HomeMy WebLinkAbout2004-032 Council Resolution• • City Council Marshan Estates March 8, 2004 CITY OF LINO LAKES RESOLUTION NO. 04-32 RESOLUTION APPROVING THE PRELIMINARY PLAT FOR MARSHAN ESTATES WHEREAS, the City has received an application for preliminary plat approval for property currently described to -wit: Exhibit A and WHEREAS, the applicant is proposing to subdivide the property into five parcels and 6 Outlots described as: Lots 1 Block 1, Marshan Estates Lots 1 — 4, Block 2, Marshan Estates Outlots A,B,C,D,E,F ; and WHEREAS, the preliminary plat approval request is based on the following submittals: 1. Boundary and topographic Survey of Marshan Estates, prepared by Glenn Rehbein Companies, and dated December 18, 2003. 2. Preliminary Plat of Marshan Estates, prepared by Glenn Rehbein Companies, dated March 1, 2004. 3. Preliminary Grading, Drainage, and Erosion Control Plan, Marshan Lane, prepared by Glenn Rehbein Companies, dated December 18, 2003, revised January 6, 2004. 4. Preliminary Grading Plan Notes and Details, Marshan Lane, prepared by Glenn Rehbein Companies, dated December 17, 2003. 5. Preliminary Sanitary Sewer and Watermain Utility Improvements, prepared by TKDA WHEREAS, at their meeting on February 11, 2004, the Planning & Zoning Board conducted a public hearing and recommended approval of the preliminary plat subject to the conditions listed in the meeting minutes; and WHERAS, the proposed preliminary plat meets the requirements of the City's zoning ordinance and subdivision ordinance subject to certain conditions of approval. NOW, THEREFORE, BE IT RESOLVED that the City Council of Lino Lakes hereby approves the preliminary plat for Marshan Estates subject to the following conditions: 11 • City Council Marshan Estates March 8, 2004 1. The City approves the Comprehensive Plan Amendment to change the land use from Low Density Unsewered Residential to Low Density Sewered Residential. 2. The City Council orders the sanitary sewer and water improvements. 3. A 20 feet wide conservation easement shall be provided, adjacent to County Ditch 10, across Lots 1 -4. 4. Building Permit applications shall include a tree preservation plan and a grading plan in conformance with the approved grading plan. 5. Tree cover will be evaluated against Firewise requirements (i.e.; trees should be thinned) subject to review by the City Forester. 6. The Developer shall enter into a Development Contract with the City. 7. The Developer shall provide a 10 -foot wide trail easement adjacent to Lake Drive, which would overlay the required 10 -foot drainage and utility easement. 8. Parkland dedication shall be in the form of cash payment in the amount of $6,600. 9. Applicant shall provide Quit Claim Deeds to adjacent property owners for the Outlots. No. 12976 -002 Routing: The City of Lino Lakes has received plans providing for a Preliminary Plat and improvements to the properties bordering Marshan Lane. Marshan Lane is essentially a short dead end street, extending easterly from Lake Drive, just south of Town Center Parkway. The street is just under 800 feet in length and serves existing residential properties. The proposed plans provide for re- platting the roadway and properties in order to provide for the construction of additional single family residential units. The following has been received for review: 1. Boundary and Topographic Survey of Marshan Estates, prepared by Glenn Rehbein and Associates, and dated December 18, 2003. 2. Preliminary Plat of Marshan Estates, prepared by Glenn Rehbein and Associates, dated January 6, 2004, and received by the City of Lino Lakes January 7, 2004. 3 Preliminary Grading, Drainage, and Erosion Control Plan, Marshan Lane, prepared by Glenn Rehbein and Associates, dated December 18, 2003, revised January . 6, 2004, and received by the City of Lino lakes January 7, 2004. 4 Preliminary Grading Plan Notes and Details, Marshan Lane, prepared by Glenn Rehbein and Associates, dated December 17, 2003, and received by the City of Lino lakes January 7, 2004. Sanitary sewer and water are currently not available to the existing properties on Marshan Lane. As part of the proposed improvements, preliminary plans providing for the extension of and water to Marshan Lane were initiated in the fall of 2003 by the City of Lino Lakes. This review; therefore, considers the proposed plat and improvements, along with the extension of utilities under a separate plan. Preliminary Plat 1 Additional right -of -way (20 feet) is shown dedicated along Lake Drive (Lot 1, Block 1). Along with 10 feet of platted drainage and utility easement, this may adequate as further explained in this memorandum under the sewer and water comments. However, the plat shall be subject to the review and approval of Anoka County. In