October 24, 1977
The regular meeting of the Lino Lakes City Council was called to order at 8:00 P.M.,
October 25, 1977 by Mayor Bohjanen. Council members present; Karth, McLean, Zelinka.
Absent; Schneider. Mr. Gotwald was present and Mr. Locher will arrive late.
Mr. Karth moved to approve the minutes of October 11, 1977 as presented. Seconded by
Mr. McLean. Motion carried unanimously.

Mayor Bohjanen said as long as bikeways were being discussed, he had a question. If the
City establishes bikeways, and someone is injured while using those bikeways, is the City
responsible? Whose insurance would cover the injured person? There was some discussion
with the Council deciding to ask Mr. Locher for an opinion on this matter.
The Clerk presented the following items for Council consideration:
..The application for Planning Assistance Grant Funds is due October 27, 1977. Since
Mr. Short and Mr. Gotwald felt that more time was needed in order to complete their work.
A provision for the extension of the due date is made and and Mr. McLean moved to pass
a Resolution stating "The City of Lino Lakes requests a thirty (30) day extension to pro-
vide ample time for the City Planner and City Engineer to complete the necessary work
to complete the application." The motion was seconded by Mr. Zelinka. Motion carried
unanimously.
..A form in connection with the Anti- recession funds had been received should be answered
and returned. Mr. Zelinka moved to authorize the Clerk to answer the questions. Seconded
by Mr. McLean. Motion carried unanimously.
..Mr. Schneider had called to say he had no problems with the letter of engagement from
Mr. Anfinson. The authorization for the Mayor to sign should be voted on by this Council.
Mr. Zelinka moved to authorize Mayor Bohjanen to sign the letter. Seconded by Mr. McLean.
Motion carried unanimously.
..A contract from Mr. William Short, City Consulting Planner, should also be considered.
Mr. McLean moved to authorize the Mayor to sign this contract. Seconded by Mr. Zelinka.
Motion carried unanimously.
..The Clerk had confirmed the postphooeeent of the Union Meeting until November 3, 1977
at 8:00 P.M.
..A copy of the proposed rules governing standards for individual sewage treatment systems
had been received from the Pollution Control Agency. A copy for Mr. Locher, Mr. Vadnais
and Mr. Gotwald had been made.
..A check for $341.99 for shade tree control had been received. This is for the 1st
quarter only.
..A copy of the proposed amendments to the Development Guide had been received. The
Clerk was instructed to forward this to Mr. Short. Mr. McLean so moved. Seconded by
Mr. Karth. Motion carried unanimously.

III..Mr. Locher had forwarded a copy of a pre- hearing statement written by Mr. Hoeft, Assist-
ant Staff Counsel for the Metropolitan Council. Copies of this had been made for all Council
members, Mr. Short and Mr. Gotwald. The hearing before the Public Examiner has been post -
phoned indefinitely.
..The Auditor had sent a notice of two parcel of property that have been forfeited to the
State of Minnesota - one is the outlot in the Rondeau Lake Addition bordering West Rondeau
Lake Road and the other is the lots on the Northwest corner of Sunrise Avenue and North Road.
The Council instructed the Clerk to contact the Auditor on this last parcel to be used
as a possible collector point for the transit system. Mr. Zelinka so moved. Seconded by
Mr. McLean. Motion carried unanimously.
..An application for reimbursement funds for the shade tree program had been received. The
Clerk will contact the Tree Inspector for assistance with the application.
..Information from Anoka County on the 911 Emergency Telephone service had been received
in the office.
..Mr. Donald C. Slater of Norfolk, Virginia, is the new Executive Director of the League
of Minnesota Cities.
..Mr. Ed Wiener of Ware Road had filod,an application for the storage of an unlicensed
car belonging to his daughter who is in the service. Mr. Zelinka moved to approve this
application. Seconded by Mr. Karth. Motion carried unanimously.
IIII..Municipal fines for the month of September were $540.00.
..The Clerk had received notification of a Intergovernmental Cooperation Program to be held
at the Ramada Inn, St. Paul, on November 17th and 18th. The total cost for attendance is
$10.00. This invitation was extended to the Clerk and the participants were nominated by
State Senators and State Representatives. The Council asked this be tabled until the
November 14, 1977 meeting.
Mr. Roy Stanley had applied for a variance for an extra long driveway on one of the lots
in Sunset Oaks. The area best for constructing a home is beyond the 300' limit. The Clerk
had attempted to contact members of the Planning and Zoning Board for their input, but
had been unable to contact them. Mr. McLean moved to approve this variance with the Clerk
to inform the Planning and Zoning Board of this action. Seconded by Mr. Zelinka. Motion
carried unanimously. Mr. Zelinka reminded Mr. Stanley that the maintenance and upkeep
of this driveway is the responsibility of the home owner.
Mayor Bohjanen had no report.
Mr. Karth presented an application from the State Highway Department for funding assistance
for bikeways. Mr. Gotwald felt this should be checked out. Mr.Zelinka felt the Park Board
should be made aware of this. Mayor Bohjanen felt this is a good idea but the liability
of the City should be checked with the Attorney.
Mr. Zelinka moved to submit this to Mr. Short with the suggested plan designed by the
Park Board members several years ago, ask that he put some suggestions on a map and submit
the application. Seconded by Mr. McLean. Motion carried unanimously. Mr. Gotwald will
assist Mr. Short.
Mr. Karth reported that West Shadow Lake Drive is ready for blacktop and felt it should be
completed this week. 77th is dry and in good shape.

