preference to the on -premise owner or occupant; and
(g) Temporary commercial speech signs and off -premise signs .: - - _ .. which
provide an opportunity for grand openings and occasional salesspecial events while restricting signs
which create continuous visual clutter and hazards at public right-of-way intersections.
(2) Findings. The City of Lino Lakes finds it is necessary for the promotion and preservation
of the public health, safety, welfare and aesthetics of the community that the construction, location, size
and maintenance of signs be controlled. Further, the city finds:
(a) Permanent and temporary signs have a direct impact on and relationship to the image of
the community;
(b) The manner of installation, location and maintenance of signs affects the public health,
safety, welfare and aesthetics of the community;
(c) An opportunity for viable identification of community businesses and institutions must be
established;
(d) The safety of motorists, cyclists, pedestrians and other users of public streets and
property is affected by the number, size, location and appearance of signs that unduly divert the
attention of drivers;
(e) Installation of signs suspended from, projecting over or placed on the tops of buildings,
walks or other structures may constitute a hazard during periods of high winds and an obstacle to
effective firefighting and other emergency service;
(f) Uncontrolled and unlimited signs adversely impact the image and aesthetic attractiveness
of the community and thereby undermine economic value and growth;
(g) Uncontrolled and unlimited signs, particularly temporary signs which are commonly
located within or adjacent to public right-of-way or are located at driveway/street intersections, result
in roadside clutter and obstruction of views of oncoming traffic. This creates a hazard to drivers and
pedestrians and also adversely impacts a logical flow of information;
(h) Commercial speech signs are generally incompatible with residential uses and should be
strictly limited in residential zoning districts;
(i) The right to express noncommercial opinions in any zoning district must be protected,
subject to reasonable restrictions on size, height, location and number; and

(j) Light pollution creates negative impacts on the community, particularly in residential and
rural areas.
§ 1010.002 DEFINITIONS.
The following words and terms, when used in this sign chapter, shall have the following meanings,
unless the context clearly indicates otherwise.
ADVERTISING SIGN. A sign which directs attention to a business, commodity, service or
entertainment not exclusively related to the premises where a sign is located or to which it is affixed.
AREA IDENTIFICATION SIGN. A ground sign which identifies the name of neighborhood, a
residential subdivision, a multiple residential complex or a commercial or industrial complex consisting
of three or more businesses.
BANNER. A temporary sign made of cloth, flexible plastic or other fabric. National flags, state or
municipal flags or the official flags of any institutions or businesses shall not be considered BANNERS.
COMMERCIAL SPEECH. Speech advertising a business, profession, commodity, service or
entertainment.
CONSTRUCTION SIGN. A temporary sign identifying a building or construction site, architects,
engineers, contractors or suppliers.
DIRECTIONAL SIGNS. A sign providing directional information about the use or uses within the
development where the sign is located.
DYNAMIC DISPLAY. Any characteristics of a sign that appear to have movement or that appear
to change, however frequently, caused by any method other than physically removing and replacing the
sign or its components, whether the apparent movement or change is in the display, the sign structure
itself or any other component of the sign. This includes, but is not limited to, a sign display that
incorporates a technology or method allowing the image on the sign face to change without having to
physically or mechanically replace the sign face or its components. This also includes, but is not limited
to, any rotating, revolving, moving, flashing, blinking or animated display, and any display that
incorporates rotating panels, LED lights manipulated through digital input, "digital ink," or any other
method or technology that allows the sign face to present a series of images or displays.
FLAG. Any cloth, flexible plastic or fabric containing distinctive colors, patterns or symbols, used
as a symbol of a government, political subdivision or other entity, that is attached along one side to one
pole or attached to a rope on one pole that allows for raising and lowering the flag.
FACADE. That portion of any exterior elevation on a building extending from grade to top of the
parapet, wall, or eaves and the entire width of the building elevation.
FLASHING SIGN. An illuminated sign on which the illumination is not kept constant in intensity
or color at all times, when the sign is in use.

