Otter Lake Road ROW transfer

CITY OF LINO LAKES
RESOLUTION NO. 04 -150
AUTHORIZING TRANSFER OF CITY STREET RIGHT -OF -WAY TO
ANOKA COUNTY (OTTER LAKE ROAD) AND ACCEPTING RIGHT -OF -WAY
FROM ANOKA COUNTY (OTTER LAKE SERVICE ROAD)
WHEREAS, the City of Lino Lakes and Anoka County entered into a Joint Powers
Agreement executed by the City on July 7, 1998; and
WHEREAS, the parties to the agreement mutually agreed that Otter Lake Road should
continue to be on the County System; and
WHEREAS, the parties to the agreement mutually agreed that after construction of the
realigned Otter Lake Road it will be mutually desirable to turn over the existing Otter
Lake Road between the realignment and Main Street to the City; and
• WHEREAS, Section IX.0 of the Joint Powers Agreement stipulates that the both the
County and City agree to pass the necessary resolutions to transfer the roadways and
re- establish the County designations on the routes
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Lino Lakes,
Anoka County, Minnesota authorizes the Mayor and City Clerk to execute the deed to
transfer the realigned Otter Lake Road right -of -way to Anoka County.
BE IT FURTHER RESOLVED that the City hereby accepts the transfer of right -of -way
for the former alignment of Otter Lake Road (Otter Lake Service Road) to the City of
Lino Lakes.
Adopted by the Lino Lakes City Council this 12th day of October 2004.

Consideration of Resolution No. 04 -150
Authorizing Transfer of Otter Lake Rd ROW to
Anoka County.
ACTION REQUIRED: Simple Majority
BACKGROUND
In 1998 the City entered into a Joint Powers Agreement (JPA) with Anoka County to
construct the realigned Otter Lake Road through the Clearwater Creek Development
Center. As set forth in the JPA the City acquired the right -of -way and constructed the
project. Anoka County, in return, agreed to $678,348 in cost sharing for the project.
Additionally, under the terms of the agreement, upon completion of the project the new
alignment would be transferred to Anoka County and the old alignment (Otter Lake
Service Road) would be transferred to the city.
RECOMMENDATION
The City Attorney has drafted the necessary quitclaim deed to convey the right -of -way
to Anoka County. Since the right -of -way lies within a Charter Exempt area the City can
transfer the property by resolution.
Staff is recommending approval of Resolution No. 04 -150

The centerline of said strip is described as follows:
