HomeMy WebLinkAbout2003-060 Council ResolutionCITY OF LINO LAKES RESOLUTION NO. 03-60 RESOLUTION APPROVING A MUSA RESERVE ALLOCATION AND PRELIMINARY PLAT/ PLANNED UNIT DEVELOPMENT STAGE PLAN FOR CENTURY FARM NORTH WHEREAS, the City has received applications for developing an area known as Century Farm North; and WHEREAS, the development requires approval of the allocation of Metropolitan Urban Service Area (MUSA) reserve and approval of a preliminary plat/planned unit development stage plan; and WHEREAS, a public hearing was held before the Planning & Zoning Board on December 11, 2002 and was continued to January 8, 2003 and February 12, 2003; and WHEREAS, the proposed MUSA allocation and preliminary plat/planned unit development stage plan meet the requirements of the City's Growth Management, Zoning and Subdivision Ordinances; and WHEREAS, the City Council approved Ordinance 12 -03 rezoning the site to Planned Unit Development for residential development; and NOW, THEREFORE, BE IT RESOLVED that the City Council of Lino Lakes hereby approves the MUSA allocation and preliminary plat/planned unit development stage plan for Century Farm North with the following conditions: 1. A total of 55.0 acres of MUSA shall be allocated for the project, and the project's 249 residential units shall be developed in accordance with the following phasing plan, which is illustrated on Attachment A: year 2003 2004 2005 2006 2007 total MUSA acres to be Allocated 15.3 11.4 13.5 5.4 9.4 55.0 Lots to be final platted 60 61 52 43 33 249 2. A cul de sac will be constructed at the east terminus of the new Carl Street within Century Farm North. Carl Street will not be connected to the existing Carl Street as part of the Century Farm North development. • 3. The driveway of Lot 7, Block 6 be shifted eastward to the extent possible. 4. The submitted townhome housing types and building elevations be modified to specify finish materials and be subject to City approval. Side walls facing public streets shall include windows or other architectural features to avoid the appearance of a blank wall. 5. Lots 1 -3, Block 4 shall be "airpark" lots. If these or other designated airpark lots are to be converted to non - airpark lots in the future, depending on the extent of changes to the design or configuration of the lots and roads, this could require replatting and a PUD amendment, at the City's discretion. 6. The applicant provide documentation to the City that all applicable runway safety requirements have or will be satisfied. The runway safety zone requirements are herebay established as a zoning restriction. As shown on the preliminary plat, the restricted area is measured from the edge of a 200' wide strip centered on the runway. At 126' from the edge, the maximum structure height is 18'. At 175' from this edge, the maximum structure height is 25'. The structure height maximum limit shall follow the slope of this imaginary surface and shall continue to extend over the development. 7. Specific hanger designs be submitted subject to City approval prior to consideration of the final plat approval of the lots with the hangers. 8. All homeowner association by -laws be subject to review and approval by the City Attorney prior to consideration of the final plat for lots where the association applies. 9. The wetland mitigation plan be subject to comment and recommendation by the City Engineer and Rice Creek Watershed District. All conditions imposed by the Rice Creek Watershed District shall be satisfied. The filling of land intended to be upland for park dedication must be accepted with the mitigation plan. 10. Park dedication shall include cash as well as land, shall include the trail across the 2 °d Addition to the eastern plat boundary, and include rough grading of the park land. Generally, park land shall be as indicated on the "Parks /Open Space" plan submitted in the April 2003 booklet. However, a new preliminary plat shall be submitted that clearly shows the park dedication lands, along with upland data for all areas intended to be dedicated as parkland. This data shall be reviewed to ensure acceptability prior to final plat approval. There must be a minimum of 4.5 (four and one -half) acres of contiguous upland useable for active recreation uses as determined by the Public Services Director, and a minimum of 7.0 (seven) acres total upland. The cash dedication may, at the City's discretion, be reduced by the cost of trail construction or other in -kind activities by the developer. Trail locations within the park areas shall be determined by the overall park design. The final park dedication shall be included in the development agreement, which must be reviewed by the City Council for approval. 11. Grading, drainage and utility related modifications and comments as recommended by the City Engineer in the attached memorandum (dated April 16, 2003) shall be addressed and incorporated into the plans. 12. The project is subject to the results of the sewer feasibility study. 13. The project is subject to the City's determination of the number of residential units to be allowed to connect to the City water system, based on the system's ability to provide adequate service, prior to the construction of the infrastructure needed to provide service to the units. 14. The project is subject to all requirements of Anoka County regarding access to Sunset Road/CR 53. 