A Special Meeting of the Lino Lakes City Council was called to order at .
8:02 P.M, by Mayor Bohjanen. Councilmembers present: Jaworski, Marier,
McLean and Zelinka. Absent: None. Mr. Gotwald and Mr. Locher were
_also present. Mr. Ray Payne, Metropolitan Waste Control Commission
Representative was in the audience. Mr. Glenn Rehbein was here as
developer of the Shenandoah Plat.
Mayor Bohjanen said the purpose of this meeting was to discuss the in-
stallation of the internal system in the Shenandoah Area. He asked the
Clerk to read the letter from Mr. Richard Dougherty of the Metropolitan Waste
Control Commission setting forth the time schedule for the installation of
the interceptor.
After the letter was read, Mayor Bohjanen asked Mr. Payne if the time schedule
still stands and Mr. Payen said, Yes.
Mayor Bohjanen asked Mr. Gotwald if he had a report. Mr. Gotwald said the
data had been exchanged and most of the engineering problems had been
worked out. The internal system has received PCA approval and will be
installed as originally designed. Mr. Gotwald felt that the most important
subject for discussion this evening is how to best initiate the installation
of the laterals.
Mr. Jaworski asked Mr. Payne who so long to complete the installation?
Mr. Payne said it is only a matter of 7 or 8 months. He felt this is ample
time for installation. The only possible delay in the schedule would be
the delivery schedule on equipment.
Mr. Jaworski was concerned about the condition of the truck presently used for
the sewage hauling - he questioned whether it would last another year es-
pecially if used to pump two systems.
Mr..Payne felt the contractor would make every effort to get all surface work
before Fall, in order for the system to be completed by the end of the year.
Mr. Jaworski was hoping it could be completed by June in view of the fact
that Mr. Burandt said the system could be operating in 90 days. Mr.
Jaworski asked why the difference in timing?
Mayor Bohjanen asked Mr. Payne if Mr. Burandt had any basis for such a
statement.
Mr. Payne said he didn't know what Mr. Burandt had in mind but he would
rather present a workable schedule that can be lived with.
Mr. Marier made note of the memo of October, 1975 in whi:6h Mr. Payne
states the City will be responsible for pumping and hauling the sewage -
How long would the City be required to do this?
Mr. Payne said that would depend on the installation of the internal system.
The pumping would be from the time the internal system is operational
until the interceptor is completed - possibly 6 months to a yea -.

Mr. Jaworski asked what type of lift station would be installed that would be
manually operated? Mr. Payne said it would basically operate the same
as the system in Country Lakes. This could be a man hole, the Metropolitan
Waste Control Commission would install the pumps and the discharge lines.
Mr. Marier said if the City will be pumping for possibly a year and the
contractor will be installing the laterals, what about the streets?
Mr. Rehbein said the streets would be completed by September 1, 1976.
Mr. Marier asked if there were any monies in escrow at this time to ensure the
work being completed, and was told, No. Mr. Marier felt that the City should
follow the requirements of the Ordinance in this matter. The Council has an
obligation to protect the people in this matter. Mr. Locher said this is
covered in Ordinance No. 22 under Section 10. Mr. Marier asked Mr. Locher
to read that section.
Mr. Marier moved that a Surety Bond be posted and secured by January 1, 1976
for completion of the streets in the Shenandoah Plat. Seconded by Mr.
Zelinka. Motion carried.
Mayor Bohjanen asked Mr. Rehbein if there will be work on the system this
winter?
Mr. Rehbein said there are some problems to be worked out. He did not feel
that his company would be installing the internal system. The work may be
sub -- contracted out because of the depth and the water problem. Mr. Rehbein
had received one bid late this afternoon and the cost had computed out at
about $30.00 per lineal foot. He felt this was too high but Mr. Gotwald said
that is a fair cost figure. He felt that any figure between $15.00 and $20.00 per
foot is a reasonable cost.
Mr. Marier said when the plat was approved it was with the stipulation that
the Contractor was responsible for the utilities.
Mr. Rehbain said there is no problem except with maybe a couple of the
home owners. He would like some agreement in order to avoid the hearing
process. The question of the lots located on the West side of Ware Road
that could benefit from the installation came up for discussion. Mr. Marier
felt this is part of the Metro Plan and that all people should be served.
Mr. Locher said that only this project is being considered in that area at
this time. Any other lands around this project to be considered must have a
hearing.
Mr. Jaworski felt that the Shenandoah Project is the subject for discussion
here this evening and these other lands will have to be considered at another
time.
Mr. Rehbein said they had considered running the line in back of the
properties located on Ware Road, but he felt that if the line is run
along Ware Road the property owners on the other side of that street should
share in the costs.