Mr. McLean reported that Mr. Karth and Mr. Schneider had accompanied him on Satu 'day,
October 22, 1977 and they had walked the area suggested as a park by Mr. Kronholm. They
had agreed this suggested area is much too low to afford any sort of park without extensiv
work and fill. To make this area usable would be a costly project.
These Council members had also checked the area north of the Creek and had found this could
be made usable with not much cost to the City.
Mr. McLean moved to propose to Mr. Kronholm, as representative of Drovers State Bank, the
City will not accept the area South of the Creek but will accept approximately the same
amount of land area North of the Creek. Seconded by Mr. Karth. Motion carried unanimously.
The Clerk was instructed to put this in a letter form and forward to Mr. Kronholm, as the
Bank's representative.
Mr. McLean felt this area to the North could be fenced, a parking area established with
some leveling, and a launch area could be designated along the creek with a beach area
to the North completely apart.
Mr. Gotwald suggested the Council consider an Ordiance covering both the money per lot and
the 10% of land for park purposes. This would allow flexiability in the Council as to which
would serve the City best.
Mr. McLean presented the plan for giving frontage to the duplex located off Eash Shadow
Lake Drive. The Bank would give the City a 60 foot strip to the house and 75 foot strip
for frontage with no proposal for surfacing. At the time the outlot is platted, the City
would then vacate this land. In platting this outlot the street would come in from the
opposite direction. Mr. Zelinka so moved to accept this proposal with the understanding
there is to be no services for plowing or maintenance. Seconded by Mr. McLean. Motion
carried unanimously.
Mr. McLean continued his report from the Planning and Zoning Board meeting held on October
19, 1977.
Mr. Don Allen had asked to be on the agenda but did not attend the meeting.
Mr. Art Rehbein had appeared in connection with a parcel of land he had asked for a build-
ing permit on. Since the land has no frontage on an existing roadway, permits had been
denied. The Planning and Zoning Board had requested an opinion from the City Attorney.
This material had been turned ove to Mr. Rehbein. Mr. Locher had recommended that a build-
ing permit be denied on the property. The Planning and Zoning Board had approved this
recommendation to be forwarded to the Council. Mr. McLean moved this recommendation be
approved. Seconded by Mr. Zelinka. Motion carried unanimously.
Mr. Richard Lichtscheidl had applied for a special use permit to operate a small engine
repair shop on Main Street. There appeared to be sufficient signatures on the petition.
The Planning and Zoning Board had recommended approval of this special use permit. Mr.
McLean so moved. Seconded by Mr. Zelinka. Motion carried unanimously.
Mr. Don Holzmer had requested permission to build beyond the 300' limit on lands located
northeast of the corner of West Rondeau Lake Road and 81st Street West. There had been
some discussion at the Planning and Zoning Board meeting that his description did not in-
clude the lot on the corner that provided frontage for this property. Mr. Holzmer pre -
sented a legal survey to Mr. McLean that does include this lot, and had been combined with
the other lands to form one parcel. Mr. Gotwald checked the survey and approved. Mr.
McLean reported the Planning and Zoning had recommended approval of this request with the
provision the survey be provided. As that has been done, Mr. McLean moved to approve the

recommendation. Seconded by Mr. Zelinka with the provision that this property be limited
III to one building permit until a proper street has been constructed and that Mr. Holzmer un-
derstands there will be no City services to that driveway. Mr. McLean accepted the add-
itions. Motion carried unanimously.