15. Additional right of way for Sunset Road/CR 53 shall be dedicated, to total 60' from centerline, within all areas of the plat. 16. The City formally vacate the segment of Carl Street as needed for developing this plat. 17. The airplane hangers in Lots 1 -4 and Lot 9, Block 4 (Phase 1) shall be built on the runway side of the houses, with the houses fronting on the road rather than the houses on the runway side of the lots. 18. Signs shall be installed along all wetland buffer /easement areas. Wetland easements shall extend, at a minimum, 10 feet outward from the delineated wetland boundary. 19. This resolution shall not be effective until the rezoning approved by Ordinance 12 -03 is in effect. 20. Elements of the project not specifically designed or addressed in the plans and supporting documents are subject to the standards of the zoning ordinance. R -1 standards will apply to single family detached portions, the R -3 standards to the multi - family attached portions. 21. Prior to consideration of a final plat, a revised preliminary plat shall be submitted for City review to ensure that it reflects approved revisions. 22. The referenced plans essentially provide general information regarding proposed grading and utilities. The plans presented for review at this time are not considered plans to be used for actual construction since much of the detailed design and construction information is not yet provided. This includes construction notes, provisions for private utilities, City of Lino Lakes standard plates and details for streets and utilities, building elevations and types, invert and rim elevations of sanitary sewer and storm sewer manholes and appurtenances, and other pertinent information. The comments provided in this memorandum are therefore considered more general in nature, based upon the information provided. It is expected that these plans would eventually be further refined into construction plans, and would be reviewed again in more detail prior to actual construction. ip 2. Street names and stationing must be provided on all sheets in order to provide reference points and identify locations for comments. A traffic study for this area was previously prepared by SRF Consulting Group, and reviewed by TKDA. The study primarily addressed the issue of an east -west connection between Sunset Avenue and 4th Avenue in this area. Carl Street and other alternatives were addressed. It has been recommended that the street and utility plans be designed in a manner that will allow for a future connection to Carl Street and extension of utilities. However, pIn Zn tg has recommended that the Carl Street connection not be made. 4. The Geotechnical Report provided is based upon seven (7) borings conducted in 1998. As stated in their report, Braun Intertec advises that they be allowed to review final design plans prior to construction due to the limited amount of design information available at the time of their investigation. In addition, Braun advises that their recommendations again be reviewed upon establishment of final building grades, house types, and utility designs. Additional borings and piezometer tests may be necessary, particularly in view of the relatively high groundwater levels observed at the time of testing in 1998. ENGINEERING REVIEW COMMENTS: 1. Sanitary Sewer System - Plan Sheets Ul and U1A through U1D:' A. The existing sanitary manhole invert elevation located at the intersection of Pinto Lane and Mustang Lane has been revised to the correct elevation of 892.25, per available records. Per previous review and discussions, a sewage lift station will be required, and is shown on the plans. A review of the proposed sanitary sewer system is being undertaken to take into account not only the Century Farms North subdivision; but also future needs of currently undeveloped and adjacent un- sewered areas. That is, sanitary sewer system trunk and lateral lines along with pumping lift station(s) need to be sized, depth determined and alignments chosen with future use considered beyond the subdivision boundaries, in accordance with the City's Comprehensive Plan. Upon further preliminary design of the lift station, the location of the lift station may be subject to change as well. B. The utility plans received show proposed pipe sizes with minimum slopes and proposed manhole locations. Manhole rim and invert elevations are not shown on the plan, but have been provided on a separate sheet. Specific invert elevations for structures on Century Trail (15 -inch diameter trunk sewer) will be verified upon preliminary design of the proposed lift station. As previously mentioned, sizing of the 15 -inch diameter main (that will also serve future growth) will also be verified in conjunction with sizing the lift station. However, manhole structures and 8 -inch diameter lines specific to Century Farm North and feeding to the trunk line, can and should be identified with proposed invert elevations accordingly. It is expected that all structure elevations (rim and inverts) will be shown on the plans as they are further prepared for construction purposes. C. The 8 -inch diameter sanitary sewer on Century Trail and west of Pinto Trail must be reviewed and addressed further to assure that any possible future sewer needs on Sunset Trail may be accommodated accordingly. Engineering Review Page 3 April 16, 2003 Century Farms North (1st -6th Additions) D. The direction of