HomeMy WebLinkAbout07/08/1974 Council MinutesJuly 8, 1974 The regular meeting of the Lino Lakes Council was called to order on July 8, 1974 at 8:00 p.m. by Mayor Bohjanen. Councilmen present; Jaworski, Zelinka, Marier and McLean. Mr. Locher and Mr. Gotwald were also present. Mr. Marier moved to approve the minutes of June 24, 1974 as written. Seconded by Mr. Jaworski. Motion carried. With the absence of the City Clerk, Mayor Bohjanen gave the Clerks report. There was a letter from the Metropolitan Council about the Public meeting by the Environmental and Transportation Committee, July 16, 1974 at 7:30 p.m. (All Council- men have copies of this letter.) Another letter from the Metropolitan Council in regards to the Development Framework section of the Metropolitan Development Guide. The meetings setup will enable members of the Metropolitan Council to discuss implementation issues with local leaders and citizens. The scheduled meeting for our area will be July 11, 1974, 7:30 p.m. at Blaine City Hall. Mayor Bohjanen said there has been several inquires on the Natural Gas Rates for the pump house, Maple St. and Country Lakes. Mr. Zelinka stated that he had talked to Dave Collins and that we would be billed at Natural Gas rates at the pump house for the time being. It would not be offical because it is not a standard procedure with other Cities. Mr. Zelinka reported that the gas lines were approved for Maple St. and Country Lakes. They will contact the Clerk on the construction of the lines to be put in. Mr. Marier suggested that this letter on construction be forwarded to the City from North Central Gas Company. Reported, $11,459.25 collected monies sent to the Metropolitan Sewer Board (S.A.C. Fund) . Reported that Senator John Milton will have a Citizen night meeting with the residants of Lino Lakes, July 22, 1974 at 7:15 p.m. Read a letter from Harvey L. Meredith in regards to a nuisance - namely discharge of firearms. Mr. Marier suggested that the Police implement enforcement of the present Ordinance. Read a letter from the Fuel Allocation program. It will now be under the Energy Agency. Our Fuel Coordinator will be given this information with the new address and phone numbers. Mayor Bohjanen stated that our Fuel Coordinator is making a list of fuel storage resources now. He should have his report ready in 60 days or sooner. Copies were sent of the Minnesota Open Meeting Laws to the County Attorneys. Read the agreement between Emil Jandric sf U.S. Lakes Development and the City of Lino Lakes covering the maintenance work on West Shadow Lake Drive. 1 1 1 July 8, 1974 After discussion it was agreed to include this paragraph in the contact. "Maintenance" shall only be deemed to be such work which is authorized by a prior written work order signed in behalf of the parties hereto, but shall not include snowplowing, it being agreed that the City has and shall continue to provide snowplowing at no cost to U.S. Lakes nor shall such snowplowing be deemed, in anyway to be acceptance of such private roadway by the City as a City Street, Cartway or otherwise. Mr. Zelinka moved to accept the agreement to include maintance for a work order and zero dollars for snowplowing. Seconded by Mr. Bohjanen. Motion carried. With Mr. Marier voting, No. The Agreement and Contract for Law Enforcement with Centerville was discussed. Mr. Jaworski stated that we should get the contract in force so that we can legally get paid and then if there are any changes after this in our Law Enforcement Depart- ment we will be able to negotiate the changes. Mr. Zelinka agreed. There was discussion on the per capita rate. It was the general consensus that cost per capita has gone up. Mr. Marier moved to accept this contract at the present rate and inform Centerville that termaination of the contract will be August 1, 1974. At which time cost per capita will be refigured. Seconded by Mr. Zelinka. Motion carried. Reported that there are 3 signs in violation of our Ordinance No. 51. They are Allan Robinson, William Hemauer, The Francis Drake Hotel. Mr. Locher read the Ordinance Sec. Z and suggested to send letters to sign owners and the property owners. Then if there is no comply remove the signs, Mr. Marier moved to take action to remove these signs. Seconded by Mr. McLean. Motion carried. There was an application from Northwestern Bell Telephone Company to place buried telephone cable in Rondeau Lake Drive west from Main Street north to Columbus Township line. Mr. Gotwald stated that to his