Mr. Shearen had checked with some constractors in Washington County and found that 8 %.o
the land is required for parks in that County. He will check further.
Mr. Menkveld had presented a preliminary plat called Forest Glen for the 80 acres directly
West of the MMTC. This drawing has been forwarded to the Planner and Engineer for their
recommendations and Mr. Menkveld will be on the November agenda.
Mr. Zelinka reported that the Personnel Commission will be meeting some time within the
next couple of weeks to work on a job description for the part time park attendant. Mr.
Zelinka said he had tried at least six times to talk to Mrs. Billik and cannot get a response
to his knocks. He asked the Clerk to check with the Police Chief and find out if she is
still in the house. The Clerk was also instructed to withhold the October, 1977 payroll
check until this matter is straightened out.
Mr. Gotwald reported that he and Mr. Karth had inspected all the street which have had work
done on them this year. Orange Street is in good condition. There is one spot where some
drainage problems could occur but Mr. Gotwald felt this could be corrected. 77th Street
has a couple of low spots where the City will need to obtain drainage easements. This
will take care of the problems on that street. Mr. Zelink moved to authorize the Engineer
and the Attorney to start proceedings to obtain the necessary drainage easements. Seconded
by Mr. Karth. Motion carried unanimously.
Mr. Gotwald felt the Street in Carole's Estates would be constructed before any building
is done. He will forward any information to the Council. Mr. Ulmer will be constructing
the street in the Rice Lake Addition with the storm sewer installation - he will post a
letter of credit for the unfinished portion.
Mr. Gotwald had done the final inspection of the streets in Colonial Woods. They are com-
pleted, the boulevards are completed and Mr. Gotwald recommended acceptance of the streets
as part of the City's system and accept full maintenance of the street. Mr. Zelinka so
moved. Seconded by Mr. McLean. Motion carried unanimously.
Knov;1 %rive had also been inspected, the street is complete. There is some work to be
done on the boulevards. Mr. Gotwald recommended a letter of credit for $600.00 for finish-
ing the boulevards. Mr. McLean so moved. Seconded by Mr. Karth. Motion carried unanimously.
In the Plats of Lino Air Park North and Sunset Oaks there are a number of outlots that have
been designated as future streets. Mr. Gotwald's understanding was that after the plats
were filed, these outlots would then be turned over to the City. Mr. Gotwald suggested that
he get together with Mr. Locher and work out the legal aspects of this. Mr. McLean so moved.
Seconded by Mr. Karth. Motion carried unanimously.
There was no old business for discussion.
Under new Business, Mrs. Soucup presented a complaint to the Counc concerning the actions
of the Animal Control. Mrs. Bertrand and Mr. Ed Wiener also had complaints on their methods
of pperation. The Clerk was instructed to contact the firm and ask them to be present at
the next Council meeting to answer some of the questions raised here.
Mr. Locher arrived at 10:00 P.M. He cited the portions of the Ordinance that would apply
to Mrs. Soucup's problem. Her tickets were for dogs running at large.

The Clerk is to discuss this with Chief Myhre and ask that all persons whose dogs have
been impounded be notified immediately - providing there is a tag that will identify the
owner.
Northwestern Bell had applied for permission to install buried cable on Thomas Street.
Mr. Gotwald recommended approval. Mr. McLean so moved. Seconded by Mr. Zelinka. Motion
carried unanimously.
Mr. Locher said he had spent some time going over the Carole's Estate plat making some
minor corrections. There are still some problems with signatures of persons involved with
the estate of which this land was a part.
Mr. Zelinka moved to approve requisitions #781 through and including #785. Seconded by
Mr. Karth. Motion carried unanimously.
The office had questioned the paying of a bill from NSP for pumping sewage. The Clerk was
instructed to continue paying these bills but to keep a record of the amounts beginning
when this City ceased hauling.
Mr. Zelinka moved to approve checks #8315 through and including #8335. Seconded by Mr. Karth.
Motion carried unanimously.
Mr. McLean moved to adjourn at 11:00 P.M. Seconded by Mr. Karth. Aye.
These minutes were approve with correction November 28, 1977 at the regular Council meet-
ing.