GROUND SIGN. Any permanent, freestanding sign supported by or upon standards, poles, beams
or other supports or foundation directly affixed to the ground.
IDENTIFICATION OR NAMEPLATE SIGN. A sign which bears the name or address or both of
the business or the occupant of the building on which it is located.
ILLUMINATED SIGN. A sign which has artificial light source directed upon it or which has an
interior light source.
INSTITUTIONAL SIGN. A permanent sign or bulletin board which identifies the name and other
characteristics of a public or private institution on the site where the sign is located.
MARQUEE AND CANOPY SIGNS. Any message or identification which is permanently affixed
to a projection or extension of a building or structure, erected in a manner as to provide shelter or cover
over the approach to any entrance of a store, building or place of public assembly.
MOTION SIGN. A sign which revolves, rotates or moves.
NONCOMMERCIAL SPEECH. Dissemination of messages not classified as commercial speech
which include, but are not limited to, messages concerning political, religious, social, ideological, public
service and informational topics.
OFF -PREMISE SIGN A sign which directs attention to a business, profession, commodity,
service or entertainment not exclusively related to the premises where a sign is located or to which it is
affixed.
PENNANT. Any lightweight plastic, fabric or other material, whether or not containing a message
of any kind, suspended from a rope, wire or string, usually in series, designed to move in the wind.
Sometimes called STRINGER.
POLITICAL CAMPAIGN SIGNS. Signs or posters announcing the candidate(s) seeking political
office and/or political issues and/or dates pertinent thereto.
PORTABLE SIGN. A temporary sign designed to be movable from one location to another.with or
without copy and graphic that is designed or intended to be moved or transported. Examples of portable
signs include:
Signs designed to be transported by trailer or on wheels;
Signs mounted on a vehicle for advertsing purposes, when the vehicle is parked and visible
from public right-of-way, except signs identifying a business when the vehicle is being used in the
normal day-to-day operations of that business.
PROJECTING SIGN. A permanent sign affixed to an exterior wall or roof of a building and which
is perpendicular to the building wall.
PYLON SIGN. A permanent, free standing ground sign erected upon a post or posts, pole or poles.
REAL ESTATE SIGN. A temporary sign advertising the sale or lease of property or buildings.

SANDWICH BOARD. A temporary sign constructed to form an AA@ or a tent -like shape, placed
in front of a business to advertise its services or goods.
SIGN. Any writing, pictorial presentation, number, illustration or decoration, flag, banner or other
device, whether painted, posted, printed, affixed or constructed, including associated brackets, braces,
supports, wires and structures, that is used to announce, direct attention to, identify, advertise or
otherwise make anything known. SIGN shall not mean, and this chapter shall not apply to, any state or
local road signs displayed for the purpose of identifying road construction or for the regulation of traffic
associated therewith.
SIGN AREA. The entire area of a temporary or permanent sign within a single continuous
perimeter enclosing the extreme limits of the actual sign surface, but excluding any structural or
supporting elements such as uprights, aprons, poles, beams or standards. For the purpose of this chapter,
maximum square footage of a sign shall be computed on the basis of one face of any double faced sign.
SIGN HEIGHT. Height shall be measured from grade to the uppermost points or level of sign
structure.
TEMPORARY SIGNS. A sign erected for a limited period of time.which is designed or intended to
be displayed for a short period of time and is not permanently installed. This includes items such as
banners, pennants, flags of other than a political jurisdiction, beacons, sandwich signs, balloons or other
air or gas filled figures.
WALL SIGN. A permanent sign attached to or erected against the wall of a building or structure
with the exposed face to the sign in a plane approximately parallel to the face of the wall and extending
not more than 15 inches from the building wall face.
§ 1010.003 ADMINISTRATION AND ENFORCEMENT.
(1) Permit required. No temporary or permanent sign shall be erected, altered, reconstructed,
maintained or moved in the city without first securing a permit from the city, unless this chapter
specifically states otherwise. The noncommercial speech content of the sign shall not be reviewed or
considered in determining whether to approve or deny a sign permit. The permit owner shall be
responsible for all of the requirements of this chapter, including the liability for expense of removal and
maintenance incurred by the city. Sign permit fees shall be as specified in the city fee schedule.
(2) Sign permit fees shall be as specified in the city fee schedule. Double permit fees shall be
assessed if the permit is pulled after the sign is placed.
(2)(3) Repairs.
(a) All signs shall be maintained in good condition and the areas around them kept free
from debris, bushes, high weeds and from anything else which would be an eyesore or nuisance. All
signs must be maintained to prevent the sign from becoming unkempt in appearance. When any
ground sign is removed, the entire surrounding area shall be cleared of all debris and unsightly
projections and protrusions.

(b) Any sign located in the city which may now be or hereafter become out of order,
rotten or unsafe and every sign which shall hereafter be erected, altered, resurfaced, reconstructed or
moved contrary to the provisions of this sign chapter, shall be removed or otherwise properly secured
in accordance with the terms of this sign chapter by the owners thereof or by the owners of the grounds
on which the sign shall stand, upon receipt of proper notice so to do, given by the city. No rotten or
other unsafe sign shall be repaired or rebuilt except in accordance with the provisions of this sign
chapter and upon proper permit issued by the issuing authority.
(2) Removal. In the event of the failure of the owner or person, company or corporation having
control of any sign or the owner of the ground on which the sign is located, to remove or repair the sign
within 60 days after the use is terminated, a notice shall be given and the sign may be removed by the
city at the expense of the owner or manager of the sign or the owner of the ground upon which the sign
stands.
(3) Violations. Any violation of this chapter shall constitute a misdemeanor. Each day of the
violation shall constitute a separate offense.
§ 1010.004 DYNAMIC SIGN RECULATIONS.NON-CONFORMING SIGNS
(1) Studies show that there is a correlation between dynamic displays on signs and the distraction
of highway drivers. Distraction can lead to traffic accidents. Drivers can be distracted not only by a
changing message, but also by knowing that the sign has a changing message. Drivers may watch a sign
story in one look. People have a natural desire to see the end of the story and will continue to look at the
sign in order to wait for the end. Additionally, drivers are more distracted by special effects used to
change the message, such as fade ins and fade outs. Finally, drivers are generally more distracted by
messages that are too small to be clearly seen or that contain more than a simple message. Time and
temperature signs appear to be an exception to these concerns because the messages are short, easily
absorbed and become inaccurate without frequent changes.
(2) In addition to safety concerns, light pollution creates negative impacts, particularly in rural
areas and residential neighborhoods of the community. The city has adopted regulations of exterior
lighting intended to reduce light pollution. Dynamic displays are by nature very bright and often are
installed on highway signs, many of which are in rural and residential ar-us in Lino Lakes.
(3) In conclusion, the city finds that any sign containing, in whole or in part, a dynamic display,
except signs solely displaying the time and/or temperature or similar, should not be allowed in any

lawful before this sign chapter was enacted, which would be prohibited, regulated or restricted under the
terms of this chapter or future amendments. It is the intention of this sign chapter that nonconforming
signs shall be allowed to continue to exist, but they shall not be enlarged upon, expanded or extended,
nor be used as the grounds for adding other signs or uses prohibited elsewhere in the same district. It is
further the intent of this sign chapter to permit legal nonconforming signs existing on the effective date
of this sign chapter, or amendments thereto, to continue as legal nonconforming signs provided the signs
are safe, are maintained so as not to be unsightly, and have not been abandoned or removed subject to
the following provisions:

(a) No sign shall be enlarged or altered in a way which increases its nonconformity;
(b) Should the sign or sign structure be destroyed by any means to an extent greater than
50% of its replacement cost and no building permit has been applied for within 180 days of when the
property was damaged, it shall not be reconstructed except in conformity with the provisions of this
chapter;
(c) Should the sign or sign structure be moved for any reason for any distance whatsoever,
it shall thereafter conform to the regulations for the zoning district in which it is located after it is
moved:
(d) No existing sign devoted to a use not permitted by the zoning code in the zoning
district in which it is located shall be enlarged, extended or moved except in changing the sign to a sign
permitted in the zoning district in which is it located; and
(e) When a structure loses its nonconforming status all signs devoted to the structure shall
be removed and all signs painted directly on the structure shall be repainted in a neutral color or a color
which will harmonize with the structure.

property. In these cases, a sign giving directions to the new access may be allowed in the right-of-way.

(3) Signs painted on, attached to or affixed to any trees, rocks or other similar organic or
inorganic natural matter.
(4) Any sign, signal, marking or device which purports to be or is an imitation of or resembles
any official traffic control device or railroad sign or signal, or emergency vehicle signal, or which
attempts to direct the movement of traffic or which hides from view or interferes with the effectiveness
of any official traffic -control device or railroad sign or signal. Further, no sign shall be installed, which
by reason of position, shape or color would conflict with proper function or interpretation of any traffic
sign or signal.
(5) Signs with revolving beacons, flashing signs, zip flashers or similar lighted devices.
(6) Signs that obstruct any door, fire escape, stairway or other access of any building or
structure.
(7) Signs placed on vehicles or trailers which are parked or placed for the primary purpose of
displcaying the sign, except for lettering on buses, taxis, or vehicles operating during the normal course
of business except as otherwise permitted in 1010.007.
(8) Projecting signs which extend over public property without an encroachment agreement,
which the city may agree to at the city's discretion.
(9) Roof signs including signs mounted on a roof surface or projecting above the roof line of a
structure if either attached to the structure or cantilevered over the structure.
(10) Abandoned signs or signs, other than temporary off -premise signs, that advertise an activity,
business, product or service no longer available on the premises on which the sign is located.
(11) Pennants or Stringers
(12) Any signs not specifically allowed by this chapter.
§ 1010.006 GENERAL REGULATIONS APPLICABLE TO ALL DISTRICTS.DYNAMIC
DISPLAY SIGN REGULATIONS
(1) Advertising signs as defined in this chapter are prohibited in all zoning districts.
(2) All signs shall be constructed in conformance with the provisions of the Uniform Sign Code
and made a part of this chapter.
(3) No sign shall be permitted within public road right of way or be affixed to public structures
signs or signs for public parks, governmental buildings or other public facilities. A special exception
may be granted by the City Council if road improvements or other public projects includes the
elimination of an access to a private property. In these cases, a sign giving directions to the new access
may be allowed in the right of way.

