HomeMy WebLinkAbout10/14/1975 Council MinutesOCTOBER 14, 1975 The regular meeting of the Lino Lakes City Council was called to order on October 14, 1975 at 8:00 P.M. by Mayor Bohjanen. Council Members present: Mr. Jaworski, Mr. McLean, Mr. Zelinka. Absent: Mr. Marier. Mr. Locher and Mr. Gotwald were also present. Mr. McLean moved to approve the minutes of the Special Meeting held on September 9, 1975. Seconded by Mr. Zelinka. Motion carried. Mr. Zelinka moved to approve the minutes of September 22, 1975 with the following correction: Page 5, paragraph 10, last line: delete the word "her" and add: "Mrs. Soukop's position." Seconded by Mr. McLean. Motion carried. The Clerk read a letter from the Minnesota Highway Department setting the speed limit on Birch Street from Highway 49 to Centerville Road at 50 MPH and from Centerville Road to 20th Avenue at 55 MPH. He also stated that the City's request concerning the service road East of 135 E will be sent to the State Highway Department for study. The Clerk was instructed to write to Mr. Paul Ruud stating that the road is not capable of carrying traffic at that speed. The design of the road makes this rate of speed unsafe. They would also like Mr. Ruud to know that the Council feels that the repair work done on Birch Street is atrocious and a waste of money. The condition of the street now makes the control of a car almost impossible. The condition of County Road No. 14 is about the same. She was instructed to send a copy of this letter to Mr. Burman and ask that he drive out and inspect these streets. Read a letter from the State Board of Assessors announcing a Property Valuation Short Course and Continuing Education Workshop for Certified Assessor's. The letter states also that in order for an Assessor to retain their certification a certain number of Continuing Education Units (CEU) will be necessary. The number necessary to retain the certification will be discussed at these classes. Mr. Kelling had requested permission to attend the one at St. Joseph on October 28, 29 & 30, 1975. The Clerk requested permission to attend the same course. After some discussion, Mr. Jaworski moved to grant Mr. Kelling permission to attend the courses to be offered on November 7, 12 & 13, 1975 to be held in Chaska. Seconded by Mr. McLean. Motion carried. Mr. Zelinka questioned the Clerk as to how many of the CEU's are necessary to retain certification. She said she didn't know, this has just been start- ed and will be discussed the first day of the course. She said she would like to attend one of the sessions in order to retain her certification and would pay her own transportation charges. After consideration, Mr. Zelinka moved that the Clerk be allowed to attend the course at Chaska, the only cost to the City to be Mrs. Sarner's wages for the three day period she is gone. Seconded by Mr. McLean. Motion carried with Mr. Jaworski voting, No. Read a letter from Rep. Oberstar in connection with the approval of the interceptor. In connection with this, Mr. George Gotwald said that his firm had been told that the funds for this interceptor are not in the 1976 budget but will be in the 1977 budget. This information had come from Mr. Ray Payne 11 2 . 8 OCTOBER 14, 1975 during an informal meeting. Mr. Gotwaid reported that the Metropolitan Waste Control Commission had requested the plans for Shenandoah from his firm. Mr. Gotwald suggested a letter to the Metropolitan Council asking the status of the budget for the interceptor and what effect this will have on the construction schedule. Mrs. DeVries said that she had spoken to Mrs. Opal Peterson recently and had been assured Shenandoah is to be taken care of this Fall and there should be a holding tank in before Christmas. The Clerk was instructed to write the letter suggested by Mr. Gotwald and with his assistance. This letter to be sent to the Metropolitan Council, Metropolitan Waste Control Commission, Mrs. Peterson, Mr. Rehbein and Rep. Oberstar. A gentleman from the audience asked what if Mr. Rehbein refuses to install the internal system? Can the City let contracts? Mr. Locher said, Yes, this can be done under Chapter 429 of the State Statutes. The City can do this by the letting of bids and the selling of bonds to finance and assessing all abutting and benefitting properties. if 100% of the property owners petition for the system, then the public hearings are waived. Mr. Zelinka moved to have the Clerk write the above letter with the Engineer to fix