HomeMy WebLinkAbout10/08/1975 Council MinutesOCTOBER 1, 1975 Mr. Wisenberger said this must be done by statute. The Council must be notified by July. The contract must be opened by May, 1976 for negotiations for 1977. Mr. McLean said this meant this contract then would cover the period of 1975 and end December 31, 1975. Discussion of this date was held because of the implication of retroactive salaries. Article XXV - The union asked to hold this one. This deals with longevity pay. The Council felt that since this is such a young department, this clause has no bearing on this department. Mr. McLean felt that increases in salary should be on merit not because that person has been employed a certain length of time nor because he has taken extra course in a related field. The obtaining of knowledge and being able to use that knowledge in the correct way are two different things. Mr. Wisenberger felt the merit pay method does not deal realistictly with the people involved. He felt that if an officer is not performing, then he should be discharged, but job performance is hard to measure. Article XXIV - This deals with wages. Mr. McLean said the Council will not consider retroactive pay because this issue is not considered in the 1975 budget, therefore there are no funds to cover such an expenditure. The Clerk was asked to read the schedule as proposed by the Council. This schedule is based on a starting salary of $930.00 per month to begin January 1, 1976. After 6 months - $1,014.00; One year - $1,042.00; two years - $1,088.00; three years - $1,107.00. On the part -time employee salaries, Mr. Weisenberger said that the hourly rate for the full time would be the same for the part -time. Mr. Bastain said if this schedule is agreed to, the City would be going backwards in reaching the salary schedule for the Metro Area as presented by the Union. There was more discussion on the percentages of this schedule with more to come at a later date. The Clerk was instructed to contact Anoka County for the possibility of this City participating in their hospitalization program. The next meeting is scheduled for 7:30 P.M. on October 8, 1975. Mr. McLean so moved. Seconded by Mr. Jaworski. Motion carried. Mc. McLean moved to adjourn at 10:05 P.M. Seconded by Mr. Jaworski. Aye. OCTOBER 8, 1975 The Special Meeting of the Lino Lakes City Council was called to order at 7:30 P.M. by Mayor Bohjanen. Council Members present: Jaworski, Marier and McLean. Absent: Zelinka. Mr. Locher was also present. 1 1 OCTOBER 8, 1975 Chief Myhre was also present. This meeting had been called for the purpose of negotiations with the Union in conjunction with the proposed contract for the Police Department. Mr. Marier moved to waive the rule of only discussing the subject open for discussion. He has another item he would like considered at this meeting. Seconded by Mr. Jaworski. Motion carried. Mr. Jaworski moved to table approval of the minutes of the previous meetins until the final meeting. Seconded by Mr. Marier. Motion carried. Sgt. Costa asked for a five minute delay in the appearance of the Union Representatives and Police Personnel. The Council Agreed. Mr. Zelinka arrived before the meeting started. Mr. Bastain and Mr. Wisenberger were here representing the Union. Mayor Bohjanen noted that in the last meeting there were several articles that had been held because of differences. He suggested discussing these points. Mr. Bastain preferred to go through the contract and single out the Articles that the City and the Union could agree upon. According to their notes the following action was taken at the last meeting: Article I - No objections. Article (1 No objections. Article III The rest breaks and lunch period was discussed and Section 3.8 dealing with overtime was held. Mr. Marier questioned the violation of the time for rest breaks. Mr. Wisenberger said there is a section in Article X that deals with discipline that could be applied in this case. He also stated that most Police don't have the time to take the full time allotted. They are subject to call at all times. After some discussion, the Coucil asked to hold on Article III. Article IV No objections. Article V No objections. Article VI No objections on Section 6.3, Mr. Marier asked who supplies the bulletin Board and was told the employer did. Chief Myhre said there is a bulletin board in the Police Office at the present time. Article VII No objections. Article VIII No objections Article XI Hold by Council request. Mr. Marier felt there is no advantage to posting a seniority list. Mr. Bastain said they would like it posted. Mr. Marier felt that this causes more friction and any employee can ask the supervisor at any time. This practice become another record keeping process. Mr. Jaworski felt if the phrase 'available on request by the employee' was inserted, that would be sufficient. The Union agreed. Mr. McLean asked the length of the 'probationary period', is it six months, a year, or what? Also, what is the definition of this? OCTOBER 8, 1975 This definition will be inserted in Article III, under Section 3.12 and will be 'as provided by State Statute.' Ar Article IX No objections, with additions. Article X Mr. Marier questioned Section 10.3, what if the employee refused to sign? What is the purpose of this section? Mr. Bastain said it is to certify that the employee had received the notice and had read it. If he refuses to acknowledge the receipt by signature, this act should be noted on the report and witnessed. Mr. Bastain said the report could also be sent by certified mail, then he would have to sign for the letter. Mr. Wisenberger noted that the contract reads 'shall sign'. He felt this makes the signature mandatory. Article XI No objections. Article XII Hold. Article XIII No objections - with the addition of Section 13.2 Part -time employees will be reimbursed for court time at the pay scale of their regular employment. Article XIV This deals with call back time and does not deal with overtime No objections. Article XV Articles XVI SICK LEAVE Article XVI Article XVI Mr. Marier felt this article could create a problem especially during vacation time. Mr. Bastain says the classification must be assigned by the Employer, the employee cannot