HomeMy WebLinkAbout02/12/1979 Council Minutes208 January 30, 1979 included in the Comprehensive Land Use Plan. The matter of the rural density will also be discussed at the time this plan is updated. Mr. Mazanec said he would rewrite this memo, get a copy to this Council, for discussion before it is forwarded to the Physical Development Committee. He also felt it might be a good idea for members of this Council to get together with members of that committee for an informal meeting to discuss this matter before it is presented to the committee as a whole. There was some discussion on the definition of soils used in the City's Restrictive Soils Ordinance. There are some differences that the Metro questioned. The City's practices as to requiring perc tests and soil borings was explained. These are required on all new buildings within the City - no matter where they are located. Mr. McLean indicated that he would like to start the work on updating the Comprehensive Land Use Plan, but most of these questions must be resolved first. Mr. Kulaszewicz moved to adjourn at 10:30 P.M. Seconded by Mr. McLean Aye. These minutes were considered and approved at the regular Council meeting held on February 12, 1979. 4L, Edna L. Sarner, Clerk- Treasurer February 12, 1979 The regular meeting of the Lino Lakes City Council was called to order at 8:00 P.M. on February 12, 1979 by Mayor Karth. Council members pre- sent; Kulaszewicz, McLean, Schneider. Absent; Zelinka. Mr. Locher was also absent. Mr. Kulaszewicz moved to approve the minutes of January 22, 1979 as pre- sented. Seconded by Mr. Schneider. Motion declared passed. Mr. Schneider moved to approve the minutes of January 30,1979 as pre- sented. Seconded by Mr. McLean. Motion declared passed. The Clerk presented the following items for Council consideration: ..An information booklet from the Bureau of Census on the Local Review Program had been received. They are asking for a liaison person to con- tact. The general consensus of the Council members was that all infor- mation should be sent to the Clerk's office. ..The application forms for the additional monies for Land Planning must be signed and returned. Mr. McLean moved to authorize Mayor Karth to sign the applications. Seconded by Mr. Kulaszewicz. Motion declared passed. ..Mr. Paul Miller, of Acton Construction, had written requesting the street that enters into their building site be bamed "Phelps Road ". The Council had no objections to this, however, Mr. McLean moved that this matter be checked with Mr. Arnold Kelling for conformance to City and Metro planning. Seconded by Mr. Kulaszewicz. Motion declared passed. All other incoming information has been copied for each Council member. February 12, 1979 Mayor Karth reported that he had oncsulted with Anoka County Engineers and had been told that the County has a policy against installation of street lights. Therefore, if the City desires a street light at the intersection of County Road #14 and County Road #84, the City will have to install the light. Mr. McLean moved to instruct Mr. Volk to obtain cost figures for this installation for Council consideration. Seconded by Mr. Schneider. MOtion declared passed. Mr. Schneider reported that he had talked with three different persons on the insurance problem and suggested setting a special meeting for this purpose for March 7, 1979, at 7:30 P.M. and he will contact these men and set the schedules. Seconded by Mr. Kulaszewicz. Motion declared passed. Mr. Schneider had some questions pertaining to Capital Outlay fro the Park Department, but will defer this matter until Mr. Zelinka is present. Mayor Karth reported that the Circle Pines Utility Commission had contacted him and asked to meet with the Council to discuss this Commission. The Council set 8:30 P.M. at the February 26, 1979 Council meeting for this purpose. If it is found there is not sufficient time at that meeting, then a special meeting will be scheduled. The matter of billing the Anoka County Park Department and the Anoka County Court Services for Police services was discussed. Mayor Karth will contact Mr. Robert Burman on these matters. The Public Hearing on the El Rehbein & Son request for rezoning was called to order at 8:30 P.M. In the absence of Mr. Locher, Mr. McLean read the notice of publication. All documents are in order. Mr. McLean asked for comments from the audience on this matter- there was none. Mr. McLean moved to approve this rezoning from Commercial and Residential /Agricultural to Light Industrial with the following stipulations, 1) to provide screening for the property to the North with the acceptance of the property owner; 2) the front of the building to be landscaped with grass and shrubery. Seconded by Mr. Schneider. Motion declared passed. Mr. McLean moved to close the hearing at 8:35 P.M. Seconded by MR. Kulaszewicz. Motion declared passed. After a small recess, the Public Hearing on the Oak Knoll Plat was called to order at 8:45 P.M. In the absence of Mr. Locher, Mr. McLean read the notice of legal publication. Mr. McLean asked for comments from the audience - there was none. Mr. McLean moved to approve this plat as presented subject to Mr. Locher's approval of the deeds setting forth the street description, the 10' strip on the East side of the plat and the 10' strip withheld from the plat, subject to bonding for the street con- struction prior to the issuance of building permits. Seconded by MR. Schneider. Motion declared passed. Mr. Schneider moved to close the Hearing at 8:55 P.M. Seconded by Mr, McLean. Motion declared passed. Mayor Karth opened the hearing on hunting at 9:00 P.M. The audience was told this meeting is for the purpose of gathering information. This in- formation will be studied and if there are changes, an Ordinance will be written and published. A public hearing will be held on the passing of the Ordinance. He asked taht all persons wishing to speak to please stand and give their 21.0 Februaru 26,E 1979 This meeting will be closed at 9:55 P.M. Chief Myhre was asked the major porblems and he said, I) treaspassing, 2) use of single ball shot and 3) shooting in the Anoka County Park. Mark Shaugnessy - Is the Park Boundaries defined? Mary - not ver good. Mark Hickle - Problems with Bor and Arrow? Mary - No. Ron Marier - Felt the current Ordinance was - adequate - just enforce it. Ben Benson - Problems with hinting or discharging of firearms? Mary - both. Felt problems come from illegal hunters and not enforcing the law rather than changing the law. Set aside an area for trap shottbng in the County Park. Conservation Officer - Cit's Ordinance cannot be enforced as written - maube only needs to ba reworded. His office cannot enforce local ordinances - can only enforce State Statutes. Mayor Karth - Is Lino Lakes included in a deer hunting zone - Yes, the zones include the eintire State. Larry Johnson - State Statute against carrying singel shot during grouse season - No. Gene Mobley- abolishing the right to carry single shot violation of Consitiution. Brian Dobie - Southeren communities have problems with treaspassing - have strong firearm laws - need permit to carry weapon, written permission from property owner. Richard Long - gave summary of data sheet given to all Council members. Locke Perkins - are there any proposed changes to prevent any man hunting if he was hinting legally? No, Mary said just to prohibit single shot weapons - loaded or shells on person and require written permission from property owner to hunt property. Dave Savernick - this area is not zoned for rifle so should not be using is zoned for slugs - some persons might not know they are illegal. Gene Mobley - could open space be used for trap shooting - duck hunting? Mayor Karth - didn't know - could be presented to Park Board. Jerry Blackbird - if trap shooting is condoned, have all the Twin City people out here using the range. Jim Flannery - understood legal hunter Ik - proposing to make enforce- ment easier - would provide for arresting of poachers. Larry Leibel - has never had problems with people from this area - problems with perople who come in from the outside. Glenn Rehbein - people from St. Paul with a card and key to the cable use the park property for hunting. Marv. - members of One Shot Gun Club have lifetime hunting privileges. Glenn Rehbein - has neighbor who was not a member of that Club but has hunting privileges in the park. Richard Long - has a guard who will tell people where they can hunt and have been sending them to George Watch Lake - is this correct? Mary - can hunt on the Lake but not around the Lake. Resident of Circle Pines - was concerned about the shooting in the Baldwin Lake area becoause of the close proximity to Golden Lake and the homes in that area. Jim Flannery- hunitn in Northfield area must have written permission from land owner on person. Should have additional signs for hunters 1 information. 1 Mayor Karth thanked all the people for there input and for attending the meeting. All the information will be sutdied and if any changes are to be made, this will be published and a public hearing held. February 12, 1979 A. JL 1 Mr. McLean presented some held over items from the last Planning and Zoning Board meeting. Mr. Dennis Cinningham had applied for a special use permit to operate a riding stable, with the boarding of horses and riding lessong. This to be located on the SouthEast corner of Cedar Street and 24th Avenue. Mr. McLean moved to approve this special use permit with an annual review. Seconded by Mr. Schneider. Motion declared passed. Mr. Gene Mobley had applied for a rezoning of his property on 20th Avenue South from Limited Business to General Business. Mr. McLean moved to set a public hearing on this rezoning for February 26, 1979 at 9:15 P.M. Seconded by Mr. Schneider. Motion declared passed. The method of reimbursing the building inspector was discussed. Mr. Schneider moved the Building Inspector be paid on a quarterly basis, with the check to be issued within the next 30 days. Seconded by Mr. McLean. Motion declared passed. Mr. Jim Arntzen appeared before the Council with a potential drainage problem in the Shenandoah area. This had been caused by the filling of a drainage ditch during the construction of a new home. He had contacted the builders 4 times with no results. After some discussion of this matter, Mr. Mobley said he would contact North NorthEast on the matter and get it cleared. There was discussion of the color of the new storage building with the suggestion that perhaps both buildings should be painted. The matter was deferred until next budget time. Material from the City of Andover had been received on the manner in which they have established septic system inspection. The Clerk is to re -write the information to conform to this City and forward to Council members. Mr. Mobley gave a report on the status of Mr. Ed Mann house. He felt they are conforming and the building should be finished by the latter part of June. There was some discussion on just who covers the homes at the North end of West Shadow Lake Drive. The two fire departments are discussing this matter. Mr. Schneider said the City should get written confirmation on the decision as to what department will be covering that area. Mr. Schneider moved to approve the Fire Contract with Centerville for the year 1979. Seconded by Mr. McLean. Motion declared passed. Mr. Ross had submitted a coucher for expenses incurred during his attendance to BCA. There were some questions and Chief Myhre was asked to clear the matter and submit a requisition for repayment. Mr. McLean moved to pay the Long Term Disability Insurance premiums. Secounded by Mr. Schneider. Motion declared passed. Mr. Volk reported on the problems of water damage in the police office and informed the Council of the action taken to recover some of the costs from insurance. Mr. McLean moved to approve requisitions #888, 894 through and including 212 February 12, 1979 #897., holding #896. Seconded by Mr. Kulaszewicz, Motion declared passed. Mr. McLean moved to approve checks #9421 through and including #9465. Seconded by Mr, Kulaszewicz. Motion declared passed. Mr. Kulaszewicz moved to adjourn at 11:00 P.M. Seconded by Mr. McLean. Aye. Sarner, Clerk- Treasurer February 26, 1979 The regular meeting of the Lino Lakes City Council was called to order at 8:00 P.M., February 26, 1979 by Mayor Karth. Council members present; Kulaszewicz, McLean, Schneider, Absent; Zelinka. Mr. Locher and Mr. Gotwald were also present. Mr. Kulaszewicz moved to approve the minutes of February 12, =1979 as presented. Seconded by Mr. Schneider. Motion declared passed.. The Clerk presented the following items for Council consideration: ..A copy of a letter sent to Mr. Short on a meeting scheduled by the County asking Mr. Short to attend. Mr. McLean moved that a letter be written to Mr. Crosswhite stating that members of this Council are unable to attend meetings scheduled during the day, but would be very willing to meet with him in the evening to discuss the plans. Seconded by Mr. Schneider. Motion declared passed. Mr. Gourley will be contacted to attend this meeting. ..Chief Myhre had recomputed the contract with the City of Centerville for Police coverage with credit to that City of the State Aid received by this City. Mr. Schneider moved to approve the contract with the new figure. Total cost to Centerville for the year 1979 will be $19,148.60. Seconded by Mr. McLean. Motion declared passed. ..All Council members have a copy of the letter received from WCCO on the special use permit. Mr. McLean moved this matter be presented to the Planning and Zoning Board for reconsideration. Seconded by Mr. Schneider. Motion declared passed. ..The matter of the contract with the animal control was discussed. Mr. Schneider moved to approve the contract with Baline Midway All Pets. Seconded by Mr. Kulaszewicz. Motion declared passed. ..The matter of naming the road into the Acton Company was considered. Mr. McLean moved to approve the request to name this "Phelps Road" Seconded by Mr. Kulaszewicz. Motion declared passed. ..Municipal fines received for the month of January was $212.17. Mayor Karth introduced Mr. Andy Gibas, of the Circle Pines Utility Commission, who gave background information on the establishment of the franchise with the City of Lino Lakes. He also presented his reasoning III for allowing Circle Pines Utltity to service Ulmer's Rice Lake Addition. Mayor Karth had a question as to the difference in the allocation of costs - if this is one system, why are the allocation different? Why is the Circle portion in the black and the Lino Lakes portion in the red? ,