the terms in which these letters are written. Seconded by Mr. McLean Motion carried. Also that the City expects an answer within a few days. The Clerk had received a request from the Lino Parents Club for a Bingo Permit for November 14, 1975. Mr. Jaworski so moved. Seconded by Mr. Zelinka. Motion carried. The Lino Recreation Association had requested permission to use the Hall for an open meeting on October 29, 1975 at 8:00 P.M. Mr. Zelinka so moved. Seconded by Mr. Jaworski. Motion carried. Mayor Bohjanen asked the Clerk to read a letter of resignation from Mrs. Sylvia Brisson of the Park, Recreational and Environmental Commission. The resignation was accepted with regrets and the Clerk was asked to write a letter and commend Mrs. Brisson for her participation on that Commission. This letter should be ready for signatures at the Thursday Budget Meeting. Mayor Bohjanen reminded the Council members of the Budget Meeting schedule for Thursday, October 16, 1975 at 8:00 P.M. Mayor Bohjanen reported that he had received a letter from Senator Milton stating that he will be unable to attend the November 10th meeting as planned. 1 1 1 OCTOBER 14, 1975 Election Judges for the coming election must be approved at this meeting. The Clerk read a list of names which included the following people: Margaret Hensel, Vi Schwankl, Norma Nadeau, Signe Miller, Suzette Houle, Peter Scherer, Betty Livin -ston, Donna Singleton,Dorthea Dougherty, Dorothy Kincade, Erma Grygelko, Eileen Rolstad, Harriet Hill, and Beverly Clausen. The number needed will be three from each party for each shift. Mr. Jaworski moved to approve the list. Seconded by Mr. Zelinka. Motion carried. Mr. Zelinka suggested to the Clerk if any problems arise with the DFL list, she should contact Mrs. Juleen. Mayor Bohjanen asked Mr. Locher if he was correct in stating that absentee ballots could be picked up at the City Hall? Mr. Locher said, Yes. Mayor Bohjanen asked when the ballots would be ready? Mr. Locher said that he had proof -read them today and that they should be ready by Friday. He said the ballots could be picked up at the Hall and either left with the Clerk for delivery on Election Day or they could be mailed and the post man would deliver them on Election Day. Mr. Jaworski reported on the road work. Due to the cost the planned Seal coating on Ware Road would have to be dropped for this year. Mr. Jaworski felt that the surface of that road was in good condition and could wait another year. Work on 64th Street and Rolling Hills Drive should begin next week. So far $30,230.00 of the allocated $38,000.00 has been spent. Mr. Zelinka asked Mr. Gotwald if he felt that Ware Road could be held for another year? Mr. Gotwald said, Yes and the possibility of sewer installation in that area could cause some damage to the street. Mr. McLean reported that the Park Board had a Special Meeting on September 29, 1975 that dealt basically with the budget. There is another meeting scheduled for October 20, 1975 and they will finish at that time. Mr. McLean reported on the note from Mr. Volk dealing with the wells. All Council Members have a copy of this report, does the submission answer their questions? Mr. Jaworski asked if a larger pump would work since there is 25' of static water in the well? Mr. McLean said that had been tried at the Hall well and had only pumped the well dry. Mr. Zelinka suggested driving the wells deeper. Mc. McLean said this had not been recommended because of the possible damage to the casings. Mr. Zelinka asked Mr. Gotwald his opinion and Mr. Gotwald agreed. Mr. Gotwald said one factor was missing from this report. Mr. Volk should have included the draw down water level. Mr. Zelinka suggested pulling the present wells and driving them deeper. The fact that these two wells serve an area adequately at the present and are only deficient in flooding hockey rinks, it was suggested that the present wells remain and the new wells be located in a different area. Mr. Gotwald cautioned the consideration of well at the Hall Property should be in relation to the plans for the park property. Mr. Zelinka moved to ask for bids for two wells complete (this is to include the pump, 10" screen, electric hook -up, all casings, tanks, etc.) Mr. McLean asked that Mr. Gotwald provide the specs and that the low bid be accepted on each well, not as a two well bid. Seconded by Mr. Jaworski. Motion carried. Bids are to be opened at the first regular meeting in OCTOBER 14, 1975 November