City of Lino Lakes Planning & Zoning Board MEETING GUIDELINES Open Mike — The purpose of a Board Meeting is to accomplish the business of the city. When presenting at a meeting please remember to be respectful, and follow these guidelines: • Please address the meeting chair. • State your name and address for the record. • Please observe a 4-minute limit. • The topic must relate to city business. • Open Mike is for items not on the agenda. • A spokesperson must represent a group of five or more — groups will have 8 minutes. • The Presiding Officer may limit duplicative presentations. • Remember, the meeting is to discuss city business only. Public Hearing - Held as a separate item of business on the agenda. The public hearing segment is your opportunity to tell the Board how you feel about issues scheduled to be heard. Typically, a hearing follows these steps: • The Presiding Officer (Chair or Vice -Chair) will announce the proposal to be reviewed and ask for the staff report. The presiding Officer shall maintain strict order and etiquette at all meetings. • Staff will present their report on the proposal. • Board members will then ask City Staff questions about the proposal. • The Presiding Officer will then open up the public hearing for anyone present who wishes to comment on the proposal. This is the time for the public to make comments or ask questions about the proposal. Comments should be limited to four (4) minutes unless further time is granted by the Presiding Officer. All comments should be directed to the Board as a body and not to any individual Board Member or City Staff Member unless permission is granted by the Presiding Officer. No person shall be permitted to enter into any discussion, either directly or through a member of the Board without the permission of the Presiding Officer. • After everyone in the audience wishing to speak has given his/her comments, the Presiding Officer shall close the public hearing. • The Board will then discuss the proposal. No further public comments are allowed. • The Board will then make a recommendation(s) and/or a decision. When you are called upon for your comments, please step to the microphone at the podium and state your name and address for the record. Occasionally, the Board may continue a hearing to another meeting before taking action. Meeting Etiquette The Planning & Zoning Board must preserve order and decorum while the meeting is in session. A resident shall not, by conversation or otherwise, delay or interrupt the proceedings or the business of the Board, nor disturb any resident or Board Member while speaking or refuse to obey the orders of the Board. Mr. Hyden made a MOTION to close Open Mike at 6:33 p.m. Motion was supported by Mr. Laden. Motion carried 5 - 0. 5. ACTION ITEMS DRAFT MINUTES Planning & Zoning Board October 8, 2014 Page 2 A. PUBLIC HEARING to consider rezoning property from GB, General Business to R-4, High Density Residential, Preliminary Plat, Site Plan Review, and a 39-unit assisted livinLy facility uronosed at 43-0018. The facility is referred to as White Pine Senior Living. Katie Larsen, City Planner, presented the staff report. Board discussion included: - Staff should consider allowing for this type of use in additional commercial zones. - Park dedication fees. - Anticipated completion date is approximately eight months. - Proposed trails along Lake Drive and 77th. - Consider a turn lane on Lake Drive at 77th Street to increase safety. - Lighting plans for the facility will be submitted. - Consider signage for a "no turn on red" onto Lake Drive light at Marketplace Drive. - Consider striping a crosswalk area. Developer, Jamey Bowe, River Valley Architects, 1403 122nd Street, Chippewa Falls, WI, stated that they are excited to be here in Lino Lakes. Their facility will encourage residents to get out in the community as much as possible when family members visit. Most residents will be memory care patients and will stay in the residence. It Staff noted that existing sidewalks are present to connect this site with neighboring business. Chair Traille opened the Public Hearing at 7:07 p.m. David Dahlgren, 12383 Pierce St, Blaine, MN stated that he owns the auto repair facility located across the street from the proposed project. He was concerned how residents would be affected from the noise, traffic, and parked vehicles at his facility. He asked if there would be any corrections to the existing drainage problems onto his property. Staff noted that the city did some work in the past to alleviate drainage issues, but pointed out that the site is lower than the street. Mr. Grochala stated that this could be a larger surface water management project issue. Mr. Hyden made a MOTION to close the Public Hearing at 7:15 p.m. Motion was supported by Mr. Evenson. Motion carried 5-0. (Tralle abstained.) Mr. Hyden made a MOTION to recommend approval of the Rezone, Preliminary Plat, Site Plan Review and CUP for White Pine Senior Living based on the following conditions of approval, which includes the addition of condition 16.a.i. as suggested by the Board: DRAFT MINUTES Planning & Zoning Board October 8, 2014 Page 3 1. All comments from the City Engineer letter dated October 1, 2014 shall be addressed. 