HomeMy WebLinkAbout09/24/1975 Council MinutesSEPTEMBER 18, 1975 A Special Meeting of the Lino Lakes City Council was called to order at 7:30 P.M. on September 18, 1975 by Mayor Bohjanen. Councilmen present: Jaworski. Absent: Marier, McLean and Zelinka. Mr. Locher was also present. This early meeting had been called for the express purpose of discussing the proposed Union Contract as submitted by representatives for the Police Department. Chief Myhre sat in on the conference. Mr. Larry Bastaii , Union Representative, arrived late. He said that he had just finished a negotiating session to finalize the 1975 Police Contracts that had been in dispute. He reported that the top Patrolman's salary would be around $1,200.00 per month, retroactive to January 1, 1975, and increse to around $1,230.00 per month on July 1, 1975. Mr. stated that all Patrolmen are on probation for one year after completion of BCA. The starting wage for new partolmen is between $880.00 and $950.00 per month. This is withour certification. The salary raises are computed on the 6 months, 12 months, 2 years and 3 years basis. There was discussion on the need to change the City Police Ordinance to conform with this contract. Mr. Jaworski asked if the Ordinance can be changed by Resolution and Mr. Locher said that it could. The contract was then discussed by Article beginning at the beginning. Mr. Locher asked about the insurance portion and Mr. Britain said that any City employee could become a member of the plan. The matter of seniority and the means of computing was discussed. The Article on discipline was discussed with a fifth catagory of "suspension" to be added. Chief Myhre said that sometimes, in lieu of suspension, he has given the patrolman extra duty without pay with the employee's co- operation. The matter of overtime being paid in wages rather than compensotory time was also discussed. Since a budget meeting was scheduled for 8:00 P.M. this evening it was agreed to set a meeting for Wendesday, September 24, 1975 at 7:30 P.M. for negotations on this contract. In the meantime, Mr. Baustain will deliver a copy of the new wage schedule to the office for distribution to all Council Members. SEPTEMBER 24, 1975 The special meeting of the Lino Lakes City Council was called to order at 7:45 P.M. by Mayor Bohjanen. Council members present: McLean, Zelinka. Absent: Marier and Jaworski. Mayor Bohjanen said the purpose of this meeting is to consider the wage scale and cost factor as presented in the contract submitted by the Union for the Police Department. Mr. Larry Bastain;, Union Representative was to attend this meeting but had not arrived. Chief Myhre was present. 1 1 1 SEPTEMBER 24, 1975 Mr. Jaworski arrived at 7:55 P.M. Mr. McLean felt that the classification of "Police Woman" is unnecessary for a department of this size and constitutes over staffing. This position had been created to deal with female prisoners. Mr. McLean asked Chief Myhre how many times she had been used in that capacity in the last eight months and Chief Myhre said, None. Mr. McLean felt this position should be reduced to that of a civilian clerk to be used for typing, filing and answering the phone. The cost of uniforms was discussed and the practice of a clothing allowance as compared to the City supplying the uniforms. There was discussion of an initial starting allowance and an annual clothing allowance for each patrolman. The starting allowance to include 6 shirts, 4 slacks, hats, jacket and misc. with no additional allowance for the first year of employment. The replacement of clothing damaged or 'destroyed in the line of duty was brought up. Does our insurance cover? If this is covered, there is no problem, if not, then the City should be responsible. The part -time men's clothing needs were discussed. Chief Myhre felt that they require about e the amount of a full time person. Mr. Zelinka suggested suggested the condition of the clothing dictate replacement. The suggested figure of $85.00 per year as an annual allowance. If found inadequate, this could always be studied. On Article XII - Overtime - Mr. McLean reads that paragraph to say that over- time will be paid on a daily basis; that is any time worked after the regular 8 hour shift will be paid as 12 times regular wages. Mr. McLean wondered which was more favorable - overtime after 8 hours or after a regular 40 hour week? Sgt. Costa interrupted to say that Mr. Bastain was on the phone and that he had mis- understood and did not know that he was to attend this meeting. He apologized for the misunderstanding. The Council set October 1, 1975 at 7:30 P.M. for a continuation of discussion on this contract and asked that the Clerk confirm this date with Mr. Bastain by certified mail. Mr. McLean returned to the payment of overtime and moved to specify over- time as time worked after a regular 40 hour work week. Seconded by Mr. Zelinka. Motion carried with Mr. Jaworski voting, No. There was no objections to the Court Time Article. 234 SEPTEMBER 24, 1975 The matter of the part -time policemen appearing in court was discussed. At the present time they are reimbursed for time lost at the wage scale of their regular positions. This is a matter of policy and the Council found no problems with the practice. On considering Article XVI, Section 16.1 was modified to read "Employees shall be compensated for a maximum 12 days sick leave per year. There shall be no carry -over of sick leave from year to year. If an emplyee is out for an extended period, it will be necessary to present a doctor's certificate covering any period of time beyond the third day. All of 16.2 was deleted from the contract. Article XVII - Vacation - was discussed. The Council felt that the method of computing vacation time was out of line. After much discussion, Mr. Mc- Lean moved the following schedule: One week after one Year; Two weeks after two years; Three weeks after ten years; Four weeks after fifteen years; and five weeks after twenty years. Mr. Jaworski seconded the motion. Motion carried. Article XVIII - Holidays - in Section 18.1 the Holidays will be reduced to a total of six paid holidays per year eliminating Washington & Lincolns Birthday, Columbus Day and Veterans Day, Mr. McLean so moved. Seconded by Mr. Zelinka. Motion carried. Mr. Jaworski left at 10:00 P.M. Section 18.2 changed to read "six" in the place of "nine" and the clause "their regular pay plus" deleted and the clause "in either pay or credit" deleted. Sections 18.3 and 18.4 deleted in their entirety. Article XIX - the Council will consider assuming 50% of the cost for the insurance. There was also discussion of paying the employees portion and the employee will assume the cost for his /her dependents. Article XX - Funeral Leave - add the word "consecutive" to be inserted after the word "three." Article XXIV - Wages - Mr. McLean said there could be no retroactive pay since the City does not provide for such expense in the 1975 budget. He also felt that the position of Police Woman should not be considered under this contract. The position to be abolished is that of a "Female Police Officer." This will have to be done by Council action. There will be three positions in the Police Department: Sergeant, Police Officer; and Clerk /Typist. The salary schedule for Spring Lake Park was consulted and the precentages on the salary increases was computed. This salary scale was delivered to the Office on Friday, September 19, 1975 by Mr. Baustain and constitutes the results of the latest negotiations with the Metro Area Police Departments. The Council asked the Clerk to compute the salary costs to the City with a starting salary for 1976 at $930.00 per month with the Sergeant to receive 10% additional and the Chief's salary to be 10% above the Sergeant's. She is to also compute the PERA cost to the City, that portion of the Attorney fees directly attributable to the Police Department, add 10% to the total salary for covering any overtime to be paid. L SEPTEMBER 24, 1975 i The Council requested that this be typed and a copy be mailed to Mr. Locher for his consideration and that he be at the next meeting. The Clerk was also instructed that these minutes are to remain strictly confidential and that no one is to get a copy. It was suggested that she type them at home to insure privacy. Article XXV was deleted completely and the phrase "merit increase on the basis of performance" substituted. The meeting was adjourned at 11:00 P.M.. OCTOBER 1, 1975 The special meeting of the Lino Lakes City Council was called to order at 7:35 P.M. by Mayor Bohjanen on October 1, 1975. Councilmen present: Jaworski, and McLean. Absent: Marier and Zelinka. Mr. Locher was also present. This meeting had been called for the purpose of considering the Police Contract as presented by the Union. Mr. Baustain and Mr. Wisenberger were here to represent the Union. The entire Police Department was present. Mr. Jaworski corrected the minutes of the previous meeting as follows: Change his time of arrival from 8:55 P.M. to 7:55 P.M. There was some discussion of the 7th paragraph with the numbers not being clear. This was deferred for discussion at a later time. Mr. Jaworski moved to approve the minutes as corrected. Seconded by Mr. McLean, Motion carried. Mayor Bohjanen suggested that in order to clear this, he felt that the contract should be discussed from the beginning. Article I - Date - to be entered when contract is signed. No other questions or objections. Article II - Mr. Locher felt there should be more classifications under this article. Mayor Bohjanen suggested adding the classification of Clerk - Typist. Mr. Jaworski wondered if this is the correct terminology. Mr. McLean; what then? Mr. Jaworski 'Community Relations Officer, not a sworn officer but could function if needed for female prisoners. Mr. McLean said since we have no use for a person with that kind of duties; what other duties other than normal office work? Mr. Jaworski said the same duties as now but not a sworn officer. There was more discussion on the duties of this position, with Mr. McLean feeling that a Clerk- Typist is all that is needed in that office. Mayor Bohjanen felt that if another position becomes necessary, it can be added. Mr. McLean asked if the Council determines that another position is necessary this contract will not cover that position. Mr. Bastain said that was correct, it would be added and negotiated for at that time.
