CITY OF LINO LAKES
RESOLUTION NO. 03-07
RESOLUTION AMENDING AND RESTATING THE CITY OF LINO LAKES HEALTH
CARE AND DEPENDENT DAY CARE PLAN EXPENSE REIMBURSEMENT PLAN,
(the "Plan ")
WHEREAS, the plan was adopted per Resolution No. 78 -90 with the effective date of
January 1, 1991, and
WHEREAS, the plan was amended and restated per Resolution No. 95 -156 with an
effective date of January 1, 1996, and again per Resolution No. 00 -119
with an effective date of January 1, 2001 and
WHEREAS, the City of Lino Lakes wishes to amend and restate the plan document
effective January 1, 2003, to include the following;
1. Final COBRA Regulations issued January 1, 2001;
2. Final FMLA Regulations issued October 17, 2001;
3. Update Claims Appeal Process issued July 1, 2002;
4. Plan Name shall be changed to the City of Lino Lakes Flexible
Spending Accounts Plan
• NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Lino Lakes
that:
1. The City of Lino Lakes Flexible Spending Accounts Plan is hereby amended
and restated and adopted in the form presented to the City council effective
as of January 1, 2003.
2. Any authorized persons of the Employer are hereby authorized to make such
contributions from the funds of the Employer as are necessary to carry out the
provision of said plan at any time.
3. In the event any conflict arises between the provisions of said Plan and the
Employee Retirement Income Security Act of 1974 (ERISA) or any other
applicable law or regulation (as such law or regulation may be interpreted or
amended), the City shall resolve such conflict in a manner which complies
with ERISA or such law or regulation.
Adopted by the Lino Lakes City Council this 13th day of January, 2003.

Expense Reimbursement Plan (the "Plan')
VOTE REQUIRED: Simple Majority (3/5 Vote)
BACKGROUND:
The City maintains a flexible spending accounts plan through which employees may
elect to pay for medical and daycare expenses using pre -tax income. From time to time
it is necessary to update our plan documents to comply with and incorporate new
regulations. It is recommended that the city's Health Care and Dependent Day Care
Expense Reimbursement Plan be amended to incorporate changes that have occurred
since the last plan document update in 2001.
The following resolution incorporates four changes to the current plan document. They
are:
1. Incorporate the final COBRA Regulations issued January 1, 2001;
2. Incorporate the final FMLA Regulations issued October 17, 2001;
3. Update Claims Appeal Process issued July 1, 2002; and
4. The Plan Name shall be changed to the City of Lino Lakes Flexible Spending
Accounts Plan
OPTIONS:
1. Approve Resolution 03 -07
2. Deny Resolution 03 -07
RECOMMENDATION:

Councilmember O'Donnell introduced Resolution No. 03 -07 and moved its adoption.
The motion for adoption of the foregoing resolution was duly seconded by
Councilmember Carlson and upon vote being taken thereon, the following voted in favor thereof:
Dahl, Reinert, Bergeson, Carlson and O'Donnell.
The following voted against same:
None.
Whereupon said resolution was declared passed and adopted.