knowledge the application was in order. Mr. Jaworski presented the cost of $150,000.00 for roads that were primed and sealed in 1973. An additional $82,000.00 for patching, sealing and resurfacing of 4th Ave., Hanson Rd., 24th Ave. North and Ware Rd. It is approximately 3 times the cost of seal coat. Mr. Gotwald suggested to Rd. Mix the streets that we feel need it. Then seal some of the roads that were road mixed last year. The cost for the entire program would be $115,000.00 He also suggested to take the first mile and keep a very detailed record of all material and cost. After that you will know what the actual cost for the first square yard basis or mile basis. Based on that you can tell exactly how much could be done this year. Mr. Marier so moved. Seconded by Mr. McLean. Motion carried. Mr. Marier reported that he went to a meeting at the Metropolitan Council for the Immediate Action Grant Program for Regional Parks. Anderson Lake in Bloomington, they purchased 62 acres for $1,450,000.00. Anderson Lake in Eden Prairie, 84 acres for $1,239,000.00. For Lino Lakes purchasing for immediate action 2,295 acres for $1,798,075.00. Lake Elmo 1515 acres. At this meeting 32 million dollars for land acquisition was spent in one night, with 20 people there. July 8, 1974 It was also brought out that the Metropolitan Council would like to purchase another 400 acres in addition to our agreement with Anoka County. Mr. Marier asked the Council if they had seen our Resolution with Anoka County. They said, they thought they had seen it. Mr. McLean gave the Council another copy of the resolution. Mr. McLean said that Mr. Jacobson brought up the intrest of Ramsey County for the N. Otter Lake area. He said that they would hold back because of the agreement between Lino Lakes and Anoka County. Mr. McLean and Mr. Marier were introduced to Mr. Bernie Edman who is head of the Ramsey County Open Space. Mr. Edman asked if he could speak with the City Council at a future date. He was told that the Council would speak to him, but he was not going to get anything. Mr. Marier said that the Metropolitan Council seems to rove only on the recommendations of the staff. He would like to encourage the Council to extend an invitation (at their convenience) to the staff people of 1) Open Space, 2) Sewer, 3) Transportation. Show these people our area and after talking to the staff people we may be able to enhance our position as far as their views are concerned in this area. There was further discussion on this topic and it was decided that Mr. Marier and Mr. McLean will contact these people. Mr. Glen Rehbein complained to the Council to turn off the M.C. Transit. They want us to pay for their buses, but they don't want to help with the sewer. He also complained on the Mosquito Control. That they are spraying fuel oil on the ponds and killing frogs and toads in the City. He suggested that some effort should be made to stop some of these M.C. Activities. He also complained that they are getting $1600 a acre at Anderson Lake which is a big swamp. And that the people in our City should not sell there land unless they can get a good price. He said that a few years ago he paid $1200 an acre for swamp Land. Anoka County is offering $100 to $500 an acre. He said that this isn't a bit fare. Anyone who is getting their land condemned at these low prices should get some help. Mr. Locher said to get behind the petitioner's is the only thing we could do. He also mentioned that we have a problem with our bonds due Nov. 1, 1974. Mr. Jandric is delinquent with taxes. Second half of 1973, First half for 1974 and two installments on special assessments. Mr. McLean reported that maintenance in the Parks is good. Also he will contact the contractor installing the fence at Lino Park and see when he is going to finish the job. If the contractor isn't able to finish the job, cut off that amount of payment for the part of the fence not completed. Then find someone else to finish the job. Mr. Zelinka reported that there was a Personnel Commission meeting and they did not have a quorm. The next meeting will be July 16, 1974. At this time they will be interviewing applicants. Mr. Gotwald had no report. Mr. Locher checked the application from Annie J. Ross for a 3.2 off sale license and found everything in order. Mr. Marier moved to approve this license. Seconded by Mr. McLean. Motion carried. 