HomeMy WebLinkAbout01/17/1989 Council Minutes (2)1 1 1 COUNCIL WORK SESSION JANUARY 17, 1989 Mayor Benson called the Council Work Session to order at 3:00 P.M., January 17, 1989. Council Members present: Neal, Bohjanen, Reinert, Bisel. Council Members absent: None. City Attorney, Bill Hawkins; Public Works Director, Don Volk, Engineer, Ron Stahlberg and Clerk - Treasurer, Marilyn Anderson were also present. Mayor Benson explained the purpose of the meeting is to review engineering matters for the upcoming year. MSA SYSTEM Mr. Stahlberg explained the MSA rules and regulations regarding the MSA fund balance for Lino Lakes and noted he was concerned that Lino Lakes not be penalized for not using its allotment. He noted that 4th Avenue was the last MSA project completed in Lino Lakes. He also explained that if Lino Lakes did not use a portion of their allotment, future allotments could also be reduced. Three possible MSA projects for 1989 were discussed: 1) intersection of Lake Drive and Highway #49; 2) West Shadow Lake Drive, Birch Street north to the County Park entrance; 3) Elm Street, Sunset to Lake Drive. Mr. Volk said he felt that since the first item was a County and State intersection, Lino Lakes should lobby both of them to upgrade the area and not make it a City project. Mr. Reinert said he felt it is important that the Lino Lakes citizens be informed that if the MSA funds are not used, they are lost. Mayor Benson said that it should be noted that whatever project is selected, it would be a project that would have to be completed in the near future and not just a project to use the funds. This is money from the state aid funds and the public should be educated on this subject. Upgrading Elm Street was discussed. Mr. Bisel said he felt it would be senseless to upgrade this street without putting in the utilities. Development of a frontage road along the freeway was also discussed and Mr. Stahlberg said this could be built to meet state aid standards. He explained the area east of 35E could be planned and the street built and then the area could be marketed. Mr. Stahlberg explained the map that was on the wall behind the Council table. West Bald Eagle Blvd. was discussed noting that it should be a county state aid road. Mr. Volk said the only way he knew that Anoka County would assume this street is to trade it for another County road. Mr. Reinert suggested that Lino Lakes could tell the County that if they accept West Bald Eagle Blvd., Lino Lakes would provide uncontested fire coverage in the Regional Park. There discussion regarding developing the industrial area east of 35E and north of Main Street. Mayor Benson explained 167 168 COUNCIL WORK SESSION JANUARY 17, 1989 it could be developed similar to the area of 35W and County Road C. It was noted that platting an area prior to any expected development could also be a hinderance. Mr. Reinert explained that sometimes you have to plan in advance to make the amenities available. It was noted that in a true industrial park concept, industries must fit into the scheme. Mr. Bisel explained that the Economic Development Committee (EDC) is dealing with this concept now. They do not want helter skelter development. Mr. Reinert explained what happened in Wausau, Wisconsin. Mayor Benson felt that what ever is decided for east of 35E would not be done this year. Mayor Benson asked if the extension of 7th Avenue South to 62nd Street could be considered this year. Mr. Stahlberg explained the utilities should be completed with the street and at this time there is not enough support for a gravity sewer system. Mr. Bisel referred to West Shadow Lake Drive and asked if the County will eventually be able to get access to the golf course through Aqua Lane. Mr. Stahlberg explained the problems regarding archeology studies. He also noted that permits would be needed to cross wetlands in this area. Mayor Benson referred to 34th Avenue, north of Main Street and asked if this could be pursued with Hugo and Anoka and Washington Counties. Mr. Volk explained that he had met with the Administrator of Hugo and this side of Hugo is low priority for them. Mayor Benson said development in Lino Lakes could force Hugo to change their priorities. Mr. Stahlberg explained that Tilsen Homes have submitted a potential development plan for property they own on Elm Street and utility services would be needed for this development. He also explained how utilities could be installed on the rear of the lots on the north side of Elm Street thereby eliminating the need to put utilities in the street. Mayor Benson said he felt the citizens should be asked if they want utilities first. Mr. Bisel explained how he felt utilities could be placed in Elm Street to Lake Drive and then north to service the entire area south of 35W and Lake Drive. He'explained this route could eliminate the need -to cross under 35W with utilities a second time. Mayor Benson discussed with Mr. Hawkins how the City Charter prohibits the use of general funds for improvement projects. Mr. Hawkins explained that generating enough funds to pay for the improvement is difficult especially when the City has adopted the policy of not forcing property owners along the line to hook up to the services. The Council asked Mr. Stahlberg to prepare a cost estimate of PAGE 2 1 COUNCIL WORK SESSION JANUARY 17, 1989 putting utilities under the freeway. The Council can then make a decision regarding Elm Street after this cost figure is know. Mr. Reinert asked the staff to determine how old septic systems are along Elm Street. He noted that possibly many are old and will need upgrading. He suggested that maybe the residents would rather replace them with city services. He suggested that the staff hold another neighborhood meeting on Elm Street and explain the importance of Elm Street in terms of getting utility services to other sections of Lino Lakes. Also they should know how this will impact them directly. Mr. Bisel asked Mr. Stahlberg to prepare an overall plan and cost estimate for the Elm Street area to Lake Drive and north to 35W. He said he feels the 7th Avenue extension would be his first alternative and West Shadow Lake Drive would be his second alternative. Mr. Volk said that it may help to sell the Elm Street project by delaying the bulk of the assessments until the end of the assessment period. Mayor Benson said if Elm Street is not a viable project his choice would be: 1) West Shadow Lake Drive; 2) 7th Street South; and 3) the street between Otter Lake Road and Bald Eagle Blvd. Mr. Volk noted that if West Shadow Lake Drive is not improved now there will be a need for major rebuilding in the next three to five years. Mr. Reinert said this should be pointed out to the residents. HIGHWAY #49 AND LAKE DRIVE This area was briefly discussed. It was noted that this should be addressed by Anoka County and the State. Some traffic patterns were discussed. WEST SHADOW LAKE DRIVE Mayor Benson asked that this be placed on the next Council agenda. DRAINAGE Mr. Stahlberg has prepared and given' to the Council a Comprehensive Storm Drainage Plan for a portion of Lino Lakes, Cost Estimates for Ditch Cleaning for a ditch from Birch Street north to Reshanau Lake, Cost Estimates for Ditch Cleaning for a ditch from Main Street northwest to Wood Duck Trail and northeast to the east plat line, and Cost Estimates for Ditch Cleaning fora ditch from Main Street south to 35W. He explained easements would be needed as well as permits and field surveys. There was discussion regarding asking Rice Creek Watershed District (RCWD) to participate in the ditch cleaning and /or costs. Mr. Volk said his first priority woul d be the ditch north from Birch Street to Reshanau Lake. g9 t 10 COUNCIL WORK SESSION JANUARY 17, 1989 There was discussion regarding funding the costs of these three ditch improvements. It was suggested to approach RCWD, Anoka County and the developers. It was noted that some of the landowners have already said they would pay their fair share. Mayor Benson suggested that Mr. Stahlberg prepare a map showing ditches that have been cleaned and ditches that still need to be cleaned. There was discussion regarding obtaining easements for ditches. Mr. Hawkins explained the process could take two weeks to four months. He noted that some landowners are not willing to give easements so that the City would have to negotiate a price for the easements. Mayor Benson said the City could do some arm bending on the local RCWD member. Mr. Bisel asked that these three ditch proposals be pursued with RCWD, Anoka County and the developers. Mayor Benson suggested that in the future plat approvals could include making the developer responsible for ditches beyond his property line. Mr. Stahlberg was asked to prepare a map showing what ditches were cleaned and when and what ditches need to be cleaned and when WEST CENTRAL TRUNK RIGHT -OF -WAY AND PERMIT STATUS Mr. Stahlberg pointed out property on 2nd Avenue belonging to Mr. Steve Begenisich. He noted at the public hearing it was proposed to allow this property two hookups. Now that the utility trunk route will cross the entire length of the property, several more hookups are possible. He asked Mr. Hawkins if another public hearing will have to be held because of this proposed change. Mr. Hawkins explained that the landowner could petition to waive the public hearing. He suggested Mr. Begenisich and any other landowner whose assessment is proposed to be increased be contacted and offered an opportunity to petition to waive a public hearing. There was discussion regarding the proposal that will be before the Charter Commission on Thursday. It was noted that the Council could still allow landowners to petition out of an improvement if the new proposal was adopted. Mr. Hawkins explained he had to leave this meeting for another commitment. He explained he had received a question regarding his position regarding the negotiations of the Centennial Fire District Joint Powers Agreement. He explained that he and h-is firm would not be available for any legal opinions or actions on this matter since he represents both Lino Lakes and Centerville. He suggested that Lino Lakes use David Kennedy if needed. , Section 18 - 19 Overall Plan - Mr. Stahlberg explained the PAGE 4 1 1 1 COUNCIL WORK SESSION JANUARY 17, 1989 plan is part of his presentation tonight and it is ready for Council action. Permanent Records - Mr. Stahlberg said he is working toward preparing permanent drainage records for Lino Lakes. Hopefully this will be complete within a few years. Financing - Mr. Schumacher will address this item at a later date. WEST CENTRAL TRUNK RIGHT -OF -WAY Mr. Stahlberg explained the trunk right -of -way is established until it reaches just north of 35W. He discussed the Tilsen preliminary plat for north of the freeway noting that there will be no access to the plat from the Tilsen property to the industrial area on the east side of the plat. The only access to this property is to go south on Jon Street or go east from Sunset Avenue. Menkveld's Sunrise Meadows - Mr. Stahlberg explained the original route of the utilities through the Sunset Meadows plat. A route on the west side of the plat has been designed to conform to the re- alignment of the trunk utilities approved by the Council. This new route will require some variances on some of Mr. Menkveld's lots. Mr. Volk said he wanted to be sure there is a written agreement allowing the City to go on the easements to maintain the trunk lines. Mr. Stahlberg explained this is a disadvantage of placing trunk utilities on easements rather than in the street. EAST ASH STREET Mr. Stahlberg updated the Council on this matter. He noted there is no support from White Bear Lake or Ramsey County. Mrs. Anderson explained that some of the new homes are closing and are requesting dollar amounts for assessments. This is not available and is making some people angry. It was explained that it would be prohibitive for Lino Lakes to build the road on Lino Lakes property only. Mr. Volk felt it would be nice to build the street and not allow access from Ramsey County. There was discussion regarding moving the road and discussing this with the Ramsey County residents on the south side of East Ash Street. Mayor Benson asked that this be pursued. CORRECTIONAL FACILITY FEASIBILITY STUDY This report was included for Council information only. Mr. Stahlberg expects the Correctional Facility to get back to him on this matter. He was concerned about the legislature appropriating funds for this improvement when the funds are needed. PAGE 5 1:72 COUNCIL WORK SESSION JANUARY 17, 1989 COMPREHENSIVE PLAN AMENDMENTS Mr. Miller has submitted a memorandum on this matter. He is recommending that the Comprehensive Plan be revised and a public hearing scheduled. SERVICE AREA ONE TRUNK SEWER CONSTRUCTION SCHEDULE - (MONTAIN PROPERTY) Mr. Stahlberg explained the Montain property is on the market again. He has been getting telephone calls asking when utilities will be available for this property. He noted problems with the force main and the need for the gravity main. He also explained that Metro Waste Control should be contacted regarding upgrading the lift station at Laurene Avenue. MIDWEST- CIRCLE PINES GAS EXTENSIONS Mr. Stahlberg explained that both gas utilities are trying to go into the same area and he felt it is time for Lino Lakes to find a way to say we want to be part of the decision as to where utility lines will go. Mr. Stahlberg explained that White Bear Township has a project in the mill to install sewer and water utilities north on West Bald Eagle Blvd. to the Lino Lakes border.