2. All comments from the Environmental Coordinator dated September 29, 2014 shall be addressed. 3. All comments from the Anoka County Highway Department letter dated September 12, 2014 shall be addressed. 4. All comments highlight "red" on the Site Plan Worksheet shall be addressed. 5. A separate Sign Permit shall be submitted to the City for review and approval. 6. A Tree Preservation Plan sheet shall be submitted on a separate plan sheet in compliance with City ordinance. 7. Sheet A2: a. Elevations shall be to scale. b. Types of exterior materials shall be included on plan sheet. c. Percentage of exterior material per elevation shall be included on plan sheet. d. Developer must verify the existence of well or record that it was abandoned and properly sealed. 12. Sheet C2-Site Plan: a. A photometric plan including proposed lighting and fixture details shall be submitted to the City for review and approval. b. Calculations for required number of parking stalls shall be included on plan sheet. Use calculations provided on Site Plan Review Worksheet. c. All outdoor or rooftop mechanical equipment (in addition to noted air conditioning units) shall be noted on the plan sheet. d. Driveways and aisles shall be 5 feet from property line. Aisle on south side is only 4 feet from property line. Plan shall be revised. 13. Sheet C3-Grading Plan: a. The impervious/pervious data under Stormwater Summary does not match the data noted in the Drainage Report. Please revise. b. The Normal Water Level and High Water Level of the stormwater pond shall be noted. 14. Sheet C5-Erosion Control Plan: a. The location of the silt fence shall be clearly marked on the plan sheet. 15. Sheet C6-Landscape Plan: a. Revisions as noted in the Site Plan Worksheet shall be made. b. Details of air conditioning units (height, width) shall be provided. c. Air conditioning unit shall be completely screened with landscaping. d. All other mechanical equipment (ground or roof mounted) shall be completely screened. All revised plan sheets shall reflect additional 5 feet. c. "Comprehensive Plan Land Use = Mixed Use" shall be added to plat. d. Building footprint shall be "flipped" to reflect proposed facility. e. PUBLIC HEARING to consider Comprehensive Plan Amendments to Chanter 3: Land Use Plan and Chapter 7: Sanitary Sewer Plan of the City's Comprehensive Plan related to the redistricting of sanitary sewer services and an amendment to the Future Land Use Map to guide PIN 26-31-22-31-0004, 26- 31-22-31-0003 and a portion of 26-31-22-33-0002 from Park/Open Space to Civic/Institutional land use. Kelsey Johnson, Municipal Planner from WSB & Associates, Inc., presented the staff report. Board discussion included: - This site is still being considered for development of a future recreation complex. The corner of this site is well -suited for the location of a fire station. The south 40 acres would still be available for park development. - The existing fire station on Lake Drive will remain to serve the northern part of the city. Chair Tralle opened the Public Hearing at 7:23 p.m. There was no one present to speak for the Public Hearing. (Tralle abstained.) Mr. Laden made a MOTION to recommend approval of the Comprehensive Plan Amendments as described in the staff report, based on the following conditions of approval: 1. The adoption of the amendments to the City's Comprehensive Plan is subject to review and approval by the Metropolitan Council. Motion was supported by Mr. Hyden. Motion carried 5 - 0. (Mr. Tralle abstained.) C. Concept Plan Review for Watermark Development Katie Larsen, City Planner, presented the staff report. Staff explained that this is an opportunity for the board members to make comment on the concept plan prior to the developer's submittal of an application for development. Board discussion included: - A mixed use area should include some commercial development. - Staff noted the abundance of commercial zoned land at the 35E/Main St. quadrant available for commercial/retail. - Consider turn lanes on 20th Avenue. Staff noted that a street light will also be considered. - Ensure adequate parking space for the public park. - A utility phasing plan will allow for development in other areas of the city. - City should get the best product for the city rather than the quickest development. - Consider allowing an outlot area to be used for future commercial development. Rick Packer, Developer, Mattamy Homes, 7201 Washington Ave S, Edina, MN, was available to address the concerns and questions of city staff, council and boards. Mr. Packer provided some background information about Mattamy Homes, explaining that it is a privately held company with one owner and, although relatively new, (founded in 2007) is now the 4th largest builder in Minnesota. They expect the Watermark development to take 10 years to complete and in general they do not like to plan projects that will take longer. They prefer to develop large multi -use projects with a variety of lot sizes in order to appeal to a wider market to meet that 10 year limit. Consumer housing demand is currently focused