HomeMy WebLinkAbout09/09/1974 Council Minutes1 1 1 September 9, 1974 The regular meeting of the Lino Lakes City Council was called to order at 8:05 P.M. by Mayor Bohjanen. Councilmen present; Jaworski, McLean, Zelinka. Absent; Marier. Mr. Locher was also present. Mr. McLean moved to approve the Minutes of August 26, 1974 as written. Seconded by Mr. Jaworski. Motion carried. The Clerk reported on the following items; Letter from North Central Public Service Company announcing a rate increase for natural gas from that company. The increase will amount to about $8.45 per year on the average residential billing. Mr. Jaworski questioned the committee that was formed to study gas rates in this area. The Clerk reported that she had no correspondence from anyone on that subject. The Council requested that she con- tact the Mayor of Coon Rapids, who was the Chairman of that committe, for information. Read a letter from the Minnesota Pollution Control Agency requesting that an enclosed questionnaire be completed by September 10, 1974. The Clerk read some of the questions and Mr. Locher supplied the answers. She is to answer the questionnaire and return it. Read a letter from the Department of Agriculture in connection with the inspec- tion of diseased trees. This will be forwarded to Mr. Ellingsen. Mr. Tichner, representative from the Ford Company was here to discuss the Ford Patrol Car. The main paints of discussion centered on the 4bbl. carburator and the seat. Chief Myhre pointed out that the specs had called for a 4bbl. carburator and the car has a 2 bbl.; the specs had indicated a heavy duty astro bench and he felt that the seat was inadequate. Mr. Tichner presented the Council with copies of the specs for the Police Special that is built by the Ford Motor Co. This includes a heavy duty frame for the seat. He felt that this is what is in the car, if not, then this would be the responsibility of the Ford Motor Co. and he was certain that if not according to thier specs, it would be replaced. Mr. McLean :asked if a -4 bbl. carburator could be installed on the motor that is in the car. Mr. Tichner said he would have to check with mechinacs, he didn't know. He also questioned the possibility that this would be in violation of Federal regulation in the area of pollution control devices. Midway Ford would like to be paid for the car. They will also take the car back charging the City 0.15 per mile as a form of rental. Mr. Locher pointed out that the maintenance, painting and installation of police equipment would be lost and the fact that this would leave the City with only one patrol car. September 9, 1974 Mr. Tichner said that since Midway Ford was open this evening he could pos- sibly contact a mechanic and get some sort of an answer on the installation of the 4 bbl. carburetor. He left to use the phone. He will also check on the cost. Mayor Morstad, Benjie Munson and Fire Chief Goertz of Lexington were here to discuss the 1975 Fire Contract. Mayor Morstad asked Mr. Munson to present the contract to the Council. Mr. Munson reported that the charges will be computed in the same manner as last year and the only change in the rates would reflect the increase in valuation. He discussed the wong/ the% the Centerville contract that allows Centerville to collect $100.00 per hour from the home owner, Lexington would like to include this wording in their;oontract. Chief Goertz said that Is any one has any complaints on the service of the Fire Department, he asked that these be forwarded to him. Mr. Clem Frazer asked about the charges to persons who do not have this fire service clause written into their insurance policy. Would all people be inform- ed of this charge and would they have to take out this insurance? Mr. Jaworski said, No, the woxc]}ding is such that this only applies to person who now have such insurance. Mayor Bohjanen thanked the representative for Lexington and told them that the Council will consider this at budget meetings that will begin this week. Mr. Prokop and Mr. Jankus had presented the Council with a petition for the installation of Lakeview Avenue; in the Otter Lake Hills Plat. The Clerk read the petition which asks for a variance to Ordinance 22, Sections 20, 22 and 23. They request that an oiled roadway of 32 foot width be installed at this time since this will serve two families and should be sufficient for the amount of traffic generated by these two homes. They request that no other building be allowed until such time as the street is brought up to City specifications. Mr. Locher read the Ordinance pertainingoto the variance request. He would recommend that if this request is granted, that building permits for Mr.Prokop and Mr. Jankus, (1 each) be issued and no other building permits be issued until the street is brought up to specs. Mr. McLean asked if this would be setting a precedent? Mr. Locher said that any time a variance is granted there is this danger. He said that if this is grant- ed it should be carefully documented. Mr. McLean asked if the other property owners can legally be stopped from build- ing on their property? Mr. Locher said that he had not completely researched this, but he had found cases from New York where the municipalities did refuse to issue building permits until the street was brought up to City specifications. 