COUNCIL WORK SESSION 5 FEBRUARY 1992
Council Members present: Mayor Reinert, Neal, Kuether, and Elliott. Staff Members
present: City Administrator Randy Schumacher, and Assistant to the Administrator
Daniel Tesch. Others: Design & Review Board Chairman Fred Chase.
Mr. Schumacher explained the purpose for this meeting was review all changes to the
city's Planning and Zoning Code prior its adoption. Mr. Schumacher explained that
the proposed changes to this code range from simple codification of previously
adopted ordinances, to cosmetic changes prepared by DRB members and staff to
make the document more "user friendly ". Those changes have not been approved by
the council and for that reason it is necessary for the council to look at all changes,
one by one.
Mr. Schumacher introduced Mr. Fred Chase, Design & Review Board Chairman. Mr.
Chase has been very involved with the changes and is therefore the best qualified to
review this document with the council.
Council Member Kuether wanted to know how members of the public would be
informed of these changes. Mr. Schumacher replied that the public was notified
initially when most of these changes were adopted as ordinances. He also stated
that copies are on file for public inspection at city hall, and that any changes that
were not originally in ordinance form would be reviewed with the public in some
fashion.
Mr. Chase began by explaining that this has been an ongoing process for some time.
Mr. Chase added that in the updating process the disc with the original document had
had the new document saved over it, therefore we have no soft copy of the original
document.
Mr. Chase went on to explain, page by page, the changes made to the Planning and
Zoning Ordinance. The changes ranged from deleting redundant and outdated words,
to the establishment of Overlay Districts. There were no changes made to standards
or dimensions that were not part of an ordinance change.
After all the changes had been reviewed, Mayor Reinert thanked Mr. Chase for
meeting with the council, and also thanked him for his service to this Design and
Review Board. Mr. Chase had not wished to be reappointed when his term expired
in 1992. Mr. Chase thanked the council for their expression of gratitude. Mr. Chase
added that he would be willing to assist the council in the future in any manner they
would see fit. Mayor Reinert asked Mr. Chase what his opinion was on moving public
hearing to the advisory board level. Mr. Chase replied that they run the risk of having
two public hearing instead of one, one at the advisory board level and one at the

council level. The council again thanked Mr Chase for coming this evening.
Mr. Schumacher went on to review the upcoming council agenda. Mr. Schumacher
explained that a meeting would be held to discuss the Ron Birch lawsuit. Mayor
Reinert expressed his desire to be able to resolve this issue soon. Mr. Schumacher
also explained that the Paul Howard litigation was over.
Mr. Schumacher brought the council up to date on County Road J, and what the
process on this project would be. The council agreed that the upgrade was a good
thing for Lino Lakes. Also discussed was Apollo Drive and the Palumbo litigation.
The council discussed the consolidation and annexation proposals now being faced
from Centerville. The council agreed that this type of atmosphere is not conducive
to that of good neighbors. Mayor Reinert asked if a meeting could be set up with the
City of Centerville. Mr. Schumacher replied that he would contact Centerville.
