RESOLUTION NO. 04-65
RESOLUTION DENYING VACATING ROAD EASEMENT REQUEST,
1390 KARTH ROAD, EQUITY ESTATES
WHEREAS, the City Council of Lino Lakes hereby denies the request to vacate
the 30' Road Easement at 1390 Karth Road in Equity Estates, in its entirety, from its
intersection with Karth Road to the south property line of said parcel; and
WHEREAS, a public hearing was held on May 10, 2004 before the City Council
in the City Hall Council Chambers after due published and posted notice had been given
on April 20, 2004, and a reasonable attempt was made to give personal notice to all
affected property owners, and all persons interested were given an opportunity to be
heard; and
WHEREAS, it appears to be in the best interest of the City to keep such road
easement; and
WHEREAS, three -fifths of all members of the City Council concur in this
resolution.
NOW, THEREFORE THE CITY COUNCIL OF LINO LAKES ORDAINS:
Section 1. That the 30' Road Easement vacation request, as dedicated on the Plat of
Equity Estates, Anoka County, Minnesota, is hereby denied.
Section 2. That any person, corporation or city owning or controlling easements
contained upon the property reserves the right to continue to maintain, repair, replace,
remove or otherwise attend thereto.
Adopted by the Lino Lakes City Council this 10th day of May, 2004.