1 July 8, 1974 Mr. Locher read a report from the City Fire Marshall that Joe LaCasse Jr. is in violation of the Fire Code by having a 560 gallon gas tank above the ground. Mr. McLean moved to have the State Fire Marshall inspect this violation. Seconded by Mr. Jaworski. Motion carried. There was a request by Henry Rosengren to review the "Off Sale" ordinance amending the separate entrance. Mr. Jaworski moved to delete the separate exterior entrance and allow the doorway to be in the interior wall. Also "Off Sale" to be sold only in established area. Seconded by Mr. McLean. Motion carried. Cabaret license was tabled until the Sept. meeting. 3.2 Ordinance was tabled until the Sept. meeting. June 27, 1974 the Metropolitan Council rejected the construction of an interceptor across nearly the entire Municipality of Lino Lakes. The Metropolitan Council decided to build the Lino Lakes interceptor only as far as the southwestern corner of the City. Centerville would be served by line running west from the Forest Lake interceptor. This would mean that Lino Lakes could not use a metropolitan interceptor as a locsl line to serve the Country Lakes development and would have to pa °,r the cost of connecting the development to the interceptor. Mr. Jaworski asked if Mr. Locher and Mr. Gotwald would give a report on this meeting. Mr. Locher reported on the meeting of June 27, 1974 with the Metropolitan Council as such: Mr. Gotwald, Mr. Carley and myself were at this hearing. We were suppose to be heard at 1:30 p.m. and didn't get on until 4:20 p.m., Mr. Gellette presided at the hearing. Mr. Boland and Mr. Gramm were absent. Mr. Gillette announced that we weren't allowed to interpose any evidence because the committies that had been established has heard it all. Mr. Kegler spoke and read paragraphs 3, 4 and 5 from Mr. Burandt's recommendation. Mr. Kegler made a motion to follow the recommendations of staff. It was second. Mr. Locher read a letter from Robert Burman, dated June 27, 1974 and a letter from Ed Field recommending the passage of the Lino Lakes - Centerville inter- ceptor. Mr. Kozlak amended the motion. Seconded by Mrs. Kreber. The main motion went and was passed 10 to 2. Mr. Locher read the letter's from 1) Mr. Hoffstead, dated July 18, 1971, refering to the interceptor for Lino Lakes. 2) Mr. Honsens that there will be an interceptor. Mr. Locher said that they were not allowed to rebute anything or have any questions asked of them. Also that the Metropolitan Council won't listen to anyone but staff. Mr. Gotwald stated that Mr. Burandt had 45 minutes to speak and we were lucky to have 10 minutes. July 8, 1974 Mr. Jaworski said the City Council can't stand still on this we should take them to court. I don't think we should have to accept this. We should be able to run our own government. Mr. Locher said it would cost 4 to 8 thousand dollars to take them to court. Mr. Jaworski moved to get a court injunction to stop the Metropolitan Council from running the Centerville line from Hugo through Lino Lakes. Seconded by Mr. Bohjanen. Motion carried unanimously. Mr. Zelinka moved to instruct Mr. Locher to prepare the necessary papers for court action and to do research on what the grounds would be. Seconded by Mr. Jaworski. Motion carried. Mr. Zelinka moved for a Memorandum of Law. Seconded by Mr. Jaworski. Motion carried. Mr. Glen Rehbein asked if he could go ahead with his installation of the mains and laterals. After discussion it was considered unwise to let Mr. Rehbein install the mains and laterals because of the possibilities of 1)added lift stations. 2) if Mr. Jandric sells to another developer it could mean another 200 connections. 3) the increased cost of pumping sewage. Mr. Gotwald said that 5 years ago we could have applied for grants. But now all grants go through the Metropolitan Council. Mr,. Marier said that we should explore the possibility of some other grants for the possible extension of the interceptor without Metropolitan Council aid, and if these are available to us. This then would not make it a burden for everyone. Mr. Zelinka moved to give Mr. Glen Rehbein special permission to install 2 roads and 2 cul -de -sac's at City Code, elimate the storm sewers and laterals. And then use individual septic systems. Seconded by Mr. McLean. Motion carried. No Old Business. No New Business. Mr. Marier moved to approve requisitions #'s 451, 452, 453. Seconded by Mr. McLean. Motion carried. Mr. Marier moved to approve bills from #5839 through and including #5852. Seconded by Mr. McLean. Motion carried. Mr. Marier moved to adjourn at 11:50 p.m. Seconded by Mr. McLean. Aye.