addition to the added property needed for the utilities, it is likely that Anoka County will also require dedication for eventual future roadway improvements, including widening. An Employee Owned Company Promoting Affirmative Action and Equal Opportunity Marshan Estates City of Lino Lakes, Minnesota Page 2 February 4, 2004 The Preliminary Plat does show drainage and utility easements around the platted properties per City of Lino Lakes standards. This includes 5 -foot easements along all side property lines and 10 foot easements across the front and rear of all properties. A drainage easement is also provided adjacent to. County Ditch 10 on the south boundary of the plat. Sanitary Sewer and Water 1. Plans for extending sanitary sewer and water to Marshan Lane have been initiated by the City and are therefore not included as part of the plans submitted by the Developer. However, comments are being provided herein to address specific issues related to the Developer's submittal. The closest available utilities are 10 -inch diameter water and 12 -inch diameter sanitary sewer mains at Town Center Parkway, a distance of less than 400 feet north of Marshan Lane. It is proposed to connect directly to the existing facilities by extending mains southwesterly along the east side of Lake Drive to Marshan Lane, and further extending mains easterly to the end of Marshan Lane. For the watermain, it is proposed to extend 12 -inch diameter pipe along Lake Drive in accordance with the City's Comprehensive Plan. The 12 -inch main would then terminate at Marshan Lane, a 12 -inch stub to the south to be provided for a future connection, and 8 -inch main then extended easterly to the end of Marshan Lane. Individual services would then be provided for the individual parcels along Marshan Lane (for both existing and proposed single family units). For the sanitary sewer, it is proposed to extend PVC sewer pipe to Marshan Lane in a similar fashion. The size of the sewer main has not yet been firmly determined, and can be further explained as follows: • The depth of the sanitary sewer at Town Center Parkway is approximately 19 feet deep. However, the ground elevation drops as much as 11 feet from Town Center Parkway to the end of Marshan Lane, thus raising concerns regarding the depth/cover and invert elevation of the main by the time it reaches the termination point (a total distance of approximately 1100 feet). For the majority of properties on Marshan Lane (including the three proposed new units on the south side of Marshan Lane), gravity flow from the homes to the sewer doesnot appear to be a concern. However, the three existing units along the south and east sides of Marshan Court are situated at lower elevations, and the lowest floors of these three properties cannot be served sanitary sewer by gravity. Preliminary design of the sanitary sewer places the invert of the sewer at an elevation of 890.5 (plus or minus) at its termination at Marshan Court and the end of Marshan Lane. The low floor elevations of the three properties are as follows: 580 Marshan Lane 888.97 590 Marshan Lane - 88838 600 Marshan Lane - 889.01 Therefore, an ejector or lift would be required to service the lowest floors of these three properties. Marshan Estates Page 3 February 4, 2004` City of Lino Lakes, Minnesota An 8 -inch diameter sewer is adequate in size for the proposed improvements and area served. However, upsizing of the pipe to further flatten grades and gain additional depth can be done. However, ejectors would still be necessary for the properties as mentioned above. A sewer stub for eventually extending the sewer further south beyond Marshan Lane may not be necessary for the following reasons: In accordance with the City's Comprehensive Sewer Plan, it is not anticipated that a significant amount of additional area would require collection from this extension. In addition, the current Marshan Lake Industrial Park (Panattonni), located just to the south of Marshan Lane, has extended sewer to the east side of Lake Drive for future collection of those properties. An extension of sanitary sewer further south would require crossing County Ditch No 10, which . is immediately south of Marshan Lane. According to the survey provided, the bottom of the ditch is 5 feet below the sewer invert at Town Center Parkway. If sewer were to be extended to the south of County Ditch 10, a small lift station would be needed, according to the survey information provided. The alignment and location of the water and sewer along Lake Drive has not yet been firmly determined, pending completion of the utility design and review by Anoka County. However, it appears additional right -of -way and/or utility easements will be necessary to construct the utilities, and will