CITY OF LINO LAKES
RESOLUTION NO. 03-26
RESOLUTION APPROVING THE SUMMARY OF THE SUBDIVISION ORDINANCE
(ORD. NO. 04-03) FOR PUBLICATION
WHEREAS, The City Council approved a new subdivision ordinance, Ordinance 04 -03, on
February 24`h, 2003, and
WHEREAS, Ordinance 04 -03 is lengthy and MN Statute 412.191, Subd. 4. provides for a city to
publish a summary of an ordinance, and
WHEREAS, the City Council determines that the summary clearly informs the public of the
intent and effect of the ordinance, and
WHEREAS, the publication in the official newspaper will include a notice that a full printed
copy of the ordinance is available at City Hall,
NOW, THEREFORE, BE IT RESOLVED that the City Council approves the summary in
Attachment A for publication according to state law and the City Charter.

SUMMARY OF ORDINANCE NO. 04 -03
AN ORDINANCE REGULATING SUBDIVISION AND PLATTING AND
AMENDING CHAPTER 1001 OF THE LINO LAKES CITY CODE
The City Council of Lino Lakes hereby ordains that this Ordinance 04 -03 replaces Chapter
1001.01 through 1001.19 of the City Code.

Section 1001 Title and Application, including definitions
Section 1002 General Provisions, including compliance with comprehensive plan and zoning
ordinance
Section 1003 Concept Plan requirements, including submittals and review procedure
Section 1004 Preliminary Plat requirements, including submittals and review procedure
Section 1005 Final Plat requirements, including submittals and review procedure
Section 1006 Minor Subdivision requirements, including submittals and review procedure
Section 1007 Design Standards, including blocks, lots, streets, stormwater management, and
utilities
Section 1008 Public Land Dedication (park dedication)
Section 1009 Tree Preservation requirements
Section 1010 Improvements required for subdivisions, including development agreements
Section 1011 Financial Guarantees, per the City's public improvement financing policy
Section 1012 Enforcement
Section 1013 Severability
Section 1014 Effective Date

Approving A Summary of the Subdivision Ordinance

BACKGROUND
The City must publish all ordinances. The subdivision ordinance is lengthy and the cost of
publishing the entire ordinance would be excessive. State statute (412.191) allows a city to
publish a summary of an ordinance rather than the entire ordinance.
• The attached Resolution No. 03 -26 includes a summary of the ordinance and approves the use of
the summary for publication.
OPTIONS
1. Approve Resolution 03 -26 to authorize publication of a summary of the subdivision
ordinance.
2. Return to staff with direction.
