CITY OF LINO LAKES
RESOLUTION NO. 04 -38
RESOLUTION AUTHORIZING PREPARATION OF REPORT ON IMPROVEMENT
LEGACY AT WOODS EDGE
WHEREAS, it is proposed, in conjunction with the Legacy at Woods Edge project, to
make improvements of street, sanitary sewer, water main, storm sewer, streetscaping
and sidewalks within the development area and to make street and storm sewer and
Traffic Signal improvements to Lake Drive adjacent to the site and to assess the
benefited property for all or a portion of the cost of the improvement, pursuant to
Minnesota Statues, Chapter 429 and the City Charter,
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
LINO LAKES, MINNESOTA:
1. That the proposed improvement be referred to SEH, Inc., for study and that they are
instructed to report to the council with all convenient speed advising the council in a
preliminary way as to whether the proposed improvement is necessary, cost -
effective, and feasible and as to whether it should best be made as proposed or in
connection with some other improvement, and the estimated cost of the
improvement as recommended.

Authorizing Report on Improvements, Legacy
at Woods Edge
Simple Majority
The City Council approved the 1st Reading of Ordinance 04 -04 rezoning the subject
property to Planned Unit Development and Resolution No. 04 -33, approving the
Development Stage Plan /Preliminary Plat on March 8, 2004.
The Development Stage Plan approval included a condition requiring the preparation of
a feasibility study for the public improvements. Preparation of this report is also a
• statutory requirement for projects where the costs are proposed to be assessed against
the benefiting properties.
The report will include a refined design on the proposed infrastructure including Lake
Drive Improvements and proposed streetscaping for the development. Additionally, the .
estimated improvement costs and cost allocation break down will be prepared. It
should also be noted that the study does cover the improvements necessary for the
YMCA project.
Short, Elliott, Hendrickson, Inc., the City's Engineering consultant, has prepared a
proposal to perform these services for an estimated cost of $24,402. The cost of the
report preparation will be included in the proposed assessments for the project.
Staff is recommending approval of Resolution No. 04 -38.