be required by the County. The existing right -of -way currently extends 40 feet from the center of Lake Drive. It is recommended at this time that at least 30 feet be provided. Per the plans provided, 20 feet of additional right -of -way is provided along with the 10 foot standard drainage and utility easement. This may be adequate. However, the actual required amount of dedication will be subject to the review of Anoka County, including their review of the Preliminary Plat and proposed Utility Plans. A permit from the County will also be required for any work within the County right- of-way. The sanitary sewer and services must be placed a minimum distance from existing wells per Minnesota Department of Health requirements. Grading Plan 1 The proposed site development results in grading (disturbing of property) of over 1.0 acre. The development shall therefore be subject to the requirements of NPDES (National Pollution Discharge Elimination System) as most recently adopted by the Minnesota Pollution Control Agency (MPCA) and the City of Lino Lakes. A Stormwater Pollution Prevention Plan (SWPPP) will also be required. Because the site is Iess than 23 acres, a review and approval of the Rice Creek Watershed District (RCWD) will not be required. Marshan Estates City of Lino Lakes, Minnesota February 4, 2004 • As part of the NPDES and SWPPP requirements, at least some measure of stormwater treatment must be provided, subject to the review and approval of the MPCA. For the portion of property disturbed as shown on the Grading Plan, it is recommended that the grading be adjusted to provide for detention or infiltration as may be required by the MPCA, prior to discharging to the County ditch. • Silt fence and erosion control measures are provided on the Plans. No soil or geotechnical report is provided. Any imported material for the site shall be subject to the approval of the City Engineer. In addition, floor elevations for the proposed housing units must meet the requirements of the City of Lino Lakes as follows: The lowest building opening must be a minimum of 1 -foot higher than detention basin emergency overflow elevations. Basement floor elevations must be at least 4-feet above the normal water elevation and 2 -feet above the design flood level (for consideration of County Ditch 10 and any infiltration basins that may be required). The low floor elevation shall also be subject to the level of subsurface groundwater elevations. Memo C I T IN 0. :E Environmental To: Michael Grochala From Marty Asleson Date January 30, 2004 Re Recommendations of the January 28, 2004 Environmental Board Meeting The Environmental Board met on January 28th, 2004 and made the following recommendations: Marshan Estates Land Cover The developer needs to submit a detailed tree inventory and follow the subdivision ordinance for Tree preservation plans. In addition, the developer should remove /prune any remaining trees to conform to National Fire Wise Standards (Attachment 1). Pre- existing conditions should include Lino Lakes MLCCS. Soils There should be no importing or exporting of soils without City approval. The developer should include a plan for soil compaction prevention. Surface Water Would like RCWD input on impact mitigation. The Environmental Board would like to see a minimum buffer to .include at least the designated drainage easement area, and should include a distance of 50 feet from the ditch. The City native seed specification should be used to replant in this buffer area. Signage should be used in this easement area. The signage should say "no cutting, or removal of vegetation, no fill or debris." Developer should submit the required NPDES control measures and best management practices to be used with particular emphasis on the ditch. Ensure the developer is complying with the City Shoretand Management Overlay Ordinance in not exceeding 30% impervious. Downspouts from roofs should be directed to pervious yard areas. • Page 1 Additional Comment This Environmental Board review does not include the multi -use area. There is concem for the type of use that may be proposed for this area. Motion by Grundhoffer to approve Marshan Estates with Environmental Board comments and recommendations. The motion was 2 "d by O'Dea. Motion was approved with all in favor. Justin's Preserve Tree Preservation A tree preservation plan should be submitted following the City Tree Preservation Ordinance. Soils Importing or exporting of soils without City permission should be prohibited. Surface Water. Create rain gardens to capture extra impervious runoff. Direct runoff from roofs to yard and/or rain gardens. Habitat Concerns Inform property owners of shoreland ordinance and of the benefits of .leaving the trees (both alive and dead) as habitat.
