HomeMy WebLinkAbout2003-003 Council Resolution• • CITY OF LINO LAKES RESOLUTION NO. 03-03 AUTHORIZING APPLICATION FOR TITLE OF TAX FORFEIT PROPERTY WHEREAS, The real property (PIN #36 31 22 14 0004) described in Exhibit A (hereinafter "The Property") became forfeited by the State of Minnesota by reason of nonpayment of taxes and due operation of law as evidenced by the county auditor's certificate of forfeiture dated August 23, 1994 and recorded on August 23, 1994 as document number 1132126 in the office of the Anoka County Recorder. WHEREAS, The Property was acquired by the City of Lino Lakes for public use; WHEREAS, it is advisable that the City of Lino Lakes retain The Property for public use. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LINO LAKES, MINNESOTA: 1. The classification of The Property for public use is hereby approved. 2. Staff is authorized and directed to notify the Anoka County Land Commissioner that the City would like to obtain title to The Property for public purposes. Lino Lakes,•County of Anoka, Minnesota • • STAFF ORIGINATOR: DATE: TOPIC: VOTE REQUIRED: AGENDA ITEM 7B Mary Alice Divine 1/13/03 Consideration of Resolution No. 03 -03 Authorizing Application for Title of Tax Forfeit Property Simple majority BACKGROUND: This parcel of property in Lino Lakes went tax forfeit in 1994. The City obtained title to the property for public open space by notifying Anoka County pursuant to M.S.A. 282.01 Subd. 1 a. However, after five years in public ownership, the city must verify the property is still being used for public purposes. A Notice of Verification was not mailed to the State, so the property reverted back to tax forfeit classification. The parcel continues to be used as public open space. This recommended action will reinstate the land as public property owned by the City of Lino Lakes. OPTIONS: 1. Adopt Resolution No. 03 -03 Authorizing Application for Title of Tax Forfeit Property. 2. Do not adopt the resolution. 3. Return to staff for further consideration. RECOMMENDATION: Option 1 • • Resolution No. 03 -03 Councilmember Dahl introduced Resolution No. 03 -03 and moved its adoption. The motion for adoption of the foregoing resolution was duly seconded by Councilmember Reinert and upon vote being taken thereon, the following voted in favor thereof: Dahl, Reinert, Bergeson, Carlson and O'Donnell. The following voted against same: None. Whereupon said resolution was declared passed and adopted.