on narrower and longer lots and Mattamy is marketing towards that with a maximum lot width of 75 ft. Mr. Packer encouraged the board to look at other Mattamy developments in Blaine, Minnetonka, and Maple Grove to see what the end result would look like and to view the lot sizes. Mr. Packer addressed the stormwater management challenges associated with this project and affirmed Mattamy's commitment to work with the City and with Rice Creek Watershed District to meet all requirements. DRAFT MINUTES Planning & Zoning Board October 8, 2014 Page 6 Mr. Packer commented on the potential for a commercial component within the development. Mattamy consulted several local realtors and was informed that this location would have poor commercial development potential in comparison to the other adjacent properties. Overall, commercial market analysis dictates that inclusion of a commercial component is not feasible. Their current plan includes townhomes in the area that had been designated commercial under the previous developer. Mattamy believes that townhomes will be a better fit for this community and that the demand for townhomes is high. The townhomes will be priced between $180,0004240,000 and in the Blaine development Mattamy sells an average of 4 per month. Mr. Packer indicated that the phasing plan will start from the center of the development and work outwards, so if there was a commercial component it would be during a later phase of the development. Staff requested feedback from board on varying lot widths. The board did not have any objections to the lot sizes and approved of the variety. D. PUBLIC HEARING to consider Amending the City's Zoning Ordinance by re - codifying consistent with the Lino Lakes City Code. No substantive changes to the ordinance will be made. Celeste McDermott, Community Development Intern, presented the staff report. Chair Tralle opened the Public Hearing at 8:55 p.m. There was no one present to speak for the Public Hearing. This is the proposed location of White Pine Senior Living, a 39-unit assisted -living facility. The following staff report is based on the revised plan set dated October 14, 2014 prepared by River Valley Architects and CEI Engineering Associates, Inc. and received by the City on October 15, 2014. In November 2014, the City Council approved the following: • Ordinance No. 11-14 Rezoning Certain Real Property from GB, General Business to R-4, High Density Residential District • Resolution No. 14-132 Approving Preliminary Plat, Lino Lakes Development • Resolution No. 14-133 Approving Conditional Use Permit for an Assisted -Living Facility Staff has reviewed and approved a Site Plan Review for White Pine Senior Living. ANALYSIS Subdivision Ordinance Conformity with the Comprehensive Plan and Zoning Code The final plat has been reviewed for compliance with the comprehensive plan, zoning and subdivision ordinance. The subdivision is not considered premature, is consistent with the comprehensive plan for mixed -use development and meets the performance standards of the subdivision and zoning ordinance. The final plat is also consistent with the preliminary plat. Blocks and Lots The project requires the platting of two (2) existing parcels and dedication of right -of way along 77th Street and Lake Drive (CSAH 23). The final plat creates Lot 1, Block 1, Lino Lakes Development. Parcel Square Feet Acres Lot 1, Block 1 82,914 1.90 Right of Way 21,797 0.50 TOTAL 104,711 2.40 Streets and Alleys CSAH 23 is an "A" minor arterial reliever road. 77th Street and Market Place Drive are local roads. The main entrance to the site is at CSAH 23 and Market Place Drive which is a signalized intersection capable of handling additional traffic to the site. A secondary driveway access is provided off of 77th Street; however, the right in -right only onto 77th Street from CSAH 23 will limit traffic use on 77th Street. The existing road system is capable of handling traffic generated from the development. The City and Anoka County are analyzing the need for a turn lane on Lake Drive at 77th Street. Easements A drainage and utility easement of 10 feet and 25 feet wide are provided along the interior perimeter of the lot. Storm Water Management and Erosion and Sediment Control Storm water quality requirements will be achieved using a surface pond providing infiltration. The "A" soils are conducive to this type of stormwater management. This pond will infiltrate the required water quality volume (2.5 inches of rainfall over the drainage area) and route storms exceeding this runoff volume through a control structure in the pond. A control elevation will be established at the quality volume for discharges above this amount of runoff. For informative purposes the 1-year storm precipitation amount is less than the required quality runoff, thus no discharge from the pond is anticipated from this storm event. Utilities Utilities will connect to existing mains; water along Highway 23, sewer to the main on 77t' Street, and stormwater to an existing catch basin on Highway 23. Electric and telephone will connect on an existing pole on 77th Street and gas will connect to an existing main running just south