DECEMBER 8, 1975
The regular meeting of the Lino Lakes City Council was called to order
at 8:00 P.M. by Mayor Bohjanen on December 8, 1975. Council members
present: Jaworski, Marier, McLean and Zelinka. Absent: None. Mr.
Locher and Mr. Gotwald were also present.
Mr. Marier moved to approve the minutes of November 18, 1975 as written.
Seconded by Mr. Zelinka. Motion carried unanimously.
The minutes of November 24, 1975 were corrected as follows:
..Page 2, paragraph 3, change the word "removed" to "remove" in the
first line;
..page 5, paragraph 5, delete "privately owned street" and insert "dedicated
street but not accepted;"
..Page 7, paragraph 8, delete the sentence: "The Clerk had requested the
Police Department to inform her if long distance calls are made from
that office but she has had no response from them."
Mr. McLean moved to approve the minutes as corrected. Seconded by Mr.
Zelinka. Motion carried unanimously.
The Clerk reported on the following items:
..A letter from Northern Instruments, Inc. stating that, if this company
completes the purchase of the Outpost site, they will be responsible
for the septic system. Also, thanking the Council and the Planning and
Zoning Board for the manner in which their requests have been handled.
..Read a letter from Mr. John Boland, Metropolitan Council Chairman,
announcing a meeting scheduled for December 9, 1975 at 7:30 P.M. and
inviting all elected officals and their staffs to attend.
..Received a copy of a burning permit for open burning issued to the
Anoka County Park Department to be used in conjunction in clearing the
land in several County owned Parks. This permit expires December 31, 1975.
..Gave the Council copies of the proposed contract from the City of Lexington
for fire coverage for the year 1976.
..Had received another letter in conjunction with the Flood Plan Insurance.
The Clerk and the Engineer had received calls from the company in Pennsylvania
that is preparing the maps and have been assured the maps will be here
before the end of the year.Mr. Marier moved to send a letter to the
Metropolitan Council, Anoka County and the Federal Government stating
that the City is waiting for these maps and cannot proceed until they
arrive. Mr. McLean seconded the motion. Motion carried unanimously.
..A notice of public hearings to begin on December 29, 1975 and continuing
until all interested people have had a chance to be heard dealing with
the Proposed Rules of the Commissioner of Natural Resources Containing
Standards and Criteria for Granting and Denying Permits for Appropriating
Waters of the State and for Changing the Course, Current or Cross
Section of Public Waters. Mr. Marier and Mr. McLean felt this is some-
thing that should be watched since it will effect the use of Lakeshore
properties. The Clerk was instructed to contact Anoka County Shoreline
Management Office as to their plans in regards to this matter. The Council
asked for copies of the letter.

Mayor Bohjanen asked the Clerk to read a letter from the Human Rights
Commission stating that a complaint had been filed against the City
by Mrs. Joanne M. Pankratz accusing the City of discrimination due to
sex. This complaint states that she was passed over in consideration
for enrollment in BCA school. Mr. Frederick Hillyer, a part -time patrolman
with less time on the force than Mrs. Pankratz, is presently enrolled
in that school.
Mr. Locher read the letter he had prepared and documented in answer to
this charge. Basically Mrs. Pankratz was employed as a Clerk- Typist.
The only reason for adding the title "Policewoman" was for the purpose
of assisting the officer on duty if the offense included a female or
a juvenile.
During the discussion of the Police Contract meeting, Chief Myhre
had been asked how many times she had been used in that capacity in
the past eight months and Chief Myhre said, none.
Mr. McLean read this portion of the discussion from the minutes of that
meeting and also read that the position of "female police officer"
should be abolished.
The certificates obtained by Mrs. Pankratz since her employment in the
Police Office have been in the filed of clerical work. The Council
stand was that Mrs. Pankratz had been hired as a clerk- typist. Mr.
Locher was also instructed to inform the Human Rights Commission that
the City of Lino Lakes has no plans for expanding the Police Department
from the present personnel of One Chief and two Patrolmen with a Clerk -
Typist and four part -time patrolmen filling in the odd hours.
The fact that the decision as to who was to attend the school and when,
was not a Council decision but was made by the Police Chief was noted.
Mr. Marier noted that a position cannot be abolished while in contract
negotiations, without mutual consent. Mr. McLean said that when positions
are created, a complete job description must be supplied first.
Mr. Zelinka asked the Chief to verify the reason why this person was
sworn in. The general consensus of the Council was that this will
brought ou in the investigation by the Human Rights Commission.
Mr. Jaworski said he concurred with the action taken but wanted to know
why he was not notified of the meeting with the Attorney. He had some-
one home to answer the phone. He said the expenditure of City funds
can only be authorized by the Council. He felt the Mayor did not have
the authority to call this meeting without the approval of the Council.
Mr. Gerald Beach, Tree Inspector, presented his report for the 1975
Tree Inspection Program and also his cost estimates for 1976. He felt
that by 1977 the cost should be sharply curtailed. Mr. Zelinka questioned
Mr. Beach on the method of Vapam treatment for Oak Wilt and Mr. Beach ex-
plained this substance is put in holes 20" deep, 8" apart around the
infected tree or trees, it works on the root system to control the disease.

Mr. Zelinka complimented Mr. Beach on his report saying that it was
complete and on time. Mayor Bohjanen thanked Mr. Beach for his time
and the report.
Mr. Jaworski had no report. Mr. McLean had no report. Mr. Marier had
no report. Mr. Zelinka had no report.
Under the Old Business, the minutes of the December 3, 1975 Special Council
Meeting for the consideration of the Public Works Supervisor's position
was considered. Mr. Marier moved to approve the minutes as written.
Seconded by Mr. McLean. Motion carried unanimously.
Mayor Bohjanen said that on reviewing this position, that he was basically
satisfied with the performance of Mr. Volk. There needs to be some
improvement in the area of planning.
Mr. Zelinka moved, that if a salary raise is to be considered, that it
not be retroactive. Seconded by Mr. McLean. Motion carried unanimously.
Mr. McLean moved that Mr. Volk be retained as a Temporary Supervisor
until a permanent Supervisior can be hired. At that time, Mr. Volk would
become the Number 2 man and Mr. Robert Lundgren the Number 3 man.
This would eliminate some of the part -time personnel.
Mr. Zelinka asked what if the Council is unable to locate a suitable
person within the salary range and Mr. McLean said that is a Council
problem. Mr. Jaworski asked if an ad should be placed for the job and
Mayor Bohjanen asked that the Personnel Commission draft a job description
first.
The motion was seconded by Mr. Jaworski. Motion carried with Mr. Zelinka
voting, No.
Mr. Marier was concerned about more than one member of a fmaily being
employed by the City. He felt there was a conflict of getting the work
done and that individuals are controlling rather than doing. Mr. Marier
moved to make an effort that all hiring done by the City be limited to
one person per family.
Mr. Zelinka questioned the legality of this - is this discriminatory?
Mr. Locher said not if there is internal conflict.
Mr. Jaworski felt this would give the City a chance to hire some of the
unemployed. Mr. Jaworski seconded the motion. Motion carried.
Mr. Lee Parr and Mr. Byron Laher of the Anoka County Health Department
were here to present the Council with an opportunity to present the need
of the community. This department is in the process of developing a
long range plan to meet the needs of the people in Anoka County in the
areas of Mental Health, Mental Retardation and Chemical Dependency.
They have a June target for completion and are meeting with three
agencies on February 1, 1976 to ask for funding.

Mr. Zelinka felt this department must have some input - where does
this information generate from? What would be the procedure for
a City such as Lino Lakes?
Mr. Laher offered Mr. Parr and his staff; some of the information is
from record files in the Courthouse; some from the area Chruches, some
from other agencies. Mr. Laher explained the use of the detoxification
unit in Hennepin County and the inter - related family problems resulting.
Mr. Zelinka said the catagory of "family problems" had not been included
in the original statement - is this an added one? Mr. Laher said that "
only as they realte to the areas served," He said the reasons for their
visit to the Council is that the department felt the information needed
would be better known by local people.
Mr. Jaworski asked if the Kingsman and Big Brother orginazations would
be a part of their covered areas and Mr. Laher said, Yes, to a certain
point. Mr. Laher also explained this department works very closely with
the presently organized units in order to avoid the duplication of services.
Mr. Marier thought this is something that should be followed up and
asked that the Mayor consider this when making his appointments for the
coming year.
Mayor Bohjanen agreed and thanked the men for their presentation. Mr.
Laher reminded the Council his office is open for anyone at any time.
Mr. Marier asked a man from the audience if he had something he wished
to discuss with the Council. This was Mr. Schroepfer who is drilling the
well at Sunrise Park.
Mr. Schroepfer said that he is down 250 feet and is going through shale
rock. Once through that he should hit water that will give the desire
amount. Mr. Marier asked if he had hit water before this depth and Mr.
Schroepfer said that he had hit water between 65 and 90 feet. This
was at the same depth as the old well and he did not have sufficient water
to give the 50 gallons per minute as specified. Mr. Schroepfer said that
once through the shale, then he would be in the type of rock that would
eliminate the need for a screen. Thus, if it beocme necessary to go
another 50 feet, it would only add about $25.00 to the overall cost.
Mr. Zelinka moved to authorize Mr. Shcroepfer to go another 50 feet.
Seconded by Mr. Marier, motion carried unanimously.
Under Old Business, Mr. Jaworski told the Council that he and Mr.
Marier had spent about three lhours in the offices the day after Thanksgiving
going through the records in the Clerk's office and checking in the
Police Office. He had made copies of some of the things that he felt
was worng. Mr. Jaworski had inspected the petty Cash expenditues
for stamps and found only one receipt for $30.00 but $102:00 had been spent
for postage. He felt a better accountability should be made of these
funds. There were also petty cash slips for pay out for gopher feet but
no voucher signed by the person who received the payment.

In the utility department, there was no record of when the water meters
were installed, no penalty charged on over due statements and the posting
of the water deposit and meter charges were in the worng column. Mr.
Jaworski felt there were many areas of the Clerk's Office that needed to
be checked and he would like to go back and do some more checking.
Mr. Marier said that in the Police Office the records were up to date
and the Police Clerk and Chief explained the responsibilities to them.
He felt the office was run very efficiently. He recommended that within
the next quarter consideration of file cabinets for that office.
Mr. Marier said that he had asked for a tickler file from the Clerk's
Office and this was not readily available. He also felt the cash flow
report is incomplete and should be finished. Mr. Marier felt the
Federal Revenue Sharing funds are being spent the first quarter of the
year for general uses and not as planned and that the next Council
will be operating witha $30,000.00 deficit. The Council had submitted a
budget which put the levy at the limit and about 20% of that will not
be collected. A cash flow accountability is needed by the end of the
month.
Mr: Zelinka said that when an auditor is considered for the year 1976, he
would ask for not only a CPA but one which can advise in the area of cash
flow.
Mr. Marier said this cash flow should be done on a day to day basis.
Mr. McLean asked that a special meeting be set in order to go over this
before the next Council Meeting. After checking, the council set December
16, 1975 at 8:00 P.M. for a special meeting to consider this. Mr. McLean
so moved. Seconded by Mr. Zelinka. Motion carried.
Mr. Gotwald had no report other than the fact that Mr. Rehbein will be
opening bids this Friday, December 12, 1975, for the installation of
the mains and laterals in Shenandoah. As soon as Mr. Gotwald has time
to analyize the cost and compute the anticipated cost per lot, then Mr.
Rehbein will schedule a meeting with the residents in that area and
get the installation started.
Mr. Gotwald said the plans.for that area have been submitted to the
Metropolitan Council and he had been informed by phone the plans will
be approved and official notification will be by letter.
Mr. Gotwald had talked with the Engineer responsible for the installation
of the force main and they are making good progress. Mr. Jaworski asked
if pre -cast man holes will be used and Mr. Gotwald said, Yes, this is
part of the specs. Mr. Jaworski said there is some trouble in the Country
Lakes area of taking in water. Mr. Gotwald said the man holes in that
area are also pre -cast and if water is leaking in, it would be through
the covers. These should be checked periodically by Mr. Volk and the
holes plugged. The Clerk was asked to set up a file for this purpose.

Mr. Jaworski asked about the snaps. Mr. Gotwald said they are completed
except for what has been done this year. As soon as that information
is available to him, he will complete the maps.
Mr. Zelinka moved to approve requisition No. 635 holding No. 636 until
funds are available. Seconded by Mr. Jaworski. Motion carried.
Mr. Jaworski moved to approve Checks No. 6762 through and including No.
6785. Seconded by Mr. Marier. Motion carried.
Mr. Jaworski moved to approve payroll checks No. 3275 through and
including No. 3297. Seconded by Mr. Marier. Motion carried.
Mr. Jaworski moved to adjourn at 10:05 P.M. Seconded by Mr. McLean.

The regular meeting of the Lino Lakes City Council was called to order at 8:00 p.m.
December 22, 1975 by Mayor Bohjanen. Councilmembers present; Jaworski, McLean,
Absent; Marier, Zelinka. Mr. Locher was also present.
The minutes of the December 8, 1975 meeting was corrected as follows; ..Page 2,
paragraph 5, 4th line, delete 'and nothing else.'
Mr. Jaworski moved to approve the minutes as corrected. Seconded by Mr. McLean.
Motion carried.
The Clerk reported on the following items:
..Read a letter from the Metropolitan Waste Control Commission informing the
Council the Shenandoah Sanitary Sewer Extension had been approved by that
Commission;
..Had received the affidavit of publication of the advertisement for bids for
City Insurance. There has been three insurance representatives in the office
for information;
..Received notice of approval for two applications by Mr. Allan Robinson to the
Rice Creek Watershed District for permission to clean ditches located on Mr.
Robinson's property;
..Received $244.84 in municipal fines for the month of November;
..Received the second half of the tax levy in the amount of $51,231.23 to be
distributed as follows; General Fund - $5,737.49; Road Fund - $10,952.02;
CD - $387.90; Park Fund - $5,625.20; Police Fund - $14,568.88; Fire Fund -
$4,943.98; Debt #1 - $6,366.10; Metro Sewer - $40,37; Debt #2 - $2,609.29;