sewage flow at certain locations must be clarified further. For example, flow at Manhole 64 on Stallion Drive (Sheet U1B) is shown in two different directions. Similar confusion is shown on Sheet U1C at Manholes 60, 47, 45, 50, 57, and 58. Plans must be revised accordingly. E. Sanitary sewer system materials and installation methods shall follow the City of Lino Lakes engineering standards. F. The Developer shall provide to the City of Lino Lakes a copy of the completed MPCA sanitary sewer permit, including correspondence and approval of Metropolitan Council Environmental Services (MCES). G. The Developer shall provide permanent easements for sanitary sewer system piping and components for utilities not in the public right -of -way. Sanitary sewer installation shall be installed in accordance with the recommendations of the geotechnical report provided. 2. Watermain System - Plan Sheets U1 and UlA through U1D: A. Fire Hydrants shall be added at the watermain terminus for the east end of Stallion Road and the north end of Century Trail for flushing purposes. B. The watermain system proposed for Century Farms North is currently being reviewed to verify and confirm conformance with the City's overall Comprehensive Plan. In addition, the City of Lino Lakes is in the process of performing a flow test to better ascertain existing pressures at this location. We are also reviewing the need for watermain installation on or near Sunset Road (CSAH No.53) to address overall water system balancing and capacity considerations (looping), and to provide for possible future services. C. Watermain system materials and installation methods shall follow City of Lino Lakes engineering standards. D. The Developer shall provide to the City of Lino Lakes a copy of the completed MDH permit for watermain installation. E. The Developer shall provide permanent easements for watermain piping and fire hydrants in locations not in the public right -of -way. F. Watermain installation shall be installed in accordance with the recommendations of the geotechnical report provided. • Engineering Review Page 4 April 16, 2003 Century Farms North (1st -6th Additions) 3. Stormwater System - Plan Sheets 01, G2 and G1A through G1D: A. Stipulations set forth by the Rice Creek Watershed District (RCWD) permit application review /approval process shall be met, including wetland issues. It is our understanding that the Developer has submitted a review application to RCWD. It will be important for the Developer's Engineer to keep the Lino Lakes City Engineer updated as the review process with RCWD progresses. Ultimately, the City will review the approved RCWD permit to determine if the City's requirements are met. The Developer's Engineer has claimed through analysis that water levels in a wetland in Outlot C cannot support the delineated vegetation. They are requesting that the wetland area be reduced by fifty (50) percent. It is the LGU's (RCWD) responsibility to resolve this issue with the Developer's Engineer. Resolution of this issue could involve City Staff input. B. The overall routing of storm drainage from the development area must be in conformance with the City's Comprehensive Drainage Plan, and the Rice Creek Watershed District. The project area falls within the realm of the County Ditch 10 drainage sub - watershed system boundaries and ultimately drains to Marshan Lake. All drainage must continue to perpetuate from the site in accordance with the Comprehensive Drainage Plan. C. There are concerns regarding the proposed depths of the stormwater ponds in relation to groundwater elevations. The geotechnical evaluation provided indicated that the range of groundwater elevations is in the 891 to 893 range. Many of the proposed stormwater pond bottom elevations would be lower than the range of groundwater elevations. Thus, stormwater capacity will potentially be reduced significantly, and there would be other issues with regards to excavating below groundwater levels. D. In general, the City does not allow storm sewer pipes or inlets to be less than 15 inches in diameter. The Developer's Engineer should make the changes necessary to the proposed storm sewer conveyance system and inlet structures to comply with this City requirement. E. Proposed storm sewer outlet and inlet invert elevations are incomplete; elevations are shown in some locations but not others. The plans shall be updated with this information accordingly, and be further reviewed by RCWD as part of the Watershed application/review. F. Permanent easements with access availability will be required for all stormwater ponds and conveyance systems not located within the public right -of -ways. G. Drainage calculations have been submitted and the following comments are provided: 1. Existing drainage area and proposed drainage area maps need to be submitted. Drainage area maps should be labeled to match the model. 2. Pond outlet details area needed. This information is also needed to verify the pond information in the HydroCAD model. Engineering Review Page 5 April 16, 2003 Century Farms North (1st -6th Additions) 3. Pipe sizes and slopes should be shown on the Grading Plan. 4. Pipe invert elevations need to be shown on the Grading Plan for all culverts, pipe inlets, and pipe outlets. 5. Normal water level, high water level, pond or wetland labels, etc. need to be shown on the Grading Plan. Pond and wetland labels should match the HydroCAD model. 