assume the position on his own. Mr. Zelinka asks if there were and incidents in the Metro Area and Mr. Bastain said, No. Mr. Wisenberger reiterated that this can only be done by assignment by the employer, the employee cannot assume the responsibility. there was discussion of requiring the employee to work at the position for five days before being paid the higher wage scale. Mr.Wisenberger felt that this could create a situation whereby the employee works the five days and on the sixth day is put back to the lower scale and reassigned to the higher position on the seventh thus the employer could avoid paying the higher salary. Mr. Marier agreed he had a point, but felt this section could create problems. Mr. Marier felt that an employee should work for what he receives and earn his promotions. Article XV - Hold. , XVII & XVIII - the Union submitted the following proposal: 12 days per year with an accumulation of 60 days with no severance pay, Council asked to hold for consideration. I. Hold by Union Request 11 Union asked for 9 holidays with double time and 2 for work on a holiday. Article XVII Article XVII The Union accepted the City's proposed vacation schedule for this article. I The City asked to hold on this article. 1 1 1 Article XIX OCTOBER 8, 1975 The Clerk had contacted Anoka County asking if the City could participate in their hospitalization program and was told that the City cannot. Mr. Bastain asked the City to consider the Teamster's contract with Central State. Mr. Jaworski said that is an awfully expensive contract. The Council asked for a recess to consider an offer in this area. When the meeting resumed, Mr. Zelinka proposed the following: Hold on Section 16.1, accept Section 16.2, holidays to remain at 6 paid holidays, Section 19.1 out, Section 19.2 City will assume 25% of the total cost for Central State package contract for full time employees only. The Union asked for a recess to consider this. Section 16.1 - 12 days per year - no carryover; Section 16.2 Okay vacations per City's schedule; Section 17.2 - 30 days; Section 18.6 - Six days (holidays) with double pay for working on a holiday; Section 18.4 - Delete; Section 19.1 - Delete; City will pay approximately $46.20 per month per full time employee towards insurance. The Union will consider this proposal. Article XX The phrase 'consecutive working days' was added at the discretion of the employer. Article XXI Add 'less any compensation from worker's compensation.' Mr. McLean suggested thay any long term disability would also be deducted. Mr. Locher said that any long term illness would need to be substantiated by a medical report. The addition of the clause that 'the employer has the option to send employee to another doctor for verification of illness be allowed, and if employee refuses, this would disqualify that person for further payments.' Article XXIII Mr. McLean said after the initial issuance of uniforms, the second year allowance would be $85.00. There was some sug- gestion that the uniforms be replaced as needed. Mr. Marier felt that this could be misused. Mr. Zelinka said that damage could be done delibertly in order to certify a need for re- placement. Mr. Marier said if there is a dollar figure, then this could be budgeted. Hold on this by City request. Mr. Bastain skipped Articles XXIV & IIV and wnt to Article XXVI. There were no objections to this Article. Article XXVII The starting date was the questions. The contract would expire December 31, 1976. Mr. McLean asked the meaning of Article XXV. Mr. Bastain said this refers to credits in related police work courses taken and passed at colleges. Also, based on so many dollars per month for length of service. Mr. Marier said this he could not consider. He felt that this sort of benefits deteriorates a work force. He would recommend striking Article XXIV. The Union presented the following schedule for salaries for Council consideration. The starting date of this contract would be May 16, 1975. Mr. Marier asked if this meant retro- active pay. Mr. Bastain said, yes; except where otherwise agreed. 242 OCTOBER 8, 1975 The base pay from May 16, 1975 through September 30, 1975 would remain at $875.00 per month with the Sgt. to receive 10% above that amount and the part -time employees to receive the same pay per hour based on a 50 hour month. Beginning October 1, 1975, the base pay would go to $930.00 per month; $1014 after 6 months, $1,042 after one year; $1,088 after two years; and $1,107 after three years. Starting January 1, 1976 - $975.00 per month base salary; $1,025 after six months; $1,075 after one year; $1,125 after two years; and $1,175 after three years. Effective July 1, 1976 the base salary of $1,025; $1,075 after six months; $11,25 after one year; $1,175 for two years and $1,225 after three years. The Sgt. would receive 10% above the salary where his length of service would fit. Mr. Bastain said that on this schedule the City would be one-year and $5.00 per month behind the Metro Area rate just negotiated. Mr. Locher asked if this wage schedule was not based on population? Mr. Bastain was asked the communities involved and the ones named have much larger forces than Lino Lakes and more population. He was asked if he knew the average population figure and he did not. He said if this pooposal on wages is acceptable to the City, the Union would agree on the overtime after 40 hours worked. Mr. Marier felt that this in not dealing in comparable areas. Mr. Jaworski suggested getting together and work out a schedule that the City can handle. Mr. McLean so moved. Seconded by Mr. Marier. Motion carried. The next meeting was scheduled for Wednesday, October 22, 1975 at 7:30 P.M. Mayor Bohjanen asked if the Union will accept a counter proposal by mail? Mr. Bastain said they would. Mayor Bohjanen said the Council will work out a schedule and mail to them for consideration before the scheduled meeting. Mr. Marier moved to continue this meeting until Wednesday, October 22, 1975 at 7:30 P.M. Seconded by Mr. Jaworski. Motion carried. Mr. Marier said he will take up the subject proposed at the beginning of this meeting after the bills are considered at the regular Council meeting on October 14, 1975. Mr. McLean moved to adjourn.