(5) Signs in windows in the interior of buildings are allowed without permits except that
dynamic display signs including flashing signs are not allowed in windows, regardless of size. No signs

amended, shall apply. Notwithstanding other provisions of this chapter regulating the allowed size or
election. Other requirements of this chapter, including those regarding the location of signs, shall
continue to apply.
(19) Temporary signs may be erected in compliance with the requirements of the temporary sign
table and this section.
(20) Directional signs up to four square feet are allowed up to ten feet above grade provided they
are not erected adjacent to any residential streets.

(21) Projecting signs which extend over public property are prohibited without an encroachment
agreement, which the city may agree to at the city's discretion.
(22) Roof signs are prohibited.
(23) The exposed uprights, superstructure or back side of all signs must be painted a neutral color

(24) For the purpose of this chapter, maximum square footage of a sign shall be computed on the
basis of one face of any multi faced sign.
(25) Multi occupancy business and industrial buildings. When a single principle building is
devoted to three or more businesses or industrial uses, a comprehensive sign plan for the entire structure
shall be submitted and shall be of sufficient scope and detail to permit a determination as to whether or
not the plan is consistent with the following regulations. The plan shall be subject to the approval of the
consistent with the approved comprehensive sign plan.
(a) The maximum individual tenant sign sizes for multiple occupancy structures and
individual uses which may display signs shall not exceed the maximum provisions for single occupancy
structures in the same zoning district.
(b) Multiple occupancy structures may display an area identification sign consistent with
the applicable district provisions. Individual freestanding signs identifying the tenants— business shall

provided for in section 1010.008 shall be used for dynamic display signs, except that in Rural,
Residential and Rural — Business Reserve zoning districts dynamic display signs shall only be allowed
for non-residential uses.
§ 1010.007 SUBSTITUTION CLAUSE.GENERAL REGULATIONS APPLICABLE TO ALL
ZONING DISTRICTS
The owner of any sign, which is otherwise allowed by this sign chapter, may substitute a noncommercial
speech copy in lieu of any other commercial or noncommercial copy. This substitution of copy may be
made without any additional approval or permitting. The purpose of this provision is to prevent any
noncommercial message over any other noncommercial message. This provision prevails over any more
specific provision to the contrary.
(1) All permanent signs shall be constructed in conformance with the provisions of the
Minnesota State Building Code, as amended, and Chapter 1003 of City Code.
(2) Signs in windows in the interior of buildings are allowed without permits except that
dynamic display signs including flashing signs are not allowed in windows, regardless of size. No signs
shall be attached to the exterior of windows.
(3) "No hunting" and "No trespassing" signs are allowed as regulated by M.S. § 97B.001, as it
may be amended from time to time. No permit is required.
(4) Illuminated signs are allowed in all zoning districts. Illuminated signs also are allowed in a
planned unit development when the illuminated signs comply with the requirements of this chapter and
are part of an approved comprehensive sign plan.

(5) The source of light for any illuminated sign must be controlled so as not to shine directly
upon or light adjacent property or public right-of-way. Signs which are not internally illuminated shall
have light fixtures and sources screened from view.
(6) Signs shall not be painted directly to any exterior building surface, but shall be on a separate
frame except for temporary display windows. Sign letters/symbols may be directly attached to a wall by
adhesive or mechanical fasteners.
(7) Signs in election years. In state general election years, the provisions of M.S. § 211B.045, as
amended, shall apply. Notwithstanding other provisions of this chapter regulating the allowed size or
number of signs, in city election years all temporary noncommercial signs of any size may be posted in
any number without a permit from 30 days before the city election until ten days following the city
election. Other requirements of this chapter, including those regarding the location of signs, shall
continue to apply.
(8) Temporary signs. A temporary sign may be erected on a property in accordance with Section
1010.008 and the following regulations:
a. Temporary signs are allowed in all districts except that in Rural, Residential, and Rural —
Business Reserve zoning districts temporary signs shall only be allowed for non-residential uses.
b. One temporary sign per property is allowed except that the maximum number of
temporary signs for properties with multi -occupancy buildings shall be one per business, with no more
than three (3) per property displayed at one time.
c. Signs may not be displayed for more than 90 days per calendar year, per property, except
that for properties with multi -occupancy buildings shall be allowed 90 days per tenant per calendar year.
A single permit shall not exceed 30 consecutive days.
d. Signs may not be displayed without a permit. Each permit must indicate the number of
days and the dates the sign is be displayed. A fee and deposit at a level established by ordinance adopted
by the city council is required. The deposit shall be forfeited if the sign was erected past the date of
removal, as indicated on the permit.
e. Permits shall be signed by the property owner and/or property manager.
f. The city has the right to remove the sign at the end of the permit period and collect the
cost of removal from the permit holder and/or property owner.
g. The maximum height of a ground mounted temporary sign shall not exceed ten (10) feet
in height as measured from the ground.
h. No temporary sign shall have lighting or illumination of any sort.

(9) Temporary Off -Premise Signs are allowed, without a permit, as follows:

(12) Multi -occupancy business and industrial buildings. When a single principle building is
devoted to three or more businesses or industrial uses, a comprehensive sign plan for the entire structure
shall be submitted and shall be of sufficient scope and detail to permit a determination as to whether or
not the plan is consistent with the following regulations. The plan shall be subject to the approval of the
City Council. No permit shall be issued for an individual use except upon a determination that it is
consistent with the approved comprehensive sign plan.

(a) The maximum individual tenant sign sizes for multiple occupancy structures and
individual uses which may display signs shall not exceed the maximum provisions for single
occupancy structures in the same zoning district.
(b) Multiple occupancy structures may display an area identification sign consistent with the
applicable district provisions. Individual freestanding signs identifying the tenants' business shall not
be displayed. Twenty-five percent of the area identification sign must identify the entire site, the
balance of the sign may be used for individual tenant identification.
(c) Except as provided in this chapter, individual tenants of multiple occupancy structures
shall not display separate wall signs unless the tenants' business has an exclusive exterior entrance.
The number of signs shall be limited to one per building facade that the tenant occupies, and each
sign shall be limited to the maximum wall size sign permitted per building facade, the total of which
shall not exceed the square footage allowed.
(d) In any multiple occupancy structure qualifying as a mall type shopping center, directory
signs shall be permitted for each common public entrance. Each directory sign area shall not exceed
a total of 50 square feet and shall be located within 50 feet of the common public entrance being
served. The size of individual business identification signing within the directory shall be established
during the site plan review process. Attention shall be given to the possible number of tenant or
occupancy bays which may be served by the common public entrance for which the directory sign is
intended.
(12) Street addresses required to comply with address ordinances or building codes do not
require a sign permit.
(13) Flags
(a) Flags symbolizing a government or political subdivision, or a branch or department of a
government or political subdivision, US military service, or veteran's organizations chartered by
Congress are not regulated by this chapter.
(b) Each lot may fly one flag that is not a symbol of a government provided that it is affixed
to a building or flagpole that is permanently mounted in the ground or mounted on a building. More than
one non-government flag shall be regulated as permanent signage.
(c) Display of a flag(s) does not require a sign permit.

The owner of any sign, which is otherwise allowed by this sign chapter, may substitute a
noncommercial speech copy in lieu of any other commercial or noncommercial copy. This
substitution of copy may be made without any additional approval or permitting. -The purpose of
this provision is to prevent any inadvertent favoring of commercial speech over noncommercial
speech, or favoring of any particular noncommercial message over any other noncommercial
message. This provision prevails over any more specific provision to the contrary.

Well Drilling Company on behalf of the City of Lino Lakes in the amount of $176,950.00
for the construction of the Well No. 6 Improvements according to the plans and
specifications approved by the City Council and on file in the office of the City Clerk.
3. The City Clerk is hereby authorized and directed to return forthwith to all bidder the Bid
Bonds made with their bids, except that the deposits of the successful bidder and the next
two lowest bidders shall be retained until a contract has been signed.
Adopted by the Council of the City of Lino Lakes this 27th day of October, 2014.
