Approving Summary Publication Method and
Language pertaining to Summary of Ordinance
04 -04 (Rezoning of Legacy at Woods Edge
Property to Planned Unit Development)
ACTION REQUIRED 4/5 vote
BACKGROUND
The City Council approved Ordinance 04 -04 amending the Zoning Ordinance by
rezoning the Legacy at Woods Edge project area to Planned Unit Development.
Included in the Ordinance are the Design Guidelines which establish the regulatory
framework for the development. Due to the length of the ordinance (the design
guidelines are 43 pages alone) staff is requesting approval of a summary publication. A
full text version will be available at City Hall.
MN statute 412.191 provides for a city to publish a summary of an ordinance.
Staff is recommending approval of Resolution No. 04 -93 approving the Summary
Publication of Ordinance 04 -04.

RESOLUTION APPROVING A SUMMARY OF THE ZONING ORDINANCE
(ORD. NO 04 -04) FOR PUBLICATION
WHEREAS, the City Council approved Ordinance No. 04 -04 amending the Zoning
Ordinance by rezoning certain real estate from LB, Limited Business and PSP, Public
Semi- Public to PUD, Planned Unit Development, on March 22, 2004, and
WHEREAS, Ordinance No. 04 -04 is lengthy and MN statute 412.191 provides for a city
to publish a summary of an ordinance, and
WHEREAS, the City Council determines that the summary clearly informs the public of
the intent and effect of the ordinance, and
WHEREAS, the publication in the official newspaper will include a notice that a full
printed copy of the ordinance is available at City Hall,
• NOW, THEREFORE BE IT RESOLVED THAT the City Council approves the summary
in Attachment A for publication according to state law and the City Charter.
Adopted by the Lino Lakes City Council this 28th day of June, 2004.

A SUMMARY OF ORDINANCE NO. 04 -04
CITY OF LINO LAKES
ORDINANCE NO. 04 -04
AN ORDINANCE AMENDING THE ZONING ORDINANCE OF THE CITY OF LINO
LAKES BY REZONING CERTAIN REAL ESTATE FROM LB, LIMITED BUSINESS
DISTRICT AND PSP, PUBLIC SEMI - PUBLIC TO
PUD, PLANNED UNIT DEVELOPMENT
The City Council of the City of Lino Lakes, Anoka County, Minnesota does ordain:
SECTION 1. FINDINGS
The City Council makes the following findings regarding the application for
rezoning the property described below, based on the factors listed in Section 2,
Subd.1 E of the Lino Lakes zoning ordinance:
1. The proposed action has been considered in relation to the specific
policies and provisions of and has been found to be consistent with the
official City Comprehensive Plan, as the site is guided for mixed use.
2. The proposed use is or will be compatible with present and future land
uses of the area. The site is guided for mixed use. Land in the area of
the site is already developed with commercial uses or designated for
such use. Subject to the conditions of site and building plan /conditional
use permit approval the site is compatible with existing commercial and
residential uses as well as future commercial and residential.
3. The proposed use conforms with all performance standards contained
within the city's zoning ordinance and is subject to the Design
Guidelines attached hereto.
4. The proposed use can be accommodated with existing public services
and will not overburden the City's service capacity. Existing sanitary
sewer and water services are available to the site and will not
overburden existing public services.
5. Traffic generation by the proposed use is within capabilities of streets
serving the property in conjunction with the public improvements
proposed.

The Zoning Ordinance of the City of Lino Lakes, Anoka County, Minnesota, passed by
the City Council on March 10, 2003 is hereby amended by rezoning from LB, Limited
Businsess and PSP, Public Semi - Public to PUD, Planned Unit Developnment District
pursuant to the provisions of the Zoning Ordinance of the City of Lino Lakes, the
following described real estate:

SECTION 2. DISTRICT PROVISIONS
A. Development of the property shall be subject to the Lino Lakes Town Center
Design & Development Guide, attached hereto as Exhibit B and made a part
hereof.
B. Unless otherwise specified herein the development shall be subject to the
provisions of the Lino Lakes Zoning Ordinance and all other applicable chapters
of City Code.
SECTION 3.
As above amended, said Zoning Ordinance shall stand as initially passed and
previously amended.
SECTION 4.
This ordinance shall be in force and effect from and after its passage and publication
according to the Lino Lakes City Charter.