Mr. Gotwald felt that the line should be constructed to include that property
but something must be put in writing that the costs will be shared by those
owners.
Mr. Zelinka said to his knowledge there are 3 homes along Ware Road at the
present time and that area is platted for 8 - would a bond be required for
the other side of the street or what? How has this been handled in other
areas? 1
Mr. Locher asked if the line could be designed to only serve those homes
on Ware Road that are within the Sehanadoah Project?
Mr. Gotwald said, No, the State requires the line to be 8" and this is
large enough to serve both sides of the street. The areas affected must be
handled by an agreement between the property owners. There are some
problems on Birch Street of the same nature. Mr. Gotwald thought this will
have to be worked out by the Attorney.
Mr. Zelinka asked if this would invoke a public hearing and Mr. Locher said,
Yes, it there is to be an assessment.
The cost figures on the bid received by Mr. Rehbein was discussed again.
One man form the audience thought is was too high. Mr. Gotwald said, No, that
this bid is in line with other ones that he has seen in recent weeks.
The depth of the line and the water table was discussed. Mr. Gotwald explained
why it is necessary to put the line at a depth of 10 feet. Mr. Rehbein
said that in some places the water table is at 4 or 5 feet. Mr. Gotwald
felt that most of the area is about 10 feet and some as high as 14 feet. There
was discussion on how the lines are installed when the water table is so high.
Mr. Rehbein said that he would like to have the time to get more bids on
this project and Mayor Bohjanen asked him how soon he could have them. Mr.
Rehbein felt that within two weeks he could come back with some plans that both
he and the Council could live with. Mr. Rehbein said he wanted some competative
bids in order to protect the people. He wanted to be as fair as possible in
this matter. He suggested that the City take the bids and he pay for the lots
he still owns and the residents pay the City for their assessments.
Mr. Zelinka felt that if Mr. Rehbein asked for the bids, he could get a better
cost figure for the residents from his brother contractors. Mr. Zelinka felt
that when a municipality asks for bids there is always a little extra added on.
Mr. Marier felt that this is the obligation of the contractor and he should
handle this. Mr. Marier felt that the cost of pumpoing and hauling the
sewage from that area should not be paid by all the citizens, this should be
assessed to the people, owners or contractor in that area.
Mr. Marier moved that all costs for pumping, hauling and manpower be assessed
to the people, contractor or owners in Shenandoah until the interceptor is
completed. Seconded by Mr. McLean.
Mr. Zelinka asked Mr. Marier if he meant the cost of just hauling the sewage
and Mr. Marier said, "just for the cost of pumping and (hauling the sewage."

Mayor Bohjanen asked Mr. Payne if there would be a contract with the Metro-
politan Waste Control Commission for this hauling comparable with the contract
dealing with the Country Lakes Area? Mr. Payne said, yes. The Metropolitan
Waste Control Commission will supply the submersible pumps and pay the electrical
charges.
One gentlemen from the audience asked "What if the truck broke down? Would
the people in Shenandoah be expected to bear the expense of repair ?" Mr.
Zelinka said, No, that truck is used, or will be used, in both projects and
the breakdown could not be attributed to one and not the other.
Mr. Jaworski said that at one time he had understood that the Metropolitan Waste
Control Commission would pay the entire cost of hauling the sewage from Shenandoah.
And while on this subject, Mr. Jaworasi said the sewage charges in the Country
Lakes area have remained the same while other area rates have doubled. He felt
that the Council should look into this.
Mr. McLean asked if he was making that a motion and Mr. Jaworski said, No.
Mr. McLean moved that the Council make a study of this and make a recommendation
for Council consideration. Seconded by Mr. Marier. Motion carried.
A man from the audience asked Mr. Locher "based on the motion made and passed,
can the City assess the Shenandoah residents for repairing the truck if it breaks
down ?" Mr. Locher said, based on the discussion, No. Mr. Zelinka thought
there might be a possibility if the City had to purchase a second truck.
Mr. Rehbein asked if the City is operating at a loss in the Country Lakes
Area and Mr. Marier said, yes, the City has the lowest sewer rates in the
Metro Area.
Mr. Rehbein felt the residents of Shenandoah should pay the same as the residents
of Country Lakes. He would like to get toghether with the home owners and the
Engineer and figure out how this can be paid for.
Mr. Zelinka thought that Mr. Rehbein and the owners should get together and
work out their problems without City interference.
Mr. Rehbein asked if he could use the City Hall for a meeting with the
home owners on Tuesday, December 2, 1975 at 8:00 P.M.
Mr. Zelinka moved to approve this request. Seconded by Mr. McLean. Motion
carried.
Mr. Gotwald told Mr. Rehbein to get his bids, take the lowest bid, get this
bid to Mr. Gotwald. He will compute a cost splitting formula method for Mr.
Rehbein. These steps should be taken before the meeting.
Mr. Rehbein questioned the oversizing of the line on Totem Trail - would he
be reimbursed for oversizing that line to serve other projects to the East?
Mr. Gotwald felt not since this is oversized to serve the land owned by Mr.
Rehbein. Mr. Rehbein asked if the 12" line was necessary to serve the lands
he owns - would• not an 8" line be sufficient? Mr. Gotwald said, No, it would
requrie the 12" line.

Mr. Zelinka told the residents from Shenandoah that it would be to their
advantage to work with the contractor to solve these problems. When an
installation is done by the contractor such as is being proposed here, the cost
is usually $4 to $5 per front less than if it becomes necessary to go through
the process of hearings.
Mr. Gotwald repeated his recommendations for procedure to Mr. Rehbein.
Mayor Bohjanen reminded the people this scheduled meeting is with the
Contractor and there will be no Council involvement.
Mr. Marier moved to adjourn at 9:10 P.M. Seconded by Mr. McLean. Aye.
These minutes were approved at the December 8, 1975 City Council Meeting.