6. Building pad elevations, including lowest floor elevations must be provided on the Grading Plan. 7. Overflow locations and elevations are needed for all yard catch basins. 8. How are the wetlands being modeled? 9. How is the ditch from Outlot C to Outlot B being perpetuated through the proposed road? 10. City of Lino Lakes standard details for catch basins and catch basin/manholes call for a minimum build of 4 -feet from top of pipe to gutter, unless a perforated drain is added. Then the minimum build is 2' -6" from top of pipe to gutter. 11. The Site Plan and a Wetland Mitigation Plan must be approved by RCWD, and documentation provided to the City. 4. Airport Issues: On the south side of the development site there is an airport runway landing strip area. Since the proposed construction will abut the runway area, it is recommended that the Developer provide written permission (or if a permit is needed) from the appropriate regulating authorities stating that there are no conflicts or issues that affect the airport runway. 5. Street System - Plan Sheets G1, G2 and G1A through G1D: A. All centerline street grade slopes are to be a minimum of 0.5 %, including slopes around the perimeter of culs -de -sac. B. At the east end of Carl Street, a roadway connection to the existing cul -de -sac is recommended to be constructed as part of the Century Farm North subdivision. This should include a 32 -foot wide permanent street with modifications to the existing cul -de -sac. It is also recommended that utilities and sidewalk be extended in conjunction with the street construction, as previously mentioned in the General Comments. However, wing and 4g has recommended that the Carl Street connection not be made. C. All of the public streets with the exception of Stallion Road scale as 32 -foot wide roadways. Stallion Road scales as 36 feet wide. It is recommended that no parking be allowed on any Engineering Review Page 6 April 16, 2003 Century Farms North (1st -6th Additions) public subdivision street. Recommended speed limits should range between 30 and 40 miles an hour, and be established in accordance with the roadway design, and regulations and policies of the City and State of Minnesota. Street typical sections will need to be developed based on engineering traffic, soils data, and recommendations of the geotechnical report. The report has indicated that the top 0.5 to 2.5 feet of existing ground is organic in nature and should be removed. Underlying the organic materials are silty sands that are highly frost susceptible. As recommended in the report, the silty sand (up to two feet in thickness) should be removed and replaced with granular bedding material beneath the aggregate base and pavement. A typical street section and pavement design must also be provided and reviewed. D. All street system components shall, as a minimum, meet City of Lino Lakes engineering standards. 6. Anoka County Highway Department Issues: A. The Anoka County Highway Department staff, through its permitting process, will need to be involved with connection from Century Trail and Stallion Road to Sunset Road (Anoka County No. 53). It could be expected that turn lanes may be necessary at these two (2) intersecting subdivision roadways. It is important that this issue remain at the forefront of final street layout considerations. City staff needs to be involved with any County/Developer access discussions. B. Also, regarding driveway access to an existing home in the southeast quadrant of Century Trail and Sunset Road (CSAH No. 53), Anoka County may require relocation of this driveway from Sunset Road to possibly Century Trail. The close proximity of the existing driveway to the proposed Century Trail Street has traffic safety concerns. 7. Bikeway /Sidewalk - Plan Sheets G1, G2, and G1A through G1D: According to the information provided on the plan sheets, there is an existing walkway (type unknown) located approximately at the SW corner of Lot 1 and Block 4 on the south side of Century Trail and runs parallel to the existing ditch. It is recommended that a connection from Century Trail be extended to the south to meet this existing walkway. City Staff should review the comprehensive Trail Plan to determine if this connection is necessary. 8. Preliminary Plat with Easements: The Developer is to provide to the City Engineer a copy of the preliminary plat clearly showing dimensions of public rights -of -way and permanent easements with designation for review and comment. Project Phasing It is recommended that the Developer and City staff together review the proposed phasing plans in further detail. Mutual understandings and agreements regarding utility extensions, Carl Street connection, wetland mitigations, and other improvement issues must be resolved and agreed upon prior to commencing any construction. • Do December 4, 2002 TO: Jeff Smyser, City Planner FROM: Rick DeGardner, Public Services Director SUBJECT: Amended Preliminary Site Plan for Century Farm North 1 -7th Additions The Park Board reviewed the Preliminary Parks /Open Space Plan for the Century Farm North 1- 7 Additions (dated 11/18/02) at the December 2, 2002 Park Board Meeting. There was consensus among the Park Board Members that the concerns /issues discussed at the August 5 Park Board Meeting have been addressed. I have identified some issues that should be discussed prior to