Home My WebLink About2004-124 Council Resolution• CITY OF LINO LAKES RESOLUTION NO. 04 -124 RESOLUTION APPROVING APPLICATION FOR EXEMPT PERMIT TO CONDUCT GUN RAFFLE WHEREAS, Minnesota State Statute, Section 349 requires non -profit organizations to be licensed by the Charitable Gambling Control Board, and WHEREAS, PACE (Paper, Allied- Industrial, Chemical & Energy) International Union #7 -0264 has acquired said license, and WHEREAS, PACE has submitted an exempt permit application to hold its annual gun raffle in conjunction with its annual golf tournament at Chomonix Golf Course, 646 Sandpiper Drive, on September 18, 2004, and WHEREAS, the Minnesota Gambling Control Board requires the City of Lino Lakes approve or deny this application by resolution, WHEREAS; the City of Lino Lakes may approve the application with or without a 30- day waiting period NOW, THEREFORE, BE IT RESOLVED that the Lino Lakes City Council hereby approves the exempt permit application, with no waiting period. Adopted by the Lino Lakes City Council this 23rd day of August, 2004 ATTEST: Ann Blair ity Clerk • ergesdfi, Mayor • • AGENDA ITEM 1B STAFF ORIGNINATOR: Jean Viger, Deputy Clerk MEETING DATE: August 23, 2004 TOPIC: Consider Resolution 04 -124 Approving Application for Exempt Permit to PACE (Paper, Allied- Industrial, Chemical & Energy Workers International Union, Local #7 -0264 VOTE REQUIRED: Simple Majority (3/5 Vote) BACKGROUND: PACE, Local #7 -0264 is planning a gun raffle in conjunction with its 9th Annual Golf Tournament. The tournament is being held at Chomonix Golf Course on September 18, 2004. All lawful gambling conducted in Minnesota requires authorization from the Minnesota Gambling Control Board in the form of a license, exempt permit or excluded authorization. An exempt permit may be issued to non -profit organizations conducting lawful gambling activity on five or fewer days during a calendar year. PACE holds just this one tournament every year. Minnesota Statute, Chapter 349, Section 349.166, Subd. 2 does, however, require that the non -profit organization applying for the exemption permit notify the City. The City must than take action at least 45 days prior to the event. Because the event is to take place less than 45 days after council approval, the applicant requests that the council approve the application with no waiting period, an option on page two of the exempt application. A copy of the application for the exempt permit is complete and on file in the city clerk's office along with the forms showing tax exempt status. Attached are flyers with information regarding the golf tournament and the gun raffle as well as the contract agreement between PACE and Chomonix Golf Course. OPTIONS: 1.