of the property. The parking lot will be graded so as to drain to a series of catch basins. The roof runoff will be collected and conveyed underground to the proposed stormwater pond on the west side of the property. Public Land Dedication The City will require cash in lieu of land dedication. The assisted -living facility will be considered commercial for the purpose of calculation park dedication fees. Park Dedication FeeE;$4r,133 !1.9!0acres x $2,175 per acre = Tree Preservation The preliminary plat identifies 18 trees on site. The demolition plan indicates the removal of approximately 4 trees and undergrowth shrubs within the non -ESA Basic Use Area. No tree mitigation is required. Landscaping A Landscaping Plan has been submitted and reviewed. Details and required revisions can be found in the Site Plan Worksheet. Comprehensive Plan The proposed final plat for the construction of an assisted -living facility is in compliance with the Comprehensive Plan in terms of Resource Management System, Land Use Plan, Housing Plan, and Transportation Plan. Wetlands There are no wetlands on the parcel. Floodplain There is no floodplain on the parcel. Development Contract A Development Contract shall be drafted by the City, executed by the City and the developer and recorded by the developer. Stormwater Maintenance Agreement The White Pine Senior Living project includes the construction of a stormwater pond to convey surface water and provide water treatment prior to entering public waters. A stormwater maintenance agreement shall be required. RECOMMENDATION Staff recommends approval of the Lino Lakes Development final plat subject to the following conditions: 1. All comments from the City Engineer letter dated November 5, 2014 shall be addressed. 2. All comments from the Environmental Coordinator letter dated November 5, 2014 shall be addressed. 3. The following executed documents are required to be approved by the City Council prior to issuance of a Grading Permit: a. Development Contract. 4. The following items shall be submitted to the City prior to issuance of a Grading Permit: a. Revised plans based on staff comments. b. Storm Water Facilities Maintenance Agreement. c. NPDES Permit. d. RCWD Permit. e. Securities and Escrows as detailed in the Development Contract. f. Grading Permit Fee of $150. 2 5. The following items shall be submitted to the City prior to issuance of a Building Permit: a. Revised plans based on staff comments. b. An electronic PDF of the final approved plans. c. Building Permit application and fee as determined by the Building Official. 6. Final Plat a. A Consent to Plat shall be required by Coulee Bank and recorded. b. Access Control along CSAH 23 shall be dedicated to Anoka County. c. The Final Plat shall be printed to scale. 7. Sheet C8, Tree Preservation Plan: a. Add note, "All trees proposed for removal are located in the non -ESA Basic Use Area. No tree mitigation required." 8. Site Plan Comments: After reviewing the above documents against the City of Lino Lakes site design standards, we have the following comments: 1. Concrete Sidewalk: The connection point to the existing sidewalk at Market Place Drive needs to be revised to include a 4 foot boulevard from back of curb and a 6 foot concrete sidewalk per GEN-10 plate of the City Standard Details (attached). Transition to proposed concrete sidewalk on site location and width to occur on subject property. Include GEN-10 Standard detail plate to Sheet C9 of the plan set. Add pedestrian crosswalk block markings from sidewalk connection point south across Market Place Drive. Drainage Report: ■ Update the proposed conditions area summary, the totals do not add up on page 2 ■ Update the water quality volume calculation with the correct proposed impervious area on page 3 Grading and Erosion Control Plan ■ Impervious area totals shown on plan do not match HydroCAD model results or the Drainage Report 4. Administrative: ■ The applicant must provide an operation and maintenance agreement for stormwater facilities. This agreement must be recorded against the parcel so that it transfers with future sales of the parcel. This may be included as a part of the Developer's agreement with the City. ■ The applicant must receive permits from other agencies prior to construction. Permits needed may include the MPCA's NPDES Construction Stormwater Permit and RCWD's Stormwater Management and Erosion Control permits. This concludes our plan review comments at this time. New landscaping in the pond area on the Lake Drive side of the property should be pulled in a bit to accommodate possible future road alterations, and impacts that may occur in a drainage/utility easement area. 2. There should be some dialogue with Lino Lakes Environmental concerning recycling in the facility and provision of a recycling dumpster outside for pickup. 3. The proposed screening for air -conditioner units will work in the summer but not be as effective in the winter. Evergreen landscape materials will provide screening during all seasons. 4. In the "Tree Protection Notes" on page C8, the script is calling for 6 inches of woodchip mulch in areas not protected by barriers.