the final design being completed: Sidewalk along Century Trail — Current plans are to install a 6' wide concrete sidewalk along the southern side of Century Trail, within the right -of -way. The trail begins at Sunset Road and extends to Carl Street. The plan indicates the sidewalk continuing easterly along Carl Street. We need to make sure this sidewalk extension makes sense, de ending u o the existing Carl Street. P g P n the future plans of Trail along northern most street — The plans currently indicate a 8' wide bituminous trail along the southern edge of the road, from Sunset Drive to the eastern edge of the development. We need to look at the future plans for the property to the east to determine whether an 8' wide bituminous trail will make sense when the road is extended to 4th Avenue. Perhaps we may need to consider a 6' wide concrete sidewalk. Trails within ark area — The preliminary grading plan indicates the developer will be gradin g the entire park area. Past practice has been to have the developer grade and install the base for the trails. However, this should not be done within the park area as depicted on the Preliminar Tree/Landscape Plan. We will need to develop a master plan for the park area, which will y include trails. I expect that we will not locate the trails as illustrated. I am interested in being involved in the discussion regarding the application of the Pk Dedication Ordinance related to this development. This may be a complicated pro ess to determine what park dedication has already been fulfilled with prior plats. Also, we will need to ensure that the proposed trails along the streets are adequately funded; We may want to indicate in the Developers Agreement specifically what activities (i.e. grading park area, installin g trails, etc.) are required along with what City contributions will be committed for the projects. •I have also included a copy of my letter dated August 6, 2002 regarding the original reli plat for your review. There was consensus from the Park Board Members to approve the plan as presented with the following caveat: Assurance that when the wetland area within the park is defined there is at least 41/2 acres of contiguous upland area suitable for park development. In addition there should be a minimum of eight acres of useable upland within the entire park area. There is a concern from the Park Board that the open space /green ways are reducing the size of active park areas. For example, the 150'x100' area east of the park is classified as upland but really can't be used for anything than a trail corridor and open space. If. the open space areas are credited towards fulfillment of the park dedication requirements, this reduces the amount of active park land (or cash) derived from the developer. The open space areas proposed to be owned by the city need to be addressed. A determination must be made as to whether any enhancements will take place (i.e. natural prairie, native plantings) and any maintenance plan so all interested parties, including potential adjoining home owners, are aware of the plans for the open space areas. I think the development has done a good job incorporating several linear trail corridors. However, I question the necessity of having two trails branching out southward from Carl Street. The western most trail will result in a property owner having a trail on the front and the side of their home. Unless this is a pristine, natural area that residents will use for the aesthetic value, perhaps one trail access directly south of the proposed park area will suffice. Perhaps we can get together and discuss the proposed park area, trail corridors, and open space to determine what is reasonable in fulfilling the park dedication requirements. Any remaining balance should be fulfilled by cash or in -kind services such as grading. Ask Developer to reevaluate the preservation of historic oak areas on the South side. • Integrate Tree preservation into Operations plan for protection of soil, pond, infiltration and swale areas. This would include a plan for fenced protection areas for these as well as siltation fence locations. • Preserve the wet meadow area to the North and West. Use conservation easements under city ownership in other areas requiring buffering. • Require signage locating all conservation areas. • Require covenants in the Homeowner Association for no impacts in buffer areas. • Require a separate and distinct conservation disclosure brochure to be given to homebuyers before lot purchase. • Prohibit the removal or importing of soils off -site without approvals from the City. • Require the Developer to Escrow (1) 2.5 -inch boulevard tree per frontage. • Page 1 1 • Detail a Plan that sequesters park and greenway areas. • Require low impact, downward focused, low -spill, low -impact street lighting. And in Addition the December 4th Environmental Board Recommended • The tightly banded soil areas within the proposed public open -space are analyzed for preservation and restoration of possible unique resources. That these areas are protected from soil disturbance, and have the original hydrologic characteristics restored where it is possible. • That the developer be required to use pervious paving in the town home overflow parking areas if the City determines these parking areas are needed. • That staff works with the developer on changes to the proposed landscape species.
