The City Council interviewed applicants for the Park Board and
the Planning Board starting at 4:00 P.M. today.
CONSIDER PROCEDURES FOR BOARD APPOINTMENTS
Mr. Schumacher explained that the applicants have all been
interviewed and the Council can now determine how they wish to
select individual candidates. The Council decided to have each
Council Member cast individual votes for individual board
applicants.
Park Board - There were eight (8) applicants for these positions:

James Schaps received four (4) votes and Tom Mesich, John
Landers, Frederick Gelbmann and Kathleen Nordine each received
three (3) votes and will be considered for appointment by the
Council on Monday, February 24, 1992.
Mayor Reinert reminded the Council Members that they could still
nominate other candidates if they wished to do so. He also asked
that the unsuccessful candidates be notified as soon as possible
and let them know that their names will be kept on file in case
of resignations or if other committees or boards are planned in
the near future.
This matter will be on the agenda for Monday evening, February
24, 1992. Mr. Schumacher will give a brief outline of the
procedure, note all candidates were interviewed and introduce the
names for Council action.
Legal Newspaper - Mr. Andy Gibas, editor of the Circulating
Pines addressed the Council. He explained that he would like the
Circulating Pines newspaper to be considered as the legal
newspaper and he would place all Lino Lakes legals in the
Centennial Shopper. Mr. Gibas said he would guarantee that the
Centennial Shopper would reach all residents in Lino Lakes
regardless of what zip code the resident was in. Mr. Gibas also
questioned the claim of the Quad Press regarding their delivery
to all residents. He noted that a lot of their paper boxes are
still buried in the snow and asked where they are putting the
paper. Mr. Gibas also questioned the audit report presented by
the Quad Press.
Council Member Elliott said she has never seen the Centennial
Shopper. Mayor Reinert read a letter from Mr. Gibas and
explained that it is the goal of the Council to get legal
information into every home.

Mr. Schumacher asked the Council if they wanted a legal or a
shopper? He noted that not many residents will look in a shopper
for legal information. The concept of a shopper is for shopping
advertisement and the concept of a newspaper is for news.
Council Member Neal suggested that both the Quad Press and the
Circulating Pines be designated as the legal newspaper and then
no one in the City can say they are not getting the news. It was
noted that would mean double the legal costs.
Council Member Elliott noted that there is a certain credibility
level and legal publications should be in an actual newspaper.
Mayor Reinert said that the Quad Press is delivered to paper
boxes and the Centennial Shopper is delivered through the mail.
He noted that the goal is to get the news into every home and
this is done through the mail.
Mrs. Anderson asked how news items that are not legal
publications would be handled by Mr. Gibas. Mr. Gibas explained
that all publications whether they be legal publications or news
publications would be included in the Centennial Shopper.
Mayor Reinert suggested contacting the Forest Lake Times to
determine if they would still be interested in the same procedure
as outlined by the Circulating Pines. If they are, this matter
should be returned to a work session for further discussion. If
the Forest Lake Times is not interested, the appointment of a
legal newspaper can be added to the February 24, 1992 agenda.
Municipal Attorney - Mr. Schumacher explained that he has checked
the tape of the January 6, 1992 Special Council meeting and the
direction given by the Council was to take the matter of
municipal attorney appointment to the Council Work session on
January 7, 1992. Mr. Schumacher explained that he thought the
direction of the Council was to advertise the position. The
advertisement was made and five (5) applications were received.
Mayor Reinert said his idea was to advertise and look at various
options for that position. Council Member Kuether said there was
no discussion on the matter and she felt the advertisement was
placed without full Council approval.
Mayor Reinert said he felt that some things did happen this past
year in terms of fulfillment of the City Attorney's obligation
and he felt these things were not handled properly. Council
Member Elliott said that she did not know enough about the
qualifications of a city attorney but would like to see the
letters that were received. She asked what would be the basis
for comparison? Council Member Kuether felt that loosing one (1)
lawsuit was not basis for replacement. Mayor Reinert said that

he had a problem with the way the matter was handled.
Mayor Reinert explained that at the January 6, 1992 Special
Council Meeting, he asked that several items be pulled from the
appointment list and it was his intention that these items would
be reviewed. He noted that maybe the matter did not move through
the process as it should have.
DEVELOPMENT ISSUES, DARRELL SCHNEIDER
Mr. Schneider explained that there will be no development items
on the February 24, 1992 agenda. He reviewed the following
items:
Ebensteiner, Black Duck Estates, Phase I and Phase II -
Elevations are currently being taken on this proposed
development. Letters have been sent to residents regarding the
surveying and this matter will be placed on the March 9, 1992
agenda. The drainage system that is being developed will be an
improvement for the entire neighborhood.
Mr. Schumacher noted that there has been 100% cooperation from
the developer. When this matter reaches the Council there will
be no loose ends and the developer has done everything that he
has been asked to do.
Mr. Ebensteiner suggested that the City consider the following
policy:
Allow developer to install his own improvements provided
that he agrees to allow the City Engineer to prepare the
design and perform the inspections. The developer would
directly contract with the contractor. The City maintains
control and has influence regarding the selection of the
contractor. The Staff will draft the developers agreement,
not the City Attorney and this will give the City better
control of an improvement. The procedure will be more
expedient since the City will not have to go through the
bonding or bidding procedure. The City will require a
letter of credit in the amount of 150% of the total cost of
the improvement.
Mayor Reinert asked if a contractor could claim discrimination?
Mr. Schumacher explained that the City would not be employing or
making a decision on who is the contractor.
Shores of Marshan Lake - There are many issues to resolve on this
proposed improvement. The zoning is currently R -3, Medium
Density Residential. It is proposed to rezone the area to R -1,
Single Family Residential. However, there is a problem fitting

the proper lot sizes into the plat. A second problem is the
multi - family zoning on the north and south side of the
development. If single family residential is allowed to develop,
will there be a problem developing multi - family around the plat?
In addition, Mr. Hanson, owner of the sea plane base is asking
that all developers be sure to tell prospective customers that
there are low flying aircraft in the area. Mayor Reinert
suggested that all developers should be responsible for hiring a
marketing firm that would let prospective buyers know these
things. He suggested that selling agents be registered with the
City and given enlightening courses.
Council Member Neal said he has heard that some of the new
residents in Wenzel Farms are not aware that there will be town
homes constructed along Lake Drive. Council Member Kuether will
discuss this matter with Mr. Hokanson and ask him to erect a
sign.
This matter will probably be placed on the March 9, 1992 agenda.
Mr. Schumacher asked that the following items be placed on the
next Council Work Session:
1. Clarification on Pine Oaks Addition
2. Pay Equity Update
3. Support Staff Salary Recommendations
February 24, 1992 Agenda - Mr. Schumacher briefly reviewed the
draft agenda. No changes were made.
Mr. Schumacher reminded the Council of the Common Ground meeting
scheduled for Saturday, February 22, 1992.
The meeting was adjourned at 6:50 P.M.
These minutes were considered, corrected and approved at the
regular Council meeting held on March 9, 1992.