1 I 1 1 Mr. Jaworski asked if the Planning and Zoning Board petition? Mr. Locher said, Yes, this would be his recommendation. Mrs. LaBuda asked when the City would bring this street up to City specs and she was told that this is the responsibility of the property owners. Mr. Zelinka noted that if this variance is granted,the installation of the street would have to be inspected and approved by Mr. Gotwald before the City would accept for partial maintenance. Mr. Zelinka moved to table this matter until the Council has an opportunity to consult with Mr. Gotwald. This should be done be- fore the next Council meeting and Mr. Prokop should have an answer by the first meeting in October. This matter should be presented to the P &Z. Seconded by Mr. McLean. Motion carried. The Clerk is to mail a copy of these minutes to Mr. Prokop and Mr. LaBuda. Mr. Tichner returned and reported that in his tal esihe had been told that a 4 bbl. carburetor is not available for the engine in the Patrol car. He had been told that it would be necessary to go to a speciality shop that specializes in the modification of engines. It would be necessary to replace the manifold and some other parts. He will check further into this and he will also check the seat in the car. If any information is available, he will advise the Council. Mr. Jaworski moved to release the check to Midway Ford in payment for the Patrol Car. Seconded by Mr. McLean. Motion carried. Chief Myhre suggested that when bids are let for Patrol Cars he have an opportunity to check the specs before the bids are approved. The Council agreed that this should be done. Mr. Jaworski reported on the changes in the proposed full time police budget. He had done some research on the cost of repairs; 1973 -- labor and parts - $2,180.70, 1974 through August -- $1,508.63. In view of this, he would suggest that an additional $500/00 be added to that portion of the budget. It was also suggested that -an additional $2,000.00 be added for fuels bringing the total to $68,000.00. The Ordinance must be passed and published before this can be official. Mr. Jaworski asked the Clerk to read the duties of the Policewoman - Clerk- Typist. This position was discussed. 5 September 9, 1974 After more discussion, Mr. Jaworski moved to adopt the recommendations of the Police Commission including the budget of $68,000.00 for the year 1975 and have it functional by October 1, 1974. The estimated extra expenses incurred in 1974 of approximately $6,000.00 to be paid from the General fund. Seconded by Mr. McLean. Motion carried unanimously. Mr. Zelinka moved to adopt the Ordinace establishing a Full Time Police Depart- ment as presented by the Police Commission. Seconded by Mr. Jaworski. Motion carried unanimously. Mr. Jaworski moved that a letter of thanks: be sent to the Ynembera of the Police Commission excluding the Council members. Seconded by Mr. Zelinka. Motion carried. Mr. Jaworski reported that the road work is progressing. It is a little behind but should be completed in two to two and one half ;weeks. Mr. Zelinka moved to instruct the Police Department to establish specs for a new Patrol Car by November 1, 1974. Seconded by Mr. Jaworski. Motion carried. Mr. Jamorski asked if he could proceed to contact surroudning communities for th er response to either contracting full coverage from Lino Lakes or the possibility of an area wide Police Dept. The Council suggested that he set up meetings along this line. Mr. McLean reported that he had spent some time with Mr. Johnson and he has made good progress in the park department. Mr. Johnson knows what needs to be com- pleted before bad weather such as getting the hockey rinks graded, some shelter for the Hall property and scheduling work to be completed. Mr. Jaworski asked if it wouldn't cost less to construct a shelter for the Hall property and put it on skids. Also, the possibility of renting a satellite for this location. Mr. McLean said some of these things will be taken care of at the budget meetings. Mr. McLean recommended that the Planning and Zoning Board take a look at the stipulations in the Apitz rezoning and see if the requirements have been met. Mr. Jaworski suggested that a file be set up on each rezoning or special use per- mit with the time limit noted and that these be checked for compliance to stiuplations in the granted use. Mr. Zelinka reported that the applicants recommended by the Personnel Commission had been interviewed on an informal basis - or a least two out of three. The Third man had decided that he wasn't interested. In the area of qualifications, it was found that only one had the necessary licenses to qualify. The Council- men discovered that it takes three years work in the field of sewers in order to qualify for a sewer license. After all things were considered, Mr. Zelinka moved to hire Mr. Donald Volk as Superintendent of Public Works at a salary of $860.00 per month until such time as he becomes department head and then the salary would be renegotiated. Seconded by Mr. McLean. Motion carried unanimously. 1 1 1 1 1 September 9, 1974 Mr. Volk was in the audience and was asked when he could start. He said he would turn in his resignation on the 10th of September. Mr. Zelinka moved that Mr. Volk start on September 30, 1974. Seconded by Mr. Jaworski. Motion carried. Mr. Jaworski moved to advertise for a Deputy -Clerk in the local papers. Seconded by Mr. McLean. Motion carried. Mr. Locher discussed the requirements for mailing in rezoning requests and suggested that the State Statutes be followed. Mr. McLean moved that this be given to the Planning and Zoning Board for study. Seconded by Mr. Jaworski. Motion carried. The Cabaret License Ordinance was discussed, with Mr. Locher recommending that the new one simply replace the existing license. Mr. Bohjanen was concerned that the fee not raise too drastically. The Council felt that more time was needed to study this. Mr. Jaworski moved to table this until the September 23, 1974 meeting. Seconded by Mr. McLean. Motion carried. Under Old Business, Mr. Jaworski asked what sort of a contract the City has with the Metro Sewer Board and was told that at the present time the City is operating under the 1973 Contract. Mr. Jaworski suggested that a new one be worked out as soon as possible with the Metro Sewer Board assuming the full cost of hauling the sewage. Mayor Bohjanen said he would contact Mr. Ray Payne on this matter. The Mayor asked the Clerk to pull last year's contract and leave a copy in his box. Under New Business, Mayor Bohjanen reminded the Council of the budget scheduled for Thursday, September 12, 1974. A Letter from the Ramsey County Board of Commissioners passing a resolution with- drawing their support of the Battle Creek Water Shed District providing a joint powers agreement can be worked out. Mr. Zelinka asked if the Clerk had received any information from the Building Inspector or the Police Department on the location of unfinished buildings in the City. She said she had not. Mr. Zelinka requested that these men be contacted. Mr. Jaworski moved to approve requisitions #464 through,and including (#2540. Seconded by Mr. Zelinka. Motion carried.