which is the tenth day of that month. Mr. Volk is in the process of getting on the repairs and upgrading of the Billik homes. Will have more on the septic system, water and electricity for the Park Commission Meeting. Mr. Volk has contacted eight different people for repairing of the chimney and so far no one will accept the job. Mr. Jaworski suggested running a liner through the chimney. Mr. McLean said this could cost over the $100.00 limit placed on the repair. Mayor Bohjanen wondered if placing the $100.00 limit on the repairs was not hindering Mr. Volk in finding someone to fix the chimney? He felt that Mr. Volk should be instructed to do what is necessary to make the chimney safe and operable. Mr. McLean moved to allow Mr. Volk to exceed the $100.00 limit on the repairs of the chimney. Seconded by Mr. Zelinka. Mr. Jaworski felt Mr. Volk should contact Mr. McLean on the total cost before giving approval. If the figure is up to $150.00, he would recommend going ahead with the job. The motion carried unanimously. Mr. Artzen asked if the laterals in the Shenandoah project affect anyone on Birch Street and Mr. Gotwald said, Yes, the homes presently contained within the Shenandoah project. But if any of the other homes in the area desire sewer, there must be a public hearing. Mayor Bohjanen asked that any discussion of this problem be withheld until Mr. Gotwald's report. Mr. Jaworski said there are still some broken windows in the Billik home. Mr. McLean said that all windows are being repaired as quickly as possible. Mr. Jaworski said the latch on the meter box on the South Rink is broken and should be repaired. Also, there is a hole in the South Rink near the Player's Box and the rinks are not painted as yet. Mr. McLean assured him these matters will be taken care of. Mr. Zelinka had no report. Mr. Gotwald returned to the sewer problem and informed the people that as long as there is more than one property owner and the system will eventually -ecome a City System, this installation must follow the guidelines as set forth in Chapter 429 of the State Statutes. This means that the Council must firt order a feasibility study by the Engineer. This report would in- clude the design, and cost estimates for the improvement. If the Council approves the report, then a public hearing is set. This notice must be published and notice mailed toa II affected property owners. If this is approved, the City must then arrange for financing by advertising for bids and arrange for the selling of municipal bonds to cover the cost of the construction. This cost would then be assessed against the abutting and affected properties. Mr. Gotwald felt this process could take three to four months. Mayor Bohjanen asked if this line could include the people on Birch Street who want sewer. Mr. Gotwald said, Yes, this line is designed to include all properties that can be sewered. The area designated cannot be enlarged but it can be reduced in size. 1 1 1 OCTOBER 14, 1975 Mr. Zelinka asked if the one wet well could serve the entire area and Mr. Gotwald said, Yes. A resident from the audience said since Mr. Rehbein still owns the streets, it would appear that it is his bbli ation to put in the system also the water and gas. Mr. Zelinka said this Council is not aware of any contract that states that Mr. Rehbein will install the water and sewer. The gentleman asked if Mr. Rehbein does put in the sewer will he be allowed to build on the remaining lots in the project? Mr. Locher said, yes. He also told the residents that if the contractor wishes to limit the construction to only the lots in Shenandoah, he can install the present owners of property in that project, if not otherwise arranged for, will have to pay for the installation affecting their property. Mr. Gotwald said that if Mr. Rehbein agreed to fullfill his committment in that area, the present owners would have to pay. The method of handling the financing is the problem. Mr. Gotwald felt that since there are no streets and if Mr. Rehbein did this construction as the contractor, the bonding charges could be avoided and the charges could be as much as 15% less than if the City arranges for the installation. 991. There will be information on this as soon as a reply to the letter is received. The residents of the area will be informed if there are any new developments. Mayor Bohjanen said the City needs more than it now has in order to proceed. These committments by the Metropolitan Council and Metropolitan Waste Control Commission should be in writing. This is the purpose of the letter that is to be written. Mrs. DeVries had left the Council Chambers and came back to report that she had just talked to Mrs. Opal Peterson and that Mrs. Peterson did not understand the delay. She had been assured that this interceptor was in the 1976 budget and will call Mr. Payne for the information tomorrow. The Clerk was asked to ask Mr. Rehbein for an answer as soon as possible. Mr. Locher said that he had contacted the property owners to the West of the present proposed end of Maple Street. Mr. Gotwald had asked for an easement for a drainage ditch to the West in order to properly drain Maple and take care of the water problem on Orange Street at the same time. Mr. Hallblade who owns one piece of the property had agreed, the other property owner wants to take a look at where the proposed ditch would run. Mr. Locher suggested getting easements and putting the street to the West section line. Mr. Gotwald said the ditch would have to be at least three feet deep in order to handle the drainage properly. Mr. Jaworski asked if this drainage would be handled on the cross street and Mr. Gotwald said he didn't know, he would have to take a look at it. Mr. Gotwald suggested holding a public hearing and assess the affected property owners. He said in this case he didn't feel it would be necessary OCTOBER 14, 1975 to follow the street specifications as stated in the Ordinance. This could be just a drainage and then gravel. Mr. Zelinka moved to request a feasibility study for solving the water problems on Orange and Maple Streets to be prepared by the City Engineer. Mr. Zelinka asked Mr. Gotwald a cost estimate for this study and Mr. Gotwald said around $500.00 but he pointed out that even if the work is not done at this time, the study would hold for whenever the work is done. Mr. Jaworski asked if this drainage ditch could tie into County Ditch No. 22? Mr. Gotwald didn't know. He would take a shot of the elevation and compare. Mr. Jaworski seconded the motion. Motion carried. Mr. Gotwald will have a report in November. Mr. Locher asked if he should proceed to get deeds from these people. Mr. Jaworski felt that at the present time, just deal with the drainage easement. Mr. Locher read from the Election Laws in answer to a question from the Clerk in regards to when Judges may be relieved. The Law states that the Judges who receive the votes must remain until the polls close and all voters have voted. Then the Judges who count the votes may relieve them. he also read from the Laws section which allows the absentee vote to be delivered to the Clerk for delivery to the Election Judges on Election Day. Chief Myhre reported that the residency requirement for the owners of the Blue Heron have been fulfilled. The Clerk reported that the residents have also registered to vote. Chief Myhre requested the Council to reconsider the uniform requisition No. 623 that was cancelled at the last meeting. He requested permission to purchase three long sleeve shirts and a tie for one patrolman. Mr. Jaworski moved to approve the purchase of three long sleeve shirts and a tie for Officer Hillyer. Seconded by Mr. Zelinka. Motion carried. Mr. Zelinka questioned the typewriter ribbons - how long would this many last? The Clerk pointed out that the last purchase was in April of 1974 for the same number of ribbons, they should last approximately 12 years. These are the Mylar ribbons. Mr. Jaworski felt the purchase should be cut in half. Mr. McLean moved to approve requisitions No. 624 through and including No. 628. Seconded by Mr. Zelinka. Motion carried. Mr. Zelinka moved to approve Checks No. 6644 through and including No. 6685 to be debited against the General Fund. Seconded by Mr. McLean. Motion carried. Mr. Zelinka moved to approve No. 6649 - SAC Fund; No. 6650 & 6683 - Utility Fund; No. 6651, 6668, & 6679 - Road Fund; No. 6652 through and including No. 6682 - Shop Fund; No. 6655 through and including No. 6684 - Police Fund; 1 1 OCTOBER 14, 1975 1 No. 6658, 6678, & 6683 - Park Fund; No. 6666 - C.D. Fund; No. 6670 - Federal Revenue Sharing Fund; No. 6680 - Void. Seconded by Mr. McLean. Motion carried. Mr. McLean moved to approve Payroll Checks No. 3168 through and including No. 3187. Seconded by Mr. Jaworski. Motion carried. Mr. Zelinka moved to adjourn at 10:00 P.M. Seconded by Mr. Jaworski. AYE. These minutes were corrected and approved at the October 28, 1975 Council Meeting